    She’s not annoyed at them just objecting , she’s annoyed that every time they object they make it a 15 min ordeal, they can just say “objection , irrelevant” “objection, speculation”, keep it short and moving, not a god damn 15 min side bar every single time they object

    It must be super difficult for a lawyer to argue for life in prison for someone who pled guilty to a crime that clearly deserves the death penalty, especially when they have behaviors that disregard the severity of the crimes they have committed against society.

    I agree with the judge. 15 minute sidebars are ridiculous. Thus judge has a duty to move this case along and also making sure due process is protected and let's face it the victims rights is a joke compared to the defendants rights in this country so I'm glad she made this ruling. I believe she made sure nothing would jeopardize any appeals before she decided this. Their objections are still heard but she doesn't want the 15 minute sidebars that are exactly the same every single objection on these videos. It's ridiculous and it's a way for these defense attorneys to milk taxpayers. GOOD CALL JUDGE!!!!

      Depends what you mean by “as many times as necessary”. Showing the same photo or video more than once is cumulative and prejudicial to the defendant. Once a piece of evidence is published, the jury has access to it during deliberations. If they want to rewatch it, they can ask the judge to let them.

      @@scottburns2600 the way our system works, the prosecutor tries to crucify the defendant while the defense attorney puts forward the best defense they can muster. In a horrific case like this it can make the public defender look immoral, but they just as well could've been assigned to a case where their client was being railroaded with excessive charges, or completely innocent but the easiest target. It's the nature of the beast.

      I'm not against the death penalty here, but consider that in the year 2000, Florida was spending $51 MILLION per YEAR to keep the death penalty active in the state, compared to what would be saved if all death sentences were commuted to life without parole (and LWOP became the only penalty for 1st degree murder). Capital punishment in the US isn't cheap.

    You can still object to something the judge has ruled on but to object on each and every one of the judges ruling and then to present the same exact argument that she already denied during each witness testimony is just a way for them to draw out the process. The judge caught on to it pretty quickly. If you’re going to object and make the same exact argument that you had already made you can just say continuing objection instead of literally repeating everything you said when she ruled on the objecting earlier.

    As a juror in the murder trial I was in, 6 of us (jurors) sent a letter to the judge and requested this very thing. They kept removing us from the courtroom for every sidebar and we were losing our train of thought, which could lead to a mistrial. The judge agreed with us and our assessment. He questioned each of us if we can provide a fair and unbiased decision with all the side bars and the easy answer was "No". The judge was not irritated with us, but he was irritated with the prosecution and defense.

      I don’t understand why would they remove you, the jurors for a sidebar?! The whole purpose pf a sidebar in a jury trial is to present arguments and raise necessary issues without the jury hearing them and without the need to remove the jury from the room.

      That goes a bit far. It's not their job to be scumbags. It's their job to advise their clients properly, present a competent defense, and preserve the record.
      Prosecutors and judges, definitely not. To be firm, sure, but never scumbags. Whether they live up to it or not, prosecutors are to seek justice, not convictions, and judges are to be impartial arbiters.

      Yeah, if I remember correctly, an objection that the judge overrules can be appealed later on. She may just be preparing him for the appeal process. Don’t quote me on that though, I’m not 100% sure that’s accurate.

He had no problem sentencing all his victims to death and then executing them in under ten minutes and now its taken over four years and they havent even decided what his punishment should be??       In a death penalty case you MUST have lawyers who are death penalty lawyers and is usually is a team. It is a persons life we are talking about, obviously Cruz is guilty and deserves death but in other instances it could be an innocent person on that side and they deserve proper council when it comes to their literally life or death.

      From my basic understanding of this stuff, from what I heard they have to have a lawyer that is well versed with death penalty cases. So I assume that's why he has so many also I can you imagine how many people that work for these lawyers to sift through the thousands of documents for this massive criminal case.

    The trick of this is that the jury is to decide based upon the evidence whether or not this is a death penalty case, in most cases when a defendant pleads guilty he or she is given life, because they have admitted their guilt. If it were up to me based on the facts, the evidence, and his demeanor following the act and following his arrest, I’d vote for the death penalty. He knew what he was doing, I don’t see any evidence of insanity, I see no remorse. He has only shown remorse since his arrest due to the fact that he did not get away with it.

      This is pretty standard procedure, which is a good thing. Part of our open court system is having these sort of conversations on the record, in public, though outside the presence of the jury.

      From the back-and-forth between them, I assume she's already had this conversation with the defense several times in a sidebar and they just keep making the same frivolous objection. The judge is essentially shaming the defense by reiterating her position in front of the court, albeit with the jury absent.

    Keep in mind everyone that if he doesn't have lawyers representing him professionally and properly, he can claim to not have proper representation.
    Yes we all know he's guilty and will most likely get the death penalty, as I'm sure his lawyers know as well [and probably want]. But in order for the sentencing to stick, they need to represent him.

      Some states have appellate courts that would say “well you objected These 4 times but the 5th Time you didn’t specify what the objection was so that objection was Never Made.”
      I think his lawyers are just trying to be thorough and do what they can. Cruz is gonna spend the rest of his life in prison or he’ll be killed regardless so I think it best That the process just plays itself out. Now, however, the Defense May well say the trial court denied them the ability to make objections.

    The defense attorneys are doing their jobs preserving the record for an appeal. In any trial, if an objection is not made during a trial, it cannot be used on appeal. It is called "preserving the record". It should also be stated, Cruz has pleaded guilty. This phase of the trial is all about punishment: life imprisonment or the death penalty. This discussion outside the presence of the jury shows that the defense attorneys have already conceded Cruz is more likely getting the death penalty. The defense attorneys are preserving the record. While tedious, it is their job.

      No matter what happens in the case. This case will see probably a minimum of 12 appeal hearings. It's extremely expensive to conduct death sentences. Just get rid of death sentences and give him life. We can spend the next 60 years asking him question and figuring out why he did it, and learn how to spot it.
      (This is how the FBI got good at profiling serial killers, by talking to the ones locked-up.)

      It’s not a trial, it’s a penalty phase. He is guilty of the crime, but the jury is being presented evidence to prove motive, intent, premeditation, etc. in order to determine the eligibility of death penalty or life in prison. Once the penalty phase is over, there will be a sentencing phase. Then we will likely never hear or see him again.

    Sure, just drag out the inevitable for as long as you can, all the while having the victims and families be dragged along with it. The POS is guilty. He admits he is guilty. Sentence him, lock him away forever and be done with it. None of this BS in trying to find loop holes to postpone or even to declare a mistrial. What a waste of time and money for someone who doesn't deserve the oxygen he breathes.

    This is why I decided not to go to law school after getting my degree (even though I took courses that were basically pre-law). When you are an attorney it is your job, obligation, to represent your client to the best of your ability, personal feelings aside. A client could tell you “I’m guilty” in private but if you see a loophole or chance to cast reasonable doubt it’s your job to do so personal feelings aside. Attorney Client privilege is a double edge sword at times. I could not bring myself to imagining I had to represent someone I knew to be guilty or prosecute someone I thought to be innocent simply because it was my job and thus I knew I couldn’t do that job effectively. I can only imagine what his defense team is going through. They’re doing their best knowing he’s the worst

      I agree with you. But as I understand it this second part of the trial is simply to decide whether he gets the death penalty or not. He has already pled guilty to all charges.

      If a defense attorney sees the mountain of evidence against his/her accused criminal client, he/she can withdraw from representing his/her client to preserve his moral integrity and respect of the victims for future reference. He/she can let someone else represent the client.

    You don’t need a sidebar for every objection. With the example “Objection, relevance,” Judge can instruct the jury to disregard a certain component of the testimony - or that, “sustained,” in general, nullifies the question or testimony.

    I love how the Judge wanted to stop all of these "15 minutes sidebars" which resulting in a 11 minute side bar of both sides excusing and over explaining why they are doing "15 minute sidebars" 🤦‍♂️😅

      This isn’t a sidebar and the jury isn’t present for this… and 1 11minute argument is not tantamount to 17 15minute sidebars, which occur with the jury and during actual witness testimony… hope that clears things up of you.

And yes the Jury isnt there right now but this has been the defenses play the whole court and the judge tried to get a handle on it but as you saw they both continued to add in unnecessary information that doesnt pertain to changing the judges final ruling hence 11 minutes of sidebars when it could of just been 3-5 minutes

    So basically they are trying to make the jury believe that the court is not objective for denying the 15 minute long objections each time.
    Or to make the jury so bored and tired that they do not listen or watch what is going on in court.
    It is a rude tactic one that usually gets the judge upset at you.
