      %100 agreed I've had a ment disability and fired for performance even though I was working alot of departments and ended up getting fired for it because somethings I couldn't get to it and now struggling I'm filing a lawsuit because I work so hard and get screwed over afterwards

    What is ENTIRELY being missed in Discrimination Lawsuits are Mental Health Discrimination in the workplace. I’m 2016 I entered a Complaint, and I ended up settling instead of a trial. So in my eyes, I won and BROUGHT ATTENTION TO THIS TYPE OF DISCRIMINATION. Most people with mental health issues don’t even realize that they are covered under ADA. I am currently in the process of preparing another complaint, and I didn’t use a lawyer last time or this time. I’m very knowledgeable in law and very knowledgeable about every incident that happened to me. The DOHR even commented that it was the best layman’s Complaint they ever received. I’ve told everybody I know, no matter how much you love the job when you get it, document everything! I’m asking for past & future earnings this time. I’m 63.

    Great video!💜 I think you’re spot on with extraordinary circumstances. I’m working with a lawyer for fmla/retaliation/disability discrimination and thought I didn’t have a case because I had quit. However, the stress from discrimination and being unable to use fmla to treat my condition created a monster flare up on Christmas Eve of all days and I could no longer work, and was so autoimmune-sick that I didn’t even have energy to take medicine or eat. I learned that it’s really worth it to have a lawyer evaluate your circumstances. I’m unsure how it will turn out for me, but I’m really glad that I’m standing up for myself and my rights!

      I just read your post I am going through so much at work I’m being racially discriminated I’m being Disability discriminated and I’m being retaliated against and I’ve been getting sick to the point where I’ve had an up in the hospital and the stress has been so much on me and I’m bout to give up and I read your post I’ve been watching these videos if you could please send me a response and guide me or should I just called his attorney but my case as cases overlapping cases and I have the proof Just need little direction again if you can help that would be great🙏

      Definitely contact an attorney! I would still continue documenting everything as much as you can, but an attorney would be able to give the best guidance for your situation. I recommend looking up the ones that are the “we don’t get paid unless you get paid” kind!

      @@The49ers23Call an attorney. I have IBS with a tortuous colon diagnosed by a gastroenterologist. My employer said they cannot (meaning will not) provide accommodations for me to use the bathroom. At my job, I sit in a patient’s room from 3.5-6 hours and can’t leave, can’t take a drink of water. None of this was in the job description. They forced me to go on LOA. They told me specifically that I am not allowed to work, do continuing education from their website, nothing. My regional manager told me that he sent some emails to my work email and if I need to communicate with him further, then I need to use work email. I told him I was told not to work or speak to my managers at all and checking my email is considered work. I said I’d be more than happy to come back to work. What accommodations do you have in place for when I do. They told me in writing they cannot accommodate me. So I got in touch with a pro bono lawyer and we have a meeting set up

    Most informative overall vid on this topic I’ve seen. I am heading into EEOC mediation as an aggrieved plaintiff against a city government in a few weeks, trying to get the total lay of the land.

      @@ForeverYoungKickboxer I settled in mediation. It was less than hoped for of course, but it was something (equivalent to about a year's salary). My lawyer absolutely blew it. I ended up doing nearly all the research, and handling the mediation myself. She just sat there silent, and tried to get me to settle much lower. I just kept saying no, and got twice what she told me to settle for, which was still only 10% of what she'd been telling me for weeks to push for. I was mad enough at her she ended up waiving the balance of some fees she billed me for, when I told her I thought it was unreasonable for me to pay her anything more above my retainer (I was particularly annoyed for all the charges for my sending her all the case precedent research I did, because she didn't have her own staff do it herself). I was over a barrel and needed the settlement soon. I couldn't wait another year for a court case, and she proved herself untrustworthy and ill informed, so I would have had to find another lawyer anyway. A mess.

    I am so grateful Branigan for your brilliant education of us RUclips students. I currently have considerable settlement leverage acting pro se in my employment case. I may have just secured counsel; right now, we are considering amount for demand letter. Thus far, via EEOC Position Statement, Employer spelled both my first and name wrong 🙄 (but thank you 😁), contradicted their own reasons for firing me (stating everyone needs to stay home still symptoms disappear, but they fired me for being sick?! After I had a bad reaction to flu shot for which they refused to accommodate waiver.) They provided not one piece of documentation, while under my name is Evidence 1, 2, 3, ...6 and counting. We'll see!

    I actually went to the emergency room with a panic attack a day after I was fired for being a “witch” my boss said we don’t want “witchcraft here” after finding out about my youtube channel that I read tarot. I also started seeing a psychologist for depression and anxiety as a direct cause by being fired. My youtube channel suffered I got too depressed to post videos.

    What can I do if my workplace doesn’t have an HR? My workplace is a private own market and they’re bs right now! Poor management and lying overdramatic supervisors. I’ve approached the store owner about the harassment and issues I’ve been dealing with and all he told me was either put up with it or leave if I don’t like it. Is it wrongful for him to tell me to leave the job? Cause I believe it is especially when I’ve done nothing wrong. They’ll be accusing me of things I haven’t done to. He’s always siding and finding ways to cover up the fake managers even when they are bold face lying infront of him and he knows smh. They’re trying so hard to get me to quit to the point where they cut my schedule to 2-3 days only and I usually work 5 days. And they’ll be trying to find every reason to argue with me and to write me up 🤬 They cut my days to after I requested the weekend off for my aunts funeral! What’s ridiculous is how they make fun of me or mock my language when they’re working in a Asian market 😒

    I quit a job, without going into details I'm sure it's a constructive discharge. I applied for unemployment, and put that I quit but wrote in constructive discharge and the reason behind that... Company didn't fight it, my UI claim was approved within days. I wonder if my company not fighting my UI claim can be evidence to support a constructive discharge case in court? Great videos.

      That’s crazy, I worked at Walmart for two years- was r*ped by a former Wally World employee and when I told my manager- she fired me while I was supposed to be on LOA. It was a domino effect of loss and despair. My mediation is this month 🌺

    I have a speech impediment and i caught the owner and the supervisor talking about I can't read, i never told either one of them i couldn't read they just guessed that because it's hard for me to speak, i was the supervisor and never got paid for it, then i was demoted and a male from the other race was hired and paid the money right away, do you think i have a case?

    Currently going threw a disability claim with the community live in. Over a face mask show of force. As I informed the community I have a mental impairment. And exemption under the state mandate. This lead to what was called disordly conduct. Tickets for no mask. Trying to talk civilly they then tried calling cops entrapment of me and a flee to saftey crossing state lines while family went threw trespassing of public saftey. As well as a attempt to loose my child. And loose of work being self employed. Thanks for the general information. Got my wheels turning.

    I wish u was licensed for Nv. I was hired at a company for a manager's position the person whom hired me was so respectful. Then that person's boss arrived on the work site was very rude and decided to change my paperwork and said they don't want me to be hired as manager for the company i was judge by my race not on performance at work.

    I am in California. I experienced sexual harassment and I complained to management with details in writing. I still had to work closely with this person. When his girlfriend who also worked for the company found out she bagan bulliying & age discriminating me (California work age discrimination is age 40 and I am 41) . I also put that in writing. Well after putting up with this for a month & management ignoring me I ended the bullying & had a major argument with the girlfriend (no physical violence). I then reported this to HR and then we were both suspended then I was terminated. They denied my EDD benefits so I appealed. The manager lied in court said I was the aggressor so that is why they fired me. Judge asked management did the other party get terminated he said no😮😮 Judge also ask why did it take them 30 days to fire me if I was so violent? They never investigated my sexual harassment complaint. Waiting on results of appeal. Also reported them to LB for not paying me after termination. Also have a letter saying employer needs to pay me for not cutting my final pay & California fines but they have a right to dispute which may take longer if they do.

    I could not find a a lawyer since I was terminated as an at will employee but I was recommended to go through the eeoc for my state and already filed and just waiting on the company to respond to the complaint. Crossing finger

    It's very helpful video. I didn't know that the company might be responsible for my future support in case of my lost h1b and staying without work while I expect work permission as asylum seeker and also the company will have to compensate my future looses because I wouldn't be able to get a proper work being asylum pending person up to 8 years.

    As a full-time employee, How can you tell if you are fired, if your employer refuse to communicate verbally or written and also ask you to return your keys and stop proving work? Because I was sick ( under quarantine) also withholding your cheque days after you were supposed to be paid.

      Great question. If your employer is not communicating with you and you are ready to return to work, I would send a few emails saying that you're ready to return to work. I would also politely ask to be paid for the monies that are owed. If the employer refuses to communicate with you, put something into the follow up emails that says, "I'm going to assume that you've decided to terminate me if I don't hear back from you soon." If they don't respond, then you have your answer and its pretty much in writing.

    My son has protective supervision hrs of 221.55 and the surpervisor deleted my son Faustino from the portal because I couldn’t be he’s provider and she was giving me the email to send documents and those documents never found and she asked me do u know what a hyphen is

    Mr. Branigan, thank you for the video! My case was wrongful termination and I won the Jury trial and Appeal, my attorney was paid his fee and then he quit. I recently filed a DFEH case on salary disparity, since I was rehired. The university wants me to retire as I am 63 years. Numerous documents on the trial court website state that they (university hired lecturers who are cheaper and younger in age). The discrimination and harrasment is ongoing. My low salary has also affected my pension benefit. A) Will I need to go through another Jury trial for discrimination?

    I need help please . in 2008 a coworker and I filed a charge with eeoc against our employer Aurora public school . Your employer was found guilty . They wanted to settle for 50.000 . So I wanted my job back but , the lawyer said , the didn't think they would give me my job back .So , I wanted to settle for 70.000 with my lawyer fees paid . I didn't hear from the lawyer for over a month after we spoke . When I called him , The said , the send the case to the federal sector . To this day they never paid me the settlement . every time I asked them they give me the run around . can you help me ?

    Hello. I am in need of some help here. My job was found guilty of Discrimination. But I was paid no where near this. Also a retaliation claim is filed. How can you help me here. It says in the discrimination settlement. It clearly state that I had no help at all with the matter.

    Hi Branigan, I'm not in Cali. Would this be a discrimination case? and I know it's just your hunch, not official "legal advice" what would your gut run with.
    Fired during work comp and post heart operation, lost all insurances to even know recovery progress. Can you touch on being fired after a heart operation? Within 2 months after an operation, 6 months after short manhole structural failure falling to knees inside and breaking ribs on lid.
    plus you may find this case a fun thing to think on.
    While we know a heart condition does fall into the ADA's protection, since nothing was already set up with the ADA & employer, can that still be considered discrimination, Or at least a discriminatory act? it's also confirmed beyond a doubt that the company used a false pretense for the dismissal claiming department downsizing while transferring other employees to a new department and letting me go. All while saying I was eligible for rehire. Sidenote, There's over 100 positions in the company so always something open, they had been advertising for open positions just prior to my dismissal, my supervisor at the time I was told was the actual head of the supposed department that was downsizing, so I wasn't informed offered a chance to transfer. When I went to the main office on the day of termination I picked up new printed assignments from one of my other managers and this means none of them had any clue I was about to be hit with this. Lastly this is following a work injury where a structural failure happened 6 months prior and I fell into a manhole 3 feet deep and broke ribs.
    It feels retaliatory if not straight up discriminatory for having recently taken PTO for a heart operation.

    Question: how does an Autozone worker making $10 an hour get punitive damages of $180,000,000.00 if the cap is set at 9 x compensatory?🤔

      Great question. From my understanding, the underlying compensatory award for that worker was around $1m. The jury, being unaware of the 9x cap, awarded her $185m. My guess is the Judge cut the verdict down to 9x shortly after trial. So, unless the defense lawyers were the worst in the history of the world, there is no way that worker got the full $185m verdict. Most of the time when the public hears about huge verdicts like this, the plaintiff doesn't get the full amount. Post trial motions & appeals usually cut down huge verdicts.

    Great vid! If fired, took them to court and got reimbursed for damages, can the former employer damage my reputation among other employers in that industry? Meaning, can they place negative reviews on my social media profiles or disclose the case in general with my other potential employers. I live in a small town (53k ppl) and worried if taking my former employer to court will damage my employability in this town. Thank you.

    I'm 50 years old and El Paso Tx is the most discriminated city in the United States of Amercia at job sites. Hate discrimination from your own people and I wondered why I am bipolar, etc etc. I have left El Paso most of the time went to 7 or 8 cities and 3 small towns. I come back to El Paso Tx and it is still the same discrimination at job places. Nobody cares managers, supervisors, assistants supervisors, Ethics. It is all bunch of crap. Even big companies like Amazon. There is a lot of Discrimination where I work at right now. BULLSHIT.

    What happen if I was fired before the 3 months of proof. I was working for a federal agency for temporary job, that is suppose to last 6 months, but them made me sign the letter of termination when I was about to rich the 3 months, because I was afraid to drive in canyons, they add another phobia that I really don't have, they said because I was afraid of dogs too?     Where were you when I was presured to quit and humiliated by new manager in my department at this conglomerate type company I worked for 3 years in IT before him. He was actually fired after a couple of months for laying to other subordinates that used to be in my team mee being the team leader. There was upper management avoidance/negligence to handle the issues reported by me or other team members after they hired the new manager.

    i was fired from work due to my severe ADHD and wrong fully acused of doing something i didn't . my lawyer completely took adavantage of my mental condiccion and settled for what what's worst to them. they did not filed a lawsuit against discrimination, wrongful termination. all i got was a settlement. of $20,000 out of violation of meal and break, they kept 67% of the settlement and left me with almost $50,000 worth of debt. i want to file a grievance against this firm. any recommendation?

    Thank you for this video! I recently was fired from my job for choosing to NOT take the experimental Covid-19 vaccination even after submitting my religious exemption within the time frame requested. I am in Arizona and have filed an EEOC Case. The company has hired a HIGH dollar attorney firm and I cannot afford an attorney. What next?? SO SAD!!!

They all pretty much said the same thing…. “This is all so new part of law dealing with Covid that there is no way to predict any outcome. Because of that, I would have to charge you by the hour which is terribly expensive.” Because of this, the big companies have the upper hand because they can ford to pay MEGA BUCKS to the big law firms only to have cases dismissed because you cannot afford high dollar law firms…..     I just applied to an armed security position and had a psychological test w their contracted doctor. In the interview he asked me if I have a disability from being separated from the military then proceeded to probe what my rating is. He said since its anxiety I would never be able to work for the company and he would not recommend me. Is that legal ?

    Let's say you were discriminated against and harrassed due to your disability and have been working for the company for 19 years and planned on retiring with the company until they harrassed you and you seeked a pshychologist and therapist due to harrassment. Also your 35 years old and had to quit your job cause of this. Would they take that in effect if you were going to retire with the company?

    My advocate send fax and email and she never responded back to her I’m been dealing with her supervisor and the social worker from ihss I’ve summited a claim against them too taking benefits he’s benefits away from him by giving me 18 hrs per month

      Let me rephrase.... I was openly racially discriminated during work. It was immediately reported to a supervisor & another employee rep. I was told the coworker admitted to the allegation. Later,I was told it would be an investigation. Haven't heard back sense. The coworker still remains employed.... this was over 6months. Do I have a case still?

But whether or not you should pursue the case is another question altogether. So, I recommend you call a lawyer in your state for a consultation.

    Great info. In reality . A injury from incident at employment place . Never gotten proper treatment and doctors are probly right from statements and referring that's it's natural due to aging. But a none work place incident related but from another earlier incident date. Redresal in federal court , discrimination tort not filing report until later date and fraud committed as incident date is wrong . Not getting medical treatment from getgo even tho Dr's are probably right that's injury is normal as aging of disease. Surgery needed. But issue is...why hide info real date and why didn't tge Dr's informed me from the beginning of all this so at least I could of been informed and addressed it on my behalf understandable

    Predatory lawyers get rich by gaming America's lawsuit culture.
    This is the reason why we have to have labels on the packaging of fishing hooks that reads "harmful is swallowed" and why children's playground equipment doesn't spark the interest of a child over the age of 5.
