There is NO TEST for the SMELL of anything. There is no physical device anybody has invented which can MEASURE A SMELL, therefore there is no evidence which will stand up in court. A cop saying that he can smell something is just shit talking. There are some LARGE and EXPENSIVE machines (which certainly do not fit in a cop car) which can measure components of gases, and airborne particles, but the cops don't have those.

I looked up the Levine case and his suit awarded him a quarter million dollars for wrongful sexual conduct by the troopers, in case anyone was as interested as me to see the turnout. Especially since this happened in 2017. I love ATA but I wish they would do more updates on settled suits when they can.

If cops can say “I smell marajuana” even if they don’t, and this is considered probable cause, then we have effectively nullified the fourth amendment.
They can come up with a million “probable causes” on the fly, they do it all the time and they don’t even have to articulate to anyone, yet expect peaceful interactions.
The very fact that a human is a judge in our legal system defies logic too. There’s no way to prove smell just like there’s no way to prove bias. I agree it’s complete bullshit but the bullshit is much deeper than we’d like to believe
Yeah we / my wife and I were searched for over 30 minutes before, made to stand out in the rain because "he smelt weed" neither of us had even been around marijuana and the real kicker was we were driving my jehovah's witness grandmother's truck for her.

@@DAndyLord Just spitballing here, but even if that insurance was paid by some kind of stipend it could still be effective. If an officer became a liability problem insurers would quickly raise their rates or refuse to insure them which would make them unemployable.

I would rather they pay for their own squad car, vehicle maintenance, gas, full liability coverage ( when they get sued) car insurance, pay for their own uniforms, guns and ammunition, their own monthly internet use for the car, and their own computer plus accessories used for it.

@@gravestone93 people don't, not because they want to sue, but because it's difficult to get these sort of laws passed. The police lobby is pretty strong, unions have a lot of sway, and lawmakers are quick to capitulate to them.
Just look at Houston. The citizens voted for firefighters to get a raise. The police union is suing and blocking this raise from being enacted.
The police and prison lobby is one of the primary reasons that pot is still illegal in so many states.

I've seen Marshals repo property from a Sheriff's Deputy because the person went after the individual instead. I wouldn't go for the money, I'll go to ruin your livelihood!!

Nothing is wrong. This is normal police work. They don't care about us citizens. They want to arrest you. They want to cite you. They're "just doing their job", even if that job is to kidnap you and hold you hostage in a small room without access to adequate medical care or even sunlight.

In fact there was a video I watched on this channel earlier where that is exactly what happens. No two. In both cases the supervisor comes out, tells the officer to knock it off and let the guy go.
So yeah it happens. You see it rarely simply because it's not the kinds of thing that is interesting to watch, but yes it happens. Obviously when it does happen, it's less likely to be the sort of incident of interest to people.

Technically, he indeed was sexually assaulted and the two cops involved even when his case is settled for whatever dollar amount agreed to will not suffer any consequence whatsoever. Do away with their qualified immunity and see how quickly bad police behaviors halt. These two goons clearly acted improperly, abused their authority and as it stands now have gotten away with groping and harassing this guy. On top of that, they were paid to do that with our tax dollars. People have been rioting in the streets for a reason.

Had a friend get busted for marijuana back in high school. It was found on the 2and floor of his house, in a hole in his wall behind a poster. The cops claimed they got a call stating someone was in distress in the house to bully themselves in then claimed they smelled marijuana from the living room as justification to search.
He did ultimately receive a settlement but the officers involved only received a suspension with pay. Before the suit was over he had to move because of the harrassment he would receive. As an example of the harrassment a car would be parked in front of his house when he got off the bus and would sit there until he left. Anyone leaving the property in a car (except for him and his mother) would be stopped and given a hard time. His school even received multiple "anonymous tips" that he had drugs in his school locker which would result in the school calling the police to perform a locker search. To this day I don't understand how no one in the department lost their job.

When this was first reported I was a member of a police message board. Most of the police were embarrassed by this troopers behavior, but some of them actually supported this sexual assault. But essentially he might as well have said "i dunno does a bear shit in the woods?" But he was smart enough not to use that simple euphemism but instead just asked the officer a question that technically he DIDN'T know the answer to therefore it was not enough implication to say his response with that question was synonymous with "yes"

I really want to see a case taken to trial where the victim doesn't settle and takes it all the way.
I know 250k is a large, life-changing sum of money for most people, but the potential precedent setting that could come from refusing to settle is worth it (imo) and someone will have to do it at some point or this will never end.

This is VERY disturbing! - My husband is a computer technician who does freelance jobs - he occasionally works in a commercial Marijuana growing operation, on their computers and security systems and when he leaves he smells of Marijuana. If he is ever stopped and treated the way they treated this man, we will sue EVERYONE INVOLVED until there's no one left to sue!!!! I am LIVID watching this!!
