I think there was actually 2 different cops there from different departments/agencies. The first cop witnessed the assault/battery and did nothing, and the second cop wrongfully arrested him.

It's these kinds of videos that demonstrate why "being difficult" towards police officers is important work. Every time you say "Just give up your ID, it's not that big of a deal," just remember that this person was not breaking the law but there was nothing he could have done to avoid arrest aside from giving up his first amendment right and leaving. The cop was already trying to get him on trespassing even though he was on the public sidewalk; even if he IDed himself, he was going to get removed from there. It's really a complicated process. You see, DAs have to justify their jobs by pursuing all criminal charges long enough to financially burden the defense into accepting a plea, or until public scrutiny dies down enough to sweep the dirty cop's unlawful acts under the rug. Either way the DA enjoys sovereign immunity to abuse the public trust and will continue to recieve financial campaign support from the FOP.

For an officer who claims to be a Christian, he lied for the pastor, and I'm sure, if he's fired for lying on his sworn police report, the pastor will reward him with a job, using the congregations' money! Notice how the pastor left, so he wouldn't be seen as part of the illegal arrest. But he's the one who told an employee to call and most likely told him to lie on his report! I think that there is a high probability that the church employee would have phoned the officer directly. Being a member of the congregation, the church administration probably had the officers number on speed dial.

Reminds of an Honor your Oath video in which pastors of a church came out and ask Jeff Gray if can move from in front of the church and when he refused, they called the police on him. Lucky in this situation, the police recognize that Mr. Gray was not breaking and laws and let him be.

As a citizen of Chattanooga, I can wholeheartedly say that a Police Officer asking a Pastor for permission to speak sums up living in the Bible belt pretty fully.
every hour the citizen spent in jail, the judge should throw the arresting officer in jail likewise, because even if the cop is 100% wrong, he can still make you spend 24 hours in jail for nothing. If this is never corrected for, cops will know they can inflict a one day jail sentence on anybody they see, even when they don't have the law on their side.
And that 24 hours is enough time to cause all sorts of hardships for many people. Lots of people live paycheck to paycheck and can’t afford missing work. Also, when employers hear you were arrested, they often don’t care about the details and you could lose your job. That’s just the beginning of plenty of things that can happen as a consequence to going to jail for a day.

He likely was, to some extent. I imagine being that the church is so large the cop is assigned to police that property on service days. He's probably also the cop that directs traffic when church let's out.
They held him for TWO DAYS on an infraction! He could easily have been cited and released but they chose to use their authority to punish him. Also held his minor infraction case up for over a year. He needs to also go after the Police department in a lawsuit as well. Funny how they "called the police" and the responding officer just *happened* to be a member of that particular church. I'm betting they called him directly. The pastor is the worst kind of religious leader...all smiles and buddy-buddy, but when he can't get his way he becomes nasty and physically abusive. This flock needs a new shepherd, and this police force needs a housecleaning.

In my experience, this pastor is like far too many people I've encountered who profess to be religious. I'm not saying the arrest wasn’t unjust. however, I would not call standing outside a church with a sign that doesn't seem to have much purpose in how small the subject actually holds in the entire teaching of the bible peaceful. in the state of Tennessee, the Pastor could also be charged with assault for grabbing and turning the camera and becoming VERY close in proximity in a threatening manner. Section 39-13-101 states: Intentionally or knowingly causing physical contact with another and a reasonable person would regard the contact as extremely offensive or provocative.

This case is not so easy. They had history, this protester is Titus Hartford and he was arrested inside of this very same church building back in 2016 and was court ordered to stay away. In some states, being on the sidewalk outside of place that you were ordered to stay away from would be a violation of that order.

I think there was actually 2 different cops there from different departments/agencies. The first cop witnessed the assault/battery and did nothing, and the second cop wrongfully arrested him.

It's these kinds of videos that demonstrate why "being difficult" towards police officers is important work. Every time you say "Just give up your ID, it's not that big of a deal," just remember that this person was not breaking the law but there was nothing he could have done to avoid arrest aside from giving up his first amendment right and leaving. The cop was already trying to get him on trespassing even though he was on the public sidewalk; even if he IDed himself, he was going to get removed from there. As a citizen of Chattanooga, I can wholeheartedly say that a Police Officer asking a Pastor for permission to speak sums up living in the Bible belt pretty fully.
every hour the citizen spent in jail, the judge should throw the arresting officer in jail likewise, because even if the cop is 100% wrong, he can still make you spend 24 hours in jail for nothing. If this is never corrected for, cops will know they can inflict a one day jail sentence on anybody they see, even when they don't have the law on their side.
And that 24 hours is enough time to cause all sorts of hardships for many people. Lots of people live paycheck to paycheck and can’t afford missing work. Also, when employers hear you were arrested, they often don’t care about the details and you could lose your job. That’s just the beginning of plenty of things that can happen as a consequence to going to jail for a day.

They held him for TWO DAYS on an infraction! He could easily have been cited and released but they chose to use their authority to punish him. Also held his minor infraction case up for over a year. He needs to also go after the Police department in a lawsuit as well. Funny how they "called the police" and the responding officer just *happened* to be a member of that particular church. Section 39-13-101 states: Intentionally or knowingly causing physical contact with another and a reasonable person would regard the contact as extremely offensive or provocative.

I actually think this could turn into a far larger scandal than it already is. Could this not also dig into "separation of church and state" considering an officer who was a member of the church may have used his position to benefit the church in restricting the man from being able to use his 1st amendment right?

Yes, Most judges do not like people who represent themselves, from the start you are treated as a looser from the bench. Always use a lawyer even if it is his first case, otherwise the court will give you no repect

This case is not so easy. They had history, this protester is Titus Hartford and he was arrested inside of this very same church building back in 2016 and was court ordered to stay away. In some states, being on the sidewalk outside of place that you were ordered to stay away from would be a violation of that order.

It was said very clearly that he plead guilty and the judge told him he was perfectly within his rights to hold his side on the sidewalk that surrounds the church. He was standing where the judge specifically told him he was perfectly able to do it legally

I am no longer a Christian, but when I was I stood up for the rights of Satanists, Atheists, and whomever wishes to express freedom of speech. It is the idea of freedom of speech that allows people to openly practice their religions. Christianity itself throughout history has been outlawed from being practiced in public. As a Christian or person of any religion really one should appreciate freedom of religion and freedom of speech because of what has happened throughout history.

It is clear that the "pastor" wanted nothing to do with him but saw him as a nuisance. Also, notice how he went from "I know that you are on public property" to "get off my property" and putting his hands on this guy. I am still asking myself why wasn't the "pastor" arrested? Exactly! Christians should be praying for the young man and trusting God. A true pastor and "shepherd of God" as this pastor claims to be, should feel confident in his teachings that this young man's protest won't influence his congregation.
Taxpayers should never be responsible for these lawsuits. If an officer violates a citizen's rights, it should be the officer's responsibility to pay for lawsuits. They think would twice before violating people's freedoms if they had to be personally accountable.

Probably what it should be is more like what they do with doctors. They have malpractice insurance. There should be something similar for social services like cops and fire fighters.
Things would have been different if the police officer has to pay any judgment the courts may give, instead the tax payer will foot the bill.
