It's not trivial nonsense. Not at all. Spoiling an entire set for which the company has spent decades building towards is a big deal. This is quite a theft of business autonomy and sovereignty. AKA, you can't take a businesses property that is not legally allowed to be released yet under embargo and then spoil the entire thing online thereby stealing their thunder, their product, any hype they were working on marketing and spending money on and so on. Yes, WOTC can legally and rightfully sue HIM if they wanted based on the civil matter of damages to their business. Good news for you is that very large youtube channels are covering this story, so I'm sure you could get massive support in the event of a lawsuit of any kind. Wizards are really doing their best to absolutely destroy their public image. Card are getting spoiled early all the time, especially since they release a new product (with quality issues) like every two weeks. This is just sad and disgusting. This is normal for this kind of mercenaries. They will try to gather information first, so they can ambush their target in the most opportunistic and safe for them as possible. After all, they don't wanna deal with targets who can fight back lawfully (via self defense or by recording everything). They are always trying to stick within the boundaries of the law while trying to get away with being rough if necessary. Hope this blows up in WotC's face. They could have sent a cease and desist letter or some shit. This is excessive action.

You need to talk to a lawyer. They didn't have a court order so what they committed was blatant burglary. If they intimidated you in order to enter and seize your property then it's armed burglary. What they did is ridiculous, illegal, and should be punished.
I think Hasbro can be left out of this. Their upcoming unreleased transformers toys get leaked all the time to thieves (see the toy reviewer PrimeVsPrime) and they do nothing about it for the extra hype/attention said thief brings to the upcoming releases. This is purely on WOTC.

My advice is: Be polite, but ruthless. Because at this point, WotC has shown that they do not care about anything other than their own narcissism. They don't care about the law, they don't care about morals, ethics, reasonability, or even human decency. So why should you care about any of that, as applied to them? You have every right to be righteous in your indignant anger. And if they haven't already been made to show it, made to both suffer and pay the piper on this. There is no world where calling the Pinkertons to come after you was the right call.
I mean the Pinkerton's have a literal law against them called the Anti-Pinkerton act of 1893, they have no legal authority to detain you on your property, a lawyer would've advised you to tell them to bugger off immediately, right now you're sitting on probably one of the biggest paydays, that unreleased item was technically no longer considered unreleased the moment you purchased and got a box in return, it was a breach and violation on the original sellers part, but it's a civil case at best and it doesn't fall on the customer.

Definitely talk to lawyers about the situation. There is nothing illegal with going up to the neighbors knocking and asking a question anyone can do that. You would probably have a case on them intimidating you into giving them the product. Buy it's better to find a lower and see what else they can find.

I just found out about this via the penguinz0 video and as someone who has been playing MTG for over 20 years, what WOTC has been doing the past year or so is utterly infuriating. This is just the icing on the cake. I hope you get heavily compensated for this insanity and if you haven't lawyer up. From the FTC "By law, companies can’t send unordered merchandise to you, then demand payment. That means you never have to pay for things you get but didn’t order. You also don’t need to return unordered merchandise. You’re legally entitled to keep it as a free gift." you weren't just the recipient of a product you didn't order a company hired thugs to come to your door and rob you. It doesn't matter if you got a box of the wrong series of cards before the street date, tough cookies, that's between Hasbro and whatever distributor or shop you ordered them from, and is no excuse for depriving you of YOUR property. The ramifications this potentially has if you don't do anything about it are far reaching, someone has to show these companies that they're not the law, and that includes the pinkertons and hasbro. I'm sure there's got to be a lawyer out there that would take the case, but at the very least if you don't wanna go to the trouble of suing their pants off a word to the FTC would be something worth doing. If they wanted to privately try to buy you off to take down the video and send back the cards that's one thing, but sending a goon squad to rob you crosses so many lines it's unreal.
Look man, you handle this how you want. If you don't want the trouble, that's your choice. But I really hope you look into legal action toward Wizards(/Pinkertons?). Companies should not legally be able to sick guard dogs like this over an incident that's not even your fault, and claim goods that you purchased without IMMEDIATE proper compensation, valued at or higher. (Note, I am not a lawyer, but SERIOUSLY. The ethics of this seems clear.)
Take them to court. They will certainly try to bury the court case with a deal behind closed doors, but if you bring them to court they will have to answer to the law. Either way, they will pay if you take legal action.

I don't think you even needed to return the cards. You hadn't broken any law. You didn't receive stolen goods. Wizards sent thugs for no good reason, and then the person on the phone "good-copped" you in hopes of making this go away. Unlike many others, I don't think that the courts are your best means of seeking redress; Wizards has a lot more money than you to pay for lawyers, but what they can't afford is more bad publicity after the OGL debacle. You can put pressure on them to make this right, and that doesn't mean free tickets to the new D&D movie, or a guided tour of their printing press. Don't let them off the hook for this, because there will never be a better time to get what you deserve than now. They have a freaking movie in theaters right now, and bad publicity could hurt ticket sales.
Some law firms are willing to provide pro bono services in exchnge for cut of lawsuit funds so OP should go see if there are pro bono lawyers in his area.

I think making your state police aware of the circumstances of exactly what happened they day they came to your property would be a great start. I believe both organizations have potentially opened themselves up to major criminal investigation for how they handled this. Hopefully you live in a jurisdiction that is interested in vigorously defending the rights of the citizens they serve. You can stay calm and level headed and still fight back against what was done to you and help make it more likely something like this doesn't happen to someone else in the future. Good luck.
Sue due, just sue them. Don't accept anything they offer you or they'll disregard charges since they already compensated you, collect testimony, collect your recepeits, the case is fucking shut from the get go, you didn't stole anything, you didn't act violently, your home was invaded, your wife was threatened, lawyer up and sue, I'm sure many lawyers would be happy to take a case like this one pro bono.

Well tbf, Oldschool can use his email records to prove he didn't receive anything. The way the SMTP protocol works is that the protocol can indicate if a message has been sent to an address but it doesn't mean it reached that person's inbox so yeah, WOTC has no technical grounds to stand on so if they made a statement that they have reached out to OldSchool tough luck proving that OldSchool saw the message in court. Honestly incompetent of them to say they have reached out to OldSchool when they haven't.

I've been following since the initial openings and I'm appalled that this happened to you. It's downright dystopian that Wizards/Hasbro would send hired goons to your door to threaten and intimidate you over trading cards, let alone the Brand-name Pinkertons. I really think you should talk to a lawyer because no matter how polite WotC was on the phone or how well they compensate you for stealing your stuff, the fact of the matter is this could have gone MUCH worse if you weren't such a level-headed person. One thing I've been wondering is were these guys armed? A multi-billion dollar company sent private security to your house and strong-armed you out of your possessions. All because Wizards wanted to make a show of force and send heavies to your house rather than call or email you. Definitely can sue for harassment, stolen property, unlawful entry. Hope you recorded them taking the stuff in your home, maybe outside footage of them showing up at your house. This probably wouldn’t even go to trial they would just make a private offer wizards doesn’t want more attention.
I would lawyer up and sue for harassment and damages. If the product was bought legally they have no right in taking the product from you other than the sku’s. They should have contacted you first and via their PR personnel and gone that route. I would definitely get this ball rolling asap and do not accept any product from them or sign anything because that will be there way of being able to say they compensated you for damages. Get more out of this and show them they aren’t as big as they think they are!
I think if you manage not to take this to court, you’d be doing yourself and American Citizens in your jurisdiction a disservice. HASBRO/WOTC Recent actions with the OGL Crisis, Content Creator Summit, and this most recent attack on people SUPPORTING THEIR PRODUCTS!, providing free advertising for their products and amassing a much larger customer base for them absolutely shows how little respect HASBRO and WIZARDS OF THE COAST has for them. I was a big time D&D/AD&D player and supported TSR through the purchase of many many books and products throughout the 80"s and early 90"s. I later began to support Wizards of the Coast through purchases of it's Magic the Gathering products. Recently I decided to return to playing D&D and purchased all 40 5th Edition Books, including the Spelljammer Box-Set, Both Starter Sets, Essentials Kit, all 8 Spell Card Decks, Many 5e DM Screens, Dungeons & Dragons Art & Arcana, Dungeons & Dragons Yahtzee (For the D&D LOGO Dice Tower), many of their Miniatures among other licensed products. My intent was to start my own RUclips Channel specifically to review, and promote their products. I was also considering doing live D&D sessions promoting their products and campaigns and possibly developing my own content for 5th Edition. I was honestly taken back by the OGL Controversy after having invested a huge amount of money in WOTC 5e Books and Products for resources. I had only started collecting them last month after the OGL Controversy had already taken place and began to question my recent decision to collect such a massive amount of 5e Products when I learned of it and began to study it in more depth. But due to my recent commitment continued on. Next came the "Content Creator Summit" Fiasco, and again I was seriously in question of supporting HASBRO and WIZARDS OF THE COAST as I had done. You could only imagine my anger when I pursued exploring and setting up D&D BEYOND, only to find out the fact that EVERY PHYISCAL BOOK I PURCHASED, CLOSE TO $2000 WORTH WOULD HAVE TO BE REPURCHASED DIGITALLY TO PROVIDE USE ON THEIR SITE AND SEARCHABLE FUNCTIONS! I was and still am totally pissed! I messaged D&D BEYOND/WIZARDS OF THE COAST about my feelings and they did not even have the decency to RESPOND! I watched their 2023/24 Product Preview video and others and did hear mention of Digital Content being made available free for those owning the Physical Books "Possibly in the future", but lets face it WOTC/HASBRO appears to be only interested in "A Big Money Grab" from their loyal customers. I have been awaiting response and yet have had none, increasing my anger daily... Then this NIGHTMARE Happens! a RUclipsr providing free advertisement for HASBRO/WOTC Products to a huge community gathered by "oldschoolmtg" through the hours of video recording, editing and production free of charge, gets treated LIKE A CRIMINAL! Plus they have the nerve to "STEAL FROM THEM, taking the items from them. I have to ask WHAT NEXT!!!! OPEN YOUR EYES HASBRO/WIZARDS OF THE COAST, your on your own "TITANIC" which could sink in a moments notice! This is normal for this kind of mercenaries. They will try to gather information first, so they can ambush their target in the most opportunistic and safe for them as possible. After all, they don't wanna deal with targets who can fight back lawfully (via self defense or by recording everything). They are always trying to stick within the boundaries of the law while trying to get away with being rough if necessary.

Not everybody is well informed about these types of situations. If you don't know your rights well enough, official looking people knocking at your door threatening jail time, it can be easy to cave.

Definitely talk to lawyers about the situation. There is nothing illegal with going up to the neighbors knocking and asking a question anyone can do that. You would probably have a case on them intimidating you into giving them the product. Buy it's better to find a lower and see what else they can find.

I just found out about this via the penguinz0 video and as someone who has been playing MTG for over 20 years, what WOTC has been doing the past year or so is utterly infuriating. From the FTC "By law, companies can’t send unordered merchandise to you, then demand payment. That means you never have to pay for things you get but didn’t order. You also don’t need to return unordered merchandise. You’re legally entitled to keep it as a free gift." you weren't just the recipient of a product you didn't order a company hired thugs to come to your door and rob you. It doesn't matter if you got a box of the wrong series of cards before the street date, tough cookies, that's between Hasbro and whatever distributor or shop you ordered them from, and is no excuse for depriving you of YOUR property.
The ramifications this potentially has if you don't do anything about it are far reaching, someone has to show these companies that they're not the law, and that includes the pinkertons and hasbro. I'm sure there's got to be a lawyer out there that would take the case, but at the very least if you don't wanna go to the trouble of suing their pants off a word to the FTC would be something worth doing. If they wanted to privately try to buy you off to take down the video and send back the cards that's one thing, but sending a goon squad to rob you crosses so many lines it's unreal.

Under no circumstances should you accept anything wizards gives to you, call a lawyer.
I don't think you even needed to return the cards. You hadn't broken any law. You didn't receive stolen goods. Wizards sent thugs for no good reason, and then the person on the phone "good-copped" you in hopes of making this go away. Unlike many others, I don't think that the courts are your best means of seeking redress; Wizards has a lot more money than you to pay for lawyers, but what they can't afford is more bad publicity after the OGL debacle. You can put pressure on them to make this right, and that doesn't mean free tickets to the new D&D movie, or a guided tour of their printing press. Don't let them off the hook for this, because there will never be a better time to get what you deserve than now. They have a freaking movie in theaters right now, and bad publicity could hurt ticket sales.
Some law firms are willing to provide pro bono services in exchnge for cut of lawsuit funds so OP should go see if there are pro bono lawyers in his area.

I think making your state police aware of the circumstances of exactly what happened they day they came to your property would be a great start. I believe both organizations have potentially

Well tbf, Oldschool can use his email records to prove he didn't receive anything. The way the SMTP protocol works is that the protocol can indicate if a message has been sent to an address but it doesn't mean it reached that person's inbox so yeah, WOTC has no technical grounds to stand on so if they made a statement that they have reached out to OldSchool tough luck proving that OldSchool saw the message in court. I've been following since the initial openings and I'm appalled that this happened to you. It's downright dystopian that Wizards/Hasbro would send hired goons to your door to threaten and intimidate you over trading cards, let alone the Brand-name Pinkertons.

Definitely can sue for harassment, stolen property, unlawful entry. Hope you recorded them taking the stuff in your home, maybe outside footage of them showing up at your house. This probably wouldn’t even go to trial they would just make a private offer wizards doesn’t want more attention.
I would lawyer up and sue for harassment and damages. If the product was bought legally they have no right in taking the product from you other than the sku’s. They should have contacted you first and via their PR personnel and gone that route. I would definitely get this ball rolling asap and do not accept any product from them or sign anything because that will be there way of being able to say they compensated you for damages. Get more out of this and show them they aren’t as big as they think they are!
I think if you manage not to take this to court, you’d be doing yourself and American Citizens in your jurisdiction a disservice. There needs to be a legal precedent that companies can’t just hire private or public officers of the law or security to attack someone in their home. You didn’t deserve this. No American does. 🇺🇸
1st.. consider yourself blessed that you met a Pinkerton agent and that blessing cuts both ways. You really would have benefited from calling the police on the agents and filming the interaction.. 2nd. Let's say they DO give you your money back in the form of the sets you originally went to buy. This does not compensate for the neighbors, your wife, your time, nor the reputation that has to be explained every time someone finds out the Pinkertons were sent after you.

There is however an Anti-Pinkerton Act 5 U.S. Code § 3108 which says "An individual employed by the Pinkerton Detective Agency, or similar organization, may not be employed by the Government of the United States or the government of the District of Columbia."

One example of many is Activision with Call of Duty have done it multiple times to a number of youtubers who were merely using creative licence and without a doubt shouldn't be took down, oh yeah they also take down any videos of leaked info on any upcoming cod for sure.

The point is if you know about strikes on one's channel which tbf you aren't a youtuber, but if you did and was aware ya would know getting another strike is not worth it in any case really, and yup it does screw up people who didn't necessarily do anything wrong.

HASBRO/WOTC Recent actions with the OGL Crisis, Content Creator Summit, and this most recent attack on people SUPPORTING THEIR PRODUCTS!, providing free advertising for their products and amassing a much larger customer base for them absolutely shows how little respect HASBRO and WIZARDS OF THE COAST has for them. I was a big time D&D/AD&D player and supported TSR through the purchase of many many books and products throughout the 80"s and early 90"s. I later began to support Wizards of the Coast through purchases of it's Magic the Gathering products.
Recently I decided to return to playing D&D and purchased all 40 5th Edition Books, including the Spelljammer Box-Set, Both Starter Sets, Essentials Kit, all 8 Spell Card Decks, Many 5e DM Screens, Dungeons & Dragons Art & Arcana, Dungeons & Dragons Yahtzee (For the D&D LOGO Dice Tower), many of their Miniatures among other licensed products.
My intent was to start my own RUclips Channel specifically to review, and promote their products. I was also considering doing live D&D sessions promoting their products and campaigns and possibly developing my own content for 5th Edition. I was honestly taken back by the OGL Controversy after having invested a huge amount of money in WOTC 5e Books and Products for resources. I had only started collecting them last month after the OGL Controversy had already taken place and began to question my recent decision to collect such a massive amount of 5e Products when I learned of it and began to study it in more depth. But due to my recent commitment continued on. Next came the "Content Creator Summit" Fiasco, and again I was seriously in question of supporting HASBRO and WIZARDS OF THE COAST as I had done. You could only imagine my anger when I pursued exploring and setting up D&D BEYOND, only to find out the fact that EVERY PHYISCAL BOOK I PURCHASED, CLOSE TO $2000 WORTH WOULD HAVE TO BE REPURCHASED DIGITALLY TO PROVIDE USE ON THEIR SITE AND SEARCHABLE FUNCTIONS! I was and still am totally pissed!
I messaged D&D BEYOND/WIZARDS OF THE COAST about my feelings and they did not even have the decency to RESPOND! I watched their 2023/24 Product Preview video and others and did hear mention of Digital Content being made available free for those owning the Physical Books "Possibly in the future", but lets face it WOTC/HASBRO appears to be only interested in "A Big Money Grab" from their loyal customers. I have been awaiting response and yet have had none, increasing my anger daily...
Then this NIGHTMARE Happens! a RUclipsr providing free advertisement for HASBRO/WOTC Products to a huge community gathered by "oldschoolmtg" through the hours of video recording, editing and production free of charge, gets treated LIKE A CRIMINAL! Plus they have the nerve to "STEAL FROM THEM, taking the items from them. I have to ask WHAT NEXT!!!!
OPEN YOUR EYES HASBRO/WIZARDS OF THE COAST, your on your own "TITANIC" which could sink in a moments notice! The vast array of comparable TTRPG/RPG Gaming Systems currently available, and new announcements from Content Creators such as from Critical Role, The Dungeon Coach, and who know how many others who have already "ABANDONED SHIP", should make you and your stockholders "Tremble in your boots". It's hard to sell products to those who are no longer interested...
I have really had my "EYES OPENED" to the ways of a company who clearly doesn't appreciate their paying customers. Is it time for me to "ABANDON SHIP" too??? He made a video of KNOWINGLY having ILLEGAL product - he should’ve contacted WoTC as soon as he knew about this - trust me he doesn’t want to take legal action in this one. It’s one the basic laws covered in the US constitution. He could be held to the full extent of the law -
