I'm note sure that case law matter to the extent that the police rely on it. Read the law and ask, if they violate their policies or training do they lose QI?
There first has to be a complainant before anything can be done at all. The police cannot be the complainant. They have to be given a warning first, that means no ticket or arrest. This wouldn't have even been an arrest or a citation even if the cops knew the law, it would have never even gone to court. How would a court find them in violation of the noise ordinance?

A right is clearly established when it is "sufficiently clear that every reasonable official would have understood that what he is doing violates that right" So if the policy policy is clear, and the officer has signed to say he has read that policy, then does something different that violates someone's right, my take is a reasonable official would understand they are violating rights. That extends it beyond precedent.
You give person a gun, two extra magazines, a taser, a night stick, pepper spray, and handcuffs, and you send them out to enforce laws they don’t understand. That is extremely dangerous to the public and grossly irresponsible.

Not sure if you're familiar with the term "sundown town," but this whole interaction definitely harkens back to an ugly part of American history that directly relates with your comment. Sundown Towns were places that explicitly excluded non-whites after sunset, and even beyond those towns, countless innocent black folks were historically arrested for doing any sort of otherwise normal business "after dark," whether that was purchasing or selling goods, walking outdoors, talking "loudly", etc. It became so bad that any criminal charges labeled "[mundane activity] after dark" was understood to actually mean "[mundane activity] while Black." @@darrene.vonbraun4421
They don't identify you to know who you are. They put your information in a database so that when there is an actual offense committed they have a possible suspect. That way they don't have to "figure out what's going on."

I loved seeing these two young men know the law. That cop was surprised when that young man busted out with "Oh so this is a stop and ID state?" Any legal affirmative action program can only consider things like sex, race, ethnicity, etc. when considering candidates who are already in the qualified applicant pool. Those traits can't be used to put candidates in the qualified applicant pool, let alone to give unqualified applicants a position. And again, quotas are illegal. Also, there were two male officers who also misrepresented the law in that jurisdiction.

Most cops do. I once called 911 for a buddy with a broken leg. I was talking with dispatch when an unrequested officer showed up to assist put his gun on me for having a suspicious cell phone..... The phone I was talking to dispatch with cause rural NH gps wasn't a thing yet.

It's bad enough that the first cop doesn't know the law, but the fact that the supervisors were unaware that you can't simply demand ID for no reason is mind-boggling. For citizens ignorance is not an excuse & they are required to know the law at all times in the area or State they are at or in. For officers ignorance is allowed do to immunity!
For citizens, it is not "know the law". The citizen equivalent of qualified immunity is "standard carelessness". For example, if a bartender spills a beer on a customer, the bar owner pays because this is standard carelessness, and a normal part of the job. On the other hand, if a bartender is annoyed with the customer and throws a beer on them, the bartender pays because of gross negligence.
federal law is different then state laws. i see state laws total 180° different then federal. like US code 18 chapter 2 (part 1) aircraft and motor vehicles, 31 (definitions) paragraph 6 (motor vehicle) and paragraph 10 ( used for commerical purposes). compare your local state law to the federal law.

How did that work out for doctors? Badly, right? Very, very badly. Instead of the doctor getting fired, for causing a huge lawsuit against the hospital, now they just file a claim with the insurance and nothing happens to the doctor to correct their behavior. Ending QI will also end the ability to find the police department liable. The police department can't file bankruptcy on the judgment but the cop can, and immediately will.

I think it would have been the officers lawyers who brought up qualified immunity, and legally speaking quite effectively because it basically assured his clients success. That said the idea of qualified immunity is gross, and I’m disappointed the Supreme Court made that ruling, yet I’m not surprised. But to my point it wouldn’t be the judge who makes that decision, especially a lower court judge, he simply has to apply the existing case law.

I don't know if the family here is poor or not, but it is very common for people of any economic background to own a good chunk of family-inherited land in rural SC. In a place like Winnsboro you can't even sell it. No one wants it.

I love how when the gunshots were heard that the police person freaked out but the local people didn't even act like anything happened and didn't care. I would imagine the locals' reactions would be a fairly clear sign whether something bad is going on or not.

When you live out in county it is a daily thing to hear gunshots and not think anything of it. Actually it has desensitized me when I'm in a city or town and hear gunshots. Usually about a 3 count before I'm like "oh right, that's not normal/legal"

I was in a similar situation, but I’m white. The cop just came up and said something like “oh you’re just target shooting. Your neighbor called, but it’s totally legal till 10pm”, my friend and I both had long guns in our hands and handguns on our hips. All people deserve to be treated like this cop treated me.

Same, was shooting on property I thought was gamelands but was actually private property. Cop came up said “hey guys owner has asked y’all to leave” We promptly packed up and left with no issues. How it should be, guns involved but no escalation of the situation.
I got pulled over with a gun on my hip going over 100mph listening to rap music with my high beams on in Tennessee (I was alone on the highway at 3am). the cop was extremely professional and let me go with a warning.

Never trust a cop that tells you to look up a law, ordinance or claims there's a specific law unless they quote it specifically along with the code. They should be required to show them the written law they are accusing them of. In addition, they have to requalify every year in marksmanship and other tactics. They should also requalify with law, ordinance and ethics with undercover testers. If they can't pass they need to go back to the academy.
one told me that on basically this same subject (noise ordinance after me calling them 5 times) when they came to tell me there wasn't anything they could do about my loud neighbors at 1am so I said "I'm glad you mentioned that so let me recite it to ya" as I opened the screenshot of it on my phone and read it to him he seemed irritated that he now had to go do his job and make them turn down the noise.

The fact that first information relayed was that she has “2 black males” explains a lot of why she was convinced that these people were dangerous criminals. She didn’t offer a description of their clothing, age, or any other discerning feature. The purpose of saying that was not to provide relevant information but rather to highlight why she was convinced of wrongdoing despite no apparent crime having been committed. If these guys had been 2 white Iraq war vets in their 30s shooting on their property she would have immediately put her gun away and apologized for the misunderstanding because she would have had respect for them. Instead she says “where’s the weed at” because she is fishing for a cause to arrest them. The fact that she words it like that instead of “where is the weed” is because she thinks they need to be talked to in a different way. I understand the deputy's actions up to a point. Hearing gun shots in the dark certainly requires an investigation. However, once it was clear it was just two residents and nothing nefarious was up, the situation should have ended right then and there. That she kept it going and called in for back up having detained two "black males" with a firearm speaks volumes as to her motivation and lack of professionalism. I hope these kids win their cases and get a huge payday.

As long as they say they thought they were enforcing a law then they are covered. So they enforce their feelings instead and just claim ignorance. But in a tech age like ours, where everyone has a smart phone and can literally google their state statutes, the cops have no honest leg to stand on. This isn’t 1950 where many cops didn’t have radios and were out their winging it. These guys have radios, cellphones and onboard computer systems. There’s no excuse for a cop to make a bogus arrest when all the info they need about the laws they enforce is at their fingertips, on the spot, while still in the field. It’s absolutely disgraceful.
"Stop and ID state" is not a basic legal term. You won't find that term in any legal document. It's used a lot in RUclips videos and on the internet. It's not used at all in the practice of law.

There first has to be a complainant before anything can be done at all. The police cannot be the complainant. They have to be given a warning first, that means no ticket or arrest. This wouldn't have even been an arrest or a citation even if the cops knew the law, it would have never even gone to court.

Not sure if you're familiar with the term "sundown town," but this whole interaction definitely harkens back to an ugly part of American history that directly relates with your comment.

We NEED to get rid of qualified immunity so cops can be held accountable. They can do what doctors do and buy their own malpractice insurance.

How did that work out for doctors? Badly, right? Very, very badly. Instead of the doctor getting fired, for causing a huge lawsuit against the hospital, now they just file a claim with the insurance and nothing happens to the doctor to correct their behavior. Ending QI will also end the ability to find the police department liable. The police department can't file bankruptcy on the judgment but the cop can, and immediately will.

The judge gets an F- for invoking qualified immunity and ruling that the case was merit less. The judge should be disbarred and imprisoned.
I think it would have been the officers lawyers who brought up qualified immunity, and legally speaking quite effectively because it basically assured his clients success. That said the idea of qualified immunity is gross, and I’m disappointed the Supreme Court made that ruling, yet I’m not surprised. But to my point it wouldn’t be the judge who makes that decision, especially a lower court judge, he simply has to apply the existing case law.
There needs to be some repercussions for judges who side against the law on rulings. Especially when their ruling gets over turned in a higher court.

When you live out in county it is a daily thing to hear gunshots and not think anything of it. Actually it has desensitized me when I'm in a city or town and hear gunshots. Usually about a 3 count before I'm like "oh right, that's not normal/legal"

I was in a similar situation, but I’m white. The cop just came up and said something like “oh you’re just target shooting. Your neighbor called, but it’s totally legal till 10pm”, my friend and I both had long guns in our hands and handguns on our hips. All people deserve to be treated like this cop treated me.

I got pulled over with a gun on my hip going over 100mph listening to rap music with my high beams on in Tennessee (I was alone on the highway at 3am). the cop was extremely professional and let me go with a warning.

Never trust a cop that tells you to look up a law, ordinance or claims there's a specific law unless they quote it specifically along with the code. They should be required to show them the written law they are accusing them of.
In addition, they have to requalify every year in marksmanship and other tactics. They should also requalify with law, ordinance and ethics with undercover testers. If they can't pass they need to go back to the academy.

The fact that first information relayed was that she has “2 black males” explains a lot of why she was convinced that these people were dangerous criminals. She didn’t offer a description of their clothing, age, or any other discerning feature. The purpose of saying that was not to provide relevant information but rather to highlight why she was convinced of wrongdoing despite no apparent crime having been committed. If these guys had been 2 white Iraq war vets in their 30s shooting on their property she would have immediately put her gun away and apologized for the misunderstanding because she would have had respect for them. Instead she says “where’s the weed at” because she is fishing for a cause to arrest them. The fact that she words it like that instead of “where is the weed” is because she thinks they need to be talked to in a different way. It’s the same reason the other officer calls them “cuz” as he lies about the law. I understand the deputy's actions up to a point. Hearing gun shots in the dark certainly requires an investigation. However, once it was clear it was just two residents and nothing nefarious was up, the situation should have ended right then and there. That she kept it going and called in for back up having detained two "black males" with a firearm speaks volumes as to her motivation and lack of professionalism.

This shows that QI is being used to shield officers from everything down to negligence. QI in my opinion was for errors officers made when in high pressure situations and dealing with multiple problems in an active emergency.
How can you use QI for blatantly breaking the law or in some cases causing bodily harm to an individual that was innocent.

And he was a sergeant. He either didn't know he's not in a stop and ID state, or he was fine lying about the law because he didn't fear any repercussions.. both options are awful

At 1st I was thinking that the police had a point investigating these two, but then the police started lying trying to frame them and demonstrated a misunderstanding of multiple laws. It's crazy

It never ceases to amaze me at how every cop's default position is to lie.
They are , given a test, before they can become, a officer, as to how well they can lie. Good liars are promoted more. Because that is the law of the land, in America.
That's why it is they often go to the rather nebulous smoke screen tactic of, "suspicious activity". It says nebulous as trying to catch cigarette smoke floating in the air to prove somebody was smoking where they shouldn't be. And the other problem is they end up costing their department so much money because they are too busy chasing that smoke through the air and over the cliff. They don't realize that they're now falling until they have to pay that $50,000 fine from the department's budget. Which then means that the department has to cut the number of police that they put on the street. What you're looking at is the arbitrary and capricious actions of criminals who claim that they're following the law and enforcing the law. These are not peace officers, these are enforcers of arbitrary and capricious statutes. There's a difference between the law of the land and statute. The statute is submissive to the law. Period!

Love these young men for doing what is right. Exercising their rights including their 2A and then standing up for their rights in the face of rogue law enforcement. More young people should learn like these guys did. As for the cops… stop inventing laws and pretending you know what you’re talking about when you don’t. Shameful.

Kudos to these young men for standing their ground in the face of a scary situation.
Why didn’t the boys get an A+? They tried to exercises their right to remain silent and they were very courteous.
Because what they did can (and probably would, had the officers gone about it the correct way) be cited as a breach of the peace

They were taken to jail and released the next day after being cited for breach of peace. Not sure why you’re debating that.
Just another example of don’t ever call the cops for help. They make almost every situation worse. This female cop thinks she rules the world and has the right to harass lawful people, demand their ID, threaten to lock them up for no reason and is generally disrespectful and incredibly rude.
Sad is how to protect these officers instead of upholding Justice

Perfect reason why qualified immunity needs to be abolished, my understanding ignorance of the law is no excuse especially for a cop.
Ignorance of the law is no excuse for us regular folks. But sadly the Supreme Court has ruled that cops do not have to know the laws they enforce.
As long as they say they thought they were enforcing a law then they are covered. So they enforce their feelings instead and just claim ignorance.
With QI as a shield they will continue to operate this way.
But in a tech age like ours, where everyone has a smart phone and can literally google their state statutes, the cops have no honest leg to stand on.
This isn’t 1950 where many cops didn’t have radios and were out their winging it. These guys have radios, cellphones and onboard computer systems. There’s no excuse for a cop to make a bogus arrest when all the info they need about the laws they enforce is at their fingertips, on the spot, while still in the field.
It’s absolutely disgraceful.

"Stop and ID state" is not a basic legal term. You won't find that term in any legal document. It's used a lot in RUclips videos and on the internet. It's not used at all in the practice of law.

Instead, different states have different laws on when and how people must identify themselves to law enforcement. Who says they even knew the deputy was there? They obviously couldn’t see each other. I get it, you’re on a call at night and hear gun shots..that’s not the most comforting thing but as a police officer you can’t go around assuming everyone is out to get you and everyone is a criminal. Doing your job scared is dangerous. Very. Doing it in a very alert frame of mind is better.
As soon as she figured out they were just shooting at targets, she shoulda let them go. I totally get finding out where the shots are coming from and why, but when it's clear that they haven't broken a law, that's when ya break contact.

Once you find out your chief concern has been satisfied, you let them go. I get so tired of seeing officers doing stupid shit like that. It makes all officers look bad.
