  • Criminal Defense Attorney Neil Rockind, author of Killer Cross Examination, cross examines a Michigan State Police trooper in a case in which the Trooper wrongly arrested the accused. Rockind's cross examination proved that the Trooper's testimony was not reliable and the Court ultimately ruled in favor of the accused.

    If I would've been the Judge, I would have cited the trooper for Contempt of Court in making sarcastic remarks to the defense attorney. The trooper wanted to argue and deep down inside wanted to beat up and taze the attorney but he couldn't.

      Arguing with or even talking back to a cop during a traffic stop can get you arrested. That principle should apply to cops in court.

    This is a classic example of an arrogant cop that just can't learn from his obvious mistakes. Some of the best lessons I have learned have come from getting my ass handed to me by competent defense attorneys. This trooper is his own worst enemy.

      Most cops get away with legal abuses so long they think its correct. That is until someone challenges them in court and they find out they have been doing things illegal all that time. How many times have you heard a cop say "this is how we always did these stops" to a illegal and unconstitutional action? Lots, I'm sure.

      He was arrested for Driving While Black. It happens every day all across the country. This false arrest was not an aberration, it's the norm. What's unusual is the challenge by a competent attorney.

      They can arrest you for literally anything. Worst case they have to let you go later. There's absolutely no downside to the cops arresting you. When is the last time you heard of a "false arrest" conviction?

    I’ve been listening to examples of good defense attorneys doing cross examinations, opening and closing statements for the last 3 weeks instead of listening to podcasts at work. In that 3 weeks of 6 hours a day listening while I work I’ve learned more useful information than in years of listening to podcasts. If I should ever be wrongfully arrested (very possible in the rapidly increasing police state called the “USA”) I will be prepared, at this point I can afford to hire a good attorney but if that should change (think bank accounts frozen or money “confiscated” by dirty cops”) I think I stand a far better chance of representing myself instead of trusting a deal making cop sucking public defender. Thank you for showing us what you do so well!!

    That was absolutely painful to watch. That was definitely one of the more intellectually sound cross examinations I've seen. Also, it was quite entertaining seeing the trooper get so pissed. He knew he messed up and was hating life because he was discovered.

    As a retired Cop, hate most defense attorneys. Mr Rockind is an awesome attorney and I thank him for his efforts in getting this innocent man cleared of these charges. Mr Rockind is an example for other defense attorneys to follow.

    Sometimes people, including me, don't understand why cross examination takes place with such attention to the infinitesimal detail. I suppose that this shows why some people are born with such patience. So well done Neil Rockind it pays to be thorough.

      keefy acctuly cross examination is the exact same spot as a police interview, unless you can take the 5th.
      This lawyer play the exact same game that the police or prosecutor play all the time.
      That is why you should never talk to the police not if guilty not if innocent, never.

      No, by default most cases don't go to trial, as an officer you get a subpoena delivered to work. Normal process.

    Smug cop. My favorite part is when def attorney sees the trooper is getting frustrated, he thumbs through his folder, taking his time to let the guy make another smart a$$ statement, and ends up right back at the page he was on to begin with. Very smart lawyering! Liars hate silence! It makes them even more nervous

    And stealing a car without conviction or court order is a violation of the 5th amendment....and grand theft auto...actually would be armed robbery being he had already kidnapped the man.....
    Not to mention arrest without probable cause only a hunch or presumption.....is a violation of the 4th.

      And isn't 4th ammendment to do with stopping illegal searches, not to do with illegal arrest.

    Amazed at the outcome. Judge appeared to be going out of his way to minimize the trooper's inconsistencies and blatant disregard for Michigan policies. Trooper arrested on hunches, feelings, and concoctions. Brotha goin to jail one way or another. Thumbs up to the counselor.

    Mr. Rockind you are my hero!!! The prosecutor isn’t even objecting!! Is he sleeping?? I think it’s just you and the Judge!! I love this Judge nice man, very personable. I truly wish I could afford you. I was a passenger in the car pulled out and put into handcuffs. I am not violent and was not trying to run. I’m not a known criminal. I’m blonde blue eyes the cop arrested the driver for no ops, in July of 2021, when it was citable on 4th of July weekend. He can’t elaborate a reason to why I was put into cuffs.

    That troopers attitude is coming out in the court room, imagine how bad it was at the traffic stop!
    He was really getting pissed off that his story was falling apart. The trooper lied and needs to be fired, barred from any future employment in the legal system for life (in the entire country) and he should be prosecuted for perjury.

    What sucks, I know there are plenty of ethical, fair, intrinsically motivated officers who truly do SERVE AND PROTECT. I bumped into a man who was an officer, wanted to be since childhood, and was so completely deflated, jaded, and disillusioned by the conduct and drive by many of his peers and actually resigned and will now settle on something he doesn't truly have passion for.

    Neil Rockind is what a D-attorney should be. He does his job properly and gives his clients a fair shake. Public defenders should be mandated to watch this prior to being hired. Neil is a badass lawyer!

      He must have limited his take from the donut shop of donuts, coffee, and dumps in the restroom to 3 or 4 times a week. That would get him a little star from them.

    He committed fraud on his police report to and if that man would've he would've been charged and arrested for itTHERE IS 0 OF ACCOUNTABILITY FOR POLICE OFFICERS IN THIS COUNTRY. THEY ARE INVESTIGATED BY THERE OWN.

    one of the arguments from the judge and cop was the defendant's age when getting a license. you can't discriminate against age.

    The judge should of allowed the defense to grill that corrupt cop. He wasted the defendants time and humiliated him, cop should of been allowed the same punishment, outside of being fired for lying on his report. Which is a big issue with cops, they can say whatever they want on their report. You have to go to great lengths just to prove them wrong. Too much power given to cops, thats why they end up corrupted.
