    Time to include specific verbiage in that ol’ cease and desist letter to ensure they don’t bug you online either.

      @@RWlawFLummm there’s nothing in this video that talks about charge offs! Just wait for them to fall off your credit report! A charge off doesn’t mean you don’t owe the money, all it means is, the original creditor waited the 180 days and it’s a law, they have to charge it off! Perhaps down the road it will be sent to collections, maybe a law suit, etc

      All debt in collections is charged off, so that's how you handle it.

    I think you are giving AI more credit than might be warranted. It depends on whatever programs we are specifically talking about, but AI creates a lot of opportunities for mistakes because “what works” is oftentimes a black box.

    • @RWlawFL
      @RWlawFL  Месяц назад

      I'm not saying this is a good thing. I agree with you that AI will make mistakes, and debt collectors will have to pay through the nose for those mistakes.

    Very informative video!
    What I would do is-
    1 certified letter only to contact me
    By US mail.
    2 Dispute the debt,
    and generate an FDCPA violation,
    When they don’t mark your credit report as being disputed by consumer. In 30 days.
    3. Threaten Arbitration to
    Clear up the situation
    After disputing.
    Arbitration
    Is very costly for the debt collector,
    And it puts them on notice that ,
    You may compel arbitration if they sue you.

    They still have to abide by the law though One call or one correspondence per week or they get fined and it's for if it's proven that these tactics through AI technology is coming through more than once in the week they're breaking the laws consumer law Is that not correct?

    • @RWlawFL
      @RWlawFL  4 месяца назад +1

      The limit is one conversation on the phone per week. That doesn’t apply to social media, or letters. It also doesn’t apply when they call and don’t get to you.
      They get seven tries in seven days if you don’t answer the phone.

    My car was totalled and towed to a tow yard. I let the car go and they sold it. Now the debt collector for the tow yard wants $3500 in storage fees. will this take a different strategy to deal with them since i never borrowed anything from them or contracted them in any way? The 30 day response period just finished and this is in Calif.

    • @RWlawFL

      Towing companies are a special brand of evil. That we don’t cover in this channel. You’ll need to talk to a California lawyer with towing company experience.

    Pick up the call and tell them to cease and desist from contacting you. Then record any communications from them after that call.

    • @RWlawFL
      @RWlawFL  4 месяца назад +3

      That’s the first step.
      However, it’s always best to write them a letter to tell them to stop calling.
