  • Attorneys for Nikolas Cruz, who faces a possible death sentence for killing 17 people at Marjory Stoneman Douglas High School in Parkland, Florida, demanded the judge grant a mistrial in the case for not ruling on a motion regarding allowing swastika evidence in the trial. The attorneys argued that by failing to rule on the motion the defense could not properly prepare for the penalty phase. The judge denied the motion.

      The defense attorney has been trying to get off of this trial since the beginning she has asked to be taken off of this case and the judge said no. And to be fair from the beginning of the trial the judge has treated the defense side a completely different way from the prosecuting side

      It’s that he’s plead guilty to all charges. The Prosecution wasn’t going to let a case of this news magnitude to rest until the public heard all the evidence for why this kid became a mass murderer. Maybe some of it is our desire to understand why these mass shootings have become so common; or maybe better, they simply wanted the political capital of being “the people who put away Nick Cruz.” This is the second part of a trail that’s usually short because little more is heard & only decide what sentence to give the criminal…but since he pled guilty they are using this as a full on guilt or innocence prosecution.

      Some might also say it’s FLORIDAS tax money because they still use income tax - that state is a rarity - furthermore a life conviction is life in Florida - not 10 years not 15, no parole, it’s done it’s LIFE in that state. The retirees who paid into the system and move to Florida know this and from how the state preserved the crime scene it sounds like they knew it has to be this way. If you’re not from Florida it’s irrelevant, technically.

      I was thinking exactly the same! Regardless of whether they are allowed or not, he is still guaranteed life in prison as a minimum! I couldn't be on that jury as I know exactly what sentence would be coming his way and some drawings would not deter me from passing that sentence!

      She’s being rude because she is asked the judge several times to no longer represent this person and Has said that she does not think it is in their best interest to represent him and in his best interest and the judge is forcing them to represent somebody that their law firm doesn’t feel is in their best interest to represent.     The behavior of defense counsel I thought was unbelievable. Defense attorney flipping the middle finger and then basically claiming they are more of a victim than the families of the victims was just incredible. I was surprised none of the defense counsel was held in contempt many times.

    I watched the full video and the defense wanted to submit a boatload of evidence and then pick and choose what they wanted to show the jury.
    The judge asked them to determine what documents they didn't want to show and the defense said they didn't know.
    The judge then asked how was she supposed to rule on what is admissible or not if they don't know what they are going to show the jury.

      Well, the State asked for the death penalty (which is typically a question the prosecutor asks the families) Why didn't he accept it?
      Instead when he originally sat there coloring (until the judge stopped that) he has victimized everyone involved all over again...

      She should be unbiased in her opinion of how he should be sentenced. She obviously is not. Even though he killed so many, everyone deserves a fair trial and legal representation. The defense lawyers are doing their job to make sure the court is not biased to whether he gets life in prison or death. That’s still important.

    I understand trying to be effective counsel to your client, but WOW. The disrespect to the judge and her courtroom is off the charts in all of these video clips. Not only do they not address her formally, or even stand when addressing her, but they overtalk her and dismiss her rulings. I'd be annoyed as hell if I were her, too. I guess lawyers are really that of their client :/

      To be fair, there has been tension from the beginning because this main lady tried to get off the trial several times. She did not want to represent Cruz and the judge made her. It reminds me of the Arias trial. So I think this attorney is just over it at this point.

    I can't believe the attorney does not stand to address the judge. I'm a paralegal and I've never seen this occur in a courtroom. Lawyers are usually required to show respect to the court by standing when making arguments. This judge runs a very lax court.

      Agreed. Particularly if you are addressing the court and requesting a mistrial for your client. The lack of decorum in the mistrial request from the defense does weaken their argument that the court and/or jury is not able to provide justice to the defendant. Treating a mistrial request with such a lackadaisical attitude makes it seem like its more of an informal request rather than a major accusation that the trial is unable to proceed with the defendant's right to fair judgement intact.

    Also, the Judge told lawyers not to get up without permission and not to speak between each other, yet while the defense attorney is speaking there is an attorney walking behind her and talking with a fellow person at the desk.

      This goes past what is a reasonable length of time, even given the circumstances. We’re talking months and months now. Think about these jurors. They’re barely being paid, if at all, and this is taking so much time away from their families and their daily lives! I would think a few weeks is reasonable.

Clearly neither, otherwise you would have recognized that all op was saying was that defence, while representing their client effectively, should do so in a manner appropriate for court by simultaneously remaining respectful of the court and the judge presiding over this matter.       If you think about it from the defenses POV, it’s really not that bad. They have careers to grow and uphold. Being a case that is aired live to this magnitude is imperative that they show that they will do anything for their client so that they can give a fair trial for all parties. It has nothing to do with the defense wanting to get Cruz off or not caring about the victims or any of that.

      I understand where you're coming from, but whether or not he's a monster doesn't mean he doesn't have a constitutional right to this trial in order to potentially avoid the death penalty, just like everyone else. I am in NO WAY supporting him, but sentencing trials are just as crucial to serious crimes like this as the actual trial held determining guilt. With that being said, his defense is grasping at straws and it's not a good look, even if its their job to defend him. Their unprofessionalism during this process has been wild to witness.

      The judge has shown a clear bias which isn't allowed. That would be a great defence argument by the state on its own, let alone everything else. This should never have been given to this judge, she's wasted everyone's time

      I agree with you! You can tell by her shaking voice that she's nervous, and probably realizes she's walking a very thin line. I don't think the judge has shown unfair prejudice. The defense, although doing their job, has been the side asking repeatedly for a mistrial. The other day she threatened to withdraw from the case because the judge threatened to hold her in contempt! I realize they have to do everything in their power to keep their client alive, but she has been extremely argumentative in my opinion. She's very snarky, and when she makes snide comments directly to the state, it's extremely unprofessional. From very early on, she has made it clear that she doesn't like the judge, although I think the feeling is mutual. A cynic might conclude that he has been on his best behaviour for the benefit of the jury and the judge in order not to display behaviour in court that may lead the jury to conclude that he is out of control, or cannot control his impulses.

      Thats why the judge should rule and avoid grounds for an appeal. She is showing biased and grounds for unfair trial. Remember this is not whether he is guilty or not is whether he will "rot in jail" as you desire or death. Ruling on this does makes a difference in strategy. You can have a german decent or a jew in the jury and the state alleges they may bring it up in rebuttal. It can make an effect in the decision one way or another but unfairly. Anyways, this is one of the few motions I give the defendant been right. And the judge is opening grounds for appeal.

Sounds like the defense isn't happy that it's likely going to be the death penalty for him.     I’m not impressed with Judge Scherer’s attitude throughout this whole process. From her tone of voice, hand motions, to the choice of her words, she has been snapping and scolding at people in the court, as if she were talking to her children in a classroom; her short temper makes no discrimination everyone gets scolded in that courtroom. I think that she is unprofessional and not experienced enough to be a judge over such a monumental trial. I bet the defender finds grounds for an appeal post-trial.

I believe judge Scherer used to be assistant to state attorney in Broward county under Mike Satz. Mike Satz is the lead prosecutor. She is the daughter of a republican lawyer who supported Gov. Rick Scott and it was him who appointed her judge in 2012.

    I live in the UK but met a similar issue to this as a juror here... We spent 2 weeks going through a case in detail, which we were then dismissed from because we were "accidentally" shown evidence which the court had agreed we would not see... I lost my respect for the judicial system that day... The defence here is claiming that they promised to be honest with the jury? ... If so, and justice is the intention of a trial, the jury should be shown ALL evidence!!! ... these symbols were there, on his gun, so hiding them with tape is denying the jury the ability to make a decision based on all the facts, in favour of a skewed version of the facts to suit one side or the other. A shorter version of the defence speech here could have been achieved by declaring, "We call for a mistrial because the jury have seen the truth and it could be devastating to our case!" ... It makes me sick.

      That's not how "evidence" works. For example, lets say you are accused of stealing a car and its not true, but your accuser wants to introduce into "evidence" how you took pens from the office, how you have anger issues because you scream at your mom, and that you cheated on your girlfriend. NONE are evidence that you stole a car. It just speaks ill of your character and creates a bias on the jury. Hence, a court will find all of it inadmissible to guarantee you a fair trial.
      This is the issue with the swastika. Right now the defense argues it can create an unfair bias because his motives were not against jews, so they are waiting for the court to rule on it. If the court decides its relevant, the defense strategy would be different than the current one, hence the bias from the court and the huge opening for appeal.

In the case of Cruz however, the gun used in the murders had symbols on it which have been concealed after the fact by the court. They are not preventing additional, unrelated and unfair information to be brought to the Jury, they are removing something from the evidence which was brought to the scene by Cruz himself, in order to influence the decision of the Jury.
      I know how it works, my point was that it's not true justice.

      Besides that, this was related to the location of the crime, considering that he drew these things on his backpack and in school notebooks that he used _in school_ ...therefore it coincided with the crime he committed -also at _school_
      it was 100%, relevant, and that's why her claim was dismissed as it should've been. They bit their own noses by even trying to withhold that evidence.

Whether that’s because they don’t want to defend somebody that can make their law firm look bad or they just don’t want to defend somebody because I don’t feel it’s in their best interest. The judge has forced them to can you imagine defending somebody you do not want to and asking seven times to no longer defend them and the judge is making you do something you don’t feel is in your best interest as an attorney or your law firm’s best interest?       The internals already knew that it's a straight life sentence. I think this is done purposely to torture the perpetrator disclosing everything publicly.
      Everybody must know where are the big failures of our society. We must amend them in many fronts, otherwise we will be here seeing more crazy kids doing baboonery like the one seen in Parkland.
      We all agree that this will not be the first case or the last case on the matter. I'm dead sure we will see thousands of these cases in the future.
      It's a lesson that requires at least 50 years to be learned.

      The purpose of this trial is to examine every shred of evidence that pertains to the person, Nicholas Cruz. Court cases have to be thoroughly investigated so that 10 or 15 years from now, a small minute shred of evidence can be used to overthrow his conviction and he walks and is able to resume his life as a killer. It does not matter what we want to happen. In the News, throughout history, convictions are over turned. My Uncle was shot by my cousin's son, oldest son, Brandon, my uncle's grandson. He was distraught about the cruel words my Uncle had said to my cousin's other son, Preston, in the months leading up to the death of my Uncle. Preston committed suicide in a gravel pit when his girlfriend of a number of years split up with him when Preston asked this girl to marry him. She said, "No!" and told him why! Preston was grieving and my Uncle with his cruel streak in his personality wounded Preston deep. Preston shot himself and died. Brandon blamed my Uncle. Brandon was sent to prison on 2nd degree murder. A few years later, his conviction was overturned by the Premier of Manitoba. Why? B/c tiny shreds of evidence revealed that Brandon had not received a fair and unbiased trial. Nevertheless, Brandon was a murderer but now walks free to get on with his life. Everything has to be revealed. It takes time to reveal every aspect of a trial. In the impulse of Nicolas Cruz to kill those kids and lose his freedom, he most likely never considered the length of the trial, day in and day out for over 3 weeks, plus. Every action a person takes has consequences. I think that is one of lessons I have noticed here. Also, why kill some one else's kids no matter how bad you "feel" about yourself, it is just not worth it. Their lives did not hinge on the circumstances of his own life: violence, prostitution, drugs, alcohol, etc. Those other kids were not involved in his life except at this intersection point. He should have resisted his urge to blame others.

    Whatever happens from here on out is irrelevant. The defense has strong grounds for approval and will easily be granted a retrial. It doesn't matter if the judge says they can't have one. Nor does the jury's decision matter as well.
    Her assignment to the Nikolas Cruz case was made randomly by a computer program that didn’t consider experience or the fact that no U.S. mass shooting of this magnitude had ever made it to court.
    Every decision Scherer makes is being scrutinized, at least partly, through the lens of how she was assigned and her inexperience -, particularly compared to the case’s seasoned prosecutors and defense attorneys.
    Shortly after the shootings, when she was unavailable, the defense asked another judge for an emergency order, which he granted. Scherer overruled him and ordered that all matters except search warrants would be heard only by her.

I’m not condoning her temperament or manor of speech. Those are exclusively hers. I think it would have been a greater mistake to allow the items in than to see what it is & how it fits.     I think because the defense is showing that they Repeatedly asked it to be decided on before they selected jury that it was decided after it hurt their Ability to Select the best Jury possible. It’s a really good case, so far I think it’s the only Motion that has a chance to overturn any decision that happens.

      The defense had an avenue to have it heard before the trial but chose not to use it. There is a specific motion that could have been filed to force the hearing if it was so important to their defense. It's called Mandamis. They didn't do it for whatever reason but now want to cry mistrial.

    I don’t understand the vitriol towards the Judge? Just because she’s wearing makeup doesn’t invalidate her authority, ability or decisions in this matter. I don’t like the disrespect being allowed ( defense sitting while addressing the Judge / court ) and maybe that’s a flaw, but in my estimation that’s her only flaw.
    Judges routinely dress down attorneys when necessary and they don’t have to use flowery tones to appear “nice”. And at this point she’s probably annoyed AF because she shouldn’t have to give “court 101” to already established attorneys. Period.

She's biased, incompetent, combative, rude, and to put it bluntly stupid. She argued that there are "jewish stars" next to the schwastikas. This is her argument for why she just made the ruling that she had been asked to make at 35 different court appearances. She said they were "jewish stars". The star she was looking at had five points surrounded by a circle. Also known as a pentagram which is a satan worshiping symbol. It wasn't a "jewish star" or to anybody who has ever been exposed to even the tiniest amount of Jewish culture could tell you it's called the star of David. Just like Christians refer to the lowercase "t" as a cross or crucifix.

      Whether it was intentional or not is conjecture. Maybe it was. Or, maybe the defense is blaming the court for the flaws in their strategy. Maybe it's just a desperate shot at the moon in an attempt to find glory in a case where there isn't any.
      Whatever they were thinking, the judge's job is to consider the merit of the argument, and here she found it to be disingenuous. She stopped short of accusing the defense of sabotaging the whole case, for what it's worth. However, the way the judge denied the motion seems to indicate that regardless of their intent, leaving that gap was a costly mistake strategically.

    She NEEDS to just STOP. This is a sentencing trial not whether he is guilty or not. He pled GUILTY. Let this trial move forward so these families can try to pick up the pieces of their lives.

IN THEIR MIND they probably think they’re saving a kid who did a terrible thing that he couldn’t fully understand. I’m not 100% against the death penalty, but I definitely understand how we are the last democracy on the planet that still uses it lol. In 100 years they’ll read about us killing prisoners and judge us, just like we read about slavery and judge those people.
