    Wow 2 years in and I’m only now hearing this. Work at a school. Have 7 weeks off vacation. Not salary but hourly. Workers comp calculated my pay at 52 weeks 😮 and I’ve had a lawyer this whole time.

    Hi my back injury it was 2017, I reopened my L&I case 2024 my weight in 2017 was $14. Do they are going to pay me 14$ hour that's not good

    I have a workers comp case for 3 and half year shoulder Collarbone ac join. Elbow. Elbow has previous incident. No claim was filed 22 years ago. I wake up with pain every day. I had a mother part time side gig driving Uber. Does it effect my settlement value cause of the part time ubering. My hours at a retail wc was qualified for min. Impairment was only %8. Shoulder. QMe said sorry I did not check the other come back for evaluation. That take months Offer is low
    Do I need a doctor notes to get paid for weeks. I left the job due to injury. Never quit but they are forcing to resignation
    What should I do
    California
    I can not move my shoulder and arm like before
    Attorney said if you do surgery they will deduct the surgery money from current settlement offer also seeing questions again will deduct
    Is that true?
    Me said you can not go back to this type of work

    I hear you do and hear don’t have to pay taxes on your settlement ?? That’s BS if you do because that money is supposed to go to my recovery for the rest of my life and it’s not even 100,000 it’s under and that’s supposed to be two years that I didn’t have any physical therapy or anything waiting for this settlement to come through, no medical help for my injury for two years so I hope they don’t tax what I got . And I’m 34% disabled, which means even if I go back to work I’m unlimited.

    I broke all 5 bones in my foot had a lawyer from day went for lawsuite but in tx must use workers comp it was 9mos before lawyer told me to get workers comp lawyer how good is my case

    Hi, SLU on multiple body parts with both doctors saying I am hurt but have different values on each body part. The total amount of weeks from the insurance doctor is actually more than my own doctor. What will they do? Is it just scheduled loss of use or will it be a waiver to close the case for good? My case is in NY and thank you in advance.

      That is a very good question. It really depends on what the specific body parts are. Often times they will still negotiate an amicable resolution of your claim based upon the various findings offered by the different doctors. You could also, depending on the insurance company, try to negotiate a section 32 waiver. Often times you can ask for more money Because you were giving the insurance company an absolute closure of your case. If you have any other questions please feel free to give me a call

    I have been out of work for a year now.A rotator cuff repair. Need a second surgery to repair shoulder injury again. What is my compensation.

      Assuming your case is being heard in New York State, the amount of surgeries does not have a direct correlation to your compensation. Your loss of use determination when you have reached maximum medical improvement is the ultimate determination for your compensation.

    Does the uninsured employers fund pay out less then a regular insurance company when it comes to settlements ?

      The straight up answer is no. They are subject to the same rules and laws as any other insurance company. However, under their charter, they must buy law controvert and fight every claim brought before them. This subjects, each claim to stricter scrutiny which could on the whole lead to less overall benefits as compared to Cases that have regular insurance.

    33:52 for the leg injury theory you said schedule award is around $11,000 is that a week? Until the 28 week is up?

    I get workers comp now I got into an accident at work driving a truck went through physical therapy and it ignited a herniated disc which resulted in emergency surgery which now I have Cauda Equina Syndrome I have anesthetic saddle and have to self catheter and nerve damage from the feet to my lower back it’s been almost 2 years what would be an estimated value of my settlement?

      In New York State, a hip injury is generally classified as a scheduleable injury and is dealt with accordingly. Even more significant injuries, such as yours, where a hip replacement is required is still treated with a schedule loss award. In certain exceptional circumstances the permanent disability may be considered a non-schedule type of disability. You should speak to your doctor and your lawyer about this.

    Does loss wages include how long you have been off. I make 2/3 of what I was making which is $479 a week. Is the loss wages what your not paid when getting WC leave pay? When getting a settlement?

      Is settlement for loss wages and your injury calculated separately when you’re given a settlement? is the injury settlement what they would pay you for future medical treatment? If your setting for compromise and release/total settlement. If I settle for this would I not be able to receive disability if I’m taking the settlement which includes them paying me for future medical Benefits.

      This question is very state specific. Every state has its own set of rules and laws. In New York State, the primary basis for your awards is your lost time and your level of disability, depending on the nature of your injuries you may also compensated for any permanent disability.

      Well, if you’re unsure about whether you want surgery and you’re willing to forgo the procedure in favor of settling, you can certainly mention that to the carrier as part of your negotiation. You should be very careful and make sure you discuss this with your doctor because it is likely that a full and final section 32 will close out your ability to get any future medical care from the responsible insurance company.
