    You wanna know the irony behind all of this though…people in debt getting sued, and going back into debt to pay for a lawyer 🤦‍♂️. If we all learned to be more responsible and calculated with our decisions, so many people wouldn’t be in debt in the first place. And don’t get me wrong, because there’s good and bad debt. Just saying…

    1:54 - 2:09 I’m not a fan of working for them, but that’s not true 😭😂. It it 100% against PRA’s policy to do any of the following 🤦‍♂️… but most of everything else you said was on point.

      Every debt collector does this. Every single one. Especially the ones that pretend they don't.

    Just went to trial with these guys. They were a mess in court. They were initially asking for a continuance, but we continued to negotiate throughout the morning. I eventually agreed to %30/60 months, but I have a feeling if I made the decision to push it I could have gotten it dismissed completely. I had pro bono lawyers, who were very helpful, but I just couldn’t get a feel for what I should do and didn’t want to push my luck. %30 over 60 months did show some flexibility on their part and I didn’t want to get greedy.
    I would say, if you do have a lawyer and it does go to trial, you’re probably in decent spot. They don’t want to be there.

    Very resently cotacted me on a 13 year old credit card bill!. I Used their on line service and was polite and stated I did not recall the bill nor did I believe it was falling within any States statute of limitations.. My State is 6 years. The on line servicer asked me if I wanted a cease and desist placed on the matter. I stated yes and we politely ended the on on line chat. Talk about a Zombie debt!

    Portfolio will delete if you pay. I paid 3 collections with them and they removed them within 30 days. Their website even states that will delete after you pay.

    I am being sued by Portfolio. They requested a default judgement, but I responded appropriately and the judge denied their request on the grounds of them not proving that they own my account. We had a Pre trial hearing and the judge told them that they have not proven ownership of my account and asked if they’d like to proceed to a trial and they do. I am scheduled for a civil trial in May. I was hoping that they would drop it vs going to trial. I have no attorney, nor can I afford one. I am a business owner struggling to stay afloat. Should I try and settle or wait it out and go to court? Thanks in advanced

      Erin, if you're in Florida, you might find we're a lot more affordable than you think. Have you called our office yet?
      If you're outside Florida, we can't really tell you how to approach it, because the law varies from state to state and we can only tell you about what we know in Florida.

    I live in Nevada. I have three collections with Portfolio Recovery totalling under $5000. These are from credit cards closed over 4 and 5 years ago. Can I have them removed from my credit report?

    how much money will they usually sue you for. i owe them around $736 do tehy usally sue for that amount? i couldnt make the payment plan either, just said they payment plan would be nul if you didnt pay it.

      We've seen debt collectors sue for as little as $500.
      We've sued them for much, much more than that.

    Can you tell me who I can speak to for South Carolina? I received a summons and didn’t reply in 30 days so they’ve filled with the court. I called and the payment option they gave I can’t afford.

    I am being sued by PRA, I immediately filed an answer with the courts and sent a copy to PRA. A week later I received confirmation of my answer from the court and emailed a settlement offer to PRA using the email address listed on the paperwork I was served with. It has been over 7 days now and I have not got any response from PRA.. What should I do next?

    I’m currently dealing with Portfolio, I have sent a dispute letter and they have sent me two letters with two different amounts on it. So I can not verify an amount because they have two different amounts. They are unwilling to send me copies of statements so what should be my next step?

      If they sent you two different amounts for the same account, that strongly suggests they are fudging the numbers.
      We've sued Portfolio in the past for lying and we'll do it again. If you're in Florida, give us a call.

    Thank you for your videos. You guys are amazing. Chase offers 10% of my credit debt which is around 10k to settle the debt. I am honestly a little bit skeptical to accept the offer! Is it normal that they settle for 10% of the credit card debt?

      Original creditors are very different from junk debt buyers, and each company‘s numbers are going to be different.
      Most importantly, the fact of your particular case are going to be very different.
      If you’re in Florida, and want a set of experienced eyeballs on your settlement proposal, maybe even get some advice about how to proceed, you can give us a call.

    I owe them $646 I hired 3 credit repair and thru still aint get rid of them ... should I just go ahead and pay or wat 🤔

      Credit repair can't solve this problem.
      Paying, by itself, won't solve this problem.
      You need to get a written promise from them, BEFORE you pay, that they'll delete any negative credit information. This means you need to get comfortable negotiating in writing and NOT on the phone.

      Paying does you no good unless they agree to delete the negative mark from your credit.

    Hello, what about if an old 2003 Saturn that was repoed and still 3,000 left they have not contacted in over prob at least 12 plus years and stated they have taken off credit report or cannot report it. and calling me my maiden name and does not have new address what can I do? thanks.

      Under federal law, you have a right to dispute the debt, and a right to demand they stop calling you.
      If they were to sue you, this dispute may offer you some additional protection, at least in Florida it would.
      We don’t currently have any Utah lawyers to recommend, but you can search for someone near you who handles “debt defense “or FDCPA lawsuits.

      The quickest, most effective way to do that is to negotiate a "pay for delete" agreement, which some collectors will do.
      Otherwise, you'll need to identify and dispute anything on your report that's inaccurate, incomplete, or obsolete.

      Not sure I understand your question. If you have a contract with a company that refuses to pay you voluntarily, you might need to sue.
      A contract that can’t be enforced isn’t really a contract.

      We do handle CACH LLC cases, but Kentucky law is very different from Florida law, so we can't take cases there yet.

      @@RWlawFL Thank you. Your videos are excellent. My case is odd, I think. Default judgement on a $15k case back in May 2015. They tried to garnish but failed, as my income was too low. They disappear for long periods of time, then start calling and sending letters again. Then they disappear again. Then they come back. Now theyre back again. Im an insurance broker so they have difficulty garnishing my ever changing lineup on companies. Still, I wonder when they will connect... so Im seeking options.

      Missing a court date is bad-it usually will result in a judgment against you and possible wage garnishment afterwards. (At least in Florida and most other states)
      If a judgment has been entered against you, and you had a good reason for missing the date (lack of notice, medical emergency, or something similar) you may have the right to ask for the judgment to be set aside.
      Or, if the amount is small enough, you might be able to negotiate the judgment payoff and avoid garnishment.
      Either way, you'll probably want help from a lawyer in your state.

    I have about $25k in collections with Portfolio Recovery and Midland most are $500-$1,500 each and just a few large ones under $5,000.
    I don’t care about them calling or sending me mail it’s been years and I’ve learned to ignore them. But I’m interested in maybe settling for a lot lower and paying for delete to improve my credit. Is this something you could help with? I’m originally from Florida where this debt started but now live in the state of Colorado.

      If it's been years, make sure it's not still on your credit already. Many of these will drop off sooner than you think.

      @@RWlawFL Most of them have been in collection for 4 years and 6 months according to Credit Karma. My whole mission is to improve my credit score so that is why i would be interested in a pay for delete option. But not sure if i should contact them myself over the phone and negotiate without acknowledging the debt.

      Don't rely on Credit Karma except a possible warning. We've found them to be terribly inaccurate. Go pull all three original reports from annualcreditreport.com and see what's really there before you do anything.

      @@RWlawFL Thanks! I did the Annual Credit Report and according to Experian "On Record Until" most say 06-09/2024 so about 1 year and half more. Not sure if it would be worth waiting for them to just fall off or anything else i can do to accelerate that? I have disputed them before but just for accuracy.

    What if I started a payment plan for $28 a Month for a year and half now, should I cancel the payment plan? I roughly paid $500 dollars so far. At this rate I wouldn't pay it off until 2028!! I feel stupid now listening to your video now because I've started a payment plan with them. I'm located in South Carolina

    I have a pre trial coming up. I have a lawyer I'm talking to but the total is $1,785.08 and he says he can get them to settle for most $1000. I feel he can get it down to 600-700. Am I being unreasonable? But I think he's saying 1k because they did include a bill of sale & title. So does that matter? Yes it's against Portfolio Recovery in Palm Beach County.

    Good evening thanks for this vids. I have 3 items with this collection agency.
    I send a debt validation letter , they responded and send me back the statement and letters stating they bought my account.
    I’m going to reach out to them in hope they will settle, I’m hoping to
    Buy a house in 2 years but I was told I will need to get Reid of any collections I may have . Do you think I should go ahead and req a settlement?

      it depends on what your letter said, what state you're in, the amount of the debt, how much you're prepared to pay, and a bunch of other factors.
      And it also depends on whether they break the law in the next 18 months.
