@braydensaurman5104 this is absolutely illegal. This is reckless endangerment or potentially even criminal negligence, she convinces the vulnerable potential plaintiff, after she voiced her concerns that she could drown, that she was going to go in with her, that she is SCUBA certified and promises to keep her safe. Having directly caused her to jump in and then refusing to actually provide the assistance that she offered to she flees the scene. This is definitely illegal, she took a duty of care over this person by promising to help, her actions were proximate to the woman jumping in, and she was made aware this woman wasn't confident swimming, meaning there was a very reasonable risk that she could die. Her taking a duty of care over this person was the direct cause in her putting herself in this dangerous situation ergo she is directly responsible for her.

Under deadly conduct you could prosecute an offense if he recklessly engages in conduct that places another in imminent danger of serious bodily injury - which again, can't prove intent, can't prove motive and would have to legally define jumping and swimming in water a serious bodily injury activity (would never happen), there would be no swimming allowed in the world. The woman who jumped in does have to actual be injured (though in this case that was certainly very lucky that she didn’t drown). The question is simply “would a reasonable person think that encouraging a person that you think is incapacitated to jump into open water, might cause them serious injury or death?” I think it could easily be argued yes. She has stated “I thought she was drunk or on drugs”, clearly thinking that the woman was incapacitated. A woman who can’t swim jumped into open water under coercion and offer of monetary reward. can someone explain to me how a woman who can't swim would learn to dive? to me this smells of a staged prank for attention, and (if so) whaddya know it worked. as an athletic kid to young teenager, it took me hours of practice to dive. i'd imagine it would be THAT much harder for a (no offense) very overweight middle aged woman to learn. and to do so without being able to swim?? i just don't see how it'd be possible. to practice diving you almost inherently have to do it in a place where you can't stand, due to the likelihood of hitting your head cause you're untrained and can easily dive too deep. (and yes her dive was a bit sloppy, but she still clearly knew how to do it, clearly had some practice at it.) so if she can't swim she'd have to be rescued every single time she practiced diving. and honestly who is going to do that? who is actually going to say "yeah sure big woman, i'll drag you out of the water a dozen times for you to pointlessly learn how to dive." like no, if they cared about her that much to repeatedly drag her from the water, they'd much more likely say "sure i'll teach you to dive but first i need to teach you how to swim. doggy paddle at least." logically it just makes ZERO sense that she'd have somehow learned to dive without learning to swim At All. why would someone who can't swim even WANT to learn to dive?? i just don't see it. given that it's a prank streamer, i'm MUCH more inclined to believe the whole thing is staged for attention.

She did not have to physically force the woman into the water, she did not even have to intend for her to come to harm.
(and yes her dive was a bit sloppy, but she still clearly knew how to do it, clearly had some practice at it.)
so if she can't swim she'd have to be rescued every single time she practiced diving. and honestly who is going to do that? who is actually going to say "yeah sure big woman, i'll drag you out of the water a dozen times for you to pointlessly learn how to dive." like no, if they cared about her that much to repeatedly drag her from the water, they'd much more likely say "sure i'll teach you to dive but first i need to teach you how to swim. doggy paddle at least."
logically it just makes ZERO sense that she'd have somehow learned to dive without learning to swim At All. why would someone who can't swim even WANT to learn to dive?? i just don't see it. given that it's a prank streamer, i'm MUCH more inclined to believe the whole thing is staged for attention.
