  • Bryan Kohberger's lawyers have accused prosecutors in Latah County of trying to "hide" the fact that the FBI hasn't turned over some documents in the case. In a hearing this week, prosecutors argued that an upcoming hearing about discovery be closed to the public. But Kohberger's defense team argued the hearing should be open to the public so they can see what hasn't been turned over to them. Law&Crime's Angenette Levy looks at the biggest moments from the hearing, what the disputed evidence could be and what the state is saying about Kohberger's possible alibi in this episode of Crime Fix - a daily show covering the biggest stories in crime.

There’s something about the side smirking and constant smiling that just makes his rulings consistently lack the needed amps a judge a case of this magnitude *requires.*
He literally engages as if they are at a high school reunion, or if he were a school principal and speaking to the parents of students whom were caught smoking pot in the bathroom.
Just that small town buddy buddy, highly unprofessional vibe…

I think there should be a new judge. But at the same time this judge wants to make sure everything is done right so there are no chances of a mistrial or an appeal. Even with the Parkland school shooter trial, after the defendant pleaded guilty, there was still a lot of red tape and delays for the penalty phase trial and took four years. So it's a long process which sucks for the victims.

It just seems to me that a truly innocent person would have wanted this whole case to get going months and months ago. If you were innocent and could prove why you're innocent, i don't think you'd ever reject a speedy trial. At least that's how I see it.

You’ve clearly never been in the position of the state vs you in a criminal case. A speedy trial means you can’t get all discovery, bring in experts nor gather all evidence in your favor. That’s why you almost never see one when the stakes are so high. Ever. You have a right to it but that doesn’t mean it’s the right thing to do, you know?

@blackfalkon4189 _"k but what about the DNA"_
They only found "Touch DNA" (Trace DNA) on the sheath.
Touch-DNA is transferred by Touch (which isn't as direct as it sounds).
You touch the door to the bank, someone else touches the door and your T-DNA goes with them and is transferred to all the things and people they touch, and so on. Including car / Uber door handles.
Our Touch-DNA (your T-DNA) is in so many places we have never been and on so many things we've never touched. Think about this - your T-DNA is probably in all your work colleagues homes, even if you've never been in any of their homes.
Touch DNA (T-DNA) doesn't put someone at the scene. It could be transferred by someone using the same door handle at a completely different location.
This is why T-DNA isn't very dependable, especially on its own.
      -
Nuclear DNA (N-DNA) is the more substantial type (blood, semen, saliva, body tissue, and hairs that have tissue at their root ends). N-DNA is the type that usually puts someone "at the scene". It is the sort of DNA that is usually used to convict people and the sort of DNA we would usually hear being used in cases.
They found no N-DNA of his anywhere in the house, or of the victims in his home /car.
