@@Whimpykids2 Hot take, but I don't really think it matters. Officers aren't teachers, they can't arbitrarily hold you "after class" because you annoyed them a little bit. I get what you're saying, but at the same time, that doesn't warrant a crime. Just because an audit may or may not be legitimate in nature doesn't mean they're breaking the law, which I feel might be a subject already being discussed within the auditing community as well as law enforcement.
Uhm, if our bases/installations have “military secrets” that can clearly be seen from a public sidewalk outside the checkpoint, then I think we have big problems.

A guy filming gate guards finding weakness has the potential to cause way more harm. Maybe family guy is just filming, let's say how many marines drive mustangs. It's almost all BTW.

It's understandable that the guards are nervous about a guy filming the outside.
The encounter should basically have been 'hey what's up?' 'I'm allowed to be here XYZ' 'oh okay, we're gonna put up a privacy fence or something to get people like you to fuck off'

I spent 9 years in the Navy and did 3 on security. If it were actually illegal to record a base or even the gate, he would not have been hassled all afternoon. He would have been snatched up immediately.

Marine here, I see why the baggage on the Navy happens so much, different breed I guess. I had to spend 8 months as acting military police through the forward assistance program at Camp Lejeune and I can tell you that no, no one is getting snatched up. You could be detained and questioned as to why you are taking pictures but there is no CIA snatch and grab policy for photographers outside of a basic restricted base. I will say most military installations do own a decent portion of property outside the gate though which allows for investigations to occur there from military and makes it federal property not public. Also, yes it very much can be illegal, most bases are at least restricted, I direct you to 18, U.S.C. § 795 again like the video shows. This designation usually happens for normal bases during time of war, like when I served but can change, which happened towards the end of my service.

I used to go to airshows at all kinds of Navy, Air force, Air National Guard and Army bases all over the place and filmed and took pictures of all kinds of things Many other people did also . No one cared or bothered me and anyone else there filming and taking pictures. I dont understand what in the world is so horrible about filming an entrance to a military base ? Why is a video camera so terrifying ? I dont get it ?
@@rbeck3200tb40 the difference with the entrance to a military camp is reconnaissance where to mortor a bomb where an advantage point is to shoot to kill... their are tons of reasons why.. Im very security aware after serving in Northern Ireland, operation banner. Maybe read up on that and you might ger my point. 👍🇬🇧

This was a great one. I, like other viewers assumed this was going to be a failure once the auditor started speaking, but man, he was very impressive! Stayed calm and knew what he was talking about, brilliant stuff from him
Yeah no, not really. He came off as exactly what he was. An activist making a pointless point. One that he won’t follow up with or can’t even begin to understand the point of it.
There is truly a bizarre contradiction in the US law here. Police have to have a articulable reason to detain someone, but they don't have to say what it is, so how is someone supposed to know if their detention is legal or not? The logical answer would be to say "Why am I being detained" and if it can't be answered then "this is obviously an illegal detention, please let me go" , but as they don't have to answer... then it can only be debated after the fact, by which point I am sure the police can make something up retrospectively.
Its the responsibility of the courts to determine whether a stop or arrest was lawful, not the citizens.
@@a.jperez202 But that means the cops can make up a reason retroactively, which violate the spirit of the whole thing. I acknowledge there are times when it may not be possible to articulate the reason for a detention at the time (the person being detained is hostile) - however if a police has to be able to give an articulable reason to detain someone and they are asked specifically what that is, then the question is what reason is there for them not to answer? If they are not willing to answer then the question has to be "why won't you answer" and the obvious answer is that they don't have an articulable reason at this time, therefore under most circumstances logically the detainment is invalid if a police refuses to respond... except for some bizarre reason police are not required to answer a reasonable question.
@@petervenkman69 even if they were required to give an answer, it would still not empower a citizen to disobey if they disagreed. The courts have ruled that it is unlawful to resist an unlawful arrest, unless "life or limb" was in danger.
@@a.jperez202 Did I say it was ok to resist... but if they couldn't give a coherent answer you can say "this is an unlawful arrest and your camera will show that" - and the police could decide to stand down at that stage, or face legal consequences. It would prevent them from making things up after the fact, which I am certain happens.
I love how demanding cops are about showing them respect but when a civilian is talking to them they either jump on their radio or talk over them it's an obvious Fu to the person who is speaking why do cops expect more respect than they give to people

I've seen many vids where the civilian is aggressively disrespectful, talking all over the cop, and the cop is polite and listens respectfully.
The amount of respect one shows another is a direct measurement of the respect one has for themselves. If one has no respect for oneself they can't be expected to show any to other's.

It's a reason many people seek out a career as a police officer...they weren't able to get respect in their normal lives by just being decent, respectable people, so they choose law enforcement, where they can "demand" the respect their lives would so desperately lack otherwise.

@@ICBMCatcher I dont agree with that, yes there are auditors that fail, usually have some sort of legal issue depending on how badly they fail, but the better ones show how unknowledgeable or just wrong some officers are. Just as officers hold us accountable, we can hold them accountable.
@@Badartist888 Well, a guy like that can only sue if the officer(s) violate his constitutional or state rights and actually give him a cause to sue. If our law enforcement officers stay knowledgeable of the particular laws and regulations they're charged to enforce and operate within the scope of their authority these auditors would have nothing to publish and no grounds to sue. Just as some police officers say "innocent people don't run", innocent officers have nothing to fear from a recording device. Always do what's legal, always do what's right.

All law enforcement should have a mandatory 2 year course on the Constitution before they can be working the streets.
And should be mandatory short update course and re-tested every 3 years, pay for police personnel insurance for wrongful death claims similar to doctors, and have a national database open to the public to review and other police departments to use in deciding whether to hire them or not. They are able to do that for everybody else, why not police also, only makes sense.

@thunderbird002 They can give you a ticket etc or hold you for civilian authorities but any offense on a Military Base is handed by the US Magistrate as they can't try non military personally.
On that base, the staff sgt is a respected, big man. When he walks onto the street, he looks and sounds like a fool.

Once you hit E7 there’s still certain things that need to be done but mostly paperwork and babysitting those Ssg’s and Sgt’s

I wish the cops that leave a thumbs down would realize there are more of us, citizens that demand they honor their oaths and protect our constitutional rights, than there are of them. Military member here: regs only apply to US military personnel. The rest of it is irrelevant. Public viewing is public viewing. SSgt whatever his name is isn't military personnel. That's a contractor. Probably prior service, but outside the gate MPs have limited authority especially in respect to civilians.
I'm not military but I thought it would be obvious that military regulations.... are for, ya know, military. Stuff like this drives me nuts

Yeah tbh you would've been fucked back then knowing your rights or not. All a cop had to do was lie a say it didn't happen like you said then it's your word vs his. Hell even today, where we have videos of what happened, cops STILL lie about how things happen in their reports and sometimes get away with it. So you didn't stand a chance, knowing your rights even back then still helps tho I think most cops would be less likely to violate someone that knows they're rights and might file complaints or lawsuits against them.

I'm a former law enforcement officer. Simply said, these guys do not have (what's called) probable cause or reasonable cause to believe this individual has (or is) committing a crime. They also don't have reasonable suspicion to detain this man. For instance, there is nothing out of the unusual to suspect him of any wrongdoing. So you can't hold a person simply because he's filming or videotaping the outside of a government area! What they're doing is illegal and it just leads to civilian complaints and lawsuits... a complete waste of our taxpayers' money and resources!

Not even remotely true. I was an MP. There are different kinds of jurisdiction. Actually a lot of bases have MPs doing police work on the highways around base.

@christopher martin I know Fort Benning they patrol the Highways around the base. I didn't watch the whole video so I know I missed alot but civilians have to careful because as highlighted with article 795 there are plenty of things that seem silly that is classified. There many fuzzy statutes especially dealing with homeland security that makes filming military installations illegal in some sense.
Note that the edge of the base is not the fence and/or gate. Base property often extends past that line substantially. It's quite likely that sidewalk was part of the base property.

I'll hand it to the auditor. There were a lot of officers there, both police and military, bearing down on him and he stood his ground and slapped some sense into them. He got illegally detained for a half hour and was clearly livid but had the restraint to compose himself.
As an MP it is difficult to combat terrorism due to situations like this. The auditor is acting within his legal rights and the MPs don't have an SOP that can legally combat this encounter. Auditors I would advise that you meet with the MP officer in charge or commander to provide guidance on how to handle the situation correctly in order to maintain civilian and soldier safety. It could also lead to a big contract for you! Win Win!

I was in Hanoi, Vietnam, taking pictures of an army base, police station, Ho Chi Minh's tomb, museums, etc. And had no problems at all until I went by the US embassy, when someone immediately came out and said I couldn't photograph any part of the building. So much for Democratic rights trumping Communism

I happen to stumble across your channel n immediately began binge watching you. The way you're completely unbiased for one side and the other. You break down the videos with accurate information. Also have perfected explaining exactly if either side was right or wrong in a way everyone could understand, even if they no nothing about your rights or laws. Every Citizen and police officer need to watch these videos so they both can either protect themselves, or if they're a cop, respect and honor people rights and the law.
Audit the audit is most definitely biased in favor of the law and of law enforcement. It is ignorant for people to assume that if a law exists, then it must not violate our Constitution. This couldn't be further from the truth! Although it may appear as though audit, the audit is intelligent enough to interpret the law, it couldn't be more obvious that they are ignorant of the Constitution. A constitution which is relatively easy to interpret. Unfortunately, a vast majority of Americans don't value their constitutional rights enough to read the Constitution.
One thing overlooked is alot of time the bases own that land around the base fence too. There are usually signs that say no photographs or videos and all personal are subject to search. So if that sign is there and he walked past it he just agreed to it and has no leg to stand on. While I was at Fort Bragg this was the case and we had a couple people try and looses. Once you walk past that sign all your audit falls apart.
Well he was on the sidewalk so, unless the military is asserting that they own the sidewalk on a public street, which would be fallacious, he's still in the clear. If there was a sign that said "no photos", it would probably be visible from his footage, and the pigs definitely would've pointed it out instantly.

Hey guys. I love the channel, it is very informative and I've learned a ton. Here's a topic I'd like you to cover: I am on felony probation in VA and therefore I've lost my 4th amendment rights. At least until I'm off of probation, I believe. How far does that extend? And do I get my right back after I'm off probation? I've come to believe that anybody on felony probation in VA loses their right to illegal searches because of accepting a plea deal. But I haven't figured out if it's permeant or I get them back later.

Perhaps we should be asking why we haven't heard of anyone starting a lawsuit against them it's purely speculation but I believe it's because of the military, the government, and the media suppressing the reports or even the suites themselves
I think it's because it will cost a substantial amount of money. I certainly don't have enough to take anything to court and pay for a lawyer.
@Omega Minus the Catholic church has not been taken down what so ever, its base isnt even in the US and counts as their own state/country (The Vatican) Italy cant even really mess with them.
