      Yes! They should. OT after 8 hours just like all these overpaid politicians, beaurocrats, and executive officers within the state Gov't, federal Gov't, white collar professionals, and other applicable businesses.

      Indeed they should. It was mentioned the rules no overtime from the 1930’s was to prevent drivers from working long hours. If that was true then they would have prevented trucking companies from working their drivers long hours by fining the carriers and would not have authorized a 70 hour work week. They’ve always viewed truck drivers as illiterate and that may have been true for some but not all. They still view truckers as illiterate because they go for anything and won’t stand together!

      Yes. Detention pay is a version of overtime pay. Also,some drivers unload trailers and absolutley deserve overtime pay. The labor of time spent unloading a trailer is not properly paid. Also, does not include drivers with a forklift in tow. Used to unload a flatbed trailer. Mosty delivering residential and construction products.
      Performing two jobs in one and only getting paid for one. Absolute bullshit.

    This is ridiculous. What mega carrier lobbyists paid off this proposal? These shippers and receivers need some incentives to not hold truckers for so many hours to days on the docks.

      It's not about lobbyist. Sadly, its about the fact that all the wanna be lawyers who left law school and weren't clever enough to get hired in a law firm, end up as "law administrators" in government agencies where their only interest is what serves the government and finance, and not the people. Believe me, I've come across some real incompetent liars in lots of government agencies!!!

      It's not the mega carrier paying them off. Truck Drivers will never be included because we don't get paid by the hour for the most part. If you want overtime get a regular day job.

    As a company driver if overtime pay was mandatory they would simply cut my base rate and lower my miles to offset the cost. Companies know what they’re willing to pay to drivers and legislation isn’t going to change their mind.

      I am not quite so cynical. At least if the drivers get overtime, then the mega carriers will finally push the shippers and receivers to get their trucks loaded and unloaded in a timely manner.

    I will say this,I've been driving since 97 as aCDL driver,started as a local then OTR by 99 doing seattle to Miami dedicated. I made more money on % in the 90's then I do right now doing dedicated to Wisconsin and the traffic now is10 times worse then back then and the money is almost the same"crazy, I'm pulling out of this truck and going to a local position paying 30hr plus OT after 40 hrs,I can say I've had just about enough of the no home time,34 hour restarts without pay,ya good by OTR 👋

    If drivers got OT, then the capital gains and dividends the politicians receive from their inside trading would be decreased by a little bit.
    So, truck driving is the only occupation where drivers are not afforded the full protections of the 14th Amendment; meaning, drivers are forced to provide labor/services without reasonable compensation.

      Your 100% right about that!!!
      This per mile scheme scam pay that they place ever since, is now getting obvious to all Trucker’s including myself. That per mile scheme is a trap for Us not getting what is for Us!
      Yeah I just quit this rotting industry since last year, and even I’m out. I can’t help to have this distasteful feeling everytime I see this kind of unfair laws for my fellow Trucker’s.
      It’s just so sad, that I can’t see any signs of Trucker’s doing something about it. And majority of the Trucker’s just sucked it up. I don’t care if I offended somebody. I’m just letting you know, to fight what is OURS! Wake up all of you!
      They’re really fucking Us now! Over and Over again! Especially, this quacks in the ministry. Who doesn’t know anything about a Trucker job, to begin with. And keep Us screwing with their nonsense laws.

      I'm not an employee. I'm an independent contractor. That's 1 reason I don't want this. Second, you think pay per mile is bad. They don't do overtime because of pay by the mile.
      First we need to fight to get paid practical miles not short miles plus Deadhead. To hell with overtime. Make the customer really pay.

    A word on hourly pay and OT. There is no excuse now with ELDs why companies cannot arrive at a hourly number. There's FOUR time clocks running at all times. Most companies lack ethics and integrity. Their business model benefits from high turnover.

      Actually the students at my company get paid based on hours worked and that is done by the ELD. So yes it can be done but you would not like it.

    it was denied in Australia too……. Some truckdrivers went to court in 2021, with the same matter, and it was rejected.:
    One truck driver showed a log record of 17 hours and had only travelled 200 miles for the day.
    was paid about $160 for a 17 hour day .

    It's pretty stunning how we've always been left out of this overtime standard. As a almost 30 yr local driver, I've made it pretty simple, my week ends at 40-42 hrs.

      @theo10125 I work for one of the large ltl carriers, and no, there's no overtime pay. Even the ones that do offer overtime pay, most of them offer after 50, 55, 60 hrs.

Those sacrifices away with our love ones for days with this peanut pay is not worthit to begin with, as they say, it’s better to get any kind of local jobs, and be home everyday after work and enjoy a quality time with family. Rather than sacrifice everything, let alone the one thing that most of the Trucker’s unknowningly putting on the line is the HEALTH.
      Our Health to perform this duty is vital, in order to do this job.
      And my God, majority of the Truckero know that the Health is always on the line.
      Sitting all day is much worst than smoking cigarette. Sitting for a long period of time is a silent killer. I hope, this matter will not be always taken so lightly. This is a serious matter. If not for the Trucker’s, our society will not function properly. Trucker’s are vital in everything. So, why to not support the wellness of the Truckers.
      I guess we are all selfish kind of species. Only thingking for ourselves first. And just realized a thing, only when time comes that it affects Our lives, having this kind of thing to not function, as it used to be.
      Like what if, there’s no Trucker’s? Do these folks think that they have food to buy in their local groceries? They don’t even realize that how did it get there in the first place? Did it just walked 5thousand miles to get there? I know I said a lot.
      But, people need to be educated on this matter.
      Trucker’s need to overhaul the way we get paid.
      We need to push to scrap that per mile scheme type of pay.
      And there’s two kind of options of how to pay the Trucker’s.
      The first one, is by the hourly above the minimum and pay the 10hr sleeper birth, the 2nd one is fixed rate pay of the load, depending where it’s going. And that rate os none negotiable. Enough said.

    40 hrs worked is 40hrs. Anything over that should be overtime period. What does driving a truck have to do with us working a job?
    This needs to go to the Supreme Court. Why do our jobs have labor restrictions, but everyone else gets overtime after 40 hrs.

    In around 2008 I looked into this and there is a law from the 1930's regarding this subject. They flat will not update that law even though it's almost 90 years old. Mainly because our cdl's are federal and not state. We got screwed 90years ago.
    I was required to work 70 hrs a week , straight pay , no overtime. This is why I looked into it. I was a hostler at a distribution center and told by the labour board - tough shit on you Mr driver.

    I have worked in manufacturing, followed by truck driving. At this point in time, I believe it would make more sense to work in the fast food industry before being a company driver.

    Rates will go up when overcapacity in the market goes away in other words the market needs to hemorrhage more jobs! The only shortage in the trucking industry is parking-not drivers.

    With the required ELD it would be easy to require pay by the hour after 40hrs of on duty and driving time combined. But, it will never happen.

    Think of the amount of downtime truck drivers don't get paid for... you can't go home, but you can't work either. Often stuck at a truck stop or a shipper/receiver. Not so bad if you were going to have to sleep anyway, but being stuck 34 hours at a truck stop in the middle of nowhere 1000's of miles from home. Most the big truck companies screw guys out of promised pay for delays and such as well. Or only pay you after a full day of having to sit. The big companies have all the power, and take advantage of desperate rookie drivers often. Drive local with a company that pays OT after 40... usually you get a 5 day 50 hour week.. and you will make more than most OTR company guys putting in 70 hours, and you get to be home every night and at home on weekends instead of stuck at a stupid truck stop.

      It doesn’t mean that you are on sleeper, you’re not working? The fact that it is part of the job. So, it means your still not in your home sleeping. So, it’s not free!
      There for, the one that needed to push to be get paid for, is that 10hrs sleeper in the bunk.
      TO COMPENSATE THOSE DAYS OF BEING AWAY FROM HOME FOR 5-6days Straight in a week.
      If they don’t want to pay that 10hrs sleeper.
      Then we need to push to remove that per mile pay type of scheme scam pay!
      Because, that pay mile pay means after that everything you do as a Trucker, will be everything for free!
      So, in order to get what is for Trucker’s.
      We need to push this another option of pay.
      A fix minim price of load, depending it’s destination!
      Like from east to west cost, as an OTR driver will get the load for the rigt price! And not for the distance pay.
      This is no brainer! We need to get what we really deserved!

      And never corrected this scheme scam per mile pay for OTR Trucker’s who spend 5-6days straight on the road after finishing the 70hrs cycle. And only got less than 2days stay in their home with their love one’s, and repeat the cycle for decades and decades.

    Trucking sucks you need to get out of it. How do you ot pay people who get paid by the mile. Truckers all have to get paid hourly to even be able to get that. You’re always gonna get screwed as a trucker. I been getting screwed for years trucking. I tell people not to be a driver. Get a real trade. Be an electrician.

    If you've ever talked to any trucker who drove pre 1980 motor carrier act you would realize how the pay has actually gone backwards, when a driver could go out in the late 70s and make 10000 in 2 weeks , that was a huge amount for the cost of living at that time , truck drivers use to have a lot of solidarity back then today they are like rats in a cage stabbing each other in the back and kissing their slave masters a**, if the government says every truck driver has to get overtime , then the shippers simply have to pay more because every driver every where is getting more another company can't come in and under bid and take it out of the drivers pay , these greedy owners of the companies just don't want to take a pay cut because they realize thats the only way they can under bid the other companies

    I picked up two drop and hook loads at my yard last week that were overweight and needed to be reworked... My dispatch said I was crying too much asking to be compensated... they could have been live loads I was told... I said live loads pay mileage to the shipper... I had to go to the scale and back to the shipper for free... Trucking is a racket and truckers aren't in on it...

    Well, I’m having the issue of I am somewhat local driver/short range and I get paid hourly so I can sit and be loaded or unloaded and still be getting paid but the company says that since I drive a truck they don’t have to pay me overtime and I find that erroneous/wrong/bull$h¡t because I am being paid by the hour not by the mile and at the end of the day I come to the same place I start from And go home so I’m fairly certain I am a standard worker that drives a truck not a trucker, technically. Should I be suing the company, I wonder?

    It's just to bad, that no one could ever organize a United Trucker Strike ! United we Stand, divided we fall ! Truckers could more or less run this country, if we all came together, in a real all truckers just stay at home for a few days, United Trucker Strike ! ( The Trucker Strike - Sanctions ! ) Yeah ! But instead, they all just worry about themselves, and end up putting up with everything ! Sad !

    🤷 Well I knew that wasn't going to happen.... All you have to do is look at the lobbying groups that were against it.
    Then also look at what companies are bringing in labor from overseas or across the border and there's your answer. When you have the drivers that live in the truck that are paid 30 to 45 cents per mile Did you really think overtime was going to pass.
    Just a few weeks ago I met a Eastern European driver who spoke good enough English to have a conversation with He's working for some Chicago carrier making a whopping 35 cents a mile 🤦🤦🤦 And I'm sure he's jipped on plenty of miles and does not see any detention time let alone overtime.

    Personally, I think we should get paid address to address before over time pay just for the fact we are already on a 14 hour rule with 11 hours to drive that's already in place if we get over time pay they would have to restructure the way we operate

    I can’t pay my drivers overtime , already had to change to w2 due EB5 in California. And owner fleet are not profiting anything

    It was never gonna happen anyway. The amount of money companies would lose if they actually paid us for the work we did would be astronomical. That’s why most pay per mile instead of hourly and continue to use the house hold movers guide to calculate miles. You get short changed no matter what.

    Who do we call when we need help? Who is going to stand up for truckers? We provide non stop all around America.We get treated like crap for doing our jobs.They don’t care about us there here our cry’s and pain when we request more parking,When we request to be paid for all our time away from our families.Overtime should be mandatory It’s sad this shouldn’t even be a discussion This should be the norm.

    Recently company Dispatchers we’re awarded favorable lawsuits over overtime for working Saturdays.
    Truck drivers work everyday stuck in a company vehicle subjected to company rules and decisions everyday.
    Not fair

    If truck companies have to pay overtime they will just slightly lower your mileage pay or hourly rate and it will balance out to the same check your getting now. All you have to do is some simple division by 40 and add half of that hourly rate to the number of hours you work over 40 and boom you see that you are already getting overtime. Truck companies just dont pay alot like one would think. I dont get hourly paid hourly or overtime but I do some math and Boom!$26 dollars plus time and half for my monday to friday day shift at hubgroup 😕 yea i know its sad

    OTR drivers work way more than 70 hours per week. Finding a way that truck driver stop getting abused should be an emergency. This is sad!

    Automatic detention pay would be a better option, if you're at a shipper longer than an hour we should be paid. No exceptions to any shipper
