    In my area, around 1 in 20 small claims defendants will file an answer to these junk debt buyer lawsuits. It's astonishing how many cases they win just by default judgment

      Very true. Following the instructions on the summons is an important step, but by itself it’s not a complete defense.

    I was sued by Portfolio and the law firm I used did nothing but get me a an agreed judgement. Said in Texas the dept collectors always win. I had disputed the dept and had certified receipts.

      The first thing I'd do with a medical bill is get all my records. Second thing I'd do is make sure I got everything I was billed for. Third thing I'd do is check whether insurance should have covered all or part of the bill.

    Have a pending class action case from portfolio set for July in Tennessee I settled one with portfolio last year and has to dispute the payoff amount that was agreed to and showed that owed the difference. My question is fhe original amount owed was suppose to be 512 now they say it’s 1182$ c a I petition and ack to validate those additional charges due there untrustworthiness?

      I'm not sure I understand your question.
      If you never filed bankruptcy, you can get that removed by disputing the inaccuracy.
      If you did file bankruptcy, but it doesn't match your case, you can get that removed by disputing the inaccuracy.
      If you filed for bankruptcy, and it matches your case, then you don't have a legal right to have it removed. Anyone who tells you otherwise may be advising you to violate federal law.

    Hello, I live in Florida. Back in 2018, Portfolio Recovery was calling me many times a day. I contacted an attorney who advised me to tell Portfolio Recovery to stop calling my phone. The next time they called, I told the debt collector to stop calling my phone. The calls ceased then began again at the end of 2021(on my different cellphone number from previous)then stopped again. Fast forward to this month, the calls have once again begun. Is this legal? Please advise. Thank you.

    What can I go for wage garnishment for a debt for portfolio recovery from over 5 years ago. Not a single payment was maid during that time either.

    My husband is letters from portfolio recovery, we sent them a dispute letter which they sent the information back to us but failed to include the original contract with my husband signature to show he agreed to work with them. In the letter it does state the " The law limits how long you can be sued on a debt. Because of the age of your debt, we will not sue you for it. Depending on the laws of your state, certain actions, such as making a payment or promising to pay the debt, may restart the time period for filing. So, my question is since they put this in the letter then why are they asking for money? what letter can I send them about this?

    I recieved a letter from Portfolio saying they have a judgment against me. I live in MD and can look up cases, there's nothing about them or the original creditor there ? They offered a payment option. Is it a scam? Thank you

      It’s good that you need to look it up, but you might want to speak with a Maryland lawyer, who can help you nail down once, and for all whether a judgment exists.
      Until you know that for sure, it’s difficult to make a strategy to help you solve your problem.

    When you get sued does it have to be in the same county you live in when you occurred the debt.

      The FDCPA requires that any debt collector suing you must do that in the county where you live.

    Portfolio sued me for a debt and i didnt even get notice of the hearing. I just found out i now have a default judgement against me . Can anything be done? I didnt even know i had a judgement aginst me!

    and letting us know there is still hope for consumers to win cases against junk debt buyers.
    I'm in Indiana and I spoke to you this past August about a charged off account of mine that Resurgent Capitol Services bought from Synchrony Bank.
    I disputed this account and asked Resurgent to validate the debt, and all they did was sent me was a copy of the last bill statement from July of 2020. Then they reported to the credit bereaus that I opened a new account with them. I ended up having to issue them a "cease and desist" letter against them, and dispute the account thru the credit bereaus, just for them to update on my credit report's that I disputed the account.
    I've reached out to two consumer debt lawyer's offices here in Indiana. After looking over all my documentation that I have kept, a paralegal from one place called me and told me they would represent me, but it's still my bill at the end of the day regardless of the outcome. The other office that I reached out to, the lawyer personally called me back and told me he is currently not taking debt collection cases because the judges in the federal court here in Indiana are getting tired of these cases, and that they are ruling in favor of the debt collector.
    He advised me to send them a "pay for delete" letter and to put in the letter that I am willing to pay the debt, " contingent that they provide proof of ownership of this debt."
    I have so far sent them two "pay for delete" letters, and they only respond by sending me a copy of that bill statement from July of 2020...smh

      It’s a shame that none of the lawyers in your area are willing to help you, although it may just be that your case isn’t right for representation yet.
      The case that we made the video about, we counters sued in the same lawsuit, which means we didn’t have to worry about federal judges, or what federal judges think about that collection cases. We were telling the judge in our case that the debt collector was lying.
      I hope things work out for you. If you do find an Indiana lawyer who’s aggressive enough to help you out, please let me know so I can send business their way.

      @Ricardo & Wasylik PL thank you I appreciate your words. I do have a question, if you are able to answer it. It's being reported to the credit bereaus that LVNV is the owner of this debt, but up until I issued the "cease & desist " I was receiving letters, email's & texts from Resurgent Capitol Services over this debt. Yesterday, I received a letter in the mail from another collection agency called Credit Care LLC saying they respresent LVNV and they are offering a settlement w/ payment plan's to pay this debt off. They said in the letter if I accept it, that after I pay this off, they will consider the account "resolved." Should I still have validate the debt, or should I try to reach out to them thru a lawyer to arrange the settlement to cover my 6?

      Resurgent is a smaller company owned by LVNV.
      Credit Care sounds like they're a debt collector hired by LVNV.
      I'd still ask for validation first.
