This video is very informative & educating. Know your rights & know the laws of your state . The statue of limitations in the state of Ohio is 6 years regardless of what type of debt it is. I had a Sears cc I was making payments on it & one day I got a letter in the from midland credit . Which is a debt collector. After that I never heard anything after that . Your a 💯 % right about debt collectors.I do have a lawyer on my side. Just in case .

I was sued by LVNV and went to court. Presented all the laws they had violated and the case was dismissed and removed from credit reports. LVNV then sold/gave/transferred the debt to another collection company.

I got caught in the trap before I became aware of my rights and options. Is there a way out of paying these people? In a several months, it will be moot b/c I'm going to retire and they won't be able to get my retirement. But I'd sure like to get free of their financial death grip before then.

I'm out of the country but being sued in NY by this company. All the lawyers I've spoken to said their retainer fee costs more than what I'm being sued for and I'm not eligible for pro bono representation since I'm no longer a resident. And getting all of these documents internationally notarized and shipped is nearly the same as paying smh

You’re allowed to dispute any credit report entry that’s inaccurate, incomplete, obsolete, or unverifiable. So first you have to identify how the collection fits into one of those categories.

We don't, and I doubt we'll do one, since they will vary depending on the individual judge. Go watch a CMC involving cases hat aren't yours to see what happens.
If your are sued by an original creditor . how do determine if they have the proper Docs to make it a valid case against you? If so, what docs gives them leverage? statements? T&C?
Original creditors usually have the documents they need, because they're the ones that created the account.
Which documents they need depends on the specific claims they've sued you for. Usually they would need a copy of a contract, account records, and any other correspondence. Again, it depends on the specific claim.

Plus I been sending Dispute letters to clean my credit report
How has that worked out for you?
I just recently looked at my credit report and saw LVNV I had not idea of a collection I Was able to dispute it on my trans union and they took it off as far as the other two credit bureaus it does not come off. Once I disputed it I got a text from a halsted financial (idk if it’s the same company) I’ve called to get more information but they give me nothing
I wouldn't trust a text message. Block, delete, report as spam.
I owe them only $641 and offered to pay in full if they would send a signed proof of removal but they said it’s against company policy

It might come off sooner if you can identify some way the reporting is inaccurate, obsolete, or incomplete-that way you can dispute it and they either have to correct it or remove it.
They are trying to sue me through a third party and have filled a law suit through the court house

Are they legally allowed to say you are on a pre legal track? Isn't that in violation of FDCPA since they can't sue?
LVNV sure all the time. So far in 2023 we’ve handled more LVNV lawsuits than any other junk debt buyer.
I fought with LVNV for about three years after proving that the account was a case of identity theft, they still tried to sue me. One day out of the blue I got a letter saying I was free and clear and the debt was not mine, I have held onto that letter like it was a golden ticket.
If you proved it was ID theft and they kept hunting you down, that's a violation of federal law You could have sued them for it, and put some money in your pocket.
If it's been less than a year, you still can.

I've begun getting e-mails and a dunning letter from LVNV stating my account has been purchased from Navy Federal in the amount of ~$17k

Yeah I do have a problem with them. I stopped them from calling me and anyone else, but now they are spamming my credit report and have been for awhile now. I just got served papers yesterday in Washington state from LVNV. I have 3 separate ones on my credit but only one showed up so far with papers. They did change the date from which I last paid in their document and the page they sent of my transactions but I’m pretty sure that it incorrect along with the amount they are claiming. These are Also all opened in Maryland I now live in Washington state now for 5 years not sure if that matters.

Currently have a pending settlement agreement for way more than I can afford they agreed to a complete deletion of the debt but in exchange for 70% of $1,134 and now I just recently noticed that they changed the amount on my credit report to 995 dollars not the original amount above that they sued me for and was reporting to the bureau's I somewhat agree to the settlement based only on the fact that it seemed as if the judge was validating everything they were saying and I cannot afford to hire a big attorney was a retainer that's bigger than the actual debt is there anyway you can help me with lvnv? We responded to your other comment. It’s against the law for us to provide legal services in Ohio, so there’s no way we can represent you. And because we don’t know how the court systems in Ohio work as compared to Florida, any advice we give you there is probably wrong.
If you truly can’t afford an attorney, look up your local legal services program and see if they have assistance for people in your situation.

I wish I had seen this video last week before I paid them a settlement! I’ve been watching your videos and searching “LVNV” and never came across this video! That’s horrible RUclips.
Anyway I paid 269 of a 671 balance and they said it would be deleted from my credit report but I will need to call back in roughly 3 wks.
I don’t have that time so I disputed it as “paid”… Experian updated the dispute in 3 days saying the balance is now 492 past due… not settled, not paid. So it seems like they may still pursue me for the residual balance?
I'm not sure why you don't have time, but it is going to take some time and all you're doing now is making things messier.

LVNV Still refuses to remove the negative remarks from my credit report even though they did not fulfill the requirements of validating the debt and even went so far as to hire an attorney to pursue litigation against me, though I had written them a letter to cease their attempts to pursue this moot point. I even filed a complaint with the Consumer Financial Protection Bureau regarding them, but to no avail, the negative remarks are still on my credit report.
Validation has almost nothing to do with credit reports.
If your credit report is not accurate, dispute it. If the CRA fails to correct inaccurate information, sue them.
Complaints to the CFPB, as you've found, are useless.

If that meets your goals, they put it in writing BEFORE you pay, and the amount makes sense for you, then it’s worth considering.
I've just recently gotten a letter from a defense attorney from Chicago Consumer Law Center P.C. stating that LVNV FUNDING LLC is suing me for an unpaid debt, the original creditor was Credit One Bank and I tried to get in contact with them but they were unreachable also I signed up to a protection that just in case I couldn't pay they would dismiss it without charge but here I am with an open balance of 1043 only when I originally balance was 600 what should I do?
If you've been sued, you need to talk to a lawyer in your state right away.
What about just telling the court that I don’t have a signed contract with LVNV? That is what I put on my answer to them.
We've never seen that strategy work, no matter how much certain online influencers push that idea.

LVNV tried to garnish my wages a couple years ago. But because I’m head of household and my income is under a certain amount, the judge granted me exemption. Recently, the company contacted me ordering for me to fill a paper form giving a lot of personal information about me and my kids. I wasn’t comfortable with that, so I called instead to get more information. The company went back to court again in attempt to garnish my wages. I turned in a form asking for exemption again. What can I do to get rid of this situation for good ? The old credit card dept they are suing me for is almost 20 years old

They're garnishing my wages I didn't even know they were garnishing my wages until it came out of my paycheck. I had to go to my HR lady and ask her what was going on. She found out for me. Apparently they took me to court in July 12th of this year. I never received any documentations about going to court so of course I didn't show up because I did not know that I had to go to court so they garnished over $2,000 out of my paycheck. When I called the company and told them that I never received a letter stating that I had to go to court. The demeanor of the lady that I talked to changed really quick and she gave me the lawyers phone number which was different than on my paperwork and I called both numbers and never got a hold of any lawyers at all so I ended up stuck paying over $2,000. Almost lost my car because of the garnishment of 25% of my paycheck every pay

On my credit report it says it has been disputed and verified under the FCRA and it is a valid debt ( I requested validation) . It went to a lawyer and I got a letter that it has but that's all that's happened so far? It's been over a year since that letter.

I’m in Texas and I got a letter by a man at the door ( I’m being sued ) and it’s this company, they are saying I breached contract with one of the companies for $7,132 dollars and I have 14 days to contact the court before it defaults basically. I am very concerned …. Not sure what to do. I’m on the courts website where it was submitted and I click claims & I can do a defendants answer but I wanna ask you what u think I should do first. This is very new to me. I want to DENY these allegations. On the paper it does have a few dates of “when the account was opened” and when the last payment was. Which was all in 2022. They recently picked up a 6 year old balance of $3,007 I had with navy federal I had no notice of them picking up that account it came out the wood works. Can I negotiate a payoff and possibly a pay to delete letter ? And what would be a good number to settle with in your professional opinion? If it's a six-year old debt, that would be beyond the statute of limitations in most states, meaning they can't sue you to collect. Once the debt is seven years old, it will drop from your report (and there's no way to "reset" the timeline-if they don't remove it after the seven-year mark, they're breaking the law).

If it's not your debt, we'd countersue the debt collector for violating federal law.

Is that because the debt belongs to someone else? Or is it your debt and someone messed up your middle initial? If it's someone else's debt, that's a defense. If it's your debt, probably not.

I got a letter from LVNV and it says at the bottom:
“ the law limits how long you can be sued on a debt. Because of the age of your debt, LVNV funding LLC cannot sue you for it, and LVNV funding LLC cannot report it to any credit reporting agency.”
So should I just send the form and check off that I dispute this debt because it’s not my debt? Or should I also ask for them to send me the name and address of the original creditor?

Hello! I'm in Alabama wanting to know if you can help me as I would love a consultation. They're sending me emails and text messages. At the end of the emails, they always say if this is not the email for Yolanda please disregard. I find that to be weird because they're not even sure if it's me as I havent responded to any of the texts/emails. I really don't know where to start with them, but now the emails are hinting that I still have time to accept a payment plan before they start legal options. When you learn a lesson, and pay a price, my law school professor used to call that "tuition."
What if LVNV hired a lawyer and the judge gave them the right to publish my name on the court view website as proof of being served. Then by the time I found out they filed a default of judgment and the judge granted it. Can I still file an answer or complaint??
If a default judgment has been granted you'd better act quickly. A lawyer in your state can help you figure out how to respond.
In Florida, the entry of a default or default judgment cuts off your right to defend. Many other states have the same rule.
You can file a motion to vacate default judgment for a good reason.
This is true in theory but very difficult in practice.

So My credit shows LVNV reporting collection accounts but resurgent is sending me mail saying I owe for the same account what should I do
Resurgent is a subsidiary of LVNV.
You can dispute any account on your credit report that is in accurate, incomplete, or obsolete. The credit bureaus have a duty to investigate and either remove or correct any errors.
I’ve been getting letters from Law Offices saying that I was being sued by LVNV and just the other day had a police officer come to my house. They are not on my credit report and the company they say they bought the debt from says I owe zero dollars on my credit report.
If you've been sued, you need a lawyer ASAP and your credit report is IRRELEVANT.

Hello I'm being sued by LVNV LLC. I live in NYC. I've been to court with them on Jan. 30. Their lawyer spoke to me & asked me do I receive SSDI because I mentioned that on the ANSWER IN PERSON form. I also put down a GENERIAL DENIAL which may have been a mistake. They keep sending me these interrogation forms to answer which I didn't. Now they're compelling me to come to court on June 12 because I didn't answer those forms. I responded to the judge to ask for the case to be dismissed because I'm on disability & my income is exempt in debt collection. I consulted the free legal services here in NYC & was told they don't help people who are judgement proof so they sent me some information by email. I have to return to court on June 12 because they are compelling me & for a pretrial on July 10. I want this case dismissed. Can you offer some advice. Thank you.

When you say "removed" I assume you're talking about your credit report.
10-year-old debt should come off automatically. If it doesn't, dispute it with the CRA.
Got served a summons at night with a guest here by a cop. I'm showing up in court and can try to negotiate when I get there. Would love any advice .. offer a small monthly payment. Or a reduced settlement amount because they're adding so much to the original debt? The one attorney I spoke to said to call the courts to confirm if there is actually a court date on the docket. The papers I was served by the (? Probably fake) Cop did not have a Case# or anything. It's all scare tactics. I will offer a payoff amount at 30 percent of the original debt. That's what the attorney told me to do.
This sounds VERY suspicious, and I'd strongly recommend you speak with a lawyer in your state before you try to figure it out on your own.

@@RWlawFL if one is judgement exempt, and is sued and LVNV has an affidavit ín the complaint from Resergent and you file motion to strike and judge denies, then in motion for summary judgment they bring in another affidavit from LVNV for business records, they have those 2 statements but no one (affidavit) from original creditor, claim debt is verified with 2 or 3 years of statements and the portfolio showing debtors name/information, LVNV has provided a bill of sale/transfer but nothing showing the terms of purchase. If defendant files opposition to summary judgement and the newest affidavit, and uses there is nothing showing proof of purchase/terms, only what I feel is a generic bills of sale/transfer of debt and judge sides with them, is there anything that can added for someone that is collection exempt to get the judge to find in favor of defendant. Defendant would much rather pay original creditor than a junk debt buyer who didn't even pay that much for said debt. ....
So, you don't get to choose who you pay. Whoever owns the debt can enforce it. But can they prove it?
And once the original creditor sells the debt, paying them odes you no good. (Your chance to pay the original creditor was back when they still owned the debt)
Being collection exempt is NOT a defense to a debt lawsuit. It may stop them from getting the money, but will NOT result in a dismissal.
@@RWlawFLok, but what if the debt buyer has bill of sale but nothing showing they actually purchased the debt. I had seen before that they have to have proof they purchased the debt in addition to bill of sale. In this state it's cc debt is considered as account stated but nothing in the lawsuit states the debt is acc Iunt stated just amoubt due and owing. Thanks fir the rsposnse.

Hi my name is Tammy I don’t live in Florida I live in Illinois but im being sued by this debt collector the debt is 10 almost 11 years old it has no account number so im not sure what it is even also it saying on the letter that it is a filing petition to revive a judgement so that im also confused on the judgment was entered February 11,2013 for 2,575 and now they want 4,779 I go to court Monday January 30 2023 please could you give me some insight on this to help steer me in the right direction

It sounds like they sued you back in 2013 and won. While it may be too late to stop this process, you should absolutely speak to a lawyer in Illinois who handles debt collection lawsuits.

Every communication from a debt collector, in whatever form, must comply with the requirements of the FDCPA.

If the lawyers on the other side are afraid of you they’re more likely to give you a reasonable deal.
@@RWlawFL they said to the courts they're only authorized to settle for $700... 75%. Due to my disability I could have requested a dismissal but then they were not willing to delete as long as I come up with the $700 they're willing to do a pay for deletion and file a dismissal with the court so basically I'm paying all the debt I do have another account with them but I'm not being sued for that one yet
LVNV or RESURGENT Capital shows that they will remove collections within 30 days of paying the debt. This is clear on their website. Is this a lie or just a trick tactic. Do I have a case if they don’t remove after payment since it’s clearly stated on their site.
Any time a debt collector lies to you, you can sue them for damages under the FDCPA.
I'm trying to send LVNV Funding a cease and desist letter. They have many addresses and P.O. Boxes. What address should I send the certified letter to, and does it matter?
On their most recent communication to you they should have an address.
They asked you to mail a check-where do they want that sent?

Send your dispute letter to the same place they want payment. I guarantee you they'll open that envelope and sign your green card.
Hi Michael, I'm not in the State of FL, but I've been getting letters and emails from LVNV for a credit card debt for a while. The last email I received from them was about 2 weeks ago, and they stated my account has moved onto a pre-legal track. Now, I've received a letter from an attorney debt collection office that's not in my State last week. They're giving me until April 1st to dispute all or part of the debt in writing or a phone call. If I dispute, they'll stop collection until they send info that shows it's my debt, but if I don't dispute, they'll consider it my debt. Do you have advice on how I should handle this? Would an option be to try to settle for less than the amount? I'm not sure what to do. Thanks for any advice.
Under federal law-applicable all across the US-you have a right to dispute the debt. Usually, we would recommend you do just that.

In your position, I'd ask for a lawyer in my state to review the mail I got and advise me about my possible next steps. Those will depend a lot on exactly what the letter says.
They are trying to sue me over a 300 dollar credit one card they want 670 for it im not giving them a dime but I don't know what to do next
If you’ve been sued, you need a lawyer. Otherwise you’re most likely to get steamrolled.
I have a VLNV collection I sent for validation they just send a copy of bill I send letter to bureaus comes back verified. It is inaccurate

If you've been sued, talk to a lawyer ASAP about your case. They should be able to give you an exact cost that's far cheaper than losing your case.

I live in Tennessee and have been sued by LNVN funding in Illinois for a debt that was incurred in Tennessee! My dad and I share the same first and last name, my dad lives in Illinois and I live in Tennessee! The firm representing LNVN is called Blitts and Gaines. I have reached out to the law firm to let them know I don’t live in Illinois and they keep saying it’s under review in their legal department. The court date is 5/23/22. I’m meeting with my attorney here in Tennessee on 05/16/22 to file for chapter 13. Can I still sue LNVN funding for unlawfully suing me in Illinois where I never lived even after filing bankruptcy? The credit card company knew my bank account number do they share this with LNVN funding? I’m nervous about them getting a default judgement in Illinois even though it’s unlawful and seizing my bank account! I know the bankruptcy gives a stay but with it being right before the court date and their refusal to go by the law that they will try to call it a error after being caught! Should I go to court on the Illinois court date and give the judge proof of my bankruptcy filing?
I don't understand why you'd file Chapter 13 for a debt that's not yours. If they've got the wrong person, and they've sued in the wrong state, just go after them.
A bankruptcy filing may interfere with your right to sue for FDCPA violations, or at least to get any money from that lawsuit.
