Not only should he appeal he should do a counter suit both for what the officers did to him, violation of his rights, medical bills and the officers need to do triple what would of been the so called guilty terms of this gentleman. The jury's backgrounds certainly need investigating to see if they have any links to the police or court officials, becqause if so, then THEY are guilty of adverse interest, and should have been denied a place on the jury. I am totally confused how the heck did 12 jurors find him guilty on all charges? Were these people all blind and deaf or recently released from a local state hospital possibly. That entire town needs to be investigated from top to bottom corruption. Was the jury stacked with city employees and cops? No person with common sense, or even eyeballs, would come back with a guilty vote. It is absolutely disgusting that anybody would even attempt to claim that the outcome is anywhere near justice. His lawyer didn't seem to do him any justice either. Hopefully he appeals it all the way to the state supreme court if need be.
Many people who watch these types of video have a false idea of the attitude of the general public. Unfortunately most people believe that the police always act in the best interest of the public, and that when a police officer arrests someone then it is the fault of the arrestsed person except in cases of obvious over-reaction or mistaken identity etc. In particular, most believe that anyone who deliberately places themself in a position of confrontation with police is a trouble-maker who deserves everything they get. I doubt it was a corrupt jury - just a group of average people with average pro-cop views. Those who are suspicious of the police and critical of their actions are in the minority. Having said that, if the video in question was the main evidence and was not significantly edited to cut out scenes of significant resistance or assault to the police, then either the defending counsel was pretty inept or the prosecutor was very good in order to persuade the jury to find guilt on those two charges.

This happened several years ago. The chief was forced to resign and lost his leo cert if I remember correctly. The town government got shut down and had recalls.
I asked jurors outside a courthouse once if a DUI case is believable based only on a cops testimony. They were potential jurors and waiting outside to be brought in for their checks as potential jury selection. So many of them said they would believe the cop no matter what the circumstances or testimony, I was appalled. It's run actually, as guilty unless proven otherwise. I don't know what that would be. Maybe the machine being skewed to false positives? That takes about $25 k I'm told, to prove. And someone did. They had three months of cases that had to be heard with no BAC tests.

It's called loading the jury. This is why there needs to be a tracking of some sort. If they have a group of people that the pull from they know who is willing to say guilty on just about anything. Where did he resist arrest or commit any of the other charges that aren't shown in the video? This needs to be appealed way up the change. I'd love to know how the prosecutor and judge managed to get this past a jury. I saw zero evidence that he resisted or assaulted the cops in any way as they testified that they immediately went hands on with pain compliance.
The video was edited to only show things that happened. The things the officers thought they saw were edited out. The part where he was using the unicorns horn to try and impale the officers bum to make him fart homosexual rainbows was completely removed.

It seems that most times nowadays the judges side with the police and the cash, fines and fees imposed by the probation system keep the wheels just rolling along. People always say, “the US is the land of the free….”, but in reality compared to Scandinavian countries we’re definitely a police state….!! I totally believe it and most of you are at fault. Instead of being proud to exercise your civic duty, what do you do? You do anything you can to get out of it. So who actually serves on jury duty? The people who know nothing, do nothing and have nothing better to do. I was on a jury that wanted to let a previous felon go with 2 weapons charges. One of them was a loaded pistol in his truck door. They wanted to go easy on him because he was working 2 jobs trying to get his life back together. I can sympathize with that, but you don't do something stupid like driving around with a loaded pistol in your car with a history of anger issues. I was finally able to talk some sense into them that's not our job. That's the judges job. If I wasn't there these idiots would have probably let him off. It's not the system's fault if the citizens refuse to do their part. Jury duty is the most important part but most people want to have none of it, then complain it's not working.

From what I've seen in the video, I didn't see any of those charges. How the hell did a jury convict you. Seems like either your lawer wasn't any good or you were hung by jury before the verdict.

What I don't get is how 2nd auditors don't use the laws properly. This is a kidnapping. A felony. PPA laws allow we the people to make a citizens arrest using only the reasonable force needed against armed violent felons. These violent criminals need to leave the crime scene in cuffs or body bags.

Police officers are permitted to make _Good Faith Errors,_ which means that if they make an error but reasonably believe that they are doing their job correctly, they cannot be held accountable for their error. The reason for this is that police are human beings and human beings make mistakes on their jobs all the time; so, it would be unreasonable to penalize police officers every time they make an error. Now, even though it's obvious that the police were knowingly in error in regard to how they handled the situation in this video, they can argue that they truly believed that they were justified - and an effective prosecutor could assure that a jury buys their bologna...which is what happened. So, a citizen attempting to perform a citizen's arrest on a uniformed officer because he or she has engaged in what the citizen believes is illegal or otherwise improper conduct is very foolish.

A police uniform doesn't allow the wearer to attack people without lawful authority or any reasonable cause. Cases don't appear before the SCOTUS because you want to go there....First the Court must accept the case and there must be a Constitutional Question . Often it takes years IF accepted.....MOST Cases are not accepted.....Thus, a lower District Court decision is final.....
I am absolutely dumbfounded as to how a jury of 12 people found this man guilty of the charges against him based upon the video footage we see here. In what way was he resisting? How specifically was he being "Disorderly?" When did we see him assault the officer? How was he blocking ANYTHING while walking on a public right of way? How does one get convicted of the firearms charge Mr. Miller was convicted of by carrying what is essentially a toy gun in the manner we see him doing? The fact that 12 people found him guilty is more evidence that most people have a gross misunderstanding of the law. Edit: I highly encourage Mr. Miller to hire an attorney and to appeal this conviction.
Sounds like your basic small town cops, lawyers and judges who go to the golf course together on the weekends. I'd bet the citizens are too afraid to go against the cops in court, because in small towns its easy for the police to harass people who they don't like.

I was a traffic cop in New Zealand for ten years. In that time I felt it necessary to arrest someone on exactly 6 occasions. Only once did I use a reverse wrist lock ( the hold used by the cop in the video ) and only until the person I was arresting stopped trying to break away from me. I never took anyone to the ground and continue to exert a very painful and punitive amount of force as that cop did in the video. We never had any issues about guns or any kind of violence. Hell we pretty much done whatever we wanted to do and no cops were ever called. That entire town needs to be investigated from top to bottom corruption. Was the jury stacked with city employees and cops? No person with common sense, or even eyeballs, would come back with a guilty vote. It is absolutely disgusting that anybody would even attempt to claim that the outcome is anywhere near justice. That had to be the case given the video which was clearly exculpatory. The first thing his attorney should have done was to request a change in venue.
Many people who watch these types of video have a false idea of the attitude of the general public. Unfortunately most people believe that the police always act in the best interest of the public, and that when a police officer arrests someone then it is the fault of the arrestsed person except in cases of obvious over-reaction or mistaken identity etc. In particular, most believe that anyone who deliberately places themself in a position of confrontation with police is a trouble-maker who deserves everything they get. I doubt it was a corrupt jury - just a group of average people with average pro-cop views. Those who are suspicious of the police and critical of their actions are in the minority. Having said that, if the video in question was the main evidence and was not significantly edited to cut out scenes of significant resistance or assault to the police, then either the defending counsel was pretty inept or the prosecutor was very good in order to persuade the jury to find guilt on those two charges.

I asked jurors outside a courthouse once if a DUI case is believable based only on a cops testimony.
They were potential jurors and waiting outside to be brought in for their checks as potential jury selection.
So many of them said they would believe the cop no matter what the circumstances or testimony, I was appalled.

Where did he resist arrest or commit any of the other charges that aren't shown in the video? This needs to be appealed way up the change. I'd love to know how the prosecutor and judge managed to get this past a jury. I saw zero evidence that he resisted or assaulted the cops in any way as they testified that they immediately went hands on with pain compliance.

I totally believe it and most of you are at fault. Instead of being proud to exercise your civic duty, what do you do? You do anything you can to get out of it. So who actually serves on jury duty? The people who know nothing, do nothing and have nothing better to do. I was on a jury that wanted to let a previous felon go with 2 weapons charges. One of them was a loaded pistol in his truck door. They wanted to go easy on him because he was working 2 jobs trying to get his life back together. I can sympathize with that, but you don't do something stupid like driving around with a loaded pistol in your car with a history of anger issues. I was finally able to talk some sense into them that's not our job. That's the judges job.
If I wasn't there these idiots would have probably let him off. It's not the system's fault if the citizens refuse to do their part. Jury duty is the most important part but most people want to have none of it, then complain it's not working.

The jury system you have is bound to have exactly the problem you describe. At its best you get 12 people who have little to no clue of the law and how to evaluate evidence. Watching the video there is absolutely no way any of those charges are legit. Someone needs to investigate the juror's and the prosecutor for misconduct. This needs to be appealed to SCOTUS.

It's the reverse of jury nullification, the kind of thing that was/is standard in Mississippi: a Black man is murdered by a white man, a jury of white men is convened and the murderer is acquitted. Even more common, the Sheriff and DA don't even bother to bring charges, e.g., Ahmaud Arbery. The DA didn't even bother to bring any charges until forced to by public reaction to one of the murderer's posting a video of the murder on RUclips. Or a Black man being tried by 12 White men. In this case it's not racism but fascism - law enforcement simply ignoring the law and doing whatever it wants. With impunity. With the endorsement of the local political power structure. A mockery of the "justice system." And you know that every lawyer in the county is aware of it and/or complicit in it. No one wants to rock the boat.

This is a kidnapping. A felony. PPA laws allow we the people to make a citizens arrest using only the reasonable force needed against armed violent felons.

Your reasoning is idealistic but flawed. Police officers are permitted to make _Good Faith Errors,_ which means that if they make an error but reasonably believe that they are doing their job correctly, they cannot be held accountable for their error.
The reason for this is that police are human beings and human beings make mistakes on their jobs all the time; so, it would be unreasonable to penalize police officers every time they make an error.
Now, even though it's obvious that the police were knowingly in error in regard to how they handled the situation in this video, they can argue that they truly believed that they were justified - and an effective prosecutor could assure that a jury buys their bologna...which is what happened.
So, a citizen attempting to perform a citizen's arrest on a uniformed officer because he or she has engaged in what the citizen believes is illegal or otherwise improper conduct is very foolish.

A police uniform doesn't allow the wearer to attack people without lawful authority or any reasonable cause. Cases don't appear before the SCOTUS because you want to go there....First the Court must accept the case and there must be a Constitutional Question . Sounds like your basic small town cops, lawyers and judges who go to the golf course together on the weekends. I'd bet the citizens are too afraid to go against the cops in court, because in small towns its easy for the police to harass people who they don't like.

I was a traffic cop in New Zealand for ten years. In that time I felt it necessary to arrest someone on exactly 6 occasions. Only once did I use a reverse wrist lock ( the hold used by the cop in the video ) and only until the person I was arresting stopped trying to break away from me. I never took anyone to the ground and continue to exert a very painful and punitive amount of force as that cop did in the video. This whole case disgusts me and I must say that those cops and the judge have zero ethics. Land of the Free, my ass.

I'm wondering how a jury can find you guilty of resisting arrest when there was no crime committed. Resisting arrest is a secondary charge. I would say I want another jury trial with new jury members, as seeing as those jurors must be incredibly incompetent. We never had any issues about guns or any kind of violence. Hell we pretty much done whatever we wanted to do and no cops were ever called. We did have a few disagreements on occasion but we always worked things out
