Parkland judge removes defense lawyer from Nikolas Cruz hearing - "You're out of line"

  • Judge Elizabeth Scherer ordered one of Nikolas Cruz's defense lawyers to sit in the back of the courtroom after the defense council objected to some of the victim's impact statements, which mentioned the defense attorneys, jury, and Cruz.
    The defense lawyer appeared to mention the judge's children in his argument, which Judge Scherer did not like. "To try and threaten my children and bring up my children is inappropriate. Go to the back of the room now," the judge said.

      He is going to lodge a complaint about the judge allowing threats to go unremarked in the courtroom. The judge will get scolded for that and learn from it. She's a smart and conscientious judge.

      But two of those defense lawyers should be censured and suspended from law immediately after the trial.

      The judge wasn’t earning respect. This judge wasn’t being fair with requests that are reasonable about mentioning someone’s children. She didn’t like it. Why is it not okay for him not to like it either ? Completely reasonable

      @catzee4720 That wasn’t what this was about. The primary defence lawyer was fairly savvy, and whether or not he respected the judge wouldn’t have mattered here. He had simply spotted that the judge was emotionally off guard for a moment, and was attempting to obtain an outburst which would have ruined the legitimacy of the trial. He nearly succeeded.

      Unprofessional public defence is standard. Our justice system is a sham. That is, most defendants have no access to compitant council! The judge here is also extremely unprofessional herself. Her children were not threatened, it was only a comparison regarding her own uncalled for comment of the defence attorneys children.

      @@yeeyee52 Yeah it was a dumb move on his part AS I MENTIONED in my statement if you actually bothered to read it in whole. His conduct was VERY nout of line. However she also brought up his children first and is full of it. It was a bad move largely because she has final authority in the courtroom as she is the JUDGE. She should not be! Terrible unprofessional defence overall but also terrible unprofessional and ABUSIVE judge here, allowing threats to be made by victim's family, referencing the defences attorneys. The first defence attorney seen speaking in this clip was more then reasonable however. The Secund was another story and should be removed, as frankly should the judge herself, not that the latter will happen...

    If lawyers carried on like this here in Australia they'd be disbarred in a heart beat and rightly so. You can't show disrespect to a judge no matter what you feel or think, especially as a lawyer. this is a sign of the times we live in, the lack of respect is astounding here

    I love how this judge rules her courtroom. All the jerks trying to get pushy in her courtroom. The judge should have ordered those lawyers into custody overnight for contempt. The judge was patient and in no way contemptuous. It's plain to see by anybody with integrity, the attorneys were beyond disrespectful.

      That is not at all what my conclusions would be based on this short vid. And Neither did a top Floriday Court after analyzing the whole court case, and in response reprimanded the judge, who in my opinion is clearly out of line with her "threatening her children" which the lawyer clearly didn't. No examples needed to be made but the guy kept persisting. This is not rocket science here. The judge said she did not recall the lawyers kids being threatened, nor was it in the video we are commenting on. So then the attorney brings up her kids to try and prove nothing. That is shear stupidity by the attorney.

The judge also went unhinged at the defense attorneys and accused them of doing the same thing the defense attorneys accused the family members of. Just an unhinged courtroom altogether.

There was no threat to the judge's family and her reaction thinking there was proves that the defense was right to be concerned. But the defense attorneys have also made some grave errors as well in conduct. The whole thing seems to be a mess. The only one who has it good - is the murderer as he got everything he wanted.

      @@lorae7 So basically, Mr. Schachter made an undeserving comment about the defense condoning the killings and that this is what they teach their kids, while Mrs. Oliver yelled that karma would get them and that they'd have to worry about their kids going to school (I think she meant that they helped to create an atmosphere that emboldened the next potential school shooters and that they'd have to worry about the same thing happening now). In both cases the judge should have stepped in.

    These defense lawyers are disgusting. They act like they are so offended by people who lost their own children and loved ones speaking their truth. The truth hurts and when you are defending their loved one’s killer, you are subject to hear the hurt that these innocent families are going through. God bless the victims and their families.

      @@annabellelee4535 the families didn’t want that. They wanted them to put themselves in the shoes the victims and families have walked in all these years. These families have been hurting for years only to get the sentencing that was less than expected and the defense should have compassion for that. Their hurt feelings don’t hold a fraction to the horrendous grief that their client caused. The talkback from the defense was completely unnecessary and unwarranted.

      That is not at all what my conclusions would be based on this short vid. And Neither did a top Floriday Court after analyzing the whole court case, and in response reprimanded the judge, who in my opinion is clearly out of line with her "threatening her children" which the lawyer clearly didn't.       @@kd5you1 The defendant pled guilty so there was no trial to establish guilt, what the trial was about was the death penalty as punishment. The defense won the trial obviously. He didn't get the death penalty, now did he? Pay more attention next time.

      Thank goodness this judge is resigning. A former prosecutor herself, she hugged the prosecuting attorneys after the trial, but railed against the defense attorneys whenever she had a chance. She's supposed to at least appear to be nonpartisan and fair. She failed miserably.

The automatic appeals process is wastefully expensive, but doesn't cover appropriate rates for PD's. Someone sentenced to death is more likely to die in prison, not resulting from whatever manner a particular state chooses to take the life of those that take lives.

      the defense actually didnt do anything wrong here. they asked that their kids be kept out of the impact statements... which it technically isnt even supposed to suggest or be directed at the defendant... let alone the defense team and their kids. the defense was actually in the right here... the judge let her emotion get ahead of her again... which alot of people are trying to point out... its bad for court cases to have a judge that cannot think impartially...because that is what causes mistrials. Those families were disrespecting the jury/ the defense team/ and the defenses kids... thats all a big no no. ask any lawyer. so many reasons why thats not good...

She is also very much criticised by other high profile experts, who say Sherer did a bad unprofessional jobYou will see, she will never ever be put on a high profile case like this, she did to many mistakes and half of the time she had to ask the prosecution what to do. The defense however WON the case, despite it is extremely difficult to save a mass muderes live, but they were able to convince the jury that life is the right option.       The victims are rightfully upset...but there is such thing as defense team rights...and in court the impact statements were being made at the children of the defense team (thats technically not allowed)...when the defense asked that the judge address it, she said she never heard anything... thats when he said "had it been said about your children you would have heard it"...and she called that a threat... which is was not. she kind of proved his point. this judge was wrong here... the impact statements arent even supposed to be directed AT the defendant... and she is allowing them to call him names and everything else... believe it or not there is a reason people think she is being a bad judge...because the rules she is breaking could be the reason someone like Cruz gets a lighter sentence or even a mistrial.

      she didn't do herself any favors here. she was pretty crappy to the defense from day one. i think the judge was right in a lot of ways, but she is also responsible for the dynamic she established in this courtroom a few months ago. it's been chaotic and unorganized.

High profile cases such as this one always attract unnecessary criticism from those who think things could be done better. No court room is perfect, she did what she could, the jury screwed up in the verdict, no judge could have prevented that.

    The attorney didn't threaten her children, for her to claim so is concerning. He was explaining why it was important that people not talk about his children, and he made his point, even though she may not realize it until a later time.

      Exactly. This video frightens me to my core. She is behaving as though she's having an emotional argument with her partner in private. The attorney was so transparently demonstrating a point. Her reaction to having her children alluded to proved his point. Quite worrying indeed.

      @@Zerenko I think the reason she perceived it as a threat was because as she said, no one watching knows anything about her personally or her family. There's a lot of crazy people out there so if her children are brought up here by an attorney, now everyone watching knows she has children and it feels exposing and threatening. As if him bringing up her children was calculated to bring peoples attention to the fact that she has some, and putting that idea in people's heads of possibly hurting her family. Like a form of intimidating her if you will, kind of like mob bosses. These judges go through a lot of trouble lto keep their families separate and safe from their jobs because they have to deal with so many deranged individuals so it's kind of a known thing that you don't bring up their families in court to protect that anonimity. Especially not during a trial being streamed online and potentially being watched by a lot of people that differ with how she has handled the case. I think her reaction was big but not inappropriate given the context. I appreciate your opinion on it though.

      @@Naeruve Given this, does it not seem as though the attorney's point (about it being improper for his children to be mentioned in court) is valid and serious? She entirely dismissed it, only to have it immediately demonstrated to her how serious it is. Not fit to be a judge.

    Thank God this judge was reprimanded. She let her emotions completely cloud her mind. Cruz was guilty but even if he wasn't this was a kangaroo court and a half. Letting impact statements be given that insult and berate the Defendants and their families? She was out of order.

    She's got a ridiculous amount of restraint. Halfway through that I would be like "if anyone says another word before I carry on with the sentencing I will find you in criminal contempt of court"

    This court seems messy. The defense lawyers don't respect the juge, the juge in return got easily offended when one just said "imagine if it was your children", and in return they continue to show disrespect because they feel even more justified...

    Wow...super patient. As a judge, I would give one command to sit down and after that it's contempt. This isn't play time - she's a judge in a murder case. Direct the action then enforce the direction.
