      I think he meant that as her lawyer he was not made aware that she was supposed to testify and only found out because RUclips videos were talking about it. Just my opinion on what he meant

      @@Bubblesrv81 his client is cruz's sister. She is currently under arrest for drug charges. This lawyer is making sure she is not questioned about her current drug use in this trial. Because if she is forced to answer questions like that, she will be incriminating herself in the charges that are pending against her.

      Not really. He did what he had to do based off of what info he was given by his client.. all these RUclips comment lawyers really don’t know what they are saying lol. When the client doesn’t give total info on a case that was sprung on him along with all the others he’s involved in? Yeah I’d say he did a pretty good job. The man was not afraid to go and fight for the difficult request and that’s what you want in a lawyer.

      I have nightmares like this. Except I’m back in High School or College. It’s usually either a dance recital and I have no idea what to do once I’m on stage. Getting ready for final exams in my Senior year and the only class I’m completely unprepared for is Religion (I want to Catholic school K-12)! Or in College, I’m about to go on stage for opening night of a play and I never attended one rehearsal. Long story short, I know exactly what this guy was feeling!!! 🤣🤣🤣

    I feel bad for him. He’s clearly a young attorney comparatively and has no senior council with him. This is a high profile case, and he was hired very late and is trying to make up for the lost time. He’s so flustered and has to try to keep it together and help his client even though they he had inadequate time to file. As a legal assistant, I can attest to the time it takes for documents to move through the courts for filing. I feel for him.

    When the judge reads your motion on the spot in open court and still has to ask you to clarify your arguments and specific requests you know the motion was poorly written.....it's like he wrote it moments before showing up to court......this is embarrassing to watch.

All we know is that she described the motion as vague which means lacking in detail......

      @@trapmafia4716 It really isn't. Part of being a lawyer making a motion is that YOU have to be able to indicate why YOU are filing the motion. Not being able to actually defend your own motions yourself properly is a base failure as a practicing attorney.

    I am a retired Legal Assistant, and over the course of my 20+ years worked for and/or dealt with many, many different attorneys. I just want to say how much I respect and admire this Judge. I would be honored to work for her.

      @@robertmoody1615 Well..."non-lawyer" I would not characterize it as "great" but he did what he had to do for his client...and 13 minutes into watching her testimony I can see the situation he faced was not simple.
      If in fact his incarcerated, possibly drugged up client, who he may have been involuntarily appointed to represent, did indeed not inform him of the totality of her situation he could easily be behind the eightball on knowing all her court dates and what specifically she would be testifying about.
      Would that surprise you that a Florida courts appointed attorney might have so many indigent clients that having a new one sprung on him might slip through the cracks in the system that has seen MANY innocent people convicted only to be later exonerated because details were missed in the legal proceedings?

    Judge Elizabeth Scherer showed her merit and why she was appointed as a judge. I feel bad for her that she was dealt this awful case, awful defense , high profile, etc. She handled it in an amazing way. She's a sharp cookie. We need more like her.

      This trial is to determine if he’s getting life in prison or death. The state is trying to pass the death penalty and Cruz is fighting for life in prison, hence the trial.

      They are sentencing him. Death requires a unanimous jury verdict. He had dozens of victims so it's going to take a long time. None of the victims are unimportant and none of them can be skipped to speed things up.

Anyone with a good high school education should be able to figure out that an "Act of God" doesn't apply to finding things out. Did lightening strike his client somehow making his client phone him from the hospital? Did he receive prophecy that this needed to be on the docket today? Did flooding float a bottle with a note to him in it?

    Four and half years later and these parents and family and loved ones are still being tortured and having to relive the tragedy and horror that was endured that day.
    My heart aches for the students, the families, the teachers, everyone who went thru this and now has yo go thru this over and over and over again in public when they truly should be grieving at home while this kids spends the rest of his life locked behind bars where he belongs.

      The prosecutors aren't seeking life imprisonment. They're going to be sending a dark message to any potential mass shooter that school shootings will NOT be tolerated, and by that I mean they're seeking the DP for Nicholas Cruz.

      I’m not a lawyer but upon watching this, it appears that in Miami there were concerns raised about the sisters competency to stand court. She is a witness in this trial so the lawyer is now claiming she is incompetent to serve as a witness. It seems like they tried going about it in a shady manner by filing it on a Friday in attempt to squeeze it in and rush it through. Judge wasn’t having that.

    This judge has been wonderful, standing firm on all issues. I don’t know how she does it! We need more judges like her! It’s ridiculous why we have to torture the families affected by this criminal, he’s admitted to the killings, we’ve seen him on video , witnesses that saw him that day kill testified. Why must we go through all this for some worthless human being that has 5-6 lawyers for what? Just put him in prison for life without parole. And end this torture! Plus all the money being spent on the trial and the expense the school has spent to recover!!!!!!!!!!!

    Currently sister has been claimed incompetent in her own criminal cases and why he filed this motion to protect. In reality if already Florida criminal courts to be claimed incompetent to stand trial, she would not be eligible by law to give testimony that is considered truth of the matter for any other court proceeding.
    Meaning this judge needs mental health records with that protection order which he did not provide.

      I would not characterize it as "great" but he did what he had to do for his client...and 13 minutes into watching her testimony I can see the situation he faced was not simple.
      If in fact his incarcerated, possibly drugged up client, who he may have been involuntarily appointed to represent, did indeed not inform him of the totality of her situation he could easily be behind the eightball on knowing all her court dates and what specifically she would be testifying about.
      Would that surprise you that a Florida courts appointed attorney might have so many indigent clients that having a new one sprung on him might slip through the cracks in the system that has seen MANY innocent people convicted only to be later exonerated because details were missed in the legal proceedings?

      2. The alternative to an extensive appeals process is lots of innocent people being imprisoned or executed, which already happens more than you seem to realize. What a terrible, ignorant take.

      No it is not lol. And a case that takes one year to go to Trial doesn't necessarily cost less than a case that takes five years. That is not how any of this works at all.

    Not a bad lawyer really, he got up there and stood by his client, like any lawyer should do, to go in front of a judge who is already too stressed to be working the case at the moment. In my opinion, she needs to take a well deserved small breather and calm down a bit.

      So glad someone else can see how much unnecessary SNARK, ATTITUDE & frankly unfit behavior is coming from a person who is supposed to appear unbiased & unflustered. She’s trying to give off an air of toughness but it’s reading as “stressed out” and “in over her head”. Not calm, collected, and sure of herself at all.
