    Thanks again for handling a couple of collections that sued me about a year ago. PR never filed, but they’re still squatting on my credit report. The amounts are pretty low and I’m considering settling with them for about 65%.

    They sued me over a decade ago and lost and removed it from my credit report. This is way past the SOL and they are calling me again! One thing isn't mentioned is that after you pay them you will owe taxes of the difference between what they say you owe and what you paid. For example, if they say I owe $10,000 and they settled for $800 I will end up owing taxes for $9,200! This happened to me once when I settled with one of these junk debt buyers, so I made up my mind I never settle and never negotiate or talk to these scum. If I need to communicate with them for whatever reason, I hire a lawyer. They break the law (FDCPA) all the time so just keep track of everything and then turn the tables and sue them.

    Hey, not in Florida but I was checking my credit report and I saw that portfolio recovery has 3 collections accounts on my report for the same debt. The collections they say I owe has increased but the creditor for all three was synchrony bank. First was about $800 second was $1,600 and third was $1,500. How do I handle this? I’ve gotten a decent job and have been wanting to pay it back but they are making a mess of my credit score.

      Are the reports accurate? How are they affecting your life? How will removing them improve your life right now?
      Your next steps will depend on a complex analysis of all the factors in your situation and it’s impossible to make a one-size-fits-all recommendation.

    I think im going to email the CEO and let them know im making a formal FDCPA complaint. Their rep told if I paid my balance it would be a 10 day hold vs If I made payments, it would still be 30 days before the last payment is processed. Thus giving me a incentive to pay in full. Of course it's still reflecting a balance and now Im told it takes 30 days. Ty for this info. These companies are the worst!

      Don't bother. if they have broken the FDCPA, your best (and probably only) recourse is to file a lawsuit.

    I am getting daily calls from Portfolio. My credit report shows a debt to them for over 3000. I have no idea what it is for and I don’t answer the calls but to qualify for a home equity loan I have to pay it off to beat the debt to income ratio.

    I have no debt. The closest I've come to debt was a missed card payment (late 6 days (had the money to pay, but forgot, oops)), and all three credit bureaus say I have nothing on my collections file on my most recent credit reports. They've been calling me for months, nonetheless. They have not contacted me any other way, whether it be letter, email or text, and they have not left any message on my voicemail. How should I proceed?

      If all they're doing is calling an hanging up, you have a few options:
      1. Ignore the calls.
      2. Block the number, if they're not using more than one.
      3. Send a "cease and desist" letter to the debt collector.
      If you choose #3, and they keep calling (and you can prove it's them) you can sue them for violating the FDCPA.

    Got served with law suit papers on Thursday, what would be your best advice? I live in Texas and it’s for a old credit card. Should I call their attorney to settle on a payment before going to court or what should I do?

      No. Speak with an attorney right away and see if you can actually get this thrown out and put money in your pocket.

    I recently found out that I have a lean with them in my county here in Texas that was submitted in 2019 how can I handle this if papers where not served to me and the statute of limitations in Texas is 4 years starting with the time the last payment was made to that particular dept and the last payment I made to it was around September or October of 2017 which means it's been 4 years... Thank you so much for your help!

    PR now owns my collection debt but they haven't reach out , now this debt I took it out when I was 16. It was a 100 hundred dollar credit card at Macys and since I was young with no job I stopped paying it after like 2-3 years , now im 31 and this debt stil keeps showing in my report as collection debt and they keep updating the opened date so it never falls off . The debt is fr $366 is not much but I mean the original loan or credit was only 100 dllrs . what should I do ?

      If you can prove that the date of first delinquency was more than seven years ago, then dispute the debt directly with the credit reporting agencies.
      If they refuse to remove it, you can sue them, and you probably should.

    I got sued by them last year 😅😅😅 for a debt that WAS paid off, but the account itself had been derogatory for a time, from 2017. I got an attorney and we jumped through all the hoops and sent our response within days of me receiving the papers. The case sat open for over a year until I got a call in April from my attorney informing me that the case had been dropped. That was it. During the duration of the case we had heard nothing back, until that time. This company is a full out scam.

      I received a letter from Portfolio about a debt that is long past the statute of limitations and they admitted they could not sue due to the statute of limitations. Now, I get phone calls from them that I don't answer.

    Question. I got a mail advertisement for an attorney and they attached the summons but I was never served by PR for court. What are my options if I’m not properly served?

      Whether you've been "properly served" is a matter of state law. In Florida, if they fail to make proper service, the lawsuit can't proceed but here's the reality: as soon as you learn you've been sued, you need to deal with it, not bury your head in the sand.
      Getting sued is usually the best opportunity for you to put this behind you forever even though it might seem like the end of the world.

    They also left messages with my sister and grandmother saying I had 24 hours to comply or else agents would be sent to arrest me for fraud.

      As I noted in the other comment, PRA would rarely, if ever threaten to arrest someone, so I believe this is probably a scam from somebody try to scare you into paying the money on the phone.

    So here's my situation. They called me, and I mistakenly thought two of the debts they owned were on my credit report. They weren't. So after I set up a payment plan with them, I learned it didn't affect my credit and they were over 7 years old. Can I just stop paying them?

    I was being sued by them and had to appear online in court, they never showed up to the court dismissed the case. Its now been a month since them and I just received a letter from them saying the filed a "motion to vacate dismissal" Their court date is next week. Is it likely the court will rule in their favor so they can sue me again? What should I do next?

      i can tell you're stressed out about this and unfamiliar with the court process.
      You absolutely need to speak with a lawyer in your state. If you were in Florida, we'd take care of this for you. If you're somewhere else, we can't help.

    I have PRA, receiving letters that they can not sue, past Texas state of 4 yr to sue. I just sent a debt validation, but isn't it supposed to be a closed collection account, is trying to collect a violation?

      If you got a letter from PRA on an account past SOL, that is very likely a violation. Call Bill Clanton in Texas and he can help tell you if you have a good case against PRA.

    I see in my Transunion summary that portfolio is remove the collection accounts I have with them and re adding them so every month it looks like I have new collections. They also have them reporting 120 days late. I've tried disputing this with Transunion with no results. Do you have any recommendations?

    I got a call from these guys last week. I don't have credit cards or unpayed bills to my knowledge. I recently quit my job in April, and I had insurance through them. Are there accounts that I personally need to pay now? Is that a reason why I'm getting calls from them?

      Tell them to send you a letter about the debt, and to stop calling you. Then use the letter you get (if any) to research whether it's really a legitimate debt.

    They been hounding me for almost 5 years, The last letter I got from them said the debt was too old to sue and get gave me an amount to settle. I dont even think the company that i originally owed the money to is in existence.

      Generally, yes. Two exceptions:
      1. If they break the law in some way after that, you can sue them and put some money in your pocket.
      2. They can report on your credit report for seven years. If they make a false or otherwise illegal report, see #1.

    Thanks for this video! I have been thinking this was spam, but recently came to realize it is not so finally looking into it. I am fairly certain that I have no unpaid debts and my credit is great (also showing no unpaid debts). My deceased father in law though, did have some debts when he passed. My husband worked through all of that to the best of his abilities. I am wondering if the calls I receive regularly from Portfolio Recovery (w/o a voicemail left or corresponding letter) are perhaps for his debts? Should I continue to ignore the calls or answer and (cautiously) speak with someone to learn what they are trying to go after? [I reside in Illinois, but have lived in WA, OR, CA; My late father-in-law lived in Alaska]

    I am in Florida and I am being served by Portfolio Recovery Associates due to credit card debt that I have had since 2018. Unfortunately, my circumstances at that time were rough and couldn’t keep up with life so had to let all my cards go. What do I have to do or say because I am not paying that. I am a single mother and am just now trying to keep afloat after the pandemic has affected my job, hours, & paychecks. What am I able to do?

    They offered to remove the tradeline via a settlement offer. I have their letter stating this. I have disposable income right now. Should I proceed now as I have proof of the tradeline removal offer? Honestly they havent really been on me about it. (Yet). Im thinking even if they renege on their deal. At least I have proof of their offer and dispute it via the bureaus then….

    I am German and left the U.S. a couple years ago.
    Now they show up on my credit report for a debt but I have reached the statute of limitations (3years in S.C.).
    Can they sue me overseas?
    And what would happen, if they do that and I travel to the U.S. as a tourist? Will homeland stop me at the airport and arrest me?

      I have never heard of them trying to file suit overseas.
      If they try to file in SC, I doubt they’d be able to do it, but I’m not a SC lawyer, so I can’t say for sure.

    I’ve been receiving calls from them and they call from different numbers and never leave voicemail. I never received a letter from them either. I’m in Georgia and I do not have any lates ever reported to my credit. I also pay everything on time and check my report and all of my accounts are in good standing I never allow lates on credit. Everything I have is paid on time every month and I don’t have a lot of accounts only 5 so it’s easy for me to keep track. So I don’t know why they would be calling because I don’t have anything negative.

    They call me 3 or more times a day whether I answer or not. I’ve finally have just stopped answering calls from any number that I have not confirmed and put into my contacts.

    My family member was just notified by her employer that this company dropped off a summons to garnish her wages. The employer is telling my family member that she has to abide by the court order and charge what is owed. Is the employer allowed to touch her wages? The debt is of $1,733. What is the best course of action for the employee?

      In Florida the employer MUST obey the court order for garnishment. It’s probably the same in whatever state you’re talking about.
      But federal law provides certain protections and if your family member qualifies they may be able to get the money back. There should be a notice attached to one of her papers your family member will receive.

    I agreed to settle for 170 less in exchange for an email in which they mentioned their "policy for request for deletion " and it still reflects the remaining balance owed and that is all. Did I renew the clock? Do they actually have to delete if they said they would? The email was vague

      In Florida, a mere agreement to pay doesn’t reset the “clock” for them to sue you. Only actual payment does that.
      If the email is too vague, ask them to clarify before you make any payment.

    Wife just found out she has power of attorney for her mother whos sick and in care. House has a quitdeed on it to my wife. Portfolio has a collection on the mother the last 5 years for $701 month for $65000. She's been paying on this to portfolio maybe 5 years now. Show by portfilio the debt is now $51,693 showing principal at $158.59 and interest at $404.78 a month. What can I do to stop or reduce this debt, so I can sell the house to care for the mother. I'm in Indiana.

      I strongly recommend you speak to an attorney in Indiana who deals with debt defense, FDCPA, and possible even elderly exploitation cases. I don't have anyone specific to recommend, but a call to your state bar association ought to get you on the right track.

    i got a judment agensit me saying i have 30 days to pay 2 grand from a 2015 credit dent or they garnish my wages. I looked up the case number and it doesnt exist anywhere in public records or court. so shouldni ignore the letter?

      Well, if there's no court case, there's no judgment. You probably should check with a lawyer in your state right away to find out what's going on.

    I paid off a exes computer but yeah portfolio recovery is trying to collect for it and then they're also trying to collect a 12 year old HSN card. i sayed i pay 500 i am disabled thy sayed no but thats 50% of my det

      If you’ve paid off a debt and they’re still trying to collect it, that’s a violation of the FDCPA.

      The United States Supreme Court gutted the TCPA just a few months ago.
      Florida has a pretty good law, but it does not apply to debt collectors.

    I got a call, they failed to clearly identify who they were and what the call was regarding. I told the person on the other end of the line that i was uncomfortable answering such personal questions and they hung up on me.

      Unfortunately, I never answer their calls, but today I was caught off guard and gave them my name and birthdate and then the caller gave me her name as I was hanging up. Color me concerned (it was Portfolio as I searched the number).

    I'm 58 and 100% disabled and have trouble eating I was gave 1 year to live 5 years ago I lost my family to cancer and moved to Florida to take care of my 82 yr old mother this group filed a suit against me the 13 of March 23 I broke my neck, back. Hip, ran my ribs thru left lung knees shot, bad heart, heal spurs severe anxiety from all my pain and I haven't slept in days I don't have much it was mostly stolen we eat 7 eleven hot dogs to get by I'm at the end of my rope, what can I do ?

    I've been getting calls from them. Over two years, never got a letter from them. I don't even know what debt I owe. I keep track of my debts.

      You can send them a letter, telling them not to call you, and only to communicate with you in writing.
      You can also ask them to provide evidence and identification regarding the debt.

    I have an old (judgement May, 2015) debt with CACH LLC in the state of KY, but aside from a few small hits here and there they havent been able to connect with my wages, largely due to my industry (commissioned ins broker). They disappeared for a long while but lately theyre back... and using some highly suspicious tactics to try and get me to reveal myself. I suspect some of these may be illegal, such as a $10 check they sent to see if I would cash it and reveal my account info/bank, and a mysterious phone call requesting my companies services, etc. Ive already sued them once for improper tactics but they declared bankruptcy and promptly sold my debt to a different CACH chapter. Any suggestions at this point?

      Because Kentucky law is different from Florida, we probably don't have a helpful answer for you. But the type of tactics you're describing-especially the small check-MAY be a violation of federal debt collection law. If you're still in Kentucky, consider whether it makes sense to sue them again for FDCPA violation. (And make sure the any checks go through your lawyer's trust account so you don't reveal any banking information.)

I have been receiving phone calls from Portfolio Recovery almost every at 5-6 am and when i pick up the phone call, they hang up and they never sent a letter to begin with.     I had a credit card that was closed at like 2200. It looks like Wells Fargo dropped it and I’m guessing this $472 from portfolio recovery is in regards to that. Should I pay that or are they gonna try to get the full amount it originally was?

      If it’s not your loan, then there’s no legal debt collection they can have against you.
      This might mean you get to make a profit at the same time of stopping the calls.

      Under federal law, they aren't supposed to be disclosing your debt to third parties, even family members. While a "class action" probably isn't what you're looking for, you might be able to sue. Have you looked for a NJ lawyer who handles FDCPA cases?

    I just got a letter from some random attorney from a city nearby, saying that portfolio recovery associates filed a lawsuit on me on December 9th. I haven't received anything from portfolio. I just find it odd that some lawyer knows about this before I do. Is this how it usually works? If there is a legitimate lawsuit what are my options? Sorry my question is vague I'm just new to all this stuff. Any help is appreciated, thanks.

      This is very common.
      The moment a lawsuit is filed against you, it becomes part of the public record. Anyone can access this information, and send letters to people who have been sued.
      Some lawyers, and other people who may or may not be helpful, do this all the time. in fact, sometimes we send letters.
      The only way you’re gonna find out a lawsuit has been filed as when the process over knocks on your door and delivers the paperwork. This can often take days if not weeks, so anyone looking at the public record can find out that you’ve been sued.
      At least, this is the way it works in Florida. Other states may have similar systems.
      But now that you know that you’ve been sued, you probably should talk to a lawyer to determine your best course of action. If you’re in Florida, please give us a call right away:

      I am dealing with the same thing, I got some of those advertisement letters in September and was never served. I recieved a letter from the law firm yesterday informing me they've filed for a default judgement. I'm in the process of sending an arbitration letter to the court as my original contract with the credit card company has an arbitration clause.
      Can they file for default judgement without ever contacting me? If they've done something illegal I may hire an attorney and threaten to countersue as one of the advert mailers I got said this is an illegal practice. I'm hoping the arbitration will be enough to scare them off, but if not I'm willing to fight it out in court/arbitration.

      If they are filing for a default judgment, that means you've already missed the window to demand arbitration. Stop screwing around and get professional help from someone who knows how to fix these things.

    Portfolio called me for the first time today. I missed the call so I called them back not knowing who it was just that it was Idaho number. When I called back they immediately started asking me for my phone number and my full name so they can look up my account. I'm scared to tell them anything. I said I don't know who you are or why you're calling me so to protect myself from Identity theft I can't give you any information. What do I do next?

      If you can’t find a way to come up with some proof that you already made payment, you’re gonna have a real problem.
      I’d make that my number one priority.
      Depending on your state, this debt may be beyond the time limit for them to collect, and there’s a chance they are violating the FDCPA by even making demand.

    I live in Pennsylvania and im on disability, i just got a statement in the mail today from them stating that I owe them over 5,000 dollars , 10 years ago i owed them money and entered into a payment plan 50.00 a month until it was paid completely, after that they stopped bothering me , this was from a citibank charge card from sears , I was younger at the time and my Mother actually paid for it with money orders. Now they are telling me that I owe more than what it was to begin with ? And I know that I already paid it .

      We're sorry to hear of your situation. We don't use template letters, and we don't handle tax questions.
      In our experience, the party that issued the 1099 can't take it back, but you can always negotiate with the IRS about what effect it has on your taxes. Any reasonably competent CPA or tax advisor should be able to help you out with this. (Ask them if "insolvency" is an option)

    I've NEVER answered their calls in 6 years, they don't stop. It fell off my credit report, they found an old email address of mine and stated they can't put it back on my report or take me to court. They've been calling for like 6 years 3 times a day. The debt in question is still in my ex husband's name and on his credit report. So annoying.

    It got to Legal dept bc they said SOMEONE left the SERVING DOCUMENTS outside my house. I NEVER got served but escelated to legal dept bc i never responded but i never receieved it. So i receieved a packet through mail asking for my employer info bank info my assets and sooooo much more. I tried calling and person was extremely rude i tried to explain i never receieved documents or served he didnt really care what i had to say so i just hung up so called again and young lady was speaking to me. She offered payment arrangments but never asked for bank info or cc info said i could pay online but then my kids got sick covid so i was out of work for a while and was unable to make the payment. So i am scared that since i did not pay online if they can go through with the garnish of wages or income tax return. I am so stressing out about this Portfolio. I alrwady pay several w Portfolio but this 1 is the one that has escelated. Please help i left comment that im from South Tx.

      CandidoMedia; Do Not block them! Write down every call/keep track of every single call; the Phone number, date of call/time and the name of the person the caller was attempting to reach, as well as whether the caller was a live person or a recorded message. Once you have done that, go online and find a TCPA consumer attorney.

      The TCPA is no longer useful statute for debt collection, because a few months ago, the US Supreme Court gutted that law.
      We prefer to instruct the debt collector that they can only talk to us in writing. Every time they put something in writing, it’s a potential FDCPA lawsuit because they can’t seem to resist breaking the law.

    Great information attorney please don't stop putting the videos out, I am being sued by a collection attorney for a unsecured personal loan that was charged off a couple of years ago. If they never serve me will they give up? They have the wrong address for me in the complaint they filed, the total debt is about $13,000.00, I have been monitoring the case online and since the sheriff went to the wrong address there has been no updated from before Christmas. I wrote them a debt dispute letter asking for proof they own the debt but they just send the same generic statements and not the purchase agreement showing they can collect legally, thank you very much

      It's very hard to predict what they'll do with failure of service, especially without knowing what state you're in.
      If this were a Florida case for one of my clients, I might reach out to the lawyer on the other side and see what settlement opportunities were possible. The lawyers have more flexibility than some of the pre-legal staff.

    Hi, I live in California. What can I do? Do I send a letter requesting a debt validation and verification letter? I believe the amount they have is incorrect. I just received a letter from them today 03/22 (dated on the paper as 03/16) stating that I have until 03/26 to respond to them or they will take me to court for wage garnishments. They are offering a ridiculous payment plan in which the "first payment must be received by 03/26/24." I used to get lots of calls from them, which I ignored because I didn't know who Portfolio Recovery was. I thought they were a scam since they didn't leave a voicemail. I realized the letters that I receive by mail were theirs too late. I always got letters with a PO box number without the company name visible on the window of the letter so I ignored those letter. I only realized it was their letters because today, I got a letter with the same constant PO Box letter in the mail and by curiosity opened it to find the payment plan letter requesting action by 03/26.

    Ever just before my work injury was settle I’ve been getting phone calls from them. Even on the weekend. They don’t leave a message. They call from across United States.     I don't live in the states anymore but my parent's address (mailing address in TX) just got a letter that i'm being sued but it was from a lawyer saying he could represent me and he isn't the one filing the suit. I called the courts and they indeed filed i think the amount was for about $1200. They just attempted to serve last night. I sent a certified letter of Debt verification yesterday. I'm not sure if it's too late but I tried. Not sure what I should do now. I don't have any old letters of theirs or anything. My concern is that I'd have to show up to court but don't live in the states.

      Then they’ll start to respect you.

      If you get sued, you need to speak to a lawyer in NC.
      There is no requirement that a debt collector report a debt onto your credit report. In fact them choosing not to is helpful to you.
      This letter is your chance to investigate the debt and challenge any wrongdoing you uncover.

Now, I know that does not mean they cannot continue to try to collect the debt, but it does make a solid argument why you're no longer responsible to pay the debt in question. Another term I think used once it does reach that point in TIME-Barred?! Again, I know this doesn't mean that debt collect cannot go after you and take you to court ... as this guy has said DO NOT ignore those lawsuits... respond. If I am correct on this...if you want to avoid having wages garnished, or liens against things you own... go to court and present evidence that the debt in question is time-barred and beyond the statute of limitations. Now I recall being told that you NEVER agree to pay a debt that is near, at or past the statute of limitations [each state is different]. If you agree to or even discuss a possible pay off of that debt or even make any payment towards it because that restarts the clock all over again. I think I was even told to not even confirm that you have a debit at all while dealing with this debt collectors. To simply say you have no knowledge of this debt, but they are welcomed to send you in the mail a copy of this supposed debt so you can review it and to kindly include who it was that you owed, how much it was, and interest that was added, when the debt began and when that debt account was sold over to them. 99% of the time you will get nothing in the mail from them at all showing any of that info. I was also told to never send a letter asking them to stop contacting you because then that pushed right into lawsuit mode. Just add their numbers to your BLOCK option on your cellphone if that is what they are using to contact you. How close am I with this stuff? Again, I live in Michigan, not FL so no idea what or how FL works.

    I received a summons of being sued by them. I believe I only have 2 days left to respond. Is it too late? I am in Indiana. Also, can I answer the complaint via email to the attorney? Is that considered a legal notice or does it have to be by mail?

    I just received a motion to extend the time on my judgement for another 10 years. I am in Hawaii. They mailed the unsigned copy to me from Utah, and the form says that I have 12 days to respond. Well today is now Monday, and I received the letter this past Saturday, Mar 2, which would be 11 days from the date of the service date of Feb 21, 2024. I have no idea if the 12 days is business days or just plain days of the week. I've been online trying to learn all about what I can do and how to respond, as I have no idea how to and I definitely don't want to check off the choice of "yes please extend." I have learned so much, but still have no idea what to do now they want to extend this judgement on me. This has all been very stressful. I am a single mother of 5 and just came out of a domestic relationship with my children's father and am trying to put my life back together. I have learned a lot in my researching, but still not sure as so much of the info out there is for people that have just been served.

      You need to speak to a lawyer near you who handles debt defense. Every state law is different.

    The pandemic really took a toll on me. Lost my job and my business I had just started. I got a job finally a few months later to be injured at work and sent home for a month (unpaid). I'm still injured so I can't even get another job since I can't go back to my entry level job. I couldn't get the business loan because I had no taxes filed so that's fun. sorry venting a bit, but yeah do you have someone that can help in Arizona. I feel extremely overwhelmed and I don't know what to do.

    We live in Florida. My wife owes $7,600 and $1,200 to Portfolio Recovery. We're trying to purchase a house with our VA Loan, but unfortunately the $7,600 account is causing us to be declined. I'm hoping they'll accept at least 30% for the first account. What should I do? Will they see the second account and try to collect from there too? It was opened Feb 2020. But the Debt is actually older than that.

    I just recently started receiving calls. They opened the collection account 2023. Have no idea what debt they are trying to collect, so there's no way for me to verify ownership.

    PORTFOLIORECOVERY call my house on average two to three times a week. I am not in any debt nor have I defaulted on any type of loan. My step daughter who used to live at my house, had some issues regarding her credit and finances. She moved out of my house more than seven years ago and owns her own home. How do I get these people to stop calling me? I have had my phone off the hook for about three months and yet they still call from numerous numbers in the United States. I reside in Michigan in the Detroit area. Any advice would be greatly appreciated. Thank you!

      Are they calling for you or for her?
      Are they sending you any letters?
      If they’re demanding money from you that you don’t owe, that’s probably a violation you can sue them for.
      Have you told them to stop calling you? If so, and they persist, that can be a violation as well.
      We probably need to make a “stop the calls” video.

      @@RWlawFL They are more than likely calling about my step daughter. I have no financial problems, debt issues or loan defaults. She has some debt issues. I have not received any notices from them in the mail. None. One time PORTFOLIO called me, and out of anger, I told them to stop calling me. I then hung up on them. That didn't stop them. Like I said, on average, they call me two to three times per week, but they never leave a voice mail.

      If you want them to stop calling, you can send them a do not contact letter that will hopefully have the desired effect. Because it’s not your debt, it’s not entirely clear how that would work, but I’d probably be willing to see you if someone in Florida had done that and got future calls.
