- Parkland trial Judge Elizabeth Scherer appeared to get annoyed with the attorneys for Nikolas Cruz who were attempting to withdraw some evidence in the case related to school records related to swastikas. At one point the attorney was asked which pieces of evidence they want withdrawn, and they didn't know, sparking the judge to frustratingly exclaim "this isn't working" and lead to her going through the evidence and ruling what pieces of evidence will remain in and which will not.

This defense team is absolutely atrocious. This judge keeping her patience intact is amazing because wow.

The defence is pushing the boundaries by wanting to redact evidence. The judge is doing a great job at containing the defence’s shenanigans.

The defense is doing exactly what they're job is. The states job is to get a conviction. The defense's job is to do everything they can to lessen the states case against their client. There is only ONE person sitting in that courtroom who the defense is working for... thats the defendant.

You have to remember this isn't a guilty/non-guilty case. This is a plea-sentencing case. It is these lawyer's job to literally throw anything and everything that sticks to prevent their client from dying due to providing juror doubt. This is what they have to do. Give them some credit.

People have to understand. This is Elaine Bredehoft levels of incompetence. The defense wants to admit a journal as evidence, but doesn’t want to say what to exclude until it’s convenient for them to go through it.

Nicholas will be sentenced to life in a Mental Institution in beautiful Vermont, he is a victim here and those kids needed to be sacrificed to finally bring to light Nic’s torment and anguish….he will outlive the parents so they too can find tranquility…
@Boston Gal How can they not be there with what they have invested in this - it is about their child and having what little control they have left since their child's death. It is being their child's voice to make sure this person is punished. It is about trying to understand the unimaginable. It is about trying to forgive someone sick so that they can attempt to live with their pain as they have daily reminders that their child is dead. They don't want to be there listening to all this but how can they not?

The defence is sloppy and the judge is hyper vigilant because she doesn’t want the case to be appealed.

It's obviously going to appeal and it will take years. I don't understand why there is a court case he pled guilty. Those parents dont need to hear this 4 years later. Can any judge in the US sit on a murder trial ?

@@lindajames978 A death penalty sentence would automatically trigger the appeals process. I was referring to appeals based on incorrect instructions or rulings by the judge. I wasn’t clear in my statement though so nobody would know what I meant 🙃

It is extremely funny to me how in another video the defense lawyer stated that they promised the jury they would be completely honest with them, and here they are trying to suppress something Nikolas was very passionately drawing. If your intention is to be completely open and transparent with the jury, show them the swastika. Show them what your client thinks of people who are different from him. Being open and honest doesn't just mean showing endless evidence of his troubled childhood.

I like that she is trying not to let this drag out . The defense wants to drag this out for so many stupid things . Whatever nick did , whatever he was drawing , whatever he has said , whatever racist comments he has made should most definitely be a part of this case . I find it sick that they don’t care about the N word being mentioned but they want the swastikas covered so the jury doesn’t see them . He drew this on almost everything and it most certainly should be allowed to be shown to this jury. This is who he is and how he thinks and acts . Unbelievable.
Agreed, we have to remember eventhough he pled guilty he also has a right to a defense, he could argue a mistrial just on that basis. They are just doing their job the best they can. He is the one of the worst.

The only thing I could think of is that the witness being cross examined felt threatened by the swaztikas because she identified with the Jewish population maybe? That may be why they want to redact those parts, but like the judge said, that’s not how it works.

America has generally similar or same kind of legal methods and laws as in my country and I love learning about how things work and the amount of power the individual states have is really interesting to me.

Trash Instagram model Judge with a long history of incompetence. She has essentially destroyed any possibility that Cruz will ever get the death penalty. Mark my words, even if Cruz is given the death penalty after this hearing, he will likely never even get killed by the state. This case will just get thrown through appellate court until Cruz dies of old age in prison.

What's worse is that Nicholas Cruz behaves better than their attorneys.
These lawyers have to do what they are doing to be competent. They have to preserve the record. It is a death penalty case, so please keep in mind that these are a special caliber of death certified attorneys. I sympathize with these defense attorneys, it must be extremely hard to defend this defendant. As a lawyer, I think the judge is going an okay job. Not sure she has the experience to oversee a capital case, and it shows.

@@nfgbabe072 working in the court system...I absolutely agree. It is really interesting to see the judge get as flustered as she does throughout. She is trying hard, but her inexperience does shine throughout this trial. Sometimes i feel embarrassed for her because I know she's trying but fumbling, especially in the beginning of the trial, regarding procedures.

Great job Judge in not allowing Cruz's attorney to get a mistrial. They should not be allowed to play these silly games.
Just because she’s “not allowing it” doesn’t mean it won’t get a lot of attention in the appeals. Cruz got lucky getting an incompetent judge.
He is going to get a mistrial , Eighth Amendment prohibits cruel and unusual punishments, but also mentions “excessive fines” and bail. 20 days this is beyond reasonable . 🤕🤕

Is the defence team trying to suggest that if the swastika symbol is disassociated from the defendant this will make it less likely for the jury to choose the death sentence. Is that logical?
Yeah i had the same question. What is the end goal of the defense here? Do they really think that if they throw all these speedbumps at the sentencing, he will magically avoid the death sentence from the jury?? No way in hell that is going to happen. So who is paying these lawyers to fight this hard??? It would be way cheaper for his family if they just ended all of this 6 months ago, because this result was absolutely inevitable from the beginning.

I could not live with myself to ever defend someone like him.
The defense is NOT trying to prove his innocence. They're trying to argue life in prison vs the death penalty. Could you sentence someone to death? End someones life like Nikolas Cruz did? I was for the DP until i thought about being on a jury and essentially playing god. I couldn't say - he deserves to be killed. Everyone in the US is entitled to a trial. It doesn't mean the public defenders think someone like this is innocent.
They are only "defending" him in the sense that he spends his whole life in jail vs being executed in his probably 50's. This whole thing is so dumb.

This is going on to a ridiculous level and needs to come to an end. Teams of lawyers making hundreds of thousands of dollars each... and then a guarantee of appeals for the next 25 years and more and more lawyer fees.
No one here is making hundreds of thousands of dollars. The prosecution are public/state employed, as are the defence who are public defenders. Look into the salaries of these positions, you may be surprised.

This is how trials actually work. It’s not like in the movies. I’m in law school right now. They are basically arguing about admitting certain evidence because the defense is arguing that certain parts of the paper will unfairly prejudice or result in inappropriately emotional responses from the jury and that the prejudice is outweighed by the probative value. The court is saying that the probative value is not outweighed. These kinds of arguments happen in every trial.
Remember defense did not WANT this trial.
Prosectors did. Cruz plead guilty and was ready to accept life sentence.
I felt like the preschool arguments were bs and a waste of time. There are so many other cases where you could’ve argued insanity or a developmental disability. But to go back to his first 3 years of life? Waste of time, no one cares if he punched little Timmy when he was two, only the events directly leading to his crimes. I feel his team is going too far back for the evidence or arguments to even stand. As a preschool teacher I wouldn’t remember 20+ years back clearly and accurately.
@@savannah5333 No they are important to show that he had issues even THAT young. They didn't just start when he was in middle school. He was showing signs of disturbing behavior very young. Needed help from a very young age. They are appealing to people's sympathy for a preschool age child.

Clearly the state of Florida was too rich for him. He was lucky to have had been adopted by that family imo. It’s as if this is a huge social experiment. In Florida retirees move there because they’ve paid into the system as well (they can do whatever they want in a. Court room for that reason). That state itself had income tax laws for specific reasons we all tend to collectively not want them. Anyway did you know serving life is actually LIFE there for crimes? No getting out in 10-15 etc etc . There’s a reason this is happening and hope to god there is no mistrial for what he did

I'm in Australia following this and I don't get why Nichols has not already been sentenced. Get on with it , he either gets death or life in prison it's that simple. Why drag this on and give the parents and families more anxiety and stress
He killed innocent children and people there is absolutely no excuses.
Because they are fighting for a life sentence not death. They are doing everything they possibly can to create doubt in the jury’s mind he should not be put to death. It’s hard to defend such a guilty person.

Because when it is a Death Penalty Penalty phase trial the court has to be absolutely certain they won’t make rulings that provide the Defense with Appellate issues… it’s much better to do it right this time instead of after he’s be sentenced to Death and can delay it for years by submitting a multitude of appeals based on rulings, or ineffective assistance of counsel.
this could be avoided if the state agreed to lock him up for life. the state wants to kill him (I don't disagree), so the defendant gets enormous leeway in defending himself. after he is sentenced to death, there will be at least a decade of appeals before he is actually killed.
One attorney having to spend the night in jail or write a $5000 check for contempt of court would clear up the problem for this judge

I agree. I was following it but can't any longer. Tuned in to this portion and realised it is overwhelming depressing and frustrating (justice system) and traumatically bleak (victims, families). The time and detail taken over this individual is excruciating. 17 dead.

All of south Florida seen his social media video bragging about planning the shooting for that day. We’ve all seen the videos. We all know the victims or know someone who did. The victims and survivors also got some great footage that I hope was played in court. They even have to openly admit he’s guilty now but trying to say “it’s not his fault”. These lawyers are brave. They’re going to be finished in south Florida! Time to move!

This Hearing to determine Punishment is one where I feel, the outcome is a foregone conclusion. The one who entered a Guilty Plea will never again be free to walk among the free. He should never know any Freedom what so ever. Ultimately he will die in confinement. His time in confinement will be one of constant fear, put him in General Population. Fair and Just Punishment is not possible in this case because I feel this killer was in fact aware of what he was doing, aware of how to enter and depart the scene of his Crime undetected, he was in control of his mental facilities, he knew what he was doing was beyond wrong, and did it anyway. He must be treated as the Killer he is and not a mentally defective person.

@David Wang I'm not pro rehabilitation>punishment, but my (very) impractical idea of what would be more ethical is inmates being in able to work while in jail to pay off the costs of it and the rest of the money being saved until they get out.

I mean, the parents have to work. The trial is going to last through October and maybe even go into November. Most, if not all, of them probably don't have the luxury to take that much time off work. It seems most of the parents are showing up intermittently.

Really? Because it's court. Trials typically last awhile. They said from the start it would last about 16 weeks. We're about 5 or 6 weeks in so far. Let me remind you the full scope of this trial- there are 17 deceased victims, over a dozen more that were injured and survived, and hundreds and hundreds of witnesses that are all getting called to the stand. And thousands of pieces of evidence, and tons of video and audio to go through from that day. This is a huge case so yes, it's going to drag out. They have to thoroughly go through everything and present it all to the jury.

Okay so I have a couple of things to add here whether they mean anything to anyone or not..
First and foremost, I am watching every single moment of this entire trial in solidarity with the parents and family members who have to endure this pain. I have cried, screamed and begged God for mercy WITH you through your testimonies. I have never felt pain like the one you are experiencing until I watched your testimonies.
And my second comment is for what a badass powerful amazing woman this Honorary Judge is. She truly has an incredible backbone that will not allow this sloppy defense to get away with their weird crap.
My biggest most important point is that I hope you know that we are all with you, parents and family members.. You are NOT alone and we love you SO MUCH 💔

You are confused I think. This is not a trial to find guilty or not guilty. He already confessed to the crimes and the judge has already accepted the plea. The public defenders are appointed to this case. This is a sentencing trial. The state wants the death penalty and the defense wants life no parole. Everybody in Florida knows he did it, even his lawyers, the guilty part is over with, now they need to convince a jury whether he lives or dies. Asking for a mistrial doesn't set him free but it will start the whole process over.

It was very clear this whole issue arised because the defense was either disorganized or they were trying to just get evidence admitted, cherry pick which parts favoured them, then try and block prosecution from using the bits that didn't favour them. It's transparent and really disingenuous either way, yes defense has a hard job but it's pretty sad to try and play the system like this.
I disagree. It seems the defense does have it act together and rulings were not made.
It's easy to criticize the defense because they are defending a mass murderer, school shooter, but this judge has not done a good job in making sure the defense do not have grounds for appeal. I would be surprised if the defense don't win when they appeal, and it will be this judges fault.
Of course they're going to cherry pick, both the defense and prosecutors will absolutely do that, that's how it usually goes. And I disagree with you, the judge is being sloppy.
@@connor7048 they will have grounds for appeal anyway as it's do, but as this relates to evidence they submitted anyway it's on them, you can't seem to admit evidence and then complain when it's used against them
@@takethechance7422 yes both sides cherry pick, but the thing is when it's evidence that the defense submitted its pretty poor to try and cherry pick just cause the state might use it against them- they opened the door by submitting it as admissable evidence, so they have to take the bad with the good really.

The real obscenity is what the shooter perpetrated in February 2018. I think the jury can handle the presence of a swastika - they have seen and heard much worse during this penalty trial. Dragging on this horrible experience is compounding the agony of families, friends and, yes, the jury. Get on with it.
