    I’m in NY working for the state, sustained an injury 2022. I did my physical therapy and declined surgery. I suffered a tear in rotator cuff and posterior back of labrum. Last month I did my SLU and my doctor gave me 20% but the state IME gave me 40% was 20% more than my doctor. He also gave me 75% disability. While I was on workers comp for a different injury,. My lawyer started the negotiating process and the adjusters declined the first offer at 35%. We then counter offered at 30%. Before I returned to work, the very next day my employer put me back out for this shoulder injury from 2022 because of the 75% disability from the state doctor. The adjusters had pulled back and said they were going to take things up with litigation. Now I’m currently back out on comp for this injury while I was working the entire time when I’ve already reached maximum improvement. So now we will take things up with a judge and I feel like this case may take a drastic turn. What do you think could possibly happen now????

    FL my attorney let my back pay for permanent total disaplility payments pile up for 12 years then example $500,000. He and other attorney took $90,000 each I got 300,000. We're they even instilled to that money. As he was petitioning and getting $25,000 payments 1 to 2 times a year while I was not getting any payment during those years.

    My Indemnity-Only Section 32 Agreement, has my medical care open, but I cannot go to any other doctors, but WC doctors only.. And so far, nothing! My hand surgeries, for a torn ligament and Carpal Tunnel, has been denied by WC even with Emg/MRI's evidence have been denied, my Emg of my lower back indicates, Chronic Bilateral L5 & S1 Radiculopathy caused by a disc bulge herniation impingement upon the ventral thecal sac? Why have these WC doctors, not done an ablation in almost 4 years of my fall.. and it has gotten worst, I already signed the papers 3/14 😢 which is the first offer, made to me by my lawyer.. Msybe I should have waited.
    impingement situation has not been fixed.

    I got pushed by an employee and because of him i hurt my left shoulder 3-14-2024
    After 4 weeks i just received a paycheck for for 3-18 through 3-31.. it was only $586/weekly (total is $1173 for 2 weeks)before i got hurt i was getting paid weekly
    Something doesn't feel legal...

    My attorney didn't negotiate my settlement but said take it or leave it then dropped me as a client! He stated that he didn't care how a small settlement amount would affect my life before dropping me!

    So i got injured in 2021 from my workplace. I got an L5 buldge disc and also my si joint. Oh and nerve damage on my right leg. So they did a ppd of 10 percent my claim isn't close yet but almost. Am i still able to get a bigger settlement

      Was this 10% PPD of finding made by a judge or by a doctor? If it was made by the judge you disagree you do have 30 days from the filing of decision to file an appeal. Did you have a lawyer? There is some potential to try to maximize the value

    Was wondering what happens if surgery happens and your left with a lot of pain.. but the surgeon is ignoring the dibiliataing pain. And is claiming a 100% recovery has even sent me to play sports smh..

    Great video. Im out on WC. I have multiple injuries with a lumbar herniated disc, and a torn shoulder labrum. Had two surgeries on my shoulder, and one on for my lower back for those injuries. Can you give me a ballpark of what my combined permanency rating would be? Thx

      It’s very difficult for me to give you an estimate as to what your permanent disability would be. First off, I’m not a doctor. Secondly, a doctor would not assess you for permanency until after you have reached maximum medical improvement. You should continue with your treatment and try to get as best as you can and discuss issues of permanency with your doctor when the time is right

      Insurance company denied my surgery, initially because they could not make contact with the operating doctor. They then recommended physical therapy, which both the doctor and I both agreed was not likely to help. Now they are saying my injury was not a result of the accident and saying that surgery is not a option. I have not received max medical improvement. Occupational clinic doctor's and case manager have berated me at my last 2 visits. I requested treatment from another clinic and they said I don't have that choice and that I would have to pay out of pocket to do so. I agreed to have surgery 5 months ago and now they won't approve it. Physical therapy is not helping and if I'm unable to have surgery I won't be able to work. What can I do?

    Im in CA. I was injured by a patient at my job and the first two months after my injury, my work did not abide by my doctors orders and then I finally got on disability, but my MMI ends in July. I’ve seen two orthopedic surgeon specialists . The most recent one stated that he would not recommend me having surgery because they would have to go in and examine my knee and he said it could cause further damage or resulting in needing multiple surgeries for my knee. I’ve had an MRI and x-ray and they have no idea why what is physically going on with my knee unless they microscopically surgically examine it. The orthopedic surgeon said that it might be something I have to live with the rest of my life not knowing what is wrong with my knee. Would that be something to consider getting a settlement?

      How is future loss wages figured out by your WC insurance when giving a settlement

      This does not necessarily sound like a fact pattern that would occur here in New York State. Where is your case being litigated? If you don’t have a lawyer, I would highly recommend that you speak to somebody and figure out what your options are.

      @@workerscompnewyork thank you very much for your reply. I'm currently being treated in Texas but my injury occured out of state. I have been in contact with counsel, was just curious if you have ever witnessed this sort of medical approach. Suffered multiple injuries from the accident but my care has been focused entirely on their liability and not my well being. I recommend anyone going to work in a dangerous field to inquire about the companies workers comp insurance and find out what their liability tendencies are before you put your life at risk. Again, I appreciate your response and awareness.💯

    I partially torn both my biceps at my job was out work for 5 months I’m still waiting for my lawyer to start the settlement I’m back at work but still doing therapy 3 times a week but I think she is taking too long I’m here in ny should I change or Lawer’s or give you Gus a call ?

    I'm on workers compensation in Georgia I had a surgery on my wrist. Radius fracture. It's been 6 months and my lawyer said we should try to get a settlement. So we are still negotiating their first offer was Ridiculous and all of a sudden my lawyer said they offer 50k and no more offers. I was hoping to get 100k at least, still have a long way to go. My lawyer is insisting that I take the offer because the longer I wait the risk. They may discharge me and I will end up with nothing. Im still thinking about it.

      Unfortunately, I do not know Georgia Worker’s Compensation law. However, I would suggest that you make an appointment and have a sitdown discussion with your attorney and ask for an explanation as to the overall value of your claim. You should feel free to ask questions. What are the chances of you getting more if you continue to litigate? What is the most you could possibly get? Whether or not you agree with your lawyers assessment you should certainly understand what is going on with your case.

      @@workerscompnewyork thanks for responding, however I do have a sit down with my lawyers.and we agreed on a target amount ,but the. something felt fishy like there is a conspiracy,this is awkward though but this is how feel. My lawyer initially said we should armed at the highest amount, then suddenly he told me that insurance won't offer more than 50k not even 60, he went ahead and said that if I had lost my hand completely then I'll get up 70k the least, also George workers compensation is terrible.

    Unhappy with my current WC attorney. Am I able to consult with your firm to take over my case. They are slow rolling my 1st settlement and I have many financials needs that are urgent. I have 2 WC cases at this time with 2 different employers.

    Hi i been working with a company for 10 years i been doing repeating job and at this point my wrist neck and lower back hurts, i do alot of typing and im sitting down most of the time i talk to a lawyer and they say i qualify im a little scared i don’t want to loose my job not sure if im doing tge right thing

      It’s good that you consulted with an attorney. I don’t know what state you are in, but you need to be very mindful to limitations, especially with a repetitive stress claim like yours.     What if injury is permanent , already have had 3 surgeries, right shoulder- can not use, did qualify for SSDI, so apparently I am only receiving $400 week- from WC, my job was over $90,000 annually. My Attorney says can only get this amount because I am receiving SSDI. Is this correct? Broke due to medical expenses had to pay myself. I am broke!

      Your question presents an onion with many layers. Have you been formally deemed to have a permanent disability? is this a New York State case? If you are receiving Social Security, disability, and New York State workers compensation benefits, you may do so, but there are limitations on how much you can receive. However, if there is to be a reduction, Social Security has to be reduced, not Worker’s Compensation. You should consult with both your Social Security attorney and your Worker’s Compensation attorney if you have any questions about this.

    Rex if your dr is in another state and he puts you in mmi, how will the insurance company handle that?

      You may have a pending New York State Worker’s Compensation claim while you are living and treating in a different state. This does happen quite frequently. You’re treating Dr still must follow the New York State guidelines when providing treatment and assessing MMI, permanency and schedule loss of use. Ultimately, if the case cannot be settled, your doctor will be called on testify, and will have to explain How he reaches conclusions in accordance with the relevant New York State law. Again this is another circumstance. Why having an attorney is so important. They can assist here in various ways, including resolving your case with the insurance company
