These guys are great! I used them and they helped me and fully delivered on what the said they would do.
But with that said. You don’t have to deny the debt fully. You can deny admission to the amount you are being sued for.
You can admit to owing something but you absolutely have to contest the amount that is being sued.

When will be the right time to admit? I just got serve in a lawsuit by lvnv funding(Texas) I hired a lawyer and in their questionnaire it ask do I own this debt...Orginal debtor is navy federal I'm trying to get my defense together. Such as Orginal purchase agreement. Validation of debt. And the chain of assignment..they only have copy of billing statements

Can you do a video about what to do if you are being sued but your income is social security and/or VA disability?
The steps are the same, it’s just that you might have less exposure if they get a judgment.
It’s almost always better to get the case dismissed no matter what your income source is.

Zwicker & Associates 3rd time I'm getting collection paperwork from them. I'm in FL and have been filing head of household in court and case has been dismissed (twice). They have garnished wages and all funds have been reimbursed (twice). The debt is a charged off Discover Card. This debt is not on my credit reports. Why do they keep coming for me?
It sounds like they have an open judgment against you. Lack of credit reporting doesn't affect the validity of a judgment.

Can anything be done after case has already been through lawsuit process?
If you have a judgment against you, then there are steps, you’ll need to take to address that, and those are going to depend on what state you’re in.
What do you do if the case was dismissed and they refuse to remove it from your credit report and still call you after the judgement has been entered? Thank you
If we won a judgment for the defendant and this happened we would sue.
I never did get a dunning letter from midland? I’ve moved from my last address about 2 years ago and I moved again recently to my new home and then a processor shows up at my door serving me a summons? Never been contacted by them before to dispute these allegations? But suddenly I have to go to court only to admit or deny? So now since I denied it because it seems they violated the fdcpa by not sending me any type of demand letter prior to them driving me in court? So now I have to return in November for a hearing? And the dates on their chain of custody are all off??
There is no federal requirement for them to send a demand letter before suing you.
But there may be other violations there. Talk to a lawyer in your state right away. (If you're in Florida, call us!)
In general how delinquent on a credit card account does someone have to be before getting sued? I keep hearing at least 180 days to 1 year. Is that accurate?
It’s going to depend on the credit card company and whether they sold the debt. Every debt collectors going to have a different time frame, but 180 days is probably the shortest they could get into court.

I had visited a Florida ER for a minor procedure. The procedure was done by a Resident and I was released within an hour. My insurance paid the hospital bill in full. Later I received a letter from a third party group saying that I owed them money for work performed by one of their doctors (I was not seen by anyone but the resident). This alleged debt was eventually sold to a collector who then sent me a letter trying to collect. I responded disputing this and within a month received another letter claiming I still owed this debt. I again responded in writing disputing this debt. Again I received another letter trying to collect. There is no mention of a time frame in which I have to respond or what happens if I chose not to respond. What should I do to make these letters stop?

Your insurance company should be able to provide documentation if they paid it. and if you’ve got that, the debt collector needs to stop collecting or they’re breaking the law.

Im not sure if you will see this but. I just received a letter from a bankruptcy attorney stating that a lawsuit has been filed against me from Midland, but I was not served papers. I called the court and they did let me know there was a suit. She told me that they tried to deliver the papers but were unsuccessful. So, should I try and get a copy of the lawsuit paperwork and file an answer or what should I do?
Immediately check with a lawyer in your state. I do not recommend trying to file an answer on your own.

For the junk debt buyers I’m specifically talking about, I think the number is a little less than half of that.
From ohio what happenes if certified mail.was left at my house when I wasnt home so i never signed it

These losers collections LLC's are now pushing me into Mediation! Do I have to sign the Mediation papers and do a phone call Mediation?
If you were in mediation, that means you’ve probably been hauled into court.
Some judges require mediation, and some local rules require mediation. You may have no choice, but to participate, but you don’t have to agree to anything at the end of the day.
But questions like this are why it is so important to have a lawyer any time you’re in court. It is very easy for the non-lawyer to fall into legal traps because they don’t know what is and is not required.
What's your opinion on using a company like Beyond Finance to settle the debts?
We don’t recommend debt settlement companies. In some states they’re even illegal.

If they don't send you proof, they have to stop collecting-otherwise you can sue them. If you send a cease and desist like the ones we offer here for free, your case against them is much stronger:

If they have a judgment against you, that means you've already lost. It's generally very hard, and very expensive, to get judgments re-opened.
But depending on what they're doing to you now, there might be violations of the FDCPA. Talk to a Texas lawyer like Bill Clanton or Daniel Ciment.

Hey how’s it going Mr. Michael sir, do you have an email address because I wanted to send you a private message and some information regarding a situation I’m in that brought my credit score down and I always pay my bills on time and only have 1 active credit card which is paid off. I got into an accident last year due to gravel on the road and it caused my vehicle to hydroplane into a guardrail, with that being the case my car got totaled and now it’s on my credit because even though I had gap coverage, Carvana overpriced me for the vehicle which is mainly why this $3,582 is on my credit and I haven’t yet gotten a note from the debt collection agency yet but am just trying to figure out how this can be removed from Equifax and Experian online.
