- This Audit started out as most all my other audits did, this time documenting from the curbside , just outside a few different businesses. The first location was a cordial encounter with the individual who came out to question what I was doing. I explained that it was my personal business & he left it at that . I moved to the end of the cul-de-sac where I noticed a row or rusted Porsche vehicles above the fence line, along with a few other older models (not rusted out) parked in front of the fence. After a few minutes of being out there, an individual wearing a Porsche logo tee shirt made contact with me. He asked what I was doing & I told him that I was taking pictures & video of the cars in the background. He then explained that there was a large fire that broke out on his property & that's why the cars were rusted out. He also said due to the fire , he was tied up in court for over 3 & a half years, then his attitude changed & told be to get the f**k outta here since he was rather emotional because of the fire that took place & was annoyed by my presence. He then told me to knock my socks off & continue doing what I was doing, after he informed me that other tenants in the cul-de-sac were calling him asking what I was doing. He retreated inside. It was rather hot out that morning pushing 90 degrees, & about 5 mins later the same individual returned this time offering me some candy & water due my sweating in the hot sun. As I declined his offer, another individual named Mark, wearing a plain blue tee shirt (No logos on the front) came outside, this time from the auto body shop opposite side of the cul-de-sac, & he told me that there's been a lot of theft in the area. As I was telling them that because there was theft there , that doesn't mean that I've stolen anything from them & as I was saying that the individual (Mark) in the plain blue shirt came at me, grabbing my camera & ripping off the flip screen from my camcorder. As I put my arm up to push him away in self defense, he then pushed me towards the front of the dumpster that I was standing near. Luckily My cell phone captured the attack . They then had the nerve to tell me it would be best If I just left the area & I told the individual (Mark) that I captured his assault & battery against me on camera, as he proceeded to walk back inside his business, he turned around & said good, giving a thumbs up. I then placed a call to police almost immediately after he went inside his business. About 20 minutes later the first unit arrived on scene from the Anaheim police department (Officer Brennan/ Badge# 738) He seemed to have attitude when I asked for his name & badge # , he says in just a minute as he proceeds to go inside the business. I explained that I was the calling party & he says I'll be with you in a minute. He the returns outside as he sees no-one in the office & comes back to begin the police report. After taking my side of the story , He returns to go back inside to speak with the individual who attacked me . At this time a 2nd unit arrived on scene (Officer Wallace/Badge # 449) & she is the one who I showed the video evidence of the attack. Officer Wallace claimed it was difficult to see who exactly attacked me due to the sun glare outside, but watching the clip in slow motion, it was clear to see the individual with the plain blue shirt on the front was the one who committed the assault & battery along with damaging my camera. On a side note: I will present the video evidence to whoever the detective is that will be taking over the case. Office Brennan returned outside to explain to me the next steps in filing a citizens arrest on the individual (Mark) who attacked me, I confirmed that I wanted to proceed with the citizens arrest. Brennan also explained that since Mark has a valid driver license & no warrants, he would be issued a citation & not taken into police custody for booking.
Officer Brennan mentioned that I was accused of being on the private property , as that was a lie since I was along the curbside the entire time. Brennan gave me the incident # & I asked him if the Porsche body shop would be cooperative with sharing their security camera footage , as that would have shown that I was never on anyone's private property , along with capturing the attack. Brennan said that they were not willing to cooperate with the security cameras...No surprise on that. As of now, I am waiting to hear from a lead detective & eventually the city attorney on the matter. I will be following up regularly for any updates & will pass that information on to you as it becomes available. This matter is to be continued.

Good Afternoon everyone , I appreciate all your comments advising me to carry pepper spray/mace. I'm aware other auditors carry that as a form of self defense & I respect that . I'm also aware that I have a right to carry that as a form of self defense ...However at this time , I choose not to & here is my reason:
I've seen numerous times when law enforcment will arrest or cite the auditor for an unequal return of force . That's a risk I'm not willing to take for the time being . Again thank you all for the support , advice & constructive criticism regarding the topic .

Good point that using pepper spray/mace could be used as a reason the police arrest you. I don't blame you for the caution. While doing public recording a few months ago, I used pepper spray on a perpetrator when I was attacked. The police here in Missouri, planned to arrest the perpetrator, not me.
However, 20 years ago, I would be willing to leave the pepper spray at home, but currently, its worth it for me to use the pepper spray if needed.

I been a cop for 25yrs. I never interviewed the suspect first. We always interview the victim. Something tells me this cop knows the hotrod shop owner.
Chris is a dude in a dress going around trying to instigate reactions out of people. He got what he wanted. If Chris was an actual "1st amendment auditor" then he would be auditing the government. Not going to remote industrial locations that usually have zero foot traffic and puting business owners on edge.
@@christiandruan Christian regardless what the auditor did, the biz owner went hands on. Auditing is conducted everywhere. All roads that lead to whatever place needs to be covered and educated. Half the bs that the hotrod owner said was just that, bs, just to agitate the auditor and have him do about face and leave. The government and business owners do need to know what's legal and what is illegal. Deesculation is huge in this biz. If I was the owner of that biz, I would have shut up and never approached the auditor. Remember counter surveillance is the stronger suit here. Be quiet, observe and take notes where they move and what they drive. Best advice anyone can give. One will get more answers doing counter surveillance rather than attempting to force it out of one's lips.

Exactly my thought, especially when Chris said she wasn't on their property and the cop said yeah well that's not the story I got. Clearly biased. I also find it interesting how quickly cops show up when people call to report someone with a camera who isn't breaking any laws yet they took so long to show up for a reported assault. I can certainly see why the business owners weren't interested is showing the police their recordings since it would prove the battery and property damage as well as expose them as the liars they are.
The photographer was way more condescending with the Porsche shop owner, who was just asking what they were doing.
I will give the photographer credit for actually pronouncing Porsche correctly. A pet peeve of mine is "Poorsh."

It’s amazing that they will arrest an auditor for just recording, but they can’t arrest a man who assaults someone for no reason. 🙄
they can but won't because they are corrupt these officers need to be held accountable and charged with dereliction of duty they have all the evidence they need and they could very easily have the security camera footage legally held because it witnessed the crime.
A word of advice: never audit alone. Always have other angles of their cameras and they can act as witnesses.
Also they always pick on you if you are alone.

The fact that the officer went to talk to the business owner first, and not the reporting party, is telling. They don't give a shit about you being attacked.

This incident is mentioned on his business page with some half assed explanation, but no remorse or aplogy it is affecting his business rating, he's made a lot of people ,not happy.

I have watched audits where they arrested(for real) guys for doing the same exact thing. A Pedolibre audit they cuffed and stuffed a guy and drove him downtown for almost an identical crime. Once they saw the video they went right inside and cuffed him.

The cop was professional and courteous. He was also trying to be objective. Nothing at all wrong with the way he behaved. The photographer was a RUclips-trolling jerk.

They asked if he needed an ambulance, and I thought they went straight for the violent thug to detain him until they'd watched the surveillance videos and the auditor's video, and they could arrest him and book him at the police station! But NOO!!
It was the business owner and not the auditor that was the criminal, and THAT changed the cops' decision to detain/arrest or not!! All about WHO, not WHAT!!
Because the business owner has a reason to be there. I know this area, it's all industrial. There's no reason to just be hanging out there. Its suspicious and the business's want to protect their customers cars and property.
I'm all for first amendment auditing but why is he harassing private business's? If you want to do first amendment audits then you should be focusing on government entities. Not going around to industrials areas that already deal with theft acting suspiciously. They thought he was casing the place for a theft crew.

Why is it important if "you were involved" to respond to a citizen with you name and badge number when requested? It takes longer to ask the question than it does to comply with your department's policy. STOP RESISTING!

I am a retired Leo and I want to tell you that you handled law enforcement exquisitely. Anytime anyone makes physical contact with you on purpose it is assault if that contact is unwanted. I recommend that you use this word assault as it is a trigger word for law enforcement. It is vitally important that this individual be prosecuted or every other auditor in the country faces the same result as you. Law enforcement will do everything within its power and purview to protect these individuals as law enforcement universally classifieds auditors as disruptive troublemakers. The constitutional audit program that is sweeping this country will ultimately succeed or fail based on its weakest link. Continue to learn the law especially the disorderly conduct statutes as law enforcement will use this statute as a fallback to violate your civil rights and arrest you. Keep up your good I have just liked and subscribed.

The FIRST thing this cop should’ve done is talk to the caller then view the readily available footage of the crime. SIMPLE.
I say this to many auditors all the time: don't audit alone, always take someone with you as a witness; never let anyone get close to you, verbally warn an approacher, or approchers, to stay back a certain distance; don't let them circle you; and get yourself some pepper spray or mace, just in case, because people get crazy when they are being recorded, they will attack, and you don't want to be injured or have your equipment stolen or damaged.
Get an attorney to pursue this!! Don’t let the tyrants win!!

Also, this is a fine example of how a cop will literally see evidence of a reported crime and DO NOTHING ABOUT IT. I think you should pursue this matter though. I’d say you should do your audits with another, but freedom doesn’t require for people to have to have backup. Glad you're okay.

@blindsurvival8570. You should know the law before you debase the police. A police officer cannot arrest a person for a misdemeanor crime that is not committed in their presence. He did exactly what he was required to do, let the auditor complete that citizen's arrest form. Like the officer said, once that was done it is no longer in the officer's power to do anything. He interrupted in order to cut out the trivial BS that everybody adds when reciting the events.

Cop asked the kind of questions that will come up in any criminal or civil trial, so he was absolutely right to ask them on the scene and get answers on his body camera, which can be admitted as evidence. Moreover, since what is alleged is MISDEMEANOR battery and malicious destruction, the cop CANNOT make an arrest on the scene unless he personally witnessed the act. An arrest warrant will be issued only if the DA presses charges and the perpetrator fails to appear. Cop did his job correctly. There was nothing else he could have done.
If the DA chooses to prosecute him, you should also sue him in small claims court.
That cop looked like he was either trying to be an actor or was a former actor, then became a cop to keep the bills paid.
Chris, really, please carry some legal pepper spray. Also, best not to go alone if at all possible. Please, please pursue criminal AND civil cases against these sub-humans. They need to be held accountable.

Public photography laws and court precedents prove you wrong. Also, if it is a dumpster for all those businesses there then it very well could be in a public area. People do not need to stop any activity that is legal in public just because someone's feelings get hurt or some do not like it.

If auditors had put their hands on the business owner, cuffs and arrest and take a ride. They never let them go with a “the attorney will decide”.

Immediately. But if it's someone else's camera, that's a different story.
The cop cannot make an arrest for a misdemeanor unless he directly witnessed it, so yeah, if he did it TO THE COP or IN THE COP'S PRESENCE, then he'd have gone away in cuffs. But that's not what happened. The cop's hands were tied. If he made an arrest in this case, he'd have been violating that thug's civil rights. Civil rights GO BOTH WAYS, people. Even the wrongdoer has them.
@@ajm5007 Agree, this cop was great. He was respectful ,de-escalated the situation, resolved the complaint with legally actionable work, respected everyones rights involved, and then advice the 1A auditor that he *recommends* he leaves to avoid more trouble but doesnt demand it or force it.
I hope you'll provide an update. I'd love to know that this schmuck received a healthy dose of justice. The cop obviously wanted to blame the victim and give the bully a pass. I'm hoping to see and know that the guy felt some appropriate consequences.
If you don't mind me saying, When being blindsided by an attack on your person & pushed into an object that can cause more bodily injuries by this clown, you should always drop to the ground and stay there, call the police if your able & an ambulance to get checked over, for neck, back, knee, shoulder injuries & mental distress to name a few. This is called soft tissue injuries & can cause you great difficulties later in your life. Both businesses will try not to cooperate with law enforcement & shift the blame onto you! However when these two business owners see the level of distress to you, they will be required to cooperate with your lawyer in your lawsuit.👍

Send them a bill for the repair of the camera. If they don't pay, file a lawsuit. The prosecutor isn't likely to file charges against a business owner. You'll have to sue.

I had a poker friend who was assaulted in a parking lot outside a poker room, by a regular of the poker room. Got clocked, his knee snapped and hit his head on the asphalt. Hopiltal, surgery and 6 months rehab. The police were given the guys name. Over 1 1/2 years later, no charges, no arrest, no court date.

@dwaynedee529 How do you know the business didn't also call the police and that is who the dispatch gave as the complainant. Although it is usually common practice to interview the complainant first, it is not WRONG to interview the suspect first.
There is absolutely no reason to interview the victim first. It doesn't matter who is interviewed first, so long as all interested parties/witnesses are interviewed. Cop did his job just fine.

You know the cop did not want to do that to him and probably knew him. That is why the cop made sure to say that once he processes the information - it's out of his hands from there.

Not only have I spoken to people in CA but also seen loads of videos where folks were arrested with cuffs and processed in jail (often hurt). I think the process of what this cop did should be done to all nonviolent offenders however this was not nonviolent! This was assault. The excuse of, oh he'll just be released is bs because that's often what happens when cops arrest and process people. Again, this was bs and shows how businesses are treated over "we the people".

Hi, I'm an A-hole businessman and I don't feel comfortable with anyone doing anything unless it is under my control and consent. You need to tell me everything you are doing and then I will decide if it is ok. If you don't tell me, then obviously you are the one with the problem. I always find it funny how others try to put the blame on you for their agressive behaviour and rude personality. These business owners should be put out of business and maybe but probably not, it might teach them something. He says we was in court for three years over those rusted cars. Why? Did he not make those customers whole? Did he not want to pay? Seems possible that he is the cause of this.
