      Hi I fell off ten foot wall dislocated my left elbow and broke my right fore arm both bones I'm having pain issues on my wrist and shoulder I got workers comp taking care of everything but I feel my hand doctor is not helping I still haven't got offers on my case

    First day on the job in a new position with no training, I had a tractor come in to lift a stack of trash bins. I was on the opposite side of the bins, holding them up straight at the direction of my facility manager when the forklift came in to lift the stack. In doing so the stack shifted over falling at a 45° striking my head and shoulder. I have been on workman's comp since Febuary 12th 2024. I've gone to all my medical appointments, was told I need a laminectomy from my C2 to L7. I've seen the surgeon for a medical history review and am awaiting his recommendations for the work comp MD. Ive had bad headaches everyday, cant sleep, cant drive much without neck and back pain. MRI revealed my disks are buldging and my cervical spine is narrowed and pinching my nerves. I also am having shoulder pain on both sides so bad that i nearly vomit. Feels like they were pulled out of socket an ripped off. It hurts so bad its sickening. Im also dropping my drinks and other stuff as well as stumbling. Im in Idaho and my insurance is ESIS. Any suggestions. I had a consultation early on and way told to call back once a determination is given and treatment recommendations issued. Is this how it is? I worried i wont be able to work. Im saposed to retire i 10 years.

    I had a traumatic fall w injuries the hospital treated me for just my leg broken bones concussion and my back hurts on a regular I wear pain patches on my body 5 percent this happened like 4 years ago and I have complained to my home care workers comp That I had serious pain in my back my shoulder leg had 3 weeks in hospital and then bed ridden home til I healed up then after that I had went to therapy then the comp stopped my therapy later like 7 Mons I had another surgery to leg year later then was given therapy for my shoulder like 8 months after another surgery for my shoulder I complained of pain my workers compensation lady she would will me to my appointments and never schedule an appointment to see about my others pains now I suffer Depression PTSD and my social life is gone I was told worker comp trying to stop my case for not seeing DOCTOR I have seen so many Doctors you name it they are the ones to reschedule but now I need a new primary care because she is not familiar with workers junk comp the attorney I had sad would you take $50.000 from workers comp I said no way my life has totally been interrupted by this I have 100 psych disability the leg has a perm rod,fib tib break shoulder cuff repair and herniated disc pinched nerve I can't it's to much

    Hello Rex, i had work event injury. Lower back rupture. I had my back fused. My back employer and insurance is denying the injury. 3 weeks after the event I had to get emergency to hospital and stayed there for 5 days. I reported to my work and they did not file work comp. My question, is it responsibility of the employer to document? I am in Georgia, what is a good settlement in case with lumbar fusion? I see range from $150k to $600k. I have my first court date on Aug 21.

    I was offered $10.000 for a settlement partial, torn rotator cuff and some damage muscles to my bicep left arm. They are not offering medical assistance. I had to go and get my own therapy so I didn’t accept.

    Can I sue two companies same time. First one for wages theft even I quit the job on 2018 . Second one for injury at work while I m on work compensation. ? Thanks

    I got hurt on the job with partial tear ligament on my ankle and torn tendon plus i hurt my back from a slip and fall but i had 2 back surgery in the past but both out patient how much you think my settlement worth

    Can I still get a settlement on an 18month 7.2 grant.since 3/25/22 . I'm still under medical assistance. I had an orthoscopic surgery on my left knee and left shoulder. My back has a few herniated disc. They recommend surgery cus epidural shots are not helping my back.

    I was told I wouldn't pay anything until I receive a settlement... at the determination of the injury being permanent the lawyer charged me $9400 for "services"..he said it was part of what I had recieved in lost wages??? Why?. I have had to call and ask what is going on and I get a different answer every time I contact him. My gut has told me something is off with this guy but it's down to the point that court said as of Sept it will go to a trust account.... I live in NY and would really like to have another lawyer take over and look at my case. I am not being told of any offers from Insurance company.

      I’m very sorry to hear that you’re having difficulty with your attorney. Attorneys fees in New York State Worker’s Compensation claims are set by statute and approved by the law judge. If your attorney was awarded fee, it is most likely legal and proper despite the fact that he did not do a good job explaining it. In New York State, you’re free to consult with any lawyer that you would like.

    I am 65 and still working and not collecting my SS until I am 66 & 8 months. I just took a settlement with workman's comp for 30,000. I have to put in the bank 8,246.13 for future medical. Would I been better and took $24,999.00. If it is under $25,000 is it true you don't have to put that money in the bank for future use?

    I was injured at work 6 yrs ago 7 different injuries 4 surgeries I absolutely had to have and now all my doctors have all said I’ve reached MMI and now they are all doing depositions I’ve had my cervical spine , lumbar spine done and both hips orthoscopic surgery I also have a therapist through workers comp but they’ve only made 1 offer for $80,000 and I turned it down what do you think about that what do you think is a good or better offer and I do need a total hip replacement but because we’re now having depositions I really need it but I’m waiting it out I just don’t know what to do and need some help .
    I do have a lawyer and I think I made a big mistake with the lawyers I have

      Sorry for your issues . Mine is bad, but nothing like yours. I think second guessing your Lawyers is something all of us do and it's because they really can't do anything for us since they don't allow seeing thw company anymore and make.us go through workers comp who are just evil gangsters. Mine is the same way but if you dont have one the steam roll right over you. Stay vigilant and keep fighting them. I will keep you in my prayer as I believe.God is truly more help than the attorney and he will get us all through our probl3ms. I'm sickened to see how little these pricks value our lives and how little they get away with paying out fraction of what the say our lives are worth. I am ruined for life and will never be the same and outworked and òut performed men half my age and they act like they owe me nothing

      100% SLU(schedule loss of use of a leg) in NYS is worth 288 weeks but there might be other options. Talk you your lawyer for more info.

    I was approved for bilateral knee replacement surgery. I gross 1250 dollars a week. I am 54 years old and i don't want to have surgery now because of my ptsd and blood pressure , what is the value of my case?

      Said my total knee replacement is premature at this time had arthroscopic 2019 didn't help.2018 knee injury 😢 walk with limp now back and neck and hips hurt . Trying to get second opinion on total knee replacement had epidural and facet injections in lower back didn't help legs are numb 😞 tired of workers comp B.S.

    could you pleae give me an advise how to talk to my workers comp attorney if he is always rude. When i call it is imopssibe to reach anyone, no one replay to my emails. I come to their office and ask for a short audience to discuss my return to work questions, my attorney invited me and right away he tod me with angry voice : You have 5 minutes, i am very busy and, i cant spend my time with you.. In fact the same behavior happened our prevous meetings. I got only 5 minutes reply,
    I trully dont know what to do . I heard how he talk to young beautiful girl with her mom, he was happy and kind ... With me it is disaster.. rude and angry. Please tell me what to do . Few weeks ago i got my new job, my workers comp case is not settled yet ...Thank you

    any ideas of what a $ settlement for a torn rotator cuff that i had to have surgery plus a labrum and tendens repaired and out for 7 months and i also did pt (please respond)

      Here in NY State, this would likely be handled as a schedule loss of use (SLU) claim. It is difficult to give you an estimate as to the value without additional information. Give me a call and we can go over your case. 212-406-8989.

    My doctor charges me for my treatments. I can’t afford to pay for my injures. So I don’t know what is really causing pain.

      Where do you live? In NY state, injured workers generally do not pay anything for medical care

      Assuming this is a New York State case, you are likely dealing with schedule loss of use as we have previously discussed. Depending on the severity of each individual injury, you could either be given schedules for each toe or an overall schedule for the foot. This is called loading. It depends on the severity of the individual schedules. Ask your doctor about schedule loss of use and loading. If you have any other questions, feel free to give me a call.

      You can definitely get more money without a lawyer. I know from experience. But if a person is uninformed it's probably best to hire a lawyer.

    I slipped and fell delivering pizza on a customers front porch n broke three vertebrae n ruptured 3 discs I just had my second fusion with a 3rd around the corner, the INS company has fought me the whole time with me winning the first board hearing n the insurance company rolling over before the second hearing, I didn't make much money per hour due to tips in Delaware n my lawyer said he can't get me any of tips in total earnings witch we're I made the most of my money, I went back to work at another job after the first surgery n worked for 3 years n just Iossed that job due to my back injury, i am afraid I won't get much in settlement due my earnings n my lower back is ruined for the rest of my life, I am a little over 4 years since my slip and fall with 2 fusions, 1 hardware removal, I stem cell treatment n a ablation with A 3 fusion coming does a 3 level fusion n stem cell treatment n ablation make my case worth more money or am I screwed

      You have a case for future lost wages right? I mean you are suffering from an injury that will take a long time to heal, some people never heal. I got a guy at work a 60k settlement, and he bragged to everyone at work that he was faking.

      @@MATTHEW-ic3id well as I was a caregiver for years, a home I visited had another live in caregiver, she fell when the boards to their steps popped, she sued them and was compensated through their homeowners insurance, 10,000.Most homeowners carry insurance but I’m sorry, I’m sueing, it’s not their fault but it’s in homeowners insurance policy

    Can I predict the amount of settlement after calculating the percentage of my impairment rating?

      Yes, you can. Your lawyer will have the charts and tables that are needed to make these calculations. You may also find them online. We are currently working on our own calculator to help people with these computations. Stay tuned!
