Rockind vs MSP Trooper - Part 5
HTML-код
- Опубликовано: 13 сен 2016
- Criminal Defense Attorney Neil Rockind, author of Killer Cross Examination, cross examines a Michigan State Police trooper in a case in which the Trooper wrongly arrested the accused. Rockind's cross examination proved that the Trooper's testimony was not reliable and the Court ultimately ruled in favor of the accused.

The reason this trooper is getting frustrated is he's been caught violating the law and this man's rights.
his passive aggression is oozing out of him,and the judge expects it. They say the law is equal for all in America.
In truth it is one of the worst in the western world for equal rights outside of Australia.
And the reason he's cocky about it is he knows he'll get away with it.
@@rockymntnliberty that’s the damn truth and he won’t even be disciplined for it,which will encourage him to do the same thing again
Another tryant cop lost a case love it
MSP is bullshit they never get punished!
I can’t believe that the judge allows so many snide, belligerent statements directed from the witness to the attorney. Typical “I remember nothing” cop.
The judge was actually laughing at the trooper and he was too dumb to realize it.
2:30 THE JUDGE LETS HIM GO BEYOND REDIRECT
You are a legendary lawyer
Great job. I'm tired of hearing about how lawyers need to do "soft cross." This is how it needs to be done. Good calibration of tone/aggressiveness.
All police are to be soft crossed never have found why but I have been reminded by many judges about tone and manner of questioning of law enforcement unwritten but very true

This lawyer is prepared and does an excellent job.
If I would've been the Judge, I would have cited the trooper for Contempt of Court in making sarcastic remarks to the defense attorney. The trooper wanted to argue and deep down inside wanted to beat up and taze the attorney but he couldn't.
Yeah no kidding what happened to order in the court and showing respect.. That Trooper wouldn't be so snooty if it was the D.A. or U.S. D.A. for that matter asking questions.
Arguing with or even talking back to a cop during a traffic stop can get you arrested. That principle should apply to cops in court.
Law enforcement cannot be held in contempt immunity allows him or her to misapply a lawful order or law
This cop doesn't have the chops to verbally spar with Rockind, but his pride won't let him back down. It's like a chihuahua trying to chase down a Ford
billiondollardan lmao
You right !
billiondollardan /make that fled a Shelby
Ford
NIGGA THAT LAST COMMENT CHIUAWA CHASING A FORD!!! OMG I LOVE THAT SHIT!!
Cop gets progressively more pissed as bits and pieces of his as get handed to him😂
This is a classic example of an arrogant cop that just can't learn from his obvious mistakes. Some of the best lessons I have learned have come from getting my ass handed to me by competent defense attorneys. This trooper is his own worst enemy.
Most cops get away with legal abuses so long they think its correct. That is until someone challenges them in court and they find out they have been doing things illegal all that time. How many times have you heard a cop say "this is how we always did these stops" to a illegal and unconstitutional action? Lots, I'm sure.
He's a fkn pig .. imagine all the innocent victims that are in jail or prison bc of him planting drugs guns or wtv I guarantee u it's 100's and I guarantee u he has murders under his belt of innocent ppl with their backs to him !!
Why is this cop allowed to continue his wrath unchecked while someone has to fight for their freedom?
Double standard bullshit is why!
Maybe if you start weeding out and getting rid of these career tyrants, we could actually have a decent society.
Instead, we have a fear mongering, divide and conquer police state brought to you by the good ole boys club. Js
there needs to be an independent third party federal agency to police the police also how are these people trained? where do they get the idea they are above the law? Why does this cop represent so many cops who are arrogant and dont give a damn about the law.
@@roostersideburns3440 that where you r wrong very wrong... no federal nothing . what we need is a private entity that has no ties what so ever to do with the government!!!!
These video’s never get old To bad there’s not more lawyers and judges like these two . . It would b e a much more fair world for law abiding citizens.
He was arrested because he cooperated by answering the policeman's questions.
Garry Moss moral of the story is to not answer questions
Garry Moss exactly!
-Did you had in the past get a ticket?
- I pleed my right to the fifte amendment!
He was arrested for Driving While Black. It happens every day all across the country. This false arrest was not an aberration, it's the norm. What's unusual is the challenge by a competent attorney.
They can arrest you for literally anything. Worst case they have to let you go later. There's absolutely no downside to the cops arresting you. When is the last time you heard of a "false arrest" conviction?
Exactly. The very reason the police ask so many questions. They are looking for incrimination.
THIS COP WAS SO BEATEN I DID NOT WANT IT TO END. THE WALK OF SHAME AT THE END WAS EPIC !!!!!!!!!
I’ve been listening to examples of good defense attorneys doing cross examinations, opening and closing statements for the last 3 weeks instead of listening to podcasts at work. In that 3 weeks of 6 hours a day listening while I work I’ve learned more useful information than in years of listening to podcasts. If I should ever be wrongfully arrested (very possible in the rapidly increasing police state called the “USA”) I will be prepared, at this point I can afford to hire a good attorney but if that should change (think bank accounts frozen or money “confiscated” by dirty cops”) I think I stand a far better chance of representing myself instead of trusting a deal making cop sucking public defender. Thank you for showing us what you do so well!!
This officer should be stripped of his badge and pension
Bruce Frields ..the officer should be in jail for perjury, obstruction of justice and contempt of court.
This trooper doesn’t get paid by the word. Clearly, he gets paid by the words LEFT OUT of his reports.
I think he was saying he made more money than the trooper
he's turning it around on the officer and implying that officers get paid to say less words
*in court
That was absolutely painful to watch. That was definitely one of the more intellectually sound cross examinations I've seen. Also, it was quite entertaining seeing the trooper get so pissed. He knew he messed up and was hating life because he was discovered.
lol....the prosecutors face just says "I give up".
As a retired Cop, hate most defense attorneys. Mr Rockind is an awesome attorney and I thank him for his efforts in getting this innocent man cleared of these charges. Mr Rockind is an example for other defense attorneys to follow.
David Peterson It must be awful for you for somebody to have a right to a great legal defense lawyer. I would like to welcome you to the United States of America, where people have rights under the Constitution.
Amen
Wow
Why would you hate defense attorneys?
hows the Gov. wellfare
“He must get paid by-the-word, Your Honor...”
“You know what’s interesting, I thought the same thing about you!”
😂😂😂
don't get it
That was funny. Couldn't stand that scrum cop
Well, Charles Dickens got paid by the word, and if he were alive today, he would have raked in multi-millions of dollars! Let's call this amazing prosecutor Charles. LOL
A lesson to us all - so easy to get tangled up in lies and deceit!!
I really do not like this cop. He's exactly the type who shouldn't be a cop. He's a smart ass and he's rude not to mention spiteful.
ElGatoLoco698 soooo pretty much like every cop ever..
All are like this. The good cops NEVER go to trial because there behavior is HONEST.
@@jayparra8574 Or because the good ones got run off the force for doing the right thing rather than protecting a bad cops.
Yes!!! And he’s to arrogant to admit he was wrong
It’s a requirement to be like this to be a cop !😁
The cop was.
1. Lying
2. Lazy in his execution of his job in this matter.
The prosecutor was
1. Lazy or not very good at his job since he sat silent the entire time.
Need more judges who want facts and more lawyers like this.
Cop is a total liar and corrupt, pissing me off when the judge is lipping off too. Corrupt as hell it seems
Holy crap that lawyer showed the world how CORRUPT that trooper really is.
The trooper's body language and attitude are so bratty. Yikes. Imagine what he's like when he's out interacting with the public and no one's keeping an eye on him.
Amen since the first video he has that smirk after each answer that he knows hes goin down
No doubt. You can tell that he thought he had it beat.
Right? Not to mention the tremendous amount of ass kissing he's giving this completely biased judge.
I love this lawyer ..he is awesome...finally someone doing there job..so proud..
Sometimes people, including me, don't understand why cross examination takes place with such attention to the infinitesimal detail. I suppose that this shows why some people are born with such patience. So well done Neil Rockind it pays to be thorough.
He's creating reasonable doubt.
keefy ur the type of person who would have been the Good German and said nothing when you smelled the flesh cooking at Dachau.
Jeeze man.
keefy acctuly cross examination is the exact same spot as a police interview, unless you can take the 5th.
This lawyer play the exact same game that the police or prosecutor play all the time.
That is why you should never talk to the police not if guilty not if innocent, never.
keefy - This is because most people get their legal education from television and films. In real life, they are virtually infinitely and annoyingly detailed, because everything depends on the record. You’d be bored to tears with most real trials.
This policeman is a menace to society
He's actually quite typical and the norm. I've felt safer around gang capos than cops.
This cop is being slaughter. I would've never shown up. If I would've been cross examination like this. This why you need money for a Lawyer and dash camera. A hidden dash camera.
must get pay b y the word lololo |0l
I'll take the overtime everyday.
He had to show up. He was subpoenaed.
Pedal, he probably was not subpoenaed. It's part of the job. Cops go to court expecting automatic wins. He was clueless.
No, by default most cases don't go to trial, as an officer you get a subpoena delivered to work. Normal process.
Trooper got his ass handed to him because he was sloppy in his investigation and lazy in attention to detail in his paper work. As the burden is upon the State it pays when the State crosses all it's T's and dot's all it's I's ....... Bad Trooper, no doughnut.
You hit the nail on the head.
| m f a o no shit a bit weirdz
Lazy in preparing for trial also. He knew he was going to be there. All he had to do is review the case and read his report, which he obviously didn't do.
Steven Bass doesn’t mean he’s a bad trooper, he just did a bad job with this case! Could be poor training, but I bet he does everything correctly the next time!
I bet he DOESN'T do a better job next time. I bet he hopes for a friendlier (to him) judge!
Respect for the lawyer. What a beast.
Smug cop. My favorite part is when def attorney sees the trooper is getting frustrated, he thumbs through his folder, taking his time to let the guy make another smart a$$ statement, and ends up right back at the page he was on to begin with. Very smart lawyering! Liars hate silence! It makes them even more nervous
Didn't notice that and went bacck to check...good catch,
Most leo know no one will pay for a lawyer . One of the reasons they can bend us over at will with no accountability.
This is a case of a seasoned cop taking the job for granted and becoming complacent. He got grilled, written up, made a fool of, and will never do it again guaranteed.
I would have voted for aquital in two seconds flat. What a poor excuse for a trooper.
Thank you for letting us know the outcome of the cases you post here. It helps a ton to know the outcome!
Great job Mr. Rockind , Troopers think their above the law! Thank you!
That cop should be reprimanded for the way he talks to the attorney. Maybe someone should remove his certification.
He’s getting pissed because he knows he’s caught. I wish this would have been a jury trial so they could see the arrogance on his face.
God help those out on the streets that don't have a judge and cameras next to them while dealing with this guy. If that's how he behaves in front of a judge and cameras in a court room what does one on one on the street look like???
Next time my car gets towed I'm going to FOIA request. How many times he's called the same tow truck driver it should be on record hutos the cars every time and if it's always a guy named Luke. Now you got a conspiracy this is heavy man I'm writing everything down that you're teaching man I appreciate you thank you
A trooper that has "wit & charm" f'n amazing! U go counselor, tear his ass up!!!
The lawyer should’ve asked if the cop is paid by the arrest lol
Mannnn I watch this every other month and love it more and more each time.
The trooper gets nervous at 11:10. That's when he starts criticizing the defense attorney. :-)
I've NEVER seen a judge be the 'middle child' so to speak between an attorney and witness, the fact that it's a trooper, makes it so much sweeter!!
I loved watching him tare that trooper up! and he just had to sit there and take it 😀
Tim Legg tear*
dbltrplx tare*
Yeah, but he got paid overtime for doing it. If I got paid time and a half--or maybe double time--I wouldn't really care.
EXACTLY. Who won? The defendant paid more in legal fee's to his attorney than the forfeiture.
Actually tare. He was weighed in the scales of justice and found wanting.........
Again, I thought your client was "probably" guilty. But in good ol' USA, that "gut feeling" ain't enough in the court of JUSTICE. Congratulations!
And stealing a car without conviction or court order is a violation of the 5th amendment....and grand theft auto...actually would be armed robbery being he had already kidnapped the man.....
Not to mention arrest without probable cause only a hunch or presumption.....is a violation of the 4th.
@james Barnes I'm not American, but isn't the 5th ammendment to do with remaining silent/not incriminating yourself? Nothing to do with stealing a car.
And isn't 4th ammendment to do with stopping illegal searches, not to do with illegal arrest.
I don't mind being corrected, but I'm pretty sure you're confused
9:14 prosecutor nervously biting his fingernails 🤣🤣🤣
Happens quite a lot. You are an excellent lawyer!
I hope if I'm ever arrested, this guy is my attorney...
Anyone else think Rockind sounds like hawkeye from mash?
Sounds like a prick.
This cop is so slimy. How can you make an oath to serve and then behave like that in court?
He whipped his ass in this cross examination lol
Great lawyer but that cop is so arrogant
When the Judge made the trooper say thank you I lost it. 🤣🤣🤣
if these cops hasn't been fired yet he should be fired asap .
Amazed at the outcome. Judge appeared to be going out of his way to minimize the trooper's inconsistencies and blatant disregard for Michigan policies. Trooper arrested on hunches, feelings, and concoctions. Brotha goin to jail one way or another. Thumbs up to the counselor.
Arrested this man because he speculated he was a lying criminal. Should lose his job as a trooper. I’m sure this isn’t the first time he has done that
lol The trooper got so politely and slyly told off by the defense attorney and the judge loved it.
Man, that is one cocky
"i'm above the Law" Trooper.
He is indignant that he's being questioned at all. Internal affairs should investigate every single one of this rogue cops arrests. I would DEMAND that his arrests starting from day 1 on the job be investigated.
Everyone hates lawyers until they need one.
Mr. Rockind you are my hero!!! The prosecutor isn’t even objecting!! Is he sleeping?? I think it’s just you and the Judge!! I love this Judge nice man, very personable. I truly wish I could afford you. I was a passenger in the car pulled out and put into handcuffs. I am not violent and was not trying to run. I’m not a known criminal. I’m blonde blue eyes the cop arrested the driver for no ops, in July of 2021, when it was citable on 4th of July weekend. He can’t elaborate a reason to why I was put into cuffs.
Thank you.
That troopers attitude is coming out in the court room, imagine how bad it was at the traffic stop!
He was really getting pissed off that his story was falling apart. The trooper lied and needs to be fired, barred from any future employment in the legal system for life (in the entire country) and he should be prosecuted for perjury.
That lying assed trooper NEVER wants to get crossed by this dude again. He'll still be having nightmares about it 12 years later 🤣🏴
What sucks, I know there are plenty of ethical, fair, intrinsically motivated officers who truly do SERVE AND PROTECT. I bumped into a man who was an officer, wanted to be since childhood, and was so completely deflated, jaded, and disillusioned by the conduct and drive by many of his peers and actually resigned and will now settle on something he doesn't truly have passion for.
Thank you Mr Rockind. We need skilled conscientious attorneys like you to stop the judicial freight train from running over us all.
The Problem is that not everyone can afford a incredible lawyer like Mr , Rockind !!!
When is the lawsuit coming against this cop and the city?
Never
State as he is Michigan State Trooper
jaime garcia The defendant won the case. The ticket was thrown out, the cop Was proven wrong.
@@johnspears6128 That has nothing to do with a future lawsuit....
The arrogance of this cop,he can’t even hide his contempt for the process,my opinion is he profiled him and was going to come up with reason to search his car
Neil Rockind is what a D-attorney should be. He does his job properly and gives his clients a fair shake. Public defenders should be mandated to watch this prior to being hired. Neil is a badass lawyer!
awesome lawyering, great job
someone needs to show this cop his own badge and ask him where is says "detective" on it and then tell him why it never will.
He's trooper of the year... www.theoaklandpress.com/general-news/20170206/michigan-state-police-name-metro-north-trooper-matthew-kiser-trooper-of-the-year
I was going to ask how, but then I read this...
"The Gerstacker Trooper of the Year Award recognizes the Michigan State Police trooper or sergeant who symbolizes outstanding professional ethics, dedication to duty and a concern for giving back to their community"
He must have attended a lot of community BBQ's.
He must have limited his take from the donut shop of donuts, coffee, and dumps in the restroom to 3 or 4 times a week. That would get him a little star from them.
Is this English?
Joe Coco If he is trooper of the year then god help the rest of the department and those under the jurisdiction of it.
He committed fraud on his police report to and if that man would've he would've been charged and arrested for itTHERE IS 0 OF ACCOUNTABILITY FOR POLICE OFFICERS IN THIS COUNTRY. THEY ARE INVESTIGATED BY THERE OWN.
Hey Bev I couldn't of said it better, big hugs to you for speaking the truth
one of the arguments from the judge and cop was the defendant's age when getting a license. you can't discriminate against age.
It wasn't discriminatory. It was his basis for probable cause
Bill Hester, the judge eventually ruled that it was NOT a basis for probable cause.
When the cop stepped off the stand, I was afraid the chip would fall from his shoulder. But thankfully, it stayed right where it always is, ready for the next stop. 🇺🇸⚖️
Damn cop doesn't have the guts to give a simple "yes" or "no" answer
God I love this. If I became a prosecutor, I think I’d bury myself under the courthouse if I brought such a sham witness to the stand.
I'm glad you won! BUT, it was great to see that the "obviously biased judge (in favor of the trooper), put the hammer down in your favor! GREAT JOB!!!
Nicely done, counselor!
The lawyer gets his joke in,using the cop's joke against him, then the judge is like enough...the cop and the judge are too chummy.
That trooper is sweating his balls out😂😂
yrs ago comments... but I'm here.. well done Mr.Lawyer 👏 👏👏

Is there some other part to this case or there is no more parts? I can't find any.
The judge should of allowed the defense to grill that corrupt cop. He wasted the defendants time and humiliated him, cop should of been allowed the same punishment, outside of being fired for lying on his report. Which is a big issue with cops, they can say whatever they want on their report. You have to go to great lengths just to prove them wrong. Too much power given to cops, thats why they end up corrupted.
Thank you sir.
I like how the prosecutor body language is like, “Bruh, I don’t give a s***”
Hi, I'm an undergrad student, and I was wondering if you could share the ultimate disposition of this case.
