How can you keep your benefits as long as possible? In this video I explain the #1 factor that determines how long you receive workers comp benefits, and walk you through the differences between permanent total disability, permanent partial disability, temporary total disability, and temporary partial disability benefits.
Next I explain all of the most common ways injured workers tend to get their benefits cut short, and what you can do to avoid them. Some of the things discussed here include reporting your injury, seeking medical treatment promptly, the importance of following your doctor's advice, workers' comp fraud, transitioning back to work, and the importance of honest communication with your doctor and lawyer. You'll learn about the '90-day rule' in New York State, how to handle surveillance from insurance companies, and the implications of accepting light duty work.
Finally, I explain how staying on workers compensation as long as possible is NOT the same thing as maximizing the benefits you receive! We go through a schedule loss of use example, showing how you can actually make more money by going back to work sooner rather than later!

I've been out of work for almost 2 years because of a lower back and leg injury, and I have been getting $900 dollars every two weeks from the insurance company. I have an AME appointment coming up next month to give me a rating. I wish I could have gone back to work earlier but my back was so messed up that caused nerve damage. After watching your video through the end, it sounds like I won't be getting that much (settlement award) after I return back to work since I have been out for almost 2 years. I'm glad I'm getting better though after almost two years later

Talk to your lawyer and let him know your concerns. Let him explain how your case works so you know what to expect. Good luck

You can never collect benefits from workers comp for the rest of your life. You'd have to file for disability and not workers comp
