I had a low back injury as a facility Maintenance manager. I had to have emergency surgery because I could not urinate. I had a laminectomy with L4-L5 fusion surgery. I now can not walk and have been diagnosed with cauda equina syndrome and nerve damage. What do you think my settlement could be around? Thanks surgery in oct 2023 I made 3000 every two weeks and I currently make 800 a week work comp pay which is the max in Georgia.
So I hurt my low back 8/2023 and I have mediation on 8/2024 , my attorney said we will start out with $50000 but might end up with $25000 or maybe $38000 , I didn't have surgery so you might get more than me
So sorry to hear about such a terrible injury. Bowel and bladder dysfunction are usually indicative of significant spinal trauma. Unfortunately, I’m not very familiar with Georgia Worker’s Compensation law so I cannot give you the answer you’re looking for. Have you had a discussion with your attorney about this?
Does an arthritis case settle for a fair amount? I was fine throughout my life until I slipped and fell on faulty work floor mats and hurt my shoulder and hip. Mri states extensive arthritis in Ac joint. The insurance adjuster is trying to claim it was pre-existing. I'm currently doing PT.
My lawyer just sent a demand letter for section 32. He asked for 240k. Are the amounts usually close to what they think my worth. Fell while unloading truck and hurt wrist. Knee and ankle. Been a week since we sent section 32. We tried schedule looks of use my doc gave me percentages their doc said I have not reached MMI. Been going to therapy for 8 months.
I got Injured on 8/2020 in a construction scaffold incident. Fell 7-8 feet and landed on my feet unbalanced. I got work comp and got TTD and surgery on 1/2021 for bilateral inhuinal hernia. I was put on permanent and stationary. 1-2 years later my knees started hurting and lumbar spine a lot. Not until this year I learned I could reopen. I hired attorney and got my workers comp PCP again and treatment which was 5 epidural injections. I went into deposition. Now I have appointment for QME. WHAT DO YOU HAVE TO SAY ABOUT MY CASE? Any tips , advice?
Can I email u on a case I’m goin thru still since 2019 I settled the workers comp but we waiting for 3rd party and it’s dragging what can I do they made a offer my attorney trying to squeeze more I believe but I wanna settle
Can your job still be protected after the 12 weeks of FMLA is depleted? I was jerked around with 6 weeks of PT, 2 week delay with MRI and now I was finally diagnosed with a tear and now im told its going to be another month until I see a specialist to see if I need surgery. How is that fair?
In NY do you get to choose your own comp doctor? There seems to be a lot of verbiage addressing "your doctor" in these video segments. In NJ my employer is self insured, and I had no choice but to see their contracted medical associan's doctor. So is this like putting their foot on the scale as far as a doctors word?
I am not too familiar with NJ workers compensation law but I do believe they might be able to assign your treating doctor. If you don’t have a lawyer and need help, give me a call. We have some great friends in NJ that can help you with your claim. 212-406-8989
I have a question i have mediation on 8/12/2024 for my injury. Is it likely to recieve a settlement offers before the 8/12 mediation meet? By the way i haven't received one weekly wc check...
WC section 32 was approved by the WC judge July 2 2024. I got my settlement check July 25. Medical set aside is not included. Section 32 says you can get it in 10 days but it’s not
Hi Rex. If you’re on wc for a year and a half and receiving a weekly check, does the total amount of weekly checks received get deducted from any settlement ?
The quick answer is, if it’s an SLU claim (extremity injuries) then yes. Otherwise, no. But it really depends on the circumstances of each particular case. If you want to go over this, please give me a call. 212-406-8989. May the force be with you.
Question if you have WC and 3rd party case do you have to payback the amount of money WC pays you from the 3rd party or WC can exclude you from paying back and send you the remaining balance if any…or my lawyer can apply section 32
The law permits the WC carrier to take back the money they spent on your claim from your 3p settlement. They can’t take the full amount. The lien is subject to a reduction, however this is all negotiable. Your 3p and WC lawyers can negotiate with the various carriers for the most favorable outcome possible.
I was punched in head at work (details not for youtube). Now have 4 buldging cervical disks and 2 buldging lumbar spine disks, nerve damage in foot and post concussion syndrome and ptsd. Does that pass the injury test

Hello Attorney,
What happens at a Worker’s Compensation “Priority Conference”?
Thank you.

What if a lawyer from the insurance company, right before the depo. wants to settle without letting their insurance company know.
Is a settlement the same as a schedule loss of use?

Diagnosed with a tear? Where? Hip? Shoulder?

You're welcome 😊
I thought it 💰 was based on MMI rating.
Can PTSD from an amputation be a factor in wc?
Hell yea
Yes. You should absolutely get the care you need and speak to your attorney about this issue.
I don't think that's ptsd 😂

Sound like it. But it also raises interesting questions about fights and assault cases. Maybe an upcoming topic!
