      Auditors fault should have taken it to court. Say what you want about her in the end she won because the auditor just wants to make video's and take money obviously he don't care about fighting for the constitution and has now made it harder for the next auditor because the cops will feel justified in what they did and will now do it to the next auditor and pity the regular citizens who bumps into her. He gets an F for folding and should stop auditing because he's a phoney

      Guy Souriandt can’t agree with you there. He would’ve won as so many other have for very similar situations. Since when was “trolling the cops” a crime? The police need to be better than that and keep their heads cool. Understanding that of someone is within their rights, even if what they’re doing is out of the ordinary, then that citizen needs to be allowed to continue about their business.

You can say you saw me robbing a church and I can stand there with the steeple sticking out of my ass and I STILL wouldn’t take a plea. He needed to get his butt an attorney and follow through. FOIA that c*nt’s disciplinary record cause you know this is not a stand alone incident, and take that entire dept to federal court. I don’t understand these half ass auditors that go through the trouble of getting to this point and then less than gracefully bowing out. It’s infuriating!!!

      I'll never understand how you can get a charge of resisting arrest without there being an arrest in progress for an indictable offence which you could feasibly resist in the first place. It's such a chicken and the egg thing. When I was a young lad I even quizzed my law professors, in our country that sort of shit wouldn't fly, but one of them had one consistent answer for me besides "It's codified law, they make that shit up as they go."

      Yeah I never understood how the original charges can be dropped or dismissed but yet still get charge for resisting arrest. I would think that if the original arrest was found as unlawful and the charges were dropped then that means any charges associated with it should also be considered unlawful. But the law isn't about common sense, it is about money.

    It would be really cool if this channel dedicated some time to addressing many of the common misconceptions and ambiguous legal precedents which tend to serve as legal pitfalls for auditors.

      @@personalinformation9963 I think he may be referring to the creation of a direct instructional video to ensure proper auditor's conduct and safety, which is not a bad idea, because far too many auditors overstep their bounds or unnecessarily provoke officers into acting. That just gives good auditors a bad name.
      The only issue I see with making such a video is that it would have to be done as a series of videos, covering the various laws state by state. It can be done, but that takes time and money. It may not be feasible.

      @@bobsum1745 blows my mind the "stop resisting" thing, they actually yell it out loud regardless of if the person is resisting - we know this becasue frequently they have been on top of a dead man telling him to stop resisting - the purpose of which is to make it appear to anyone watching, in any capacity, that the person is resisting so that they are then able to apply more force and in the end will call the application of the force "justified". Ive seen it in jails where they are telling people to stop resisting whie they suffocate them or break their limbs, OFCOURSE THEY ARE GONNA RESIST there isnt a single cop, guard, or even marine who could get pepper sprayed who wouldnt reach for their face or eyes, which in pig speak is "resisting" .

That said, ive had interactions with police while holding what is very clearly weaponry. Never been an issue. Besides, if someone is willing to literally throw away their greatest lifeline and protection against officers, theyve pretty much already forfeited their life. Honestly, cops should be more concerned about what citizens can do with a camera legally, than how hard they can throw it.

    My kindergarten teacher did the same thing to me.... she may have gotten an F, but ultimately she was able to get him off the streets with probation for at least a year. I'm sure they knew who he was already. I wasn't allowed to use the pencil sharpener during class time for the whole school year, so I brought my own and got detention for it so I know the feeling. Seriously, if he had an active file, he should have known better than to push it and would be able to continue to be a productive Auditor, but now we lost another soldier as unfair and unjustified as it is. You can be down with the struggle, just not the trap.

Or unless you have disposable cash in the 5 digit range.       The fact that things like this go unchallenged should tell you a great deal about the true priorities of certain organizations, such as the American Cynical Laissez-faire Union and the Institute for Just-Us to name a few, who could very easily involve themselves more often in grass roots cases of civil rights violations such as this one but very infrequently do unless it garners national/international attention.       But it was a detention which authorizes the use of force to any degree necessary to overcome resistance.
      The officer said she would charge with obstruction which wouod allow an arrest and a search. It's simply a matter of whether the officer believed she had RAS to compel identification. After that everything else is perfectly within the law.
      The only argument you can possibly put forth is that RAS did not exist but you cannot be the judge of that. We have judges who's job it is to determine the sufficiency of the evidence based upon the officers testimony.
      Have you heard the officers sworn testimony?
      I guess you cant make an actual judgement.
      But since everything hinges upon whether or not RAS existed until you make that determination nothing you present as an argument is relative.
      The truth is the officer acts as the complaintant, the judge and the executioner of any sentence they determine.
      All based upon a ambiguous undefined subjective cause called RAS.

      I've seen a lot of comments like this, most people don't recognise that she may feel an expectation from her fellow officers to be more assertive. It could be that she acts more naturally when backup is there, but it may be the opposite.

    In Massachusetts officers are actually by law forced to present an ID card. I don't know about the supervisor part though, that is, as you said, department policy.
