This is reckless endangerment or potentially even criminal negligence, she convinces the vulnerable potential plaintiff, after she voiced her concerns that she could drown, that she was going to go in with her, that she is SCUBA certified and promises to keep her safe. Having directly caused her to jump in and then refusing to actually provide the assistance that she offered to she flees the scene. This is definitely illegal, she took a duty of care over this person by promising to help, her actions were proximate to the woman jumping in, and she was made aware this woman wasn't confident swimming, meaning there was a very reasonable risk that she could die. Her taking a duty of care over this person was the direct cause in her putting herself in this dangerous situation ergo she is directly responsible for her.

Reminds me of the girls in high school who used to exploit a fetal alchohol syndrome girl and make her think she had a chance with their boyfriends. She would come up to me and vent almost everu day about how she thought they were her friends and how confused she was. She would punch me when I reassured her that they weren't and were playing games with her. But seconds after she stormed off she would come flying back and hug me saying sorry. She is the most lonely and confused person I have ever met. Later in life a man got her into drugs and got her pregnant just to SA her child and get it taken away from her. Our world is sick.

Speech is not even enough for "Disorderly conduct" as most speech is protected by law, under the 1st amendment.
Deadly conduct was largely introduced for people using fire arms, weapons or tools.
Under deadly conduct you could prosecute an offense if he recklessly engages in conduct that places another in imminent danger of serious bodily injury - which again, can't prove intent, can't prove motive and would have to legally define jumping and swimming in water a serious bodily injury activity (would never happen), there would be no swimming allowed in the world.
Are people typing here even in America.. sometimes I wonder people outside US are so oppressed in their rights they thing saying to a random stranger "hey if you go skinny dipping with me I'll pay you 20, go in jump jump".. is not protected. Mind boggling really.

@@danielj.garrido1228 false premise. She wouldn’t be charged with attempted murder, because it wasn’t.
However, she could easily be arrested and charged with “reckless endangerment” if a complaint was made.
“A person commits the crime of reckless endangerment or wanton endangerment if the person recklessly engages in conduct which creates substantial jeopardy of severe corporeal trauma to another person. “Reckless” conduct is conduct that exhibits a culpable disregard of foreseeable consequences to others from the act or omission involved. The accused need not intentionally cause resulting harm.”
She did not have to physically force the woman into the water, she did not even have to intend for her to come to harm. The woman who jumped in does have to actual be injured (though in this case that was certainly very lucky that she didn’t drown). The question is simply “would a reasonable person think that encouraging a person that you think is incapacitated to jump into open water, might cause them serious injury or death?” I think it could easily be argued yes.
She has stated “I thought she was drunk or on drugs”, clearly thinking that the woman was incapacitated. A woman who can’t swim jumped into open water under coercion and offer of monetary reward. The woman whom she offered money, and encouraged, to jump into the water also appears to be intoxicated. The live-streamer then left the scene. She had no responsibility to jump in after the woman, though she did have the moral and legal responsibility to call for help.

can someone explain to me how a woman who can't swim would learn to dive? to me this smells of a staged prank for attention, and (if so) whaddya know it worked.
as an athletic kid to young teenager, it took me hours of practice to dive. i'd imagine it would be THAT much harder for a (no offense) very overweight middle aged woman to learn. and to do so without being able to swim?? i just don't see how it'd be possible. to practice diving you almost inherently have to do it in a place where you can't stand, due to the likelihood of hitting your head cause you're untrained and can easily dive too deep. (and yes her dive was a bit sloppy, but she still clearly knew how to do it, clearly had some practice at it.)
so if she can't swim she'd have to be rescued every single time she practiced diving. and honestly who is going to do that? who is actually going to say "yeah sure big woman, i'll drag you out of the water a dozen times for you to pointlessly learn how to dive." like no, if they cared about her that much to repeatedly drag her from the water, they'd much more likely say "sure i'll teach you to dive but first i need to teach you how to swim. doggy paddle at least."
logically it just makes ZERO sense that she'd have somehow learned to dive without learning to swim At All. why would someone who can't swim even WANT to learn to dive?? i just don't see it. given that it's a prank streamer, i'm MUCH more inclined to believe the whole thing is staged for attention.

There are no laws in Texas that require anyone to assist anyone in distress, in fact there are many people who have and got sued over providing improper aid using non-approved life saving techniques which is why they had to implement the "Good Samaritan Law" in most states, which protect individuals from liability when they try to help someone in need.
The only law requiring people to aid is in car accidents and they mostly are surrounded by the "fleeing the scene" premise.
