    I have a perm/partial disability award for over 40 years. It's the same medicine for 40 years. Recently my W.C. doctor out of the blue DROPPED ME. I called for an appointment and the told me he can't see me without a new referral!
    The insurance company sent me a request for the doctor latest update. Since I couldn't get an appointment with my doc I couldn't get the info sent back to them. They sent me a second notice, threatening not to pay for medicines if they don't get a report back from the doctor. Can the insurance company do this? I'm looking for another doctor but haven't found one yet.

      This is certainly a very difficult question to answer without more information. It is not clear why your doctor dropped you. If you do need ongoing treatment and medication the doctor should certainly continue with the care and request authorizations through the medical portal as required by the law. However, you have had a case pending for quite some time, and the laws and the rules have changed dramatically over time. Depending on the type of medication that you are taking the current medical treatment guidelines do recommend weaning off of certain types of medication. This could be what you are facing currently. You should try to get back to see your doctor to gain an understanding as to the current status of the claim. Otherwise, if your doctor is refusing to see you, you might need to find a new physician.

      @@workerscompnewyork , thank you. Alliance Walgreens mail order service which provides my meds just told me Magnacare refuses to pay. Obviously this is because I'm unable to get my doctor to submit the most updated current/medical notes. I've called Magnacare to explain
      A)That my doctor dropped me with no notice.
      B)That I need to find a pulmonologist that accepts W.C. in my area. I was supposed to get a call back today from them to give me the name a pulmonologist. No call, just cut meds authorization.
      I feel like I have NO RIGHTS. I have a pulmonary condition that requires "maintenance meds". My condition has been the same for 40 years.

    I’d like to know if my employer will know the amount of my settlement. And could that knowledge be used negatively against me? I know they shouldn’t, but I’d just like to know if they are informed about my settlement. I’m not expecting a large amount, maybe few thousand,if that. But will that settlement affect their policy premiums? Thx

    I had gotten injured in two different occasions. I only requested medical treatment but no worker’s compensation lawsuit. However, I was sent back to work by their(insurance) doctors. Since resent injury I filed workers compensation on both injuries. Now insurance denied claim and I am unable to get continual medical treatment for first injury. I fear that my first injury is getting worse by the day. What should I do?

      Assuming that this is a New York State, you really can’t parse out the medical from a Worker’s Compensation claim. Once you are looking to get medical treatment, you essentially are looking to file a claim. You should certainly speak with an attorney so that they can help you get the benefits that you need and get your treatment authorized.

      Hello, basically my question was, how may I continue disability because my first injury is almost healed, but the insurance company refuses to approve treatment for the first injury. I am still injured and getting worse due to lack of treatment. What to do, when I am not able to return to work when due to first injury?.

    I have permanent damage from brain injury and made 300k a year prior my injury. My attorneys have been negotiating for about a year & insurance finally cut off medical treatment even after IMEs agreed with my doctors. What’s up with this?

      I am very sorry to hear that. Is this a New York State case? Keep in mind that your high salary probably resulted in you reaching the maximum rate of compensation per week. I know it sounds odd, but it sounds like you earned so much prior to your injury that the maximum rate doesn’t do you any justice. You also must keep in mind that the insurance companies are in the business of saving themselves as much money as possible, and if they are exposed to what sounds like a very high value case, they will do everything they can to minimize their exposure.

      @@workerscompnewyork well my employer continued paying me a based salary. So the insurance only paid medical. But now I can’t be fixed, they cut off medical. My employer knows I can’t return for any job there as well as IMEs. How long can they legally withhold medical in NY? Or you think they’re just trying to hold off & hope I settle for less?

    I already had cervical disc replacement. I’m still in pain, so I’m going back for another cervical disc replacement, and I gotta get lower back surgery. I am in 24 hours pain I applied for Social Security do you think you would be able to get me 100% disabled permanently how can I do any job when the pain does not stop 24 hours a day I have nerve pain I know it’s hard to get 100% disabled but do you think you can be able to help me on the injuries I have if so I will call you. I have a Workmen’s Compensation case. This happened at work when I was in an accident.
