    Mistakes do happen. Jones' attorney had 10 days to fix it and send an edited file of texts. That mistake was made 12 days earlier. He missed that deadline. That's why the other attorney said as of two days, that information was now his to use freely.

      Exactly. And just so everyone is clear, that was nearly 3 gigabytes of information. Jones' lawyers accidentally sent over everything the defense had, not just the copy of the phone. Mark Bankston, the plaintiff attorney, informed them immediately what had happened. They sent back a response of, "please disregard." But Texas rules state that when a mistake like this happens, the attorneys who erroneously sent the information must be specific as to which documents are privileged and should be destroyed by the other side. They failed to do this. Bankston had to wait ten days - which is how long Jones' attorneys had to respond - before he could use them.

      which is also why it seems so ludicrous to me to even question that Jones committed perjury. For one, yes he did, provably. We have heard the statements under oath and seen them contradicted by the evidence, in a way that cannot be explained other than with a deliberate lie. Though technically a jury would have to come to that conclusion, it is unfathomable that anyone could see this any other way. More important MIGHT be the question of whether the evidence proving perjury is admissible. But again, this question has been cleared up, as plaintiff's council has done their due diligence in first disclosing the error, then waiting for retractions until none came and the evidence was usable.
      I'd be very disappointed if the US Legal world didn't jump at the chance to take this case, it's gonna be even more of a cakewalk than this trial! And from what I (as not a lawyer) can tell, the maximum sentence is 5 years in prison, so I DEFINITELY want to see that!

      I'm sure they'd just edit the interviews that weren't live or had his button ready. Owen's words. But who knows, Alex is a pathological liar. Said he has a torn larynx but also can't go to court because of a hernia, couldn't go to a hearing back in march because he was sick and then went on his show.

So he wasn`t complying with discovery.

      @@Woedy818 in his deposition (in which he was under oath) he said that he searched through his phone and there were no sandy hook messages.
      There's clearly sandy hook messages on his phone.. hence grounds for perjury (willfully lying or making a misrepresentation under oath).
      If it keeps happening and he keeps getting caught the grounds for perjury pile up and he's looking at serious consequences.. prison.

      It’s especially suspect, due to the opposing attorney noticing the accident, notifying them of it, and then AJ’s attorney doing nothing about it. Even a bad attorney would have tried to roll that one back.

    I agree with some other commenters here, that his lawyer here, in TX and also in CT, have been acting ineptly by "accidentally" divulging information, to cause mistrials and they were outmaneuvered in both cases.

    Just curious, to anyone who has watched his show... has anyone ever noticed him having an allergy attack of this caliber, on any of his shows??? Because, I'm sorry... but I live with allergies that actually that severe. And they are like that MOST days. Not only on the one day that I have to testify in court. You have meds that either help, or they don't help. There's no in between. And we all know that they were trying for a mistrial (considering all of their misconduct).
    So... is this allergy attack for real, or did he purposely not take his allergy medication that morning?

      On that same day, AJ appeared on his show without the throat attacks. I don't believe a word this guy says. Even during court...you can see AJ sliding on up to "apologize" to the plaintiffs. So now, he can spend the rest of his life claiming that he "apologized to the families". (Yes, he's already started claiming it.)

      I used to watch his show years ago. He would have to cough occasssionaly, and sometimes would lose his voice. He would always have water with him. He did mention at that time, that he messed up his voice due to all the yelling he would do, when he was younger. Also, he would turn the Mike off, during coughing, and probably would cough during breaks, if I had to guess. He is on the heavy side, as well. Maybe he smokes?

    Saying he wasn't expecting the questions so they shouldn't be admissible is trash law. He didn't expect the questions because he lied to keep the prosecution from having them and wasn't expecting his team to screw up. It's admissible because it should have been disclosed in discovery, they hid it, it was found and is evidence. How does him lying about it and not thinking they have it keep it from being admissible?

      @@cattnipp Can you provide a source for plaintiffs' lawyers saying they would destroy the data? Even when AJ's lawyers spoke to the judge they did not claim that. AJ's lawyers told the judge that plaintiffs' lawyers asked them if the data was sent in error, and that AJ's lawyers responded to "please disregard" the data. Unfortunately there are actual steps outside of "please forget about this" that you need to take. Not to mention that AJ's lawyers never sent another data dump.

    There's an alternative explanation. Clients sometimes demand lawyers do unethical things. The classic example is a client who insists on committing perjury in their own defense. In such situations you see accidentally on purpose shenanigans for the lawyers to complete their ethical duties without Being a front about it.

    This is a pretty incomplete analysis for a site called "law and crime". The attorney told his aide to send a link to data and he sent a link to access the entire case folder, including the iphone files. The defense was supposed to have divulged phone data months earlier, but they chose to deny it existed instead. Mistakes happen, but in Texas there is a takeback period, and Jone's attorney did not follow up in the 10 days after the plaintifs advised him of the mistake. After they were notified and that period expired without action by the defense, the plaintifs owned the data free and clear under Texas law.

I think in the official process involves the judge looking over the accidental documents, which were things the defence claimed to the judge that they did not have in discovery.

Unfortunately this video ignores the incredible coutroom scene the following day, when Jones attorney tried to undo his mistake based on Texas law and the plaintifs attorney points out that the same law specifies what steps have to be taken and how many days you have from the day you are notified.

    IF you followed this properly you would have heard that the personal assistant prepared a link for download of the "Jones' material" and sent the link to the attorney to download himself. I suspect that the 'backup' of the phone was left there by mistake (which is in one file initially when taken off of the iPhone). In short, the assistant "shared" out the server's repository incorrectly and exposed Jones to the terrible risk that happened. **However, Jones' attorney was obligated to provide these text messages instead of pretending that they didn't have them.
