Today we’re going to be talking about the things you can do to maximize your workers comp claim! Right after getting injured, you need to act quickly: get an ambulance, give timely notice, file your claim immediately, and document everything about the accident. Seeing a doctor right away is crucial-don't wait things out. And getting a lawyer on your side can make a big difference.
One of the most important things you can do is to gather strong medical evidence. This means working with a doctor who understands workers' compensation and keeping up with your appointments to avoid gaps in your medical history. A lawyer can also help you navigate the complexities of settling your claim and negotiating with the insurance company.
There are some necessary evils you'll have to deal with, like cooperating with the insurance company, attending Independent Medical Examinations (IMEs), and being honest about previous injuries. It's also important to change your behavior to avoid surveillance issues and take light-duty work if offered.
Simple things can make a big impact on your case. Keep detailed records, avoid oversharing on social media, don't quit your job, and communicate regularly with your doctor and lawyer. Also, avoid talking too much in court.
Finally, some pro tips: don't accept early settlement offers from the insurance company, settle at the right time, and consider returning to work when you can, especially in schedule loss of use cases. If your claim is denied, appeal it-most denied claims that are appealed are eventually paid.

In NY State it depends on your SLU (schedule loss of use) findings after you reach MMI (maximum medical improvement), as well as your AWW (average weekly wage). I would need more info to help you. Give me a call if you want to discuss. 212-406-8989

Lawyer a simple questión, if after 1 or 2 surgeries, if you do not have a percentage of disability, then it is not a good case for the lawyer and no money for your client.
