"Church Member Calls Police Concerned Over My Camera" First Amendment Audit

- I was In Irvine Ca. outside Saint Paul's Greek Orthodox Church gathering images & photos from the public sidewalk leading up to the start of Sunday service. I had multiple encounters from various church members , ranging from cam- backs to one person in particular who seemed to wanna be the star of my audit. I started recording above his head since he seemed to want to try and block my recording. This individual introduced himself as "James". He can be heard in the video acknowledging I was on the public sidewalk, so I figured he was aware of my right to record in public. After a short while , "James" decided to call Irvine Police. Two officers showed up on scene eventually & spoke with the individual & he eventually went on his way. Irvine Police did not bother making contact with me.

It is so amazing to me that actual people have the attitude - " I don't know this person, have no idea what they are doing, their actions do not have anything to do with me personally, but I am entitled to know what they are doing and impose my will on them." It is so damn weird.
It does have something to do with every one of them you moron. What would you think (well your an idiot so probably nothing) if you come to church and saw a stranger filming your family and vehicles. If you were not concerned then you are a fool. They are going to church with their families only to see a NUT standing on the sidewalk and videotaping them for no reason, and there was no reason to be videotaping. Except he had something to post on his page, which resulted in all of you morons stroking his ego! Him standing there and filming has absolutely NOTHINGto to with his BS we the people nonsense. It has everything to do with scamming uneducated. Simple minded stooges like you. Now let's get to the church goers who you said should not have asked any questions and just minded their own business. These folks have families they had no idea why they were being recorded. Why their vehicles were being recorded, because a sane person would not be doing that. These were not government people. They are people who wanted to go to church. Which is their right to do, and this idiot by recording them was actually violating their right to worship as they please without harassment. So their rights were violated more than this conman's were. And who in their right mind stands and records people going to church? Please tell me how people going to church has anything to do with an amendment that was drawn up 229 years ago? I guess you have never heard of random church shootings. For all these people knew this wack-o was counting to see how many people were in the building, what they looked like. Cars they drove. Etc. These people had EVERY RIGHT to be concerned with some nut taking photos of them and their families. Was this guy going to somehow get their license plate information so they could be attacked at home or work. Was this guy a child molester. Or a sex offender? Oh yes, these people had and have every right to see what this fruitcake is up to. When you move out of mommies basement and grow up, then maybe you will understand real life. Not what some clown who puts on a dog and pony show for illiterates to drool over and send your allowance money to. Real adults take having photos of them and family serious as real adults have responsibilities to keep their family safe from idiots like this who hide behind 229 year old amendments that had absolutely nothing to do with this video. He had one purpose and that was to get attention for his channel. Nothing more and to get praises about how he is educating the people, and the sad part about it is. Uneducated people like you fall for it, hook, line and wallet. If those ADULT DADS didn't inquire what this bozo was doing. They shouldn't be fathers. They should be like you, living with mommy, and pretending you are in the adult world. Is it legal to use someone's image for financial gain without their permission? Why did photographers have to get signed releases to use pictures of people for financial gain?

I assume you're referring to the California state law known as "the bane act" (for anybody curious).
Summary: California Civil Code Section 52.1 (the Bane Act) prohibits any person from using violent acts or threatening to commit violent acts in retaliation against another person for exercising that person’s constitutional rights.

The fact that the cops didn't make contact on this one gives me a bit of hope, I've seen so many videos with oathbreakers the handful of times I have seen no actual contact is very small.

Given how the officers reacted (or didn't, actually), I'm surprised that the dispatcher didn't just tell the caller that there wasn't anything illegal going on.
Cops respond to every call to attempt to relieve the city of any liability. Corporations protect themselves, not citizens.

@@hellshade2 I can't speak for every department, but the larger the PD and the more calls they average, the better trained the dispatchers are. Most city managers do not want resources dispatched improperly i.e. wasted.

watched a video this morning where 7 cops from the Hempstead Florida police went to a mans house just to question and threaten him. 7 cops!

A photographer/videographer being impeded in his RIGHT to freedom of the press by a few members of a church enjoying their RIGHT to freedom of religion. One freedom does not supersede the other. Both should be treated equally.

I've only recently found you. These audits on churches are hysterical. These people are supposed to be welcoming of everyone, but they never fail to be obstructive and down right nosey. How you don't tell them to "do one" I will never know. Just wondered if you questioned their faith and their freedom to to choose a faith of their liking how they would react, considering that freedom of religion is also part of the first amendment.

Another great video and audit. Funny, of all of the places you would think (and there I go 'thinking again') you would be more welcomed, churches seem to have serious issues. I saw you getting slapped around at the Brea UM church... disgraceful. The bad part of it is that the people who seem to want to inject themselves into your business have no authorization from the church to be doing so. But it still makes the church look bad. At least the priest at the St. John Neuman Church had the presence of mind to tell the old fart to knock it off and leave you alone. Wow, be safe and thanks for the great stuff you provide!

This auditor is one of the most mild manner and polite auditors I've ever witnessed. He came well prepared with the actual laws regarding public photography as well. Well done. James, the rude one, learned a lesson in manners from the cops when they showed up.
