      @@MendyJanelle …it’s impressive how patient she has been throughout this case, with the Defense trying to practically sabotage the trial with any excuse they can make up just to save this killer, I can’t believe it… This happened in 2018, all those poor kids slaughtered by this piece of sh*t. I don’t know if you saw the videos of the doctors talking about the autopsies, but one kid was shot 12 times!! All these years and those parents are still waiting for some kind of justice… Yes, she’s a very patient judge.

They aren’t playing a game out in the park they are in court and when things don’t go their way one throws a hissy fit and more or less says she not continuing .       @@MendyJanelleI feel like now that I'm going back and rewatching this trial the Judge was definitely impatient, aggressively rude and snapped at the Defense every single time there was an opportunity to do so... I will also agree the Defense were annoying and somewhat unprofessional and were disrespectful of the Judge's rulings - they were pushy and painful to listen to but they were doing their job.... just because I comment that the Defense were often treated unfairly by the Judge doesn't mean that I need a lesson to be reminded of how brutal and tragic and horrific what Cruz did at that school that day was ...whether he deserved the death penalty or not I'm not going to say, but it is possible to believe that Judge Scherer was out of line at times and there's definitely a reason she's no longer a judge! But I've also been paralegal for over 30 years and have attended at least 60 trials of which 25 were murder trials... I've worked 20 years as a DA's Paralegal and 12 now for a Criminal Defense law firm... so I am very familiar with courtroom behavior.

      Gareth, do you care to explain or elaborate by what you mean with your statement? To me it looks like it's not a Florida thing but a typical lawyer trying to get the person she was charged with out of the death penalty, that is her job as a defense lawyer, even though this kid deserves the death penalty.

    The judge didn’t say she couldn’t file motions on the tampering allegations…she said you have time to do it later. I think the lawyer knew that and just said pushed the issue to get it into people’s minds. I

      Try to be a little objective here and put your emotions to the side. If you were on trial and facing a death penalty, you would hope your legal team would identify this misconduct at the time and not wait until later on. But of course since this is about nikolas Cruz and I of course hate that guy too, but gotta think objectively

Two platters on the scales of justice, one is the law, the other is justice. What qualifies as justice is all emotion. Getting down to amount of trivial detail in this trial is objectivity.

    I truly appreciate this judge. She is fair, to the point and most importantly, no nonsense. Exactly what these families need. The defense is going to make as much noise and disruption as they possibly can. Simply because they have none.

      @@blakejohnson7148 I think the judge is kind of to emotionally involved, however; I don't know how a judge could not be emotionally involved with this kind of case, and trial It would be very difficult not to be. The judge has denied almost all of the requests the defense has put in if not all which could potentially cause for an appeal, mistrial down the road. Therefore, I hope the judge is prepared to be able to give a good reason as to why she is denying all these requests when the defense puts appeals in for a new trial.

      And the families and loved ones have waited 4 and a half years for justice. . And regardless of what sentence is ultimately imposed the end result will be a life sentence for the families. And if Cruz is put to death he will be on death row for years.

      @@disneyrockz12 i did not go into the legal profession. However i can tell you that it is a very tough and competitive field. It’s not for everyone and you need to have a certain personality and a really thick skin. Relations between prosecution and defence atternies can be severely strained, if not out right hostile at times.

      I am honestly surprised more commenters aren't seeing how serious this is that the state's attorney's office contacted a witness about his testimony. That is not good that they did that before his testimony and they very well could hurt this trial.

      Well that's entirely on the prosecution. The defence offered to plead guilty in exchange for dropping the death penalty. The prosecution wouldn't accept that. NC still pled guilty regardless, saving a whole entire trial that would have had to occur before the sentencing phase. If they wanted to just sentence him and get it over with, they could have just done the plea bargain, gave him life imprisonment, and it would be over already.

      It is the professional responsibility of a defense attorney in a death penalty case to attempt to take the death penalty off the table at any point in the trial. Also, if you look at statistics about how many individuals are sentenced to death in Florida for less violent crimes than Cruz's crime, it is smart for his attorneys to be attempting to remedy the worst-case scenario. Cruz has already pled guilty to the crime so the death penalty is a real, and daunting outcome.

    I have just watched a few episodes of these proceedings in the last 2 days.
    From what I've seen, the whole place seems like a kangaroo court, IMO. I won't make any comments regarding "sides" as far as defense, prosecution, judge, etc. Some good points/some bad points all around. But the lack of professionalism by everyone in there is sorely lacking, IMO! 👀

    She seems overly dramatic about everything. Before they even got started, she accused the news station in the courtroom of printing the names, addresses, occupations, and seating arrangement of the jurors! She said she had seen it on the news station's website. The judge was immediately telling the reporter that she was to tell her employer to remove this information IMMEDIATELY, which was the correct action.....however, after the judge came down hard on the reporter, Ms. McNeil admitted that they had only listed the jurors gender and seating position in the jury box, which is no big deal, and is often done. So the judge told the reporter everything was fine. McNeil seems to be an act first, think later kind of lawyer. I will be very surprised if she doesn't come back and formally apologize for making accusations before she had any evidence. She seems really desperate to have a mistrial declared at this point. She knows her boy is going to get the death penalty, so she's trying every trick in the book to keep him off death row. She's realizing her case isn't strong enough, so she's going to focus on a mistrial, since that's her best bet at this point.

      @@jaydee4269 I understand that she is standing up for her client, but how are his constitutional rights being violated? Lawyers frequently ask witnesses what their testimony will be. As long as they aren't told how they should testify, threatened based on how they testify, or bribed to get them to testify a certain way, there is no witness tampering. My point about Ms. McNeil is that she has asked for a mistrial multiple times, during every stage of the trial, and for multiple reasons (this situation, a family member reacting verbally to the audio of the shooting, the court allowing the swastika evidence, potential jurors being released before the defense questioned them because they told the court they couldn't follow the law in this case, etc). She doesn't like this judge, and they've been butting heads from the beginning. These repeated requests for a mistrial feel a little like polite "jabs" at the court! Honestly, I hope they give him life. That way the families can get closure, knowing his only way out of prison will be in a body bag. If he gets death, there will be endless appeals, and the outcome will be the same. But if a mistrial is granted, these families, witnesses, and experts will have to go through everything again, which will be torture. And these poor jury members will have wasted the last couple months of their time. So I hope it doesn't get to that point. Just lock him up and throw away the key! 💙

      Because of that whole ‘right to a free and fair trial’ thing. Emotions are running high and the defense are all underpaid public defenders, forced to represent a guy who did the unspeakable. If they don’t defend him with vigor, as they would with any other client, we would 100% see a mistrial. I’d rather them sort out the particulars now opposed to on appeal.

      I’d like to bet on that. When you think of heinous crimes John Allen Mohammed and Timothy McVeigh come to mind. John Allen Mohammed was Executed 6 years after he was caught and Timothy McVeigh was executed 7 years after he was caught. This case fits that bill. They are going to execute Nikolas Cruz. He has already been in custody for 4 years. To be honest I would not be shocked if he’s dead by the age of 26.

John Allen Mohammed was executed in Virginia a state where any execution is rare and he was executed in just 6 years.       The defense is making a lot of arguments because this case is so high stakes for their client. While making multiple arguments and lodging objections are crucial to competent defense, appeals for ineffective assistance of counsel can still be viable based on several other factors. The defense's arguments may leave less errors to justify a claim for ineffective counsel, but such an appeal could still be made and could still succeed depending on the circumstances.

    This is a very important trial in many ways, it brings so many issues to light and is far away from the simple eye for an eye thrive of the very simple folks. Since unfortunately there will be more andmore and more school - shootings, it is to presume with deep regret, it would be the appropriate reaction to listen carefully and to take measures of PREVENTION!

      That's the shortest route from a to b. However, possible witness tampering is a federal felony. I think it's worth the long route. I mean the prosecutors called the witness just before they were scheduled to appear and said they were "concerned about the effects his testimony would have on the case and community". If that's not trying to sway or intimidate a witness, I dont know what is. Furthermore, they thought they could get away with it since one of the witnesses friends works for the prosecutors office and was in on the call. The defense was right. The judge should have been outraged.

    I’ve been following what I can in the UK and online. I’m torn about the death penalty, but surely if there has been possible witness tampering that needs to be looked into? I would hate to be the judge in this case but there has been 2 or 3 times now I feel the judge hasn’t been particularly fair towards Cruz. I know what he did was beyond words, I can’t even describe it and he should be held accountable for that but at the end of the day everyone deserves a fair trial no matter their crime.

    These defense lawyers are like a soap opera…trying to use these kind of “legal” tactics to help their client……anything to try to save him…..the lady lawyer was so “offended” by the alleged conduct of the prosecution, she wanted the entire trial stopped so she could have 20 minutes in her office to immediately. Address the alleged prosecution misconduct. All this for a client who was caught on camera and personally admitted to shooting scores of school children to death. There is no reasonable doubt in play here. This legal grandstanding and display of personal show of being offended is sad to watch. It’s becoming almost like a soap opera and circus with the defense. Very unprofessional behavior.

      Stick with me here, I reckon that might be their job mate. Could be wrong, but I’m not.
      Also, this isn’t about guilt. Defense is not arguing he didn’t do it. This is a penalty phase. He plead guilty. “Reasonable doubt” isn’t a thing.
      Defense is right. I personally guarantee, if the death penalty is awarded there will be an appeal granted based off this incident alone if the judge does handle this. There has been many, many other incidents that will very reasonably warrant an appeal, outside of the one he’d be automatically awarded should the death penalty be imposed.
      An appeal means, in some cases, we gotta do this all again. More court for the families.
      You’re assuming she’s emotional FOR the offender. She’s gotten visibly emotional for the victims. More appeals mean more court and less closure for the families.
      How are you going to literally list the things attorneys are supposed to do and call them unprofessional?
