Prosecutors have been operating under the understanding that the people don’t have rights and it’s rare to get a judge to slap them down. But this judge has yet to slap them down by throwing the whole case out the window. Prosecutors know how to game the system and take the warning from the judge but still inserted the ideas he pull off during the cross in this case. This kid shoulda sat on the side lines and let it play out without having to take the standing. Sadly, when you are young, you wanna be truthful and for coming, it’s youths greatests down fall. That was an exercise of his Fifth Amendment right, and calling the jury's attention to his silence as if that proves waiving his right would necessarily have been detrimental to his case is considered a penalty which subverts the right itself. That's why the judge told Binger he was "on the borderline, and maybe over" of "a grave constitutional violation" when he started asking about this being the first time Rittenhouse has told his story and insinuating that he has "tailored" his story based on information from seeing videos, reading articles, and hearing all the witnesses.
I think he feels a little braver than normal since the entire country is watching and he knows the Judge won't just call for a mistrial being the case is as high-profile as it is, so he's willing to take some extra chances.
Defense seems to learn what the word objection means and use it. When the prosecutor was lying shaking his head no isn't going to cut it. Object, point out the prosecutor is lying. Impeach the prosecutor's credibility as much as possible.

That basically means they are saying to the court "hey he's lying that he shot people in self defense. His star witness admitted to being the aggressor and his case was shot from there. He Knew this and was trying to get the mistrial so he could try the case again without that witness. The Judge recognized this and refused to allow it to happen.

I'm beginning to be a big supporter of courtroom video proceedings being made public. The educational value for law students, and active atorneys seems to be well worth it, and I would think that it could help in cases of mistrial and appeal.

Kyle as a minor was the kind of citizen we should all aspire to be and as a non American myself I thought he embodied the American spirit in a really profound way, he was providing a public service in the way of firefighting (and I believe he had a medical kit to provide first aid) and carried on him the same means of protection that the police had in the exact same situation. He was set upon by a mob for trying to help the community and defended himself with the only means he had available. Your bill of rights is a beautiful thing, the way your citizens have a more direct say in their governance is brilliant and it’s only the people trying to subvert those things that make your country look bad. You yanks should be bloody proud of your traditions because they empower the everyman in a way nowhere else on earth does

@@marybailey7881 The people he shot were all unarmed; he was using a gun illegally purchased for him (the person who bought the gun was convicted, but the judge here wouldn't allow that factor in this trial); and Kyle took the law into his own hands by being in a place of his own free will and seeking danger. No one asked him to be there, and he wasn't required to be there. He should have not been charged with murder, but with reckless homicide or manslaughter, along with reckless endangerment, public menacing, and use of an illegal weapon.

Binger is making an argument. He MAY have mistrial in mind but may not. He’s making argument. This kind of stuff goes on all the time. A judge should have no buttons or at least not show such anger and ad hominem derision. It’s bad form and undermines his respectability. Judges need to be above reproach. This judge is acting a child. Perhaps he’s uncomfortable with the publicity, but he’s lost decorum and seems to be attacking the defense in a personal way which may be grounds for appeal.

It would have been a massive win politically and would've allowed every corrupt court to make similar rulings in cases of obvious self-defense. They still do, but this would have made it entirely acceptable and given it popular support. The eventual outcome would be such a significant rise in criminality and destitution that every corrupt governmental body in the country would be able to bleed their taxpayers completely dry and then flee when the lights finally stopped working South Africa style. It's still happening, just significantly slower because they haven't gained the full go ahead to ruin everything yet. The judge is saying "hey man i don't think this makes sense and that situation isn't similar enough to this current case to say that ... so you can't bring that argument in court to a jury because it's invalid "

This is an experienced prosecutor is whats amazing to me. Why he thought he could continue to try and argue and bend the rules is beyond me....
His star witness admitted to being the aggressor and his case was shot from there. He Knew this and was trying to get the mistrial so he could try the case again without that witness. The Judge recognized this and refused to allow it to happen.

I'm beginning to be a big supporter of courtroom video proceedings being made public. The educational value for law students, and active atorneys seems to be well worth it, and I would think that it could help in cases of mistrial and appeal.

Kyle as a minor was the kind of citizen we should all aspire to be and as a non American myself I thought he embodied the American spirit in a really profound way, he was providing a public service in the way of firefighting (and I believe he had a medical kit to provide first aid) and carried on him the same means of protection that the police had in the exact same situation. He was set upon by a mob for trying to help the community and defended himself with the only means he had available. Your bill of rights is a beautiful thing, the way your citizens have a more direct say in their governance is brilliant and it’s only the people trying to subvert those things that make your country look bad. You yanks should be bloody proud of your traditions because they empower the everyman in a way nowhere else on earth does

What were the main arguments as to why Kyle Rittenhouse should not have used deadly force on others who were attempting to use deadly or very harmful force on him? How this was not deemed pure self defense? What did prosecutors want as punishment?
@@marybailey7881 The people he shot were all unarmed; he was using a gun illegally purchased for him (the person who bought the gun was convicted, but the judge here wouldn't allow that factor in this trial); and Kyle took the law into his own hands by being in a place of his own free will and seeking danger. No one asked him to be there, and he wasn't required to be there. He should have not been charged with murder, but with reckless homicide or manslaughter, along with reckless endangerment, public menacing, and use of an illegal weapon.

Regardles of where you stand on whether you think Kyle is innocent or guilty, we can all agree that the prosecutor was an absolute disgrace. Everything he did seemed manipulative and dishonest, even when the facts seemed on his side. He literally gave the defense the win on a silver platter.

No. The question is was the pointing of the gun warranted, I’d say no… due to all the facts the prosecution laid out. The prosecutor is a bit much… but this judge… is a much worse judge than he is a lawyer.

Binger is making an argument. He MAY have mistrial in mind but may not. He’s making argument. This kind of stuff goes on all the time. A judge should have no buttons or at least not show such anger and ad hominem derision. It’s bad form and undermines his respectability. Judges need to be above reproach. This judge is acting a child. Perhaps he’s uncomfortable with the publicity, but he’s lost decorum and seems to be attacking the defense in a personal way which may be grounds for appeal.

What is shocking is the prosecutor's great desire to nail Kyle rather than just doing their job. I submit there is a difference.
It would have been a massive win politically and would've allowed every corrupt court to make similar rulings in cases of obvious self-defense. They still do, but this would have made it entirely acceptable and given it popular support. The eventual outcome would be such a significant rise in criminality and destitution that every corrupt governmental body in the country would be able to bleed their taxpayers completely dry and then flee when the lights finally stopped working South Africa style. It's still happening, just significantly slower because they haven't gained the full go ahead to ruin everything yet. Imagine a United States where everywhere looks and feels like the downtown streets of LA but with more power shortages and probably no water at all and you've got the near future.
