  • Neil Rockind is a Michigan Criminal Defense attorney and proponent of Killer Cross Examination. The case involves an allegation of drug delivery and drug possession. The witness claimed that our client delivered drugs to him. Here is an excerpt of a cross examination of a cooperating witness in a recent case where I took a particular approach due to the witness’s conduct on direct examination. Rather than conduct an animated, "fiery" cross examination, my tactic was to remain understated and deliberate, allowing the jury's attention to remain on the witness.

      Yeah and ADHD is a big reason people use drugs. Trying to make up for the lack of dopamine. This lawyer bullied a young man for medicating himself all the time knowing his own client used drugs and committed felonies. This is one reason why people hate lawyers. They're so obviously manipulative and dishonest in their framing of testimony.

      goldkhw yeah, I didn't really see "killer" anything, but I'm also not an attorney and maybe missed some important event that took place. Either way, it was a pretty interesting testimony.

      And, Stewart Tracy, the convicted rapist and drug dealer who is paying the lawyer to LIE for him in order to get him a lighter sentence has a character above reproach? He is attempting to disprove, through his mouthpiece, that he is not guilty of having lured young people to his home with the offer of drugs where he could then take unfair advantage of them, sexually. "Don't be anally raped kids, after a large man gives you drugs. It rips and painfully tears the cells of your body and damages you emotionally for life. It could also infect you with AIDS."     I don’t understand how people are acting like this cross was bad or that the defense lawyer was wrong for attacking his credibility?
    This guy was brought by the STATE as a witness. The defense is meant to poke holes and discredit witnesses brought by the state, and that’s exactly what he did.
    By the end it was obvious that this witness was not credible at all. He had a history of lying and had a lot to lose.
    You bet your ass if you were on trial, you would want your defense lawyer to do the same. Could you imagine if this witnesses testimony was what ended up convicting you?
    And yes the defendant was found guilty. That doesn’t mean the cross was bad or that the defense lawyer did a bad job. Great lawyers lose cases all the time.

      I imagine the majority of their clients are far worse, they're only providing an essential service for a developed country. I like the fact that we have fair trials personally, we need good solicitors for the defence and good solicitors for the prosecution. What's the alternative/your suggestion? Lock every suspect up just in case they're guilty? 😂 Think it through buddy! You should direct your anger at the right people in future, the criminals who make solicitors defend them in the first place.

    I have adhd and watching this dude testify is the first time it has ever truly sunk in for me that adhd is a disability. My memory is so fucking bad, and listening to him answer questions in a way that is totally reasonable to me and then getting treated like a liar was crazy. I didn't interpret his testimony as inconsistent in a deceitful way, just inconsistent in a 'my memory is shit and doing drugs at this dudes house isn't important enough to be rememberd accurately' kind of way.

    Insinuating and strongly trying to make the jury believe that someone that is taking their prescribed medication for ADHD makes him a druggy and or high is horrible. I don't know how lawyers like that can live with themselves. Yes you could class that medication as a type of amphetamine (and this is what he stresses to make unsuspecting people believe he must be high) but I am a pharmacist and a medical student. I can tell you that someone with ADHD will not have the same response to amphetamines as other people. It will actually balance them and make them function like someone without ADHD that is not taking amphetamines. What a lowlife!

    Not a killer cross examination. A good, thorough cross examination during which the prosecutor was asleep. There were many, many questions that should have been objected to as being compound, argumentative, immaterial or calling for a legal conclusion. In addition there were several answers that were non-responsive, to which the defense attorney could have asked be stricken from the record.

      How could you even call this a "good" or "through" cross examination? The witness made multiple long speeches and explained everything he wanted to explain. The defense attorney completely failed at making the witness look unreliable, he moved on from a question at the witnesses request and stopped going down that path. The questions being asked were too long and left too much room for the witness to talk about other things.
      This is objectively an awful cross examination, the witness walked all over this attorney .

    This guy is a great example of why you should not talk too much when on the stand. Slow down when answering, give the opposing counsel time to object, and at least know a redirect is probably coming if you're not comfortable. You would have done a great job even if there were no extra comments, but his comments just handed your entire point right to the jury.

    That prosecutor is incompetent, how does she let her witness be tortured on the stand like that?
    I do not necessarily condone what the defense attorney was doing (leading questions, trying to strong-arm the kid and confuse him with red herrings and vague threats... etc), but I respect someone who is good at their job.

      That's the whole point of an objection! Attorney objects under a reason, judge rules in it.

    As a juror, I would be so aggravated by your questions. I believed the witness 100% in spite of your badgering him. I related to him more because of how you were trying to tie him up in twisted convoluted questions, and although I could see the points you were trying to make, and where you were going with it all, it fails everytime because of your approach. You start off by basically accusing him of being high, because he takes a prescription for ADHD, and then make him even more relatable by questioning his desire to lie to avoid being arrested during a raid… I don’t get it. I’d be interested to hear and see the outcome of this case.

But they can plead the fifth for questions that they deem are self-incriminating. But a witness subpoenaed to testify must testify. If you refuse the subpoenaed which is a court order it is punishable by jail, a fine, or both.

      What he means by that statement could be that he isn't trying to intentionally mislead the court. It's possible that he's trying to draw on his actual memory of events rather than on his memory of a story he's been instructed to rehearse, tell and stick to. He seems somewhat ashamed or embarrassed by some of the details of his testimony, and he even admits at one point to having perjured himself and lied to police.

      @@ErebuBat u can object any time... regardless of whether the judge agrees or not. the judge will just say over-ruled. object to anything to slow down the questioning/ allow the defendant to have time to think of something.

      After you say, "Lawyer please," the cops put the handcuffs on so tight you have finger(s) hurting for at least a month, if not permanent damage, and they write several tickets for you. Or you talk, and things seem to be easier. I've heard the same "tight handcuffs" story from several political protesters (who refused to move off the street when ordered to by the fuzz).

    The lawyer makes it appear that the witness is confused, whereas some of his own questions are confusingly put and gramatically fragmentary. The jury will assume the legitimate difficulty the witness has in answering them is due to his being evasive or disingenuous . Both appear confused to me at turns. At any rate, to call this advertisement for legal services an example of "killer" cross examination is risible.

      Hilarious! I laughed out loud. However, as an attorney, this guy would be a nightmare to try and cross examine. He reminds me of me and my friends in law school trying to mess with each other during mock trials (some of us would play the lawyer, and some witnesses...as practice).
