    I was involved in a severe incident at work where a fellow co-worker ran me over with a 30 ton forklift. I was hospitalized for 6.5 months and have permanent injuries. I lost my right foot, broke my nose, broke my wrist and severed a tendon, crushed my left knee and tibia, knee doesn't bend past 60 degrees with permanent drop foot, sheared off anus, requiring a colostomy bag, loss significant tissue of the buttocks. No 3rd party case. Been waiting 2 years for a settlement for permanent wages. We'll see, I'm a family man with 4 kids, served 8 years in the military and drove trucks for 25 years. I'm 45 and hopefully they come to terms but am worried that what is decided won't cover me for the rest of an average lifetime. The workers comp statutes are old and due for a overhaul. The rules seem to look after more for businesses and the insurance companies then injured workers. Severe cases like mine should at least be awarded pain and suffering and follow the same protocol of a personal injury claim or 3rd party case.

    How they give you Disablity ratings for psychological injuries?

    • @workerscompnewyork
      @workerscompnewyork  7 месяцев назад +1

      Permanent disability ratings for psychological injuries are more like a non-schedule award than anything else. Your permanent disability awards are based upon the degree of your permanent disability and your lost time or reduced earnings. The evaluation is similar to a neck or back injury.

    Yeah but I am only making the wage I am because my employer created an imaginary job that never existed before and will immediately be gone once I am gone. So how can I be denied disability if I can never run or walk or stand on my feet for more than ten minutes at a time

      In New York State, there is a very strong argument to be made that an injury as significant as that could be deemed a permanent partial disability rather than a schedule loss of use. I truly hope you have a very good lawyer helping you with this case. If you have any questions I would like to chat, please feel free to give me a call.

    Do you if it's bias if wc keeps sending you back to the same IME doctor, in my opinion he , the doctor already has formed his opinion on you and keeps giving you a low rating.
    What can you do ?

    • @workerscompnewyork
      @workerscompnewyork  7 месяцев назад

      Unfortunately you really do not have much say as to the doctor, chosen by the insurance company for your IME. There is always a pro and con to everything if the doctor has done such a horrible job of examining you and reaching his conclusions, it would be rather easy for your lawyer to cross examine him and show the judge how wrong he is.
