      Hey, I love that you're doing these videos. One sort of blackhole of employment law/protections is law school faculty hiring/pay. In CA, there are unions - but these unions seem to actually obscure the very real violations going on. Do you have a take on the violations with respect to adjuncts and basically all non-tenured faculty?

    Great video. I am currently John Doe suing another big school attorney with over 20 lawyers under him for sexual assault. I have him down on his knees now and he’s already haggling numbers but nothing desired yet.
    He’s going to risk everything just by going public. You have no idea how comforting it was to listen to this whole video

      Becareful if they think there is a chance you will go after them you may find yourself faced with a scheme against you so that they can force a minors compromise (one that u will not get an accounting to- false cps claims against you (a case that can total 150,000k to 1 million while u will not be able to work as u fight to get ur kid back and complete all there court ordered services.....TAKE HEED The office of the county counsel (who is the big daddy charged with defending public servants, school districts, boards, CPS, ect) will orchestrate the whole thing.

    I was involved in a car accident once, and when the paramedics arrived I was standing, mobile and cognisant. As the paramedics asked if I felt fine I said other then a headache and a stiff back, sure. Although the back of my neck felt cold.
    Oh shit. So they strapped me to a board, rushed me to the ER and I got laid on a bed for over four hours.
    Turns out, my heart rate after a car accident was about 24bpm. The doctors felt something was seriously wrong.
    What had occurred was my heart slammed into my ribcage, bruising it. This, in turn, threw the rate out. I was diagnosed with bradycardia.
    Later, my cardiologist decided I needed a pacemaker. I refused and opted for diet and exercise.
    During the discovery process my cardiologist was asked if he believes the car accident was the cause of my drastically reduced heart rate. He said that because I had a lower then average heart rate within my medical history my entire life, he could not medically say the car accident CAUSED it, only made it worse.
    And that, my friends, is how my $300,000 lawsuit was worth only ten grand.

    To clarify - lawyers don't turn down settlement offers. Lawyers are ethically required to bring offers to clients to accept or turn down.

    Yay! So glad you're doing a video on settlement. THIS IS THE ROUTE employees should be taking! Why? Because winning at trial is usually a Pyrrhic victory - even if you win, you've made yourself virtually unhire-able.

    Thank you thank you! I know your time is extremely valuable and for you to take the time to help us who have suffered is really amazing. I was searching for days for an attorney to help me with my discrimination case and I was told time and time again that unless they call you out of your name or make a derogatory comment to me I have no grounds for a suit.     Great video Branigan! Would it be possible for you to make a video about accepting a settlement, but the settlement failing to cover the lawyer fees, emotional and other health damages that exacerbated a previous disability (i.e. PTSD). Would it be possible to ‘reopen’ the claim and account for this unforeseen damages?

    Love your videos and especially this one. Some of my colleagues who get “hollow verdicts” in MVA cases (meaning $300k or $500k or more in verdict with like a $50k or $100k insurance policy (verdict will be knocked down to the policy) does not require anything special. In bi cases , with very large insurance coverage available and catastrophic injuries requires an immense amount of work (basically at least completion of discovery) and convince the other side that they will get destroyed in court. It takes a long time

    Im going through a blainttend discrimination case. I have much of the evidence encluding sexual harassment and cover up. The CEO fired me to cover up a colleague who was the woman that harassed me and did even worse to our entire department. Putting together a case like this, I needed this information to help me. They did not know I have recordings and other proof.

    Mr. Robertson I live in Upstate NY. I've spoken to 41 legal aids and two actual attorneys. Everyone is back logged or doesn't want to take on a litigation case. I filed a claim with the EEOC for gender discrimination and the EEOC took two years to "investigate" . Before finally telling me on August 5th 2024 they couldn't find evidence that they broke the law. Which traumatized me even more than the discrimination itself. NY has very little protection in place for workers. My mental health has been declining rapidly since the EEOC decision. It's beyond me how they can escape without consequences, when meanwhile I'm barely surviving mentally, physically, emotionally, and financially. Sir, I honestly don't know if I can heal from this unless justice is served. Any advice?

    I’ve thought bout just going to a news outlet to show the screws in my foot. My fmla was approved but they kept ignoring my doctors updates so I’m hoping I have a good case. Sucks that I lost the job I can’t even afford therapy with another kid on the way. Just trying to scrape by to the next update and see what’s the word. Bout 15 more days!
    I dunno I would imagine economic damages could be worst lower, they put me out on my bills consistently but the trick is getting it done quickly or funding yourself while everything is going on which is stressful and exhausting emotionally mentally and physically. But the disability dept had me hold when I requested my disability forms after the termination then said they can’t give me them, 2 weeks later my lawyer made the request. But it’s been a struggle staying sober and not being impulsive and irrational. Not to mention my pregnant wife’s been on a sick one about finances

    How do you know or find out if an attorney has a good reputation inside cases or in courtroom? Reviews online can only go so far when trying to find an attorney. Thanks for the great teaching on these grievous matters.

      Excellent question. And I don't have a great answer because, you're right, online reviews only go so far. To make it even more difficult, I know some absolutely amazing attorneys who have terrible online reviews. My recommendation - if you know a lawyer, and ask them for a referral to someone who specializes in the area of law that you need. I actually refer out a lot of cases that come in through my office to other employment lawyers who are better than me at certain things. Another way to do it would be to consult with several lawyers until you find the one you really trust and connect with. I know I'm not giving you a perfect answer, but I think you see what I mean.

I honestly think the corporatization of law might make for better client outcomes (since it’d be a more standardized experience), but as an incoming 1L that’s the last thing I want to see :)

Now I'm going to hire an atty in my state because I believe I was wrongfully terminated in TX. I know its an "at will" state but I think I still have a case because they ignored my medical mental health docs i turned in and had an outburst which cost me my job.

    I heard that there is a 90 days window for retaliation between filing for protected activity and final dismissal. If the final retaliation > engaged in protected activity by more than 90 days, you will have no case. Is that correct or not?

      Not at all. Obviously, it is easier to prove retaliation when it happens right after the protected activity. But temporal proximity is only one thing we look at. We look at lots of factors.

    Doesn’t matter much if you sign an “at-will” contract for employment with most companies these days…it’s not that easy. Plus it’s hard finding good attorneys that want to even accept your case to begin with..

    Do I should get first the right to sue the employer from EEOC? It takes 9 month for the EEOC give you the right to sue in federal court only if you win based on their interviews. When the lawyer get involve then?

    Amazing material! Ok, i got my answer to the other question I previously asked in the retaliation video! Wow, i didn't realize how much "stuff" goes into an employment lawsuit! I noticed that u never mentioned EEOC mandatory requirements before seeking an attorney? Is it because California is exempt? I jus saw your channel tonight and havent watched all of the videos yet but if you are aware of it, from a lawyers perspective, what does an attorney think of cases that are provided w/a right to sue notice? In Hawaii, we have a limited pool of attorneys to chose from and unfortunately most or all of them do not work on a contingency basis but just, are in the mido of a case or cases, and/or will flat out refuse to take the case! I am starting to think that you have to pay a large sum upfront to just spark an attorney's interest in Hawaii! What happens if you get an attorney, but notice soon after that your attorney suck at negotiating ability? What happens then?

    I am in California and my case is overtime violations. But i think a lot of points are applicable.
    Not a problem, what has happened to me is pretty jaw dropping on its own. I have not been paid overtime that was owed to me in almost 10 years.
    And during that time i would not say anything bad about the owners or company.

    I have been harassed by old coworkers for years. They stole 30k plus dollars, record my calls, hack my pc. They stole and also commit fekobjes . Prevent me from working jobs I want . Lost wages , emotional distress , they force me to lose my job multiple times

    California is known for giving outrageous settlements that most other states do not.

      That's kinda true and kinda inaccurate. Where you're right is that we have removed artificial caps on damages in many areas of the law. That allows juries to give more money when they feel it's deserved. Most other states limit damages in some ways. That drives some settlements higher here. Where you're wrong is that we have 40 million people in our state so we just have a lot more cases come out of our state. And since it's been popular to pick on CA by some groups out there, they amplify the verdicts and settlements and say we're out of control. Which is not true. It's really hard to get a big settlement as my video outlines.

    Enjoy your vids. Called your numbers and they didn't work. I had a layer and a winning case. Not a lot of lawyers take cases like this. Heres some math. 94M filed in civil court here in Maryland. Lawyer was threatened and dropped case. Threats were toward his career and personal life if he finished case. The judge called us to his chambers because the others were worried....thats 5 law firms against us. Judge was excited to get case going. He shared a personal part of himself and said he waited all his life.....for a case like this and was the reason he studied law. He grew up around injustice. 94M could have opened many law firms. Life goes on.

    Can you do a video or two on finding an above average attorney. If I needed an attorney how can I tell if they are any good? It is like buying a used car. Unfortunately, I have had to hire an attorney twice. The first time I got lucky and had a good one. The second one I wouldn't hire to scrub toilets. What are the qualities you look for if you were going to hire another attorney for your office?

    I've been at a company for 7 years. I'm one of the few Caucasian people still on the team. Our African American boss is making my life a living hell and breaking the law. I have documentation. I feel like they won't resign me after this year.

    What if your employee tells you that if you quit you can still work in the same school district just not at that school. But, if you get fired after an in estivation is completed you will never be able to work at that district again. To date I was turned down for three different jobs because of what she had said.

    I am a owner of a company and I had a contract with a condominium and because of the way the new association are operating and I saw it’s a problem for my security guards so I decided to give them 60 days to find a new company to replace us and for that reason they decided not to pay my invoices for over a months now. And I don’t exactly what can I do about it

    I live in Colorado and your video is very helpful. I do have an EEOC Charge for 1) Retaliation and 2) Age - I am 60 years old. The CEO reached out to me to mediate, which I am fine with, but only wanted to give me 7 weeks severance. I have enough emails / conversations (it is legal to record conversations in CO) for proof of both charges. I just need to know how to negotiate before I reply. Thank you for your insight.
