    I am so hoping you can take my case. The more I watch your videos the more I feel like I have solid reasoning and evidence and I know I'm not the only person at my work who feels like that. The retaliation I've experienced has filled me with so much anxiety and depression I was put on medication.

      I got false hood pretext s reasons for termination,supervisor Judy and Chf: Lou’s has harassed me in doing unsafe work afterwards,I did all my duties and tasks at 10:00 pm was forced to wash and clean Chefs sharp knives/meat slicers,Supervisor JUDY refusal to provide Jen Shadle with protected robber gloves. They Forced me to do unsafe jobs.I refused to do violation of safety.I Jen Shadle engaged in protected activities

    So I sent an email to HR about all racist remarks from a coworker. A few days later I am fired because that guy claimed that I used racist language too. Manager fired me over the phone claiming they had 2 witness about the complaints and they were still investigating my email (I was the first to complain) complains. Briefly the manager told me investigating in process. Said goodbye and hang up the phone and just like that I was fired. Nobody talks about counter accusations used against the person initially complaining.

      Sorry to read your story, which is probably more common than we realize. Retaliation is really hard, but sometimes we need to suffer for doing what is right. I’m going through a similar thing currently. God bless you 🙏

    I was just let go coincidentally a day after HR got back to me for reporting my boss for inappropriate texting behavior. Literally next day they fired me for a reason that is completely false. Saying I didn't meet my first 20 day quota which I have proof that I did.

      Same happened to me dnt waste time go to eeoc portal report it set up am interview ad gathering rally evidence of the texting submit it online on the eeoc portal.....The eeoc has a very very high rate of success in these types of employment law cases. Best of luck and DONT YOU DARE GIVE UP

      @@levitezoe1804 I worked at my job almost 8 years. I’m a guy, was sexually assaulted/battery, physically assaulted, harassed, bullied, then retaliated against for attendance but a lot of folks had attendance issues.. The eeoc starting to investigate now..

      What I've noticed about Employment Law process = it's like HR are the Witches of OZ, the Scarecrow, Tin Man & Lion are Attorneys in search of 40%+ fees, the yellow-bricked-road is Civil Court, the red-bricked-road is Criminal Court, Man behind the curtain is the EEOC, Politicians are the Munchkins, Horse of a different color is The Media....

    My work place displayed my health information for all to see in a public area to shame me for my injury at work. The form clearly said that the info is to be private to protect my identity. Is this an example of punitive damages? They had my information up for a week for all to see creating a Hipaa violation?

      I think HIPPA is for nurses and maybe HR? I am not a lawyer and not legal advice but I think taking a picture is good for building a case for this violation.
      I think removing information off background check off major sites is also good .

      Yes, you could have a lawsuit if employer is a covered entity. Punitive damages would go against the employer though not nessisarly to the impacted individual

    In Wyoming, I'm learning it's hopeless. So far, I'm learning I have no right under title 7 because of the judges. But it's not over yet. I'm going to keep fighting

    So how do you choose a good attorney? No one we know has had to hire an employment attorney. I'd choose you if I lived in California but I don't. Looked at reviews from former clients. Ended up choosing because of high interest of my case and I like his disposition. Hopefully he'll have time to work my case properly, as you mentioned, and is not overwhelmed by a heavy caseload.

      SOME counties have public cases online without any logins and looking for these cases for similar jurisdictions. Not all information is not online so you have to file public records request or FOIA the information with the city clerk if it isn't. Before the records are turned over they might have you pay a fee so you can file today and find out the costs to determine which judge is based or how that court acts . Find cases in public records for worker retailation and the attorney is listed. From there just do your research on Google and find that lawyer to defend you if he is good .

    The HR lady disrespected an employee by calling him a "Joto" which means fag and I spoke up about it and 2 months later I was terminated.

      I am a HR professional myself. My former employer suspended me, seized my phone and laptop and suspended me to had underwent investigations. Investigations were carried out and it wasn't confirmed that I violated the internal policies yet I was written up by given me a warning letter. I wrote a rebuttal and it led to employer retaliation and more follow up workplace retaliations happened including query letter and pip. I resigned later. Could that be constructive dismissal?

    My job fired me only b cus I couldn't make it that graveyard shift because I had an emergency w my mother and I'm still pending a lawsuit so I'm keeping faith in my lawyer
    And on top of that it was an unsafe work environment ! It's been two years since than and I was there for a year/half
    I went through so much stress and emotional stress because my mom was sick and I had no job
    I'm located in California and I honestly feel also that they discriminated me and I was bullied for my sexuality

    I resigned after retaliation. Department of labor found my leaving with good cause and found employer liable for my unemployment. Does this help my chances with my eeoc complaint?

      @@braniganrobertsonlaw I am a warehouse manager. I found a file with the previous managers job description which stated he should get paid for “not being a house n****”. I was fired after bringing this to my employers attention.. the excuse was tardiness.

It would have been great if you would have copied what was in the file before you turned it over to them that's what I would have done. That would have crushed them they still would have fired you not knowing you had copies but to come back would have been nice with extra evidence

      I am not sure but I always hear people gone on administrative leave like cops and I think the cops are not allowed to come back until they are told to come back but I do not know you should probably consult with Attorney or looking to public records you wouldn't want to violate a no contact order but I do not think this is the case but I am not in tourney please consult with an attorney

      To find out what they do in your jurdisdiction look at public records with the city clerk and sometimes they have online public records online for early dispositions and stuff and once you find one that is similar register with 'PACER' and file for release of those docs.
      Or if you want to find 'Administration Leave' Cases just go fishing in the internet Archive for released cases of 8,000,000 records.

      Try to find a defense or something similar of how others defend themselves just to give an idea to your lawyer or what you plan to do, your lawyer can give you options but you hve a voice too.
      ya it sort of like a soveign citizen thing to do but it's better to know something than nothing plus it's just fun to read.

    Thanks for helping the community.
    I was terminated from a
    university professor job because of title XII retaliation. My attorney
    screwed up by missing the Discovery deadline and after that lost
    interest in my case. He could not get away with representation because
    of the risk of malpractice, but lost interest in my case and continued
    with the worst representation i could imagine. Because i did not have
    the resources to hire another lawyer and the case was more than half way
    through, i had no choice but to continue. Despite my disappointment, he
    prepared an extremely weak summary judgement brief without putting
    enough time on it or strategizing the case, or disputing the incorrect
    claims of the opposition, and i lost the summary judgement. The
    rationale provided in the summary judgement is "insufficient evidence to
    prove material fact" is incorrect because abundant evidence was
    provided and the summary judgement has not refuted or referenced to any
    of those evidence, but only vaguely stated "insufficient evidence".
    I would like to know how can i appeal to move the case for a trial. As
    stated, i am not able to retain another attorney unless on contingency.
    Can attorney's ineffective representation be a ground for appeal? Can i
    self-represent? Do you have other recommendations?

    With the "Pandemic" occurring, I believe employer's are using the term Pandemic to justifying an employee "Laid off " as retaliations of many or all protective violations occurring within companies . Great clear and informative information.

      Well that could be true it also is it's just is taking a toll on many businesses even if that was the case it is not illegal for a private business to fire someone for no reason. it is illegal to discriminate against someone however against certain protected classes but usually not against his/her/other actions .this is not legal advice and I am not attorney please consult with an attorney

    Anyone have any opinions on this. I worked at my current job for almost a year. The first 8 months i never got in any trouble, 0 write ups. And then i reported unfair treatment to HR on my boss. The following week i got my hours significantly cut, and started getting wrote up for false/bogus things. And im constantly being threatened that im going to be fired if i don’t “get my act together”.

    i have a crazy one! how about Honda laying off temp employees after they said they would not!
    Previously HPE Honda Power Equipment, they merged all honda plant of nc with lawn mower, trimmer and generator (into Honda)! they after said no one is going to be let go. lately they have been trying to weed out anyone with the least problems in the temp field no matter how small the issue, as disciplinary and expendable! They seem to be making an excuse to downsize and force out anyone kelly services employee related person. Despite the meeting we attended (stating honda mowers are discontinued )over regulated) and only atv's)less regulated) no one is being let go! I have been informed (that the least of the problems) even a verbal )even once) no matter the issue you are let go! 2 weeks notice! 360 plus temp employees are at the
    end of this issue!

    10,000,000 million dollars on retaliation I'm pretty sure the lawyer can get money from the case. Deposition lost wages. Having emotional and not safety place of work. Calling people black cannot work is discrimination. They just said open a case at court.

    Is this or is this not workplace retaliation:
    I was placed on CA for not meeting a quality average of 93% in 2019 and also in 2019 my supervisor that hired me and presided over my department was promoted to another department. When I placed on the CA for not meeting a quality margin of 93% I understood that in order for me to be removed OFF of CA, I had to meet the quality margin of 93% for the next 2 consecutive quarters.
    I missed the quality margin by a FRACTION of a point (0.15) & when I discovered that, I reviewed the records that I worked during that month & realized that an AUDITOR who scores everyone’s work incorrectly audited 2 files that shld not have been audited to begin with and I brought it to the new supervisors attention. With the now new supervisor barely knowing how to maneuver in SHAREPOINT nor not knowing how the process in contesting an auditors score (as many have done in the past and the previous supervisor whom was always fair wld override and change scores if he agreed with us… if he didn’t the score wld remain) he initially agreed to review the records I was contesting that the auditor shldnt have scored & override the scores because he acknowledged i was correct, but when he spoke to the auditor inquire why she scored the records , he then became reluctant to do what he initially agreed to do. It was at that moment I knew that this new supervisor was relying on the auditor to tell him how the process worked, when the former supervisor was still accessible to be consulted with shld the new supervisor need help. I waited days for an update from the supervisor & didn’t receive an explanation until the evening of the next day & ur still didn’t make sense. The explanation he gave didnt make sense so I went to HR, emailed them my issue & asked for their assistance in mediating it. HR spoke with me following week, another zoom meeting was set up the following week which included my leadership, myself and the HR advocates assistant. The conclusion of that conversation ended with the supervisor/manager agreeing to change the scores of the 2 files and at the end of that call I knew that I was once again short a FRACTION of a point 0.15. I left that conversation under the impression that the current leadership would round that score to 93% as the previous Supervisor had also always done. 2 weeks after that group conversation with HR/myself and leadership; my supervisor & manager present to me what was titled as a “last chance agreement”. Such document or agreement had never been referenced before but it was identical to the previous CA, but this time the agreement stated that I had to SIGN/AGREE to remain on CA for a FULL year (when the maximum time a CA has ever been extended was 6 months for others), I was now being forced to come back into the office (productivity was never an issue in the office nor when I was allowed to work from home full time and I had to expect to have my quality scores micromanaged weekly/monthly instead of quarterly as it’s always been for the last 4 years. The leadership emailed the agreement and wanted an signature which would have confirmed I was agreeing/understood the terms. I did not sign it. I contacted the same HR advocate again, sent her the agreement and asked her to explain to me how it professional logical and constructive to impose more rigid stipulations on in order to KEEP my job; but none of what was required in this agreement was ever required in my previous corrective action. She and I spoken for an hour, and by her own admission she acknowledged that she was escalating this issue to her higher ups and would circle back around with an resolution. All of May and June, I continued to work from home. 6/29 I had a coaching session with my manager in which she casually informed me that the the micromanaging of my quality requirements wld start in JULY…. That was outlined in the agreement in which I DIDNT SIGN. My leadership knew I didn’t sign it & HR knew I didn’t sign & I didn’t explained why. I reached back out to the HR advocate asking for a resolution to this situation because when we last spoke in May, she hadn’t gathered all the other information she claimed she need. 7/1, I emailed the HR advocate once more asking for a resolution or update and she told me SHE herself was leaving the company and BECAUSE she hadn’t resolved my issue during the last 2 months as she assured me she would, that someone else in HR woule be reaching out to me but I could expect for the leadership to circle back around to me to clarify and re-submit the agreement with the expectation for me to sign it if I wanted to keep my job.
    I met & exceeded the quality margin for 2nd quarter & I only missed 1st quarter by 0.15 of a point & the managers refusal to round the my first quarter score was made AFTER I contacted HR.
    I received an Employee award WHILE on CA, and per the handbook, I wasn’t eligible for an award but the Manager ok’d me being nominated & I received the award & bonus.
    Ive never been an interpersonal or departmental issue for anyone while Ive been employed by this corporation.
    Productivity has NEVER been an issue while I worked in the office and it hasnt been issue the last 2 years Ive been working from fulltime. The stipulation noted in the agreement that would require to work back in the office isnt helping me nor does it have any bearing on a quality yet to stipulation CAME AFTER I went to HR.

    Are you required to "mitigate damages" by looking for another job? If so, do you have to take a substantially inferior job? By "inferior" I mean one that is unpleasant or doesn't correspond to your education and experience, not just one that pays less. What about a job that requires longer hours for the same salary?

      Anything is possible and the laws not robotic it depends on the court and the judge if he wants to proceed that way anyone could sue anyone for anything I would think in this case it would be for fraud on your part or the employee's part or whatever if the company was going to sue if the company you are speaking about is privately owned it might be different than publicly owned. The best case for the best answer would be to look at public records and see how judges have done those cases in the past usually on County websites you would be able to find the public records and if you are not able to find them online you have to file with the city clerk obtain those records.     Branigan, I was fired in 2014, and In my case I won Wrongful termination/retaliation in Jury trial/Appeal and the court awarded lodestar compensation for attorney's fee (approx 2M dollars) and the attorney quit. Now a new attorney has to file a new case on discrimination as this charge was not brought up in court case (2016). In 2018, I was reinstated at lower salary compared to male colleague. How is attorney fee determined as I have not received the compensatory damages yet. I need help.

    At home since March 18,2022 was supposed to be back at work lite duty no use of right arm hand. My manager lied to me that I can’t come back tell workers compt said well they did my manager lied said I can’t she doesn’t know I talk to my compt worker so I’m being denied.

    I was retaliated against after I reported a man at the job for sexual harrassment because he lied and said that me and him was having sex. This rumor spread all over the daycare and was told to new workers. People at the job including the administration started treating me differently and when I complained and was later fired. This happened at a daycare center at a church in Birmingham.

    What if someone puts in a 2 week notice because they are accused of something with no proof several times, gives a two weeks notice and makes clear they are quiting in two weeks because of the constant accusations, so they terminate you prior to the two weeks and dont even tell you 4 days prior to you qualifying for your quarterly bonus to avoid paying you the bonus.

      Well this is not directly answer your question you may be able to get body cam footage from public sidewalks but I do not think into party states that you are able to record a conversation made in confidence that is why it's important to record only in public places and that is usually in the statues at the time it is amended as it is always changing. This is to help against he-said-she-said that and if the person you are being attacked by his lying to the court you will be able to collect information that can be used against them in court if they are found to be lying to the judge you should check out person in it audit to determine what a reasonable person or what our constitution protects of the United States of America to record and to have freedom of press this is not legal advice and I am not in tourney

    I’m going through it Wright now I’m the only African American girl here for 16 years. I was hurt and not allowed to follow dr. Order and I have every retaliation convention on recording and this is being done by the owner and my manager and none of my co workers including my supervisor not allowed to talk to me and I have a text from my supervisor specifically saying just that. They follow me they park outside my apartment I can go on . And on recording my boss the owner claims he pays me twice the amount on my w2s.

    oh my gosh where was this video and where were you all when I was getting harassed at work at temp agency two different jobs because of my color being white... four months they would say the girls there were black they had white boyfriends and they would say the most horrific things to me. but another African-American girl that just started had had enough of them doing what they were doing to me so she went to HR turn them in. Needless to say I got two weeks paid
