A couple of years ago a similar arrest was made and the family of the woman arrested for walking in the middle of the street sued for $325,000.00 for violating her civil rights, harassment and emotional distress and they won their case in court. I hope the same for this young man.

If a citizen were to detain another citizen and threaten them (whether overtly or more subtly -- like by wearing weapons and waving them around or saying now you're going to get into the back of my vehicle) wouldn't that be battery, then perhaps kidnapping? If a person with a weapon told me I had to get into his vehicle, I'd feel that was offensive and threatening contact and my life and wellbeing may be at stake. It is one thing if an officer had reasonable suspicion. Another if that is nowhere in sight.

Didn't you see the full video? The police department answer stating the LEO did nothing wrong. The suspect was wearing a hoody so that made the detention legal and the LEOs ID request legit! WTF right! So if you wear a hoody when LEOs feel is not cold enough to wear one you have to ID? They claim they had RAS, for what crime was it? Was a burglary or some type of illegal act recently called in? Again, it seems when it comes to LEOs and courts, common sense goes out the window. It is dark, guy walking around neighborhood with a hoody, ok might be a bit suspicious. But because it is suspicious does it mean as I citizen I can go out and confront the person, force him to ID, force him to tell me what he is doing on my neighborhood? What if I use force or threaten to use force if the person doesn't want to comply to my inquiry? I would be committing crimes right? Why when and LEO does it the legal system doesn't see it as a crime? What would I want LEOs to do? SAME THING I WOULD WANT A CIVILIAN TO DO! If someone is walking around my neighborhood looking suspicious, we let them know that we are watching them, and we continue to watch them. This LEO felt this suspect was up to no good but there was no RAS of an actual crime. After the suspect declined to ID and answer questions that should have been it. Heck, the LEO could have just let the suspect go then just follow the suspect around.

What's the point when you already know that they're not going to investigate the complaint- they already said the cop did nothing wrong, and not only that, they'll falsely accuse you of lying and arrest you for trying to file the complaint. This happens all the time. In Florida a local news station sent people in to police departments to ask for complaint forms. At almost every single police station the person was detained, accosted, and threatened with arrest if they didn't identify themselves. There's footage from a court room where a male police officer inappropriately searched a woman and when she tried to file a complaint they told her if she went through with it they would arrest her for making false statements. At first she agreed to drop the complaint but when she reaffirmed that the cop touched her inappropriately they took her to jail. If you have a warrant like this guy you can't just walk into a police station and ask for a complaint form without running the risk of being detained, forced to ID, and then arrested. So filing a complaint not only doesn't do any good when you know they're going to take the cop's side, you're risking your own life and liberty by even attempting to file a complaint. No one in their right mind would put themselves through all that for no result.

Sometimes, even if they know that you are not guilty but you hurt their feelings they will retaliate. Many have gone to prison for many years because cops and/or district attorneys take a dislike to someone.
I as a kid was kidnapped by officers while walking to a friend's house. A roughly 20 minute walk and had an hour to get there. They harrassed and kidnapped me for nearly two hours. Then after holding me for an hour past curfew. They then charged me for curfew violation to justify their stop and lied about when they picked me up. So, harassment, unlawful detainment, and unlawful charges that were actually caused by the kidnapping. Many cops are dirty and if you file a complaint they start stalking you. Keep in mind walking down the side walk is not illegal.
Your parents or grandparents should have talked to a lawyer about that. You could be set for life not have to work because of what they did and had the officers would ARRESTED you and held you as a minor ARRESTED and charged with kidnapping and questioning you with out a lawyer or parent with you during questioning or interrogation

One time I was sleeping in my own home, when a traitor pig began banging on my window, flashing his light inside. He said he saw my door was open, and wanted to make sure I wasn't a burglar. Another time, I got the cops called on me because I delivered my baby at home, and my ex found out, and called the traitor pigs, who demanded to verify my baby was fine. Third time, was getting pulled over at a speed trap, the 🐖 literally told me that I could pickup my ticket at his police car, that he parked 40 feet behind me, he was standing on the passenger side behind the open door staring at me. My son was arrested in Saginaw Michigan,after a crime had been committed not by my son,he was stopped by the police for matching the description of a suspect,gray hat gray shirt and gray shorts and a bike with a speaker on it,and the police were looking for the keys of a victim that was not found on my son and they still arrested him charged him and he was not identified by a victim as the suspect during this arrest
The statement "No, you're not" opened that cop up to losing his qualified immunity. The statement shows he has no right to ID this man, yet he tries to anyway. I think the Supreme Court would wholeheartedly agree that a $100,000 bail for a minor traffic violation would be a violation of the 8th Amendment; "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."
What California does is turn failure to appear for a traffic infraction a criminal offense. Typically bail is set at the amount that typically is charged as a fine. However this can be abused.

The cop changed his tune a few minutes in. He mentioned seeing Mr. Reina in someone's yard - i.e. trespassing. But he didn't mention that at all at the beginning of the stop when Mr. Reina asked why he was being stopped - just the hoodie crap. Wearing a hoodie in 81 degree weather is not probable cause for anything. I think the cop was making things up as he went.

He could have been a cop. It's possible. Some cops come out & confirm that most, if not all, cops are like this cop...usually after they've retired or something. Most cops, however, are cops (in their own minds) for life.
That wasn't a 4th Amendment violation, my guy. It was a misunderstanding between him and an officer that could have been diffused if the suspect had told him he lived in the neighborhood because the policemen clearly asked. Policemen rely on the ambiguity of reasonable suspicion to do their jobs effectively. Both men were wrong, not one way or the other. There might have been a string of car jackings in the area.
Well like this guy maybe didn't have the money for fine,skipped court and he knows what would happen. Cops will violate your rights in a min. Record everything if you can something that simple sometimes will help. We need to lower the power the police have and make the whole building transparent from chief on down judges need to be looked at also not just in court behavior everything that goes through the office. I got stopped for walking in the winter with no coat and he said that it was suspicious and wanted my ID. I told him I don't wear coats and haven't since I was a kid. I still need your ID I said why and he said so I can find out who you are and why your out here. I told him no matter how long you look at my license you will never find out why I am out here. He didn't leave it there, carried on for another 45 minutes after that.
If you aren't charged for whatever the initial stop was, everything after should be dropped. It's absoluetly fruit of the poisionous tree and if you can't challenge it because you were never charged, that's a MAJOR issue in my book.

Prowling is a crime in California under Penal Code 647i PC. This section defines a prowler as one “who, while loitering, prowling, or wandering upon the private property of another, at any time, peeks in the door or window of any inhabited building or structure, without visible or lawful business with the owner or occupant.” Walking down the street would NOT fit the description of prowling.

If Mr. Reinas knew that the officer had nothing he should've just walked away. If you know you're in the right and the officer has nothing you shouldn't even have to ask "am I being detained or am I free to go", just go. If the officer grabs you, you can either try to reason with them (yeah right) or play the victim and yell for help. There is nothing shameful about making the officer look like the oppressor because that's what they are.

A warrant for traffic makes no since. Failure to appear happens if you miss court for a traffic ticket. A cop showing up at your house for it is unbelievable. I've missed a few court dates in my 20's and it's just a bench warrant, a misdemeanor, not a felony warrant.

It's similar to what happened to me there's a taco truck two blocks down the street that's open till 11 I was hungry one night and went out there to get some tacos and on the way back a cop pulled up on me asking where I was going I said I was going home went to get some tacos real quick he asked me again what am I doing out here so late I said it's only 11 he asked again there's been a lot of robberies out here I said I don't care what's that got to do with me he said well why you walking this late I said look at my hand I was carrying a bag with tacos in it then he got mad because I wouldn't give him my ID so he grabbed my tacos and threw them on the ground and arrested me for prowling after spending the night in jail hungry they released me and after that I had to go to 4 Courts and the judge wouldn't drop the charges until I took it to trial and then they try to give me a deal I said no I'll take it to trial 15 minutes later the da dropped the charges that was some BS and waste of time trying to put something on my record and steal some money from me

This man had no duty to provide ID! The officer had EVERY DUTY to abide by his CONSTITUTIONAL RIGHTS! HE told him his rights, and was still harassed! NO QUALIFIED IMMUNITY!! NO RAS!
The very first thing that he should have asked the tyrant is “Is this a consensual contact?” If the answer is yes then he should have said “I do NOT consent so leave me alone and any further attempt to communicate with me will be construed as harassment.” If no, then immediately and verbally invoke your right to have counsel present during questioning and your right to remain silent. It doesn’t matter if the tyrant tries to say that since this is not an arrest then those don’t apply. SCOTUS says the exact opposite in Miranda v Arizona. Below are some points pulled directly from that ruling. I am NOT an attorney and this cannot be taken as sound legal advice since that can only be provided by an actual attorney. Still, here is something to add to your toolbox. The other night I actually read the SCOTUS ruling from Miranda v. Arizona (1966). There were some very interesting things in it that auditors need to be aware of . Here are three quotes from it that are the ammo you need to use: (1) By custodial interrogation, we mean questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his freedom of action in any significant way. (2) To summarize, we hold that when an individual is taken into custody or otherwise deprived of his freedom by the authorities in any significant way and is subjected to questioning, the privilege against self-incrimination is jeopardized. (3) If the individual states that he wants an attorney, the interrogation must cease until an attorney is present. Then there is this point from Terry v Ohio (1968) that reinforces what SCOTUS ruled in Miranda about the Constitutional significance of not being allowed to leave or proceed on your way: The Fourth Amendment applies to "stop and frisk" procedures such as those followed here. Pp. 392 U. S. 16-20. (a) Whenever a police officer accosts an individual and restrains his freedom to walk away, he has "seized" that person within the meaning of the Fourth Amendment. P. 392 U. S. 16. So, when a tyrant does not let you continue to be on your way then by Miranda you are in custody. It doesn’t matter what the tyrant tries to call it, it is being in custody, period. That third point I listed then comes into effect. Once a tyrant has you in custody you need to IMMEDIATELY invoke your right to counsel. Make sure to have it all on video. We all know that they are too stupid to not ask you anything else. Once they ask you ANYTHING after you have invoked then it becomes a civil rights violation under Miranda (as per point 2 above). Also, because Miranda is settled case law that clearly says they are not allowed to ask you ANYTHING after you invoke, then it meets the requirements set by the courts to get their qualified immunity waived and sue them personally. Just my two cents worth….
This is an incorrect interpretation of Miranda. You have to read the follow-up cases. Investigatory detainment is not typically considered custody for the purposes of Miranda. See Berkemer v. In California we have curfew laws for the underaged. Giving my D.O.B. was to inform the officer that I was way past the legal age to be walking at night by my self. Also, I completely ignored the officer as he was driving beside me while I walked! I only addressed the officer once I knew my phone's camera was recording video. And, continuing to walk didn't work because he quickly jumps right out of his vehicle to follow me and escalate the situation.
What I've learned as soon as the cop said " come here ". The citizen should have said " am I being detained ". If the cop said " no" keep walking" if the cop said " yes" than the citizens says for " what reasonable suspicion of a crime ". Then be quiet and let the cop dig his own hole.
I called the DOJ's Denver office when Obama was President. I was wondering why I could read through statutes of duties of government officials and have documented proof of via records requests that the laws of their duties was clearly not being followed. I asked what they were doing about the obvious felony malfeasance. Nothing. I asked about filing lawsuits of malfeasance. The PR spokesperson for that Denver DOJ office was adamant that they would demand to dismiss any lawsuit against any government official at any level of government for malfeasance. The DOJ is literally locking in the extreme corruption, economic racism, and economic misogyny that are destroying so many lives like they've done to me.

Even opening the door would have been bad. The cops would put their foot or body in the way preventing it from closing. This escalates the situation. The entire thing was the cops lying. If they could arrest him or enter they would have.
There's body warrants and search warrants this was a body warrant which means they can arrest you but they can't knock down your door to do it and that's why he was trying to get him to come outside. If they had a search warrant they would have definitely knocked down his door. It's definitely a corrupt system though and I don't agree with anything I just watched just pointing out the difference.

A couple of years ago a similar arrest was made and the family of the woman arrested for walking in the middle of the street sued for $325,000.00 for violating her civil rights, harassment and emotional distress and they won their case in court. I hope the same for this young man.

Again, it seems when it comes to LEOs and courts, common sense goes out the window. It is dark, guy walking around neighborhood with a hoody, ok might be a bit suspicious. But because it is suspicious does it mean as I citizen I can go out and confront the person, force him to ID, force him to tell me what he is doing on my neighborhood? What if I use force or threaten to use force if the person doesn't want to comply to my inquiry? I would be committing crimes right? Why when and LEO does it the legal system doesn't see it as a crime?
What would I want LEOs to do? SAME THING I WOULD WANT A CIVILIAN TO DO! If someone is walking around my neighborhood looking suspicious, we let them know that we are watching them, and we continue to watch them. This LEO felt this suspect was up to no good but there was no RAS of an actual crime. After the suspect declined to ID and answer questions that should have been it. Heck, the LEO could have just let the suspect go then just follow the suspect around.

What's the point when you already know that they're not going to investigate the complaint- they already said the cop did nothing wrong, and not only that, they'll falsely accuse you of lying and arrest you for trying to file the complaint. This happens all the time. In Florida a local news station sent people in to police departments to ask for complaint forms. At almost every single police station the person was detained, accosted, and threatened with arrest if they didn't identify themselves. There's footage from a court room where a male police officer inappropriately searched a woman and when she tried to file a complaint they told her if she went through with it they would arrest her for making false statements. At first she agreed to drop the complaint but when she reaffirmed that the cop touched her inappropriately they took her to jail. If you have a warrant like this guy you can't just walk into a police station and ask for a complaint form without running the risk of being detained, forced to ID, and then arrested. So filing a complaint not only doesn't do any good when you know they're going to take the cop's side, you're risking your own life and liberty by even attempting to file a complaint. No one in their right mind would put themselves through all that for no result.

I as a kid was kidnapped by officers while walking to a friend's house. A roughly 20 minute walk and had an hour to get there. They harrassed and kidnapped me for nearly two hours. Then after holding me for an hour past curfew. They then charged me for curfew violation to justify their stop and lied about when they picked me up. So, harassment, unlawful detainment, and unlawful charges that were actually caused by the kidnapping. Many cops are dirty and if you file a complaint they start stalking you. Keep in mind walking down the side walk is not illegal.
Your parents or grandparents should have talked to a lawyer about that. You could be set for life not have to work because of what they did and had the officers would ARRESTED you and held you as a minor ARRESTED and charged with kidnapping and questioning you with out a lawyer or parent with you during questioning or interrogation

The statement "No, you're not" opened that cop up to losing his qualified immunity. The statement shows he has no right to ID this man, yet he tries to anyway. I think the Supreme Court would wholeheartedly agree that a $100,000 bail for a minor traffic violation would be a violation of the 8th Amendment; "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

What California does is turn failure to appear for a traffic infraction a criminal offense. Typically bail is set at the amount that typically is charged as a fine. However this can be abused.

The cop changed his tune a few minutes in. He mentioned seeing Mr. Reina in someone's yard - i.e. trespassing. But he didn't mention that at all at the beginning of the stop when Mr. Reina asked why he was being stopped - just the hoodie crap. That wasn't a 4th Amendment violation, my guy. It was a misunderstanding between him and an officer that could have been diffused if the suspect had told him he lived in the neighborhood because the policemen clearly asked. Policemen rely on the ambiguity of reasonable suspicion to do their jobs effectively. Both men were wrong, not one way or the other. There might have been a string of car jackings in the area.

I got stopped for walking in the winter with no coat and he said that it was suspicious and wanted my ID. I told him I don't wear coats and haven't since I was a kid. I still need your ID I said why and he said so I can find out who you are and why your out here. I told him no matter how long you look at my license you will never find out why I am out here. He didn't leave it there, carried on for another 45 minutes after that.

Prowling is a crime in California under Penal Code 647i PC. This section defines a prowler as one “who, while loitering, prowling, or wandering upon the private property of another, at any time, peeks in the door or window of any inhabited building or structure, without visible or lawful business with the owner or occupant.” Walking down the street would NOT fit the description of prowling.

If Mr. Reinas knew that the officer had nothing he should've just walked away. If you know you're in the right and the officer has nothing you shouldn't even have to ask "am I being detained or am I free to go", just go. If the officer grabs you, you can either try to reason with them (yeah right) or play the victim and yell for help. There is nothing shameful about making the officer look like the oppressor because that's what they are.

A warrant for traffic makes no since. Failure to appear happens if you miss court for a traffic ticket. A cop showing up at your house for it is unbelievable. I've missed a few court dates in my 20's and it's just a bench warrant, a misdemeanor, not a felony warrant.

It's similar to what happened to me there's a taco truck two blocks down the street that's open till 11 I was hungry one night and went out there to get some tacos and on the way back a cop pulled up on me asking where I was going I said I was going home went to get some tacos real quick he asked me again what am I doing out here so late I said it's only 11 he asked again there's been a lot of robberies out here I said I don't care what's that got to do with me he said well why you walking this late I said look at my hand I was carrying a bag with tacos in it then he got mad because I wouldn't give him my ID so he grabbed my tacos and threw them on the ground and arrested me for prowling after spending the night in jail hungry they released me and after that I had to go to 4 Courts and the judge wouldn't drop the charges until I took it to trial and then they try to give me a deal I said no I'll take it to trial 15 minutes later the da dropped the charges that was some BS and waste of time trying to put something on my record and steal some money from me

-If the cops don't leave your property(& have no warrant) after you have told them to please leave then slam the door right in there faces. And if they just stay their Go watch tv and fall asleep Believe me They will leave Then IF they do come back they will have a warrant this time. This man had no duty to provide ID! The officer had EVERY DUTY to abide by his CONSTITUTIONAL RIGHTS! HE told him his rights, and was still harassed! NO QUALIFIED IMMUNITY!! NO RAS!
All he had to do was show him his identification
The very first thing that he should have asked the tyrant is “Is this a consensual contact?” If the answer is yes then he should have said “I do NOT consent so leave me alone and any further attempt to communicate with me will be construed as harassment.” If no, then immediately and verbally invoke your right to have counsel present during questioning and your right to remain silent. It doesn’t matter if the tyrant tries to say that since this is not an arrest then those don’t apply. SCOTUS says the exact opposite in Miranda v Arizona. Below are some points pulled directly from that ruling.
I am NOT an attorney and this cannot be taken as sound legal advice since that can only be provided by an actual attorney. Still, here is something to add to your toolbox. The other night I actually read the SCOTUS ruling from Miranda v. Arizona (1966). There were some very interesting things in it that auditors need to be aware of . Here are three quotes from it that are the ammo you need to use:
(1) By custodial interrogation, we mean questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his freedom of action in any significant way.
(2) To summarize, we hold that when an individual is taken into custody or otherwise deprived of his freedom by the authorities in any significant way and is subjected to questioning, the privilege against self-incrimination is jeopardized.
(3) If the individual states that he wants an attorney, the interrogation must cease until an attorney is present.
Then there is this point from Terry v Ohio (1968) that reinforces what SCOTUS ruled in Miranda about the Constitutional significance of not being allowed to leave or proceed on your way:
The Fourth Amendment applies to "stop and frisk" procedures such as those followed here. Pp. 392 U. S. 16-20.
(a) Whenever a police officer accosts an individual and restrains his freedom to walk away, he has "seized" that person within the meaning of the Fourth Amendment. P. 392 U. S. 16.
So, when a tyrant does not let you continue to be on your way then by Miranda you are in custody. It doesn’t matter what the tyrant tries to call it, it is being in custody, period. That third point I listed then comes into effect. Once a tyrant has you in custody you need to IMMEDIATELY invoke your right to counsel. Make sure to have it all on video. We all know that they are too stupid to not ask you anything else. Once they ask you ANYTHING after you have invoked then it becomes a civil rights violation under Miranda (as per point 2 above). Also, because Miranda is settled case law that clearly says they are not allowed to ask you ANYTHING after you invoke, then it meets the requirements set by the courts to get their qualified immunity waived and sue them personally. Just my two cents worth….
This is an incorrect interpretation of Miranda. You have to read the follow-up cases. Investigatory detainment is not typically considered custody for the purposes of Miranda. See Berkemer v. McCarty (traffic stop where the person was not free to leave and questioned by an officer. Held that suspect was not in custody for Miranda purposes at this stage). The court stated that Miranda rights attach once a suspect’s freedom of action has been curtailed to a degree associated with formal arrest.
If a person reads your comment and follows your advice, it could actually get them in more trouble.

@@Sincere4Eva the key phrase to “curtailed to a degree associated with formal arrest.” Miranda does not attach during investigatory detainments and traffic stops (unless your freedom is curtailed to the extent associated with formal arrest). You can still invoke the fifth and remain silent (which should be done affirmatively thanks to Salinas v. Texas). However, cops are not required to give you Miranda warnings in these situations.

In California we have curfew laws for the underaged. Giving my D.O.B. was to inform the officer that I was way past the legal age to be walking at night by my self.
Also, I completely ignored the officer as he was driving beside me while I walked!
I only addressed the officer once I knew my phone's camera was recording video. And, continuing to walk didn't work because he quickly jumps right out of his vehicle to follow me and escalate the situation.

If the cop said " no" keep walking" if the cop said " yes" than the citizens says for " what reasonable suspicion of a crime ".

I called the DOJ's Denver office when Obama was President. I was wondering why I could read through statutes of duties of government officials and have documented proof of via records requests that the laws of their duties was clearly not being followed.
I asked what they were doing about the obvious felony malfeasance. Nothing.
I asked about filing lawsuits of malfeasance. The PR spokesperson for that Denver DOJ office was adamant that they would demand to dismiss any lawsuit against any government official at any level of government for malfeasance.
The DOJ is literally locking in the extreme corruption, economic racism, and economic misogyny that are destroying so many lives like they've done to me.

There's body warrants and search warrants this was a body warrant which means they can arrest you but they can't knock down your door to do it and that's why he was trying to get him to come outside. If they had a search warrant they would have definitely knocked down his door. It's definitely a corrupt system though and I don't agree with anything I just watched just pointing out the difference.
