    I’m in Florida just got sued for a debt. And I was in a debt validation program where I had a lawyer. I was paying them to take care of the debt and that was almost 4 years ago and now I randomly got a summons that shows I’m being sued for that debt

    I live in Arizona and am being sued by Portfolio Recovery Assc. LLC. Alleged debt is $1268.00 and today, 11/7/2023 i filed an answer to their lawsuit. With only 20 days to respond i am overwhelmed and now feel my answer was weak at best and that ill surely lose this case.
    I am finding conflicting info about the statue of limitations in Arizona, one says 3 years others say 6 years. I do not recall owning this debt and have limited info as to whether i actually owe this debt or whether they are within their statue of limitations.

      The trick to Portfolio is finding out how they broke the la in your case-if they did, most lawyers won't charge you anything up front to help you. They'll get paid by the other side.

      Talk to the Legal Aid or Legal Services organization near you-based on your situation it sounds like you may qualify for free legal help.
      Also, if you got served in California for a GA lawsuit, the debt collector is probably breaking the law.

      If you get sued, definitely talk to a lawyer in your state. We don’t have any Utah connections right now, but you can look for lawyers near you who handle FDCPA claims.

    If there is a judgement against you, and you are past the 30 day mark. Can you still use a dispute letter. Case since 2007. Hadnt been served. Just now looking up on line that they sent to the wrong address with court papers they have filed against me. Saying that I defaulted.

      If there's a judgment against you, this is probably too late, since the court has already determined that you owe money and how much.
      But fi you never got served, a local lawyer can help you challenge that if you've got proof.

    I love your videos - I'm binge-watching them. I am in NC and have received a letter from RAS LaVrar that they intend to collect on a charged-off debt I orginally had with Chase Bank. Then today I'm served with court documents stating that CHASE BANK has filed suit against me for the same debt. How can this be?

      Chase usually keeps their debt in-house, even after it's been charged off. It sounds like they hired RASLaVrar to sue you.

    I live in Michigan, and I am being sued by Munson healthcare for $4551.23 dating all the way back to 11/28/2016 (veto law office are their attorneys) My situation is a little bit different. I received the Summons a couple days before I went on vacation to Florida (January, 19)The day I got it I panicked, and called Veto Law Office to explain to them that I was leaving and I would be gone for a month or so, and I asked them if I could set up a payment plan and they said yes but they had to send me something to fill out and sign. About a week after when I got back I finally went to the post office and there I received a Default Request, Entry and Judgment (SUM CERTAIN) (March, 28) I have been soooo stressed out over this. I'm losing sleep, I can't eat, I'm a wreck. From there I tried calling a few lawyers, but none of them got back to me yet (I live in a small town) I am already paying off Munson Healthcare bills so I was confused as to why I got this. When I called to make my weekly payment, the lady on the phone told me that the 1,000 I'm making payments on right now is different from the bills I received from Veto Law Office. I just paid a bill I got in the mail while all of this stuff was happening that was for 300 but they said if I paid it soon they would only charge me $78 for it. I looked at the statement Veto sent me and the dates are the same on their statement, and the bill I just paid. There are a few more that are the same too. I don't want to be double charged. I have no idea what to do, I'm extremely lost and frankly a little scared. To top it off I am currently on unemployment until it warms up (I do construction) Do I still have time to send a Debt Validation Letter? They sent me a page that shows what I owe and the dates, but it doesn't show the whole reference number so I can't compare it to the bills I already paid. I don't want them to have all of my banking info. I don't trust them to give me a receipt or to not double charge me. Do you think I could do a settlement? Honestly, I just need a little guidance. I appreciate you taking the time to read this. Thank you, you're a lifesaver! Oh, and I want to avoid going to court as much as possible. Should I call them and ask if I can make a settlement?

      That’s a question it’s going to be very specific to Michigan law, and the nature of the debt collector that you are dealing with.
      I would look for a debt collection defense lawyer near you, or at least in your state.

    Ever hear of Central Portfolio Control? They dropped a collection on my credit file and I know it’s not mine so I sent a letter to them requesting them to send proof and they sent me a letter of “we can negotiate a different amount for you to pay “ 😡😡. I just recently got somebody else’s collection off my report and now another one! Bureaus say “verified”. This credit game defeats me daily 😩

      It sounds like CPC may have broken the law by attempting to "collect" the debt (by offering a bogus settlement) without providing the required verification.
      Keep an eye on them.

    How do we know if being sued? Haven’t got any mail only have got emails from LVNV and they just reported to Experian. It’s a 50k debt so I know I need to get on offense first. I’m also now sure which address they have as I’m currently in VA but was in FL when I got the loan from the original creditor

      They have to give you notice of the lawsuit in the form of a summons, served by a process server-at least in Florida.

    You helped with a debt I had with lvnv awhile back and I'm grateful. But I also now have another one claimed by lvnv. This one is very small only 450. They have not taken it court and it is small so it's not worth hiring you to handle it. How would you suggest I fight it and get it removed from my credit report.

    I've had a few court filings from Calvary Portfolio. I'm in Tennessee. Right now I only have two collections. One was from a medical bill where I was still in the process of suing the person who injured me. The other is Astra for Speedy Cash. I'm deciding now what to do about them. Neither has taken me to court

    I live in Texas and was served law suit papers by a county clerk. The company is Velocity Investments, LLC for the amount of $4,676.83. I just sent the court and lawyer an answer letter and denied all allegations. Both parties received the letter today. Included in the documents was a copy of the original loan.     If a debt collection is trying to connect from a old account/or loan from my training center, That, I thought was closed. Do to the fact, I sent the information they requested.     Hello thank God I found this video. I received a letter from the court today getting sued by LVNV to go to court next month. I was trying to fight back a derogatory statement they put on my credit report, both comeback verified and did not owe any penny to that company, and they still trying to get money from my pocket.     Hello, I have a 2016 Hyundai Elantra(financed) and I owe 10k(it hasn’t gone down since I got it out the lot and it’s been over a year now). If I volunteer surrender. The bank would auction the car and I would only have to pay the difference. If I can’t pay the difference (which the due date would be within a month), they would send it to collections. Currently, I can’t pay anything as of now. If it goes downhill, should I worry about collections?

    I have a question!
    About 6 years ago I took a lone for $3,500 it was a “car loan” I was making my payments on it everything was fine.
    About a year after they changed the loan from a car loan to a personal loan without any of my knowledge or signatures I than stopped paying on it. Is there anything I can do about this? This debt is supposed to fall off in 2023 should I just leave it alone? I don’t know what I should do.

    Hello I'm being sued by a debt collector but I've never received any information other than the paperwork to accept service. I made contact with the collector and I didn't receive anything stating that I have 30 days to dispute or a debt validation letter. In this case what do I do. I sent a debt validation letter, but they're still collecting, they haven't responded, they haven't updated my credit report, and I only have two pieces of paper for court.

      If you're in court, that's a legal emergency. You need to speak with a lawyer in your state right away, or you're going to get a judgment entered against you, and that can lead to wage garnishment or worse.

    I'm in Iowa.
    Already got served a judgement last Dec.
    Just got a letter from their office in Des Moines, asking for pmt.
    All from a credit card default for $1,200
    I'm so sick of this harrassment.
    I own nothing but my car, live barely on disability and food stamps, all my supplemental income stopped since covid.
    I have no energy to deal with these demons.
    They can't freeze my bank acct bc it's disability.

    Hi. Thank you for your videos on debt collections. You are a life saver. I live in New Jersey. I just received a letter stating that I am being sued by LVNV and I have about 30 days to "answer the complaint". I want to send a debt validation form; however, I do not know how to go about it. Do I send a written debt validation letter to the collectors, their lawyer, and the court? What should I ask them to verify? Is there a template that is used? or Do I call the collectors and ask them to validate this debt? May you please let me know what my steps are. Thank you.

    But I have heard some attorneys say not to ask for all this validation. If you do, it helps them provide evidence to the courts if they don’t have it.
    Wouldn’t it be better to wait til the trial and ask for the evidence? Then if they don’t have it, they can’t prove anything.
    If you ask for it before the trial, that gives them time and the motivation to get the proof, this no having more evidence for the trial.

    If I send a validation of debt letter to my credit card company do they have to report a dispute to the credit bureau?

      A credit card company is almost always an "original creditor" not a "debt collector" and so the FDCPA would not apply; this means they have no obligation to respond or report the dispute.

      We don't have any we recommend right now. Look for a firm that does NOT do bankruptcy. But if your debt is large enough, that may be the only answer.

    AMAZING CONTENT AND KNOWLEDGE! I have a case that was dismissed without prejudice in Florida from Presolve. I had no knowledge that I was being sued because I was never served. This was dismissed on 10/28/21 (without Prejudice). Can I now 10/15/22 ask for this to be removed from my credit report?

      By itself, dismissal, for lack of service, isn’t enough in most cases to claim that your credit report is mistaken, somehow.
      You have a right to dispute anything on your credit report that is in accurate, incomplete, obsolete, or unverifiable. A dismissal, with prejudice, based on lack of service usually doesn’t rise to that level.

    Debt collector call me and say i needed to pay a debt they text me a latter with the amount of the debt but in this inbox i notice the address is incorrect so how do they send me a validation letter
    I text back to them saying i dispute and need a validation latter by text because they don't know mi address

    I am in Florida and was just served a court summons by Security Credit Services, LLC...
    They've never reported anything on my credit or even tried to collect a debt until now...
    They did however include 2 or 3 statements from the creditor in order to validate the debt.

    i am being sued by Credit Acceptance for a car that I had a co-signer on. They are not going after the cosigner proboley because he gets social security but they are just coming after me only. the so signer was paying half the bill but stopped! Now they are suing only me. I have only a few says to respond. I know they will go after a default judgement!

    Got a call a few hours ago saying I owed a $300ish dollar balance for failure to properly cancel a gym membership. Guy was super rude and aggressive from the start demanding payment or "they" would charge another $2000 in attorney's fees. Hung up and did some research. Emailed them saying if they could provide proof of the debt and that they own it I could make arrangements to pay it. He told me to call the gym's finance company and ask who they sent the debt to. Should I respond with a direct "I am disputing" statement and request validation by mail?

    I got a notice of intention to file a lawsuit in California from Cavalry Spv I,Llc
    I called them (cavalry)to ask for a debt validation letter . But said that my account was being handled by Qualk Cardot llp and I would have to call law firm .
    But my debt is over 4 years old but it was purchased by cavalry 6 months ago
    It shows up on my credit report as 6 month old debt. But I’m wondering how to call them
    I’m confused on how to handle it.

      I can't tell you about California law but if the debt is time-barred (too old to sue) these collectors may have violated the law.

      Ohio law and procedure are different from Florida so we don’t know the answer to that question.

    In PA, being sued by LVNV for $5,000. I sent my dispute letter and they mailed me by original agreement. In that agreement is an arbitration clause, that says either party can elect arbitration and that the will pay for it. My suit is in small claims court, if they would show up, can I request to the judge that I would like to utilize the arbitration that’s in my agreement? I’ve researched that arbitration can cost around $1200, so I’m thinking that mi t be an expense that might not make it worth pursuing. Thanks for your time

      Read the arbitration guidelines. Many of those agreements (or the guidelines that come with them) require the other side to pay the arbitration fees and costs up front.
      I will also tell you that in Florida, we've found LVNV very good to work with directly (at least for those people who hire us) and we don't even need to get to that point.

      If you've been sued it should say in the complaint how this Plaintiff has the right to sue. Your lawyer (you are going to talk to a lawyer, right?) should be able to explain it.

      Because we're not in Colorado, we can't tell you what your rights are under Colorado law. But in Florida, I'd be looking at that letter to see if the debt collector had broken the law by trying to recover a debt they no longer had a right to collect.

    If I dispute debt (LVNV) via the credit companies would be that a valid notice of disputed debts? If property under living trust or life trust would it be protected?
    Tried to find one of the attorneys online on California but none of them returned my calls. It may be that I am judgment proof (SSI,SDI, and Food stamp)? Called three that made videos but none interested to call back…any help appreciated

      A dispute to the credit bureaus is NOT the same as a dispute to the debt collector.
      I can't tell you how California law might protect your assets.
      California has thousands of lawyers. Keep trying until you find one who can help you.

    I just received a letter from United Collection Bureau for a medical debt. I was in a car wreck (victim), and the party at fault's insurance company is responsible for the bills and they DID pay the hospital. Every single bill I received, was forwarded to their insurance company and was paid, but the hospital sent a portion of it to collections. Should I respond as "Not my debt", or "Amount is wrong"? And what information should I request as validation since this is a medical debt? I have gone through my hospital bills and payments, and I cannot make sense of where this amount is coming from. Thanks!

      If it was paid in full just say that.
      If they sue you, your payments are a defense and you should win.
      If they report it on your credit report, and the amounts are in accurate, you can dispute that.
      If they’re just sending you letters, and it’s not A debt that you owe, you can even sue them.

    I'm not being sued but I have a debt collector that showed up on my credit report. I've never had contact with them in writing, by email, or by phone. But it just showed up on my credit report??? Is this in direct violation of 15 USC § 1692g(a)? I never heard from them so I did not get the window to ask for validation/verification before they placed it on my report.

    I’m from Michigan, I was sued by LVNV, I filed for a motion to compel arbitration, was granted that, would it be wise to send a debt validation letter to them now? I tried through the Credit Reporting Agencies and it didn’t work, it was never verified

    I have not had anyone try to sue, but my medical bill was sent to collectors. I followed your guidance on disputing. But if I still see they payment is able to be paid directly to the original creditor online (and if I can afford to pay ) should I bother sending the dispute? Or is it better to dispute and then pay it if I can?

      It depends on what you're trying to accomplish and how they're interacting with you.
      Most medical debt going forward won't be reported on your credit report if you pay it, so that's probably a good idea if the original creditor will still take payment.

    I live near Milwaukee, Wisconsin, and I saw a bankruptcy lawyer about my debts. Instead of negotiating a settlement with these junk debt collectors, the attorney I met with suggested that I should just declare bankruptcy. I don't believe he gave me the best advice. I think he's uncomfortable negotiating settlements. I don't want to declare bankruptcy, yet I'm not experienced enough to negotiate with these debt collectors myself. Do you know of any good debt collection defense lawyers in Milwaukee?

    LVNV and are Rergeant Receivable both are suing me ( Idaho) I filed motion to compel arbitration and was granted on both with a “ Stay” in place.. deadline for Sept 30 and Nov 3rd- their attorney made a comment in court that I was responsabile for filing fees- However - why would I initiate a lawsuit against myself..
    Question: do I have the burden to file, or is it their burden to file? They have a summary of Judgement waiting to be addressed if we go back to district courts? Please’ I’m Pro se’ so far I’ve done well following numerous channels but I reached out to legal aid for possible legal representation or advice and found out the attorney volunteers for their program so conflict of interest eliminated me.. before my motion to compel I answered with Affirmative defense - burden of proof and unknown plaintiff

      This is the letter you used to respond to any initial communication for a quote debt collector and put under the FDCPA.
      If you’re auto loan company is a debt collector, and not the original predator, then the law gives you the right to enforce this letter.
      Otherwise, they might just simply ignore it.

    Good morning, I've watched your videos and you've mentioned using a certain dispute letter from the cfpb but the link doesn't take me to the letter. Can you help me please? LVNV sent a process server while I was out of state, the process server looked up my vehicle registration and told me cousin "the vehicle registration on this car is registered to this address and is in her name" that's illegal!!! She gave my personal business to someone else other than me AND told her it was from LVNV lawsuit. I thought THAT was illegal too!! I'm trying to file a complaint and send the letter you suggested.

      In Florida, the process server is required to inform the recipient of the contents of the papers, if they are someone who lives together with the person to be served.

    I live in California and I recieved a pre-legal notice from Midland. I sent them a debt validation request asking for a legal document showing that I'm obligated to pay them, the original creditor and account number, an original account statement showing the charges that they claim that I owe, and a explanation of how they obtained that information.
    They sent back a letter saying that according to their records, the debt is valid. They went on to show a letter showing when the account was transferred to them, the address to the original creditor, etc. but they did not send me any information I asked for.
    Additionally, in the letter they wrote, they claim the last known address the creditor has on me is an address that I lived in 10 years before the they claim I opened the account. There's no way that I would use an address I lived in 10 years ago to open an account if I were to do that.
    This is clearly a misunderstanding. How do I respond to them?

    hey mike so got a letter from MCM about a credit card i stopped making payments on in 2020..the letter is saying i owe 1400 and if i dont contact them or make a payment it might go to their attorney's..i question is what can i do..obviously yes i did use the card and things happen and wasn't able to make payments so my question is what are my options? also im in California

      I can't advise you on California law but:
      1. You can send a debt validation letter in response to debt collectors like Midland. That federal law applies everywhere in the US.
      2. Getting sued may be a good thing, especially for a debt of this size. Check out our video about that: ruclips.net/video/lUF0xqaFexk/видео.html
      3. If you do get sued, a good lawyer can crush them before they even get rolling. You'll want one near you in Cali.

I got a call from the iq data international, a collection company saying I owed my previous landlord $2000 damages after I moved out from the renting apartment two years ago. I followed your instructions and the collection agency refused to send me the written documents about the charge details. He said he already sent me. However, I never received it and they refused to send me again. And he said I refused to pay and will move on to the collection process and hanged up my phone! What can I do?

      Stop talking to them on the phone.
      Tell them to put everything in writing, or they can stop contacting you at all.
      If they break the law by disobeying that request, you can sue them for damages.
      If they're suing you, they have to provide proof of their claim.

    Hello, I'm in Ca. My question is, can I used the debt validation letter with the Dept. of Treasury. I had a Line of Credit for my business, Sole Prop, in 2007 with Wells Fargo, then Recession hit. I just received a letter from the Treasury saying I have a defaulted debt with the SBA. The Wells L.O.C. is the only account I can think of, however I'm not 100% sure. I vaguely remember them saying the account was SBA backed, but payments went to Wells. Either way, its been over 10+ years. The only thing I can think of is, since our business was recently approved for the EIDL, I'm wondering if that just stirred up a collections letter. Any advice is greatly appreciated! Thank You!

      The FDCPA does not apply to government agencies.
      It might apply to Wells Fargo or other companies that took over the debt after it was in default,
      But generally speaking, defaulting on SBA loans is a very bad idea, because the full way to the government comes down on you.

      If you’re dealing with the US Department of the treasury, none of the normal rules apply.
      You can and probably should write them to ask them for as much information as possible, but the reality is that this loan will follow you around forever until you resolve it with the federal government.
      If the debt is for a substantial amount, you probably need to hire a lawyer.
      Also, somethings that I didn’t point out in my first response is it if this is a business loan, nothing in the FDCPA will apply to you because this is not a consumer debt. As a business debt, you have far fewer protections than a consumer debtor would.
      You’ve got to figure out a way to fix this.

    So I found out that im going to be sued by Portfolio Recovery by solicitations from lawyers via postal service. I am in the Florida panhandle and currently disputing all of the negative items on my credit report. I have not received anything official yet but did look on my counties website and it does list the suite filed on 10/11/22. The Civil Cover sheet states that the debt is UNCONTESTED! Again I havent received notice of any kind about the lawsuit. Can you provide some assistance. I have no legal representation.

    Reposting on your most recent video. I don't mean to spam! My question is...
    Does a debt collector (attorney for an original creditor) need to notify me of my rights as stated in 15 U.S. Code § 1692g within 5 days? I was served with only a Summons and Complaints and they were the first communication, taking place on Apr 22. I filed an answer to the complaints over a week ago and they have not contacted me at all nor have they filed any additional documents with the court. Is the responsibility on me at the beginning stages of the lawsuit to reach out to them? (Nevada).
    Additional notes: Four Complains total. (1) Juridisction/County (agreed), (2) That I opened an account (no dates) (3) That they sent me statements (4) and the amount $1700. I denied the last three.

      Actually after reading a bit further, 15 U.S. Code § 1692g(d) implies that Pleadings/Complaints do not count as initial communication with the consumer. Furthermore, several courts have ruled in favor of debt collectors by defending this implication. I think...

    I have a small claim case .
    Bank of America « hired a local lawyer » for a credit card that has been sent to collection since end of 2018. Went to a Pre-trial ( via phone call) and they tried to make it settled through Mediation. I asked to send me doc that shows me that the debt in mine. And then few weeks later after I received a statement and talk to the pretend lawyer representing the Bank, I asked him that even if the credit card was mine and we decided to settle, after paying off that Debt will it be off of my credit report ??? he answered that they don’t deal with those part and stuff.
    But over all I don’t believe this is professional representation. Because when I received an email from the lawyer, I see a lot of spelling /grammar errors that get to my attention.

      They could report it on your credit whether or not you dispute it or they verify.
      But if the debt has been unpaid since 2013, it's almost certainly too old to report.
