I had Cervical Spine fusion surgery c5-c6-c7 also Rotator cuff surgery and reentry surgery in same arm I have had my 2nd QME and at MMI Permanent Stationary disability with lifting/pushing/pulling restrictions of 15lbs no overhead reaching also turning side to side state gave me a 33%WPI final rating. I like listening to you even though I'm in California.

When my doctor reports I'm at MMI, California WC stopped my temp benefits, and put me on Advance Perm Disability benefits. My question is, shouln't I be on PD payments instead of an advance payment?

What if I have not a Dr. Through workman's comp? The QME only evaluated me otherwise I am told to go to the emergency room if I am in need of medical care regarding the injuries related to the case.

Rex. Had a workplace injury to my shoulder. Surgical repair after 1 yr was clased a failure. Ime rated at 55%. Now i need shoulder replacement. We will be 2 plus yrs since the repair. Will i now have to wait another yr after shoulder replacement to reach mmi and then settle?? NY. Thanks OJ

Hello Rex, what is included in a weekly compensation settlement offer besides the medical portion staying open, does past weekly compensation benefits and section 36 loss of function awardments get deducted from the settlement that was already paid out? Does it matter from state to state? I'm from Massachusetts. Thank you
It does matter. Every state has its own workers compensation laws.
