  • Criminal defense attorney Neil Rockind is an advocate of Killer Cross Examination. Here is a video of a case in 2010 from a cross examination of a Michigan State Police Trooper who the defense contended arrested the accused unlawfully and then misrepresented himself on the stand.       Where is the evidence that the officer ‘lied’ ? And the defence lawyer did not get the issue of the ‘bottle’ thrown out, it was not pursued because there was no physical or other corroborative evidence to support the officer’s contention.

    So basically there's ZERO evidence to support the cops testimony that there was an open beer bottle in the cabin area of the person's vehicle and The People are just expected to take his "good word" on the matter simply because "that's how we've always done it". I see a BIG problem doing it this way because it places an awful lot of latitude in the hands of the cop and by not having to ever produce any real evidence to support that it happened, aside from the cop merely saying so, the cop could just make up anything about you if he chose to.

      Little Byg Matt it sure was a killer cross examination. I’m not sure if you have the complete concept of how a court works. Basically the defence destroyed any credibility of the officer in the witness stand. The defence made him trip, and step over himself, made him give different answers for the same question (even though asked differently) basically showing he can’t give a consistent story. The biggest thing is though, the fact he contradicts himself. That’s the real killer part. I’m not sure how you didn’t see this, hence me saying, I’m not sure you understand the concept of judicial work.
      But that’s how!!

I’m sorry for whatever life experiences you endured for you you to automatically assume that I’m trying to take a dig at you.
      Not really quite sure what point you’re making, apart from giving insults and making assumptions lmao. The officers credibility was ruined, and that’s that. Nothing he said would’ve been used as a credible statement.
      But hey, take a breath, not everyone is out to get you mate. You don’t have to resort to being defensive when someone slightly disagrees.

      Your ego was then hurt probably because of the first few sentences of that. From that you’ve spat insults to try and build yourself up 😂😂
      You misinterpreted the text, and read it as something against you personally, but it wasn’t.

    Open container law should of never been passed. This law has been around for about 20 years at best. Before if your passenger was drinking you were fine, but now they can charge the driver if he is in reach of the container. Just another law for the road pirates to collect revenue and power given to harass the citizens. Which in turn further pushes the divide we see today between the police and citizens. It's crazy that they view themselves as being different when wearing the badge. If he had known this individual he would of let him go, but choose to enforce a bullshit law. That's why many hate the police, they are their own worse enemy.

      That is very true that cops are their own worse enemys along with the training they are given these days. When they are out with their famileys most are normal like everyone else but once they put on that bule clotheing and the blue line is on their minds they see every person that does not ware the same costume in a different light. I thing allot of what is going on with them is power trippen and when they see other cops doing wrong the good ones are afraid to speak out as many have been sack and treated like crimanels by the force at large so I just said the good cops but they are not good if they dont speak out when seen cops break the law.
      I do know one thing the younger people are seening what is going on where as we didnt have ascess to the net and It cant go on like this for ever..

      You you’re missing is that cops don’t make the law but are charged w/enforcing what the legislature passes. You should direct your animas at the elected idiots that pass this junk, not the police. If this trooper failed to follow policy that’s a different matter than what they enforce on the street and he’ll be subjected to discipline from his supervisor. Pouring out booze rather than seizing/inventorying it is a stretch and a stupid lawyer trick to get his client off.

    I like how they stopped the attorneys cross examination from showing that the officer had failed to follow protocols, thus the whole arrest was faulty and the case should be thrown out, regardless of whether the alleged actually committed a statutory violation or not.
    HELLO!!! Can I get an objection and a ruling! Point of conclusion. I've shown proof that the officers conduct as unbecoming the office and destroyed evidence which is a violation of the oath of office. This is an appealable issue.
    Nothing to see here folks, move along, move along. We just making it look good. Go to jail.

    I wasn't aware alcohol turned into nitro glycerine after being stored for awhile. My dad has hard liquor in his garage that he's never opened and has had for years and he's never had any issue with it exploding. The cop said they dump the alcohol out because of issues with fermentation? I wasn't aware that after the process of making the alcohol it could ferment further ,also he said they dump it because of explosive concerns. That all sounds like a load of crap. None of sounds like it's scientifically based. Of course I am a moron and could be wrong but it just don't sound right to me

      High proof alcohol evaporates. People fire potato guns with everclear. I doubt all the containers have a tight seal. The cop could have had better evidence without storing the full bottle, but I get their desire to not have their evidence locker smell like a bar at 2am.

I can tell you this....I left a plastic bottle full of tomato juice in front of my window, it was forgotten when I flew to England. It exploded everywhere!     You would be surprised how many people in law enforcement do not know all the policies and procedures they are supposed to follow. That is the fault of the training systems and supervisors. Those policies and procedures are there to make sure that arrests and prosecutions are valid.

      Michael in Houston Hey Michael...I once lived in Michigan, and my roommate was a Michigan State policeman...we were friends from.high school. When he went through the program, it was 22 weeks (I just did a quick Google search, it is now 26 weeks). Does that shock you?? It sure does me, 6 months training is all it takes to become a state police!!! It takes 8 times longer to become a nurse...It took me almost 6 years for pharmacy school....I was shocked that all the training they got was 6 months for such an important job such as a policeman.

      I am sitting here stunned - 26 weeks? That is amazing. As important and difficult as being a cop is, you would think that training would be much longer. I need to ask a local cop how long their training is. Our neighborhood has off duty cops patrolling a few hours every day during the week - I am going to ask one of them about their training.

    Watching a good defense attorney work can be immensely satisfying... my own lawyer, like the lawyer here, has a unique way of cutting to the heart of a matter while taking you along the logic of their argument wonderfully. I often think I missed my calling, but 23 years on tour as the lighting director for a band has been a lot of fun so far :)

      Many, if not most, states consider an unsealed container an “open” one. If dude’s got a BAC above .08, all the worse. Cases are prosecuted without “visual evidence” all the time. It’s called police testimony and the court is to presume in its favor.

      Veronica Gombar True... But once you demonstrate and establish that a witness has lied or committed perjury, that witnesses testimony can no longer be deemed reliable. Defense attorneys often bring up past misconduct of police officers to discredit them.

      I know of no state where the level of witness credibility has been codified or explicated in case law. If a witness lies or commits perjury (usu. referred to as “impeachment”), it is incumbent upon the fact-finder (a judge or jury) to decide whether/what specifically and to what extent they choose to find credible re: a witness. Credibility (from what I remember from jury instructions) is usu. to be based on one’s experience and common sense (assuming you’re a reasonable person).
      Defense attorneys can argue whatever they want. Different attorneys keep their own bags of tricks.
      This might clear it up for you: even the worst, most dishonest drug dealer - once he steps on that stand - begins with the presumption of 100% credibility. It is up to the cross to tear that down - often lawyers know how to do this in underhanded ways that they know deviate from the real issue at hand. Going back to the presumption: it stems from logic; that being that past behavior is only the best PREDICTOR of future behavior. A PREDICTOR is just that. I can predict that it will rain tomorrow, or even try to increase or decrease the percentage of its likelihood or manipulation your perception. Ultimately, it’s about explaining my rationale and how much you, as a jury member, are willing to buy that based on the logic I present vis-a-vis the direct and cross examinations.

      while that may be true on a simplistic level tell that to the untold numbers of people who have been locked up for crimes they didnt commit. the amount of new laws that are passed each year virtually guarantees that the average person will be in violation of some law at some time. I have tried to live my life in such a way as to not draw attention to myself. as to this video if he dumps out the evidence then how could they possibly even have a case without the evidence? this lawyer handed the cop his ass. he even gave him copies of the report and policy . sounds to me like the cop wasnt following the policy which is a shocker there. The cop cant explain why he does what he does.

      I think the judge knew the defense had this trooper and wanted to help him save face.There really is no need for expediency, the pace wasn't that bad. Plus he interrupted the defense more than a time or two.

    i had to hire a public defender in my "trespassing" case.
    i put trespassing in quotations because i was on public property. i was riding my bike and the police came up and said "hey you have to stop riding your bike, you dont have protective gear." i then responded "in the state of Maryland, you dont have to have protective gear while riding a bike, unless youre under the age of 16." They then told me "well you dont have reflectors on your bike" , i then responded "in the state of Maryland, you dont have to have reflectors if the road youre riding on is well lit within 1000 yards, and doesnt exceed the speed limit of 55mph." They then got irritated and said pedal away, to which i responded "But am i right? im not doing anything wrong." and they came over and slammed me to the ground, i said "im not resisting" and they put me in the car. The dispatcher came over the radio while i was in the back of the car, and said "what are you going to charge him with, disorderly? The cop said "No, i think ill get him on trespassing." At that time, i was not aware of the property lines of that place i was at, but found out later it was public property. So it got thrown out right? No. i hired a public defender, and didnt even get to meet with him until 5 minutes before the hearing. The public defender said "oh this is easy, well put in a plead of not guilty, well explain the case, and youll get off no problem. We got up before the judge, and the judge said How do you plea, and my public defender said Guilty. i looked at him and asked what was up, thats not what we tallked about, and he said "if you plead not guilty and the judge doesnt believe your story, the charges will be more severe. i was convicted and my punishment for riding my pedal bicycle on public property was 18 months of probation, 1200 in fines and court fees, and 50 hours of community service.
    Moral of the story, always have a good lawyer. i have since learned that i was on public property, so i could have beat the case. I was also denied a phone call for all 16 hours i was in holding. I have an Associate Degree in IT/Cybersecurity with 4 certificates, that i paid alot of time and money for that are now useless since no employer ive contacted will take someone with a charge due to having to have security clearences (not even misdemeanors).

    Damn, damn, and double damn!!! I am a retired Police Officer, and spent over five years working, "dedicated DWI." The one, and only, DWI arrest I ever lost was because I did not, "keep the bottle." I observed an guy drinking a beer while driving his pickup truck. I stopped him and, after administrating a Field Sobriety Test, arrested him for DWI. I testified that my "probable cause", (p/c) to stop the operator was having an open container. His defense attorney simply asked me to produce the evidence for my p/c, which I couldn't. Bad guy 0, Good guy 1.

      He was actually kind of stupid. The main point of his entire defense was that the alleged open container was used as the sole pretext on which to arrest the suspect and then run his license which turned into the fraudulent license charge. He was attempting to prove that absolutely no evidence exists of an open container and that the pretext for the stop was unlawful, which would then make any further evidence obtained incidental to the processing of the suspect for arrest fruit of the poisonous tree and therefore inadmissible.
      He just casually allowed the judge to toss aside one of the primary pillars of his defense as if it was irrelevant.

    The problem here is the fact this officer did not call for an officer to back his lie.He has gotten away with this behavior many times in the past,and expected the same formality this time. Next time he lies he will have all his ducks in a row.Very good experience for a cop who believed there were two sets of rules/laws.(one for them,one for us.) The usual practice where your word is enough.

My father was a resident state trooper in Connecticut and I can tell you from first-hand experience growing up with a State Trooper as a father was the worst fucking thing I could ever imagine he beat the living crap out of me my two brothers until we ran away at around 13. And today he has no recollection of beating us where is were like how the fuck can you not remember beating the crap out of us every single goddamn day. There was not one day that went on that we weren't beaten. The best move I ever did was moving out of his house and then when I graduated high school I went from Connecticut to San Diego best move ever other than moving out of his house and finishing up high school with a friend of mine. They are now that he's retired, he still the same asshole. And I believe 98 out of 100 cops state or town are the same exact way bullies and tyrants.

    Most agencies have policies or directives that permit them to pour out alcohol and are not required to book in the full amount of alcohol. Those policies/directives are generally initiated BY THE COURT, meaning the presiding judges AND prosecuting attorneys not only allow this to take place, they WANT it this way, so as not to have evidence rooms and courtrooms smelling like a nasty bar.

    what right is being violated when a clearly intoxicated driver, on video, can perform a legal drunk test, UNLESS the booze he was drinking was poured out? I have NEVER been charged with drunk driving, regardless of the fact I've often worked RIDICULOSLY long hours, sometimes until 0300 or 0400. how can that be? BECAUSE I DONT DRIVE DRUNK. "Rights' does not mean the "right" to act criminally w/o recourse. grow up, or face your death via lawlessness.

    *Get fired with no pension benefits.
    *Go to jail with similar sentencing as what he gave false testimony to.
    *Be put along with general prison population.
    *Put on a national Hall Of Shame, like lawyers, physicians and sex offenders are.

    This is what happens when you hire a lawyer who does a little work for you. The police for the most part screw up most crime scenes and any lawyer with a little time can do what happened here. The lawyer completely got the open container charged dropped because the cop did not follow policy , the cop says " i did what i always have " . Well it was not fair for the accused to bring about a defense if the cop just decides to pour the bottle out and go on his word that it exist and where it exist. The judge even tried to help this poor officer .....The judge does not usually re-cross during cross examination. In the end the judge . The judge realizing the open container was a wash , asked if this was the reason to "contact the person " in and of itself , so to say. It was not , there was a drivers license problem that brought about the contact with the police. At least this is what the police is stating.

    Suppose the judge would have served the trooper with a subpoena duces Tecum which is a subpoena to bring something the court designated. What would the trooper be able to produce? I wonder why the lawyer or judge did not bring that point up.

    IMO, one small matter for the weaselly cop: Defense counsel should have married the cop to the policy early in cross.
    If the cop refused to say his work mapped on to that policy, what policy does he follow? Does he make it up as he goes? "You have the official policy next to you, do you know of any written policy that conflicts with the official policy?"
    Same goes for any police report. Marry the cop to the report. Anything that is incorrect? Any observations made that are not in the report?

    This officer is not "crooked" and I don't believe he's lying, as some are alleging. The attorney is slick and talented. The attorney knows the rules of evidence, and they apply equally to an open container just as much as they do to a handgun. Items collected should be photographed where they are found, preserved, recorded and stored without being tampered with. But, for all practical purposes, you aren't going to call a crime scene unit out to a motor vehicle stop to fully process an open container of alcohol. Evidence rooms are not equipped to preserve every open container of alcohol through court appearances and appeals. This was likely a word of mouth past practice from the property clerk, or maybe even a brief memo, but the attorney knows full well that there is no official department policy that allows the "destruction of evidence". The officer is not stupid or corrupt or a liar. He's just unfortunate to run up against a bright defense attorney. I guarantee that after this case, the MSP now has an entire warehouse to store open containers of alcohol.

    I despise confrontation. Lawyers such as the defense atty infuriate me since they purposely try to confuse, confound and criticize witnesses in an attempt to provoke them and discredit their testimony. It’s similar to double-talk. He gets the witness to question himself in order to win his case.
