I bet if the cops had to pay out of thier own pockets if they were taken to court. They wouldn't be so inclined to arrest people that are exercising their constitutional rights.
They would also be less apt to harass people for minor (petty) infractions, knowing they're putting themselves in a position to make mistakes.
They SHOULD have to pay out of pocket. If I do something while I'm working that is OUTSIDE THE SCOPE AND THE RULES OF MY EMPLOYMENT, I'm personally liable for the outcome.

You do not have rights in a democratic system.

@@andrew_koala2974 we DON'T live in a democracy. We live in a republic, where our rights are protected by law regardless of majority opinion. Also, the only thing decided by majority vote is who our representatives will be to vote on things that matter.
Any police officer who does not wish to be recorded is either committing a crime or contemplating doing so. That applies to courts as well. When any public servant refuses to be recorded while performing public service should be removed from service immediately. The first thing any criminal will do is try to avoid accountability.

1st rule of recording police. There are no rules. Its a right!
It's a right and there are no formal rules, but there are some common sense rules to help protect you from people that don't think it's a right.
There are laws though you must follow. You cannot interfere with a police investigation or an arrest. Filming isn't interfering per se, but if you are asked to step back (and are actually too close), stay put, or provide ID while operating a vehicle and don't comply, they can arrest you. The fact that you are recording doesn't excuse you from that lawful order.

ballnutz or mine in Texas. I shot this guy in self defense and have. A concealed carry permit. Cop arrested me and lied said I shot this guy with a rifle and he seen me with the rifle. I really shot the guy with a handgun not a rifle and the cop didn’t see me with any rifle at any point. The cops refuse to give up the dash cam and body cam showing he lied to arrest me.

Police misconduct is when police don't act as they ought to act, they way that they are trained to act, the way we want them to act on the job.On the job we give them permission to use more force and violence AS A COUNTERING move that we wold permit off that job.
When off the job if they don't behave according to societal norms, , its just misconduct.
A policeman who meets neither criteria when on the job exhibits two different level of misconduct.
Part of the problem stems from expecting policemen to always be "on the job" even when "off duty". That creates a mindset and a culture alien to real civil life.
That's not an excuse for acing like thug repelling invaders, just a partial explanation for how it can happen.

When he advised against holding the phone aggressively, something struck me.

I have been told to stop filming police in Ohio and Kentucky. When I kept filming in Ky, the officer grabbed my phone, threw it down and then grabbed my arm and demanded ID. I did complain to his supervisor at the station
Had a cop try to grab me once, and illegally attempt to detain me. Then tried charging me with Battery on a LEO - didn't work and never went to court, he was just butthurt because he could not bully me, and I put him on his ass! Then to top it, he pulled his service pistol, so I pulled mine!
At some point citizens will stop allowing themselves to be harassed and/or kidnapped by these badge toters and defend themselves as they would have if any other person did the same.

Rule #6: if you anticipate recording the police, for whatever reason, practice! In a rapidly unfolding situation, you want to be immediately familiar with how to do everything described in this video from starting your recording/streaming application, to locking your phone. This should all be muscle memory.

+crunch9876, ignorance of the law is not an excuse. If you didn't know the speed limit, you're still getting a ticket and there's really no defense unless there was no reasonable way for you to know the speed limit. Believing that what they are doing is legal is COMPLETELY irrelevant.
- - for police it is an excuse. And federal courts have ruled that way for a while. They just need to think they where doing the right thing, or think what they where doing was lawful and boom you can’t touch them in civil court. It’s how it is legally.
If you are using a lawyer that is suing for a percentage of the award (as opposed to charging you for the hour), he is probably not going to be interested in suing the policeman personally. Why? Because these guys make about enough money to pay their bills, and that's about it. Suing someone that essentially has no money makes no sense.

He forgot to mention one important thing that if you are brave enough to record the police you should be also prepared for being subpoenaed to appear as a witness.
This is why it is important to live stream.
It's good to stream them, but they can still beat you up for "resisting arrest" if they feel like it. They can claim that you're interfering. Anything can be construed as interference.

#6: If you're finding yourself recording the police often, buy a phone case AND camera bag that isn't black or aggressive like the color or a gun or weapon. I've seen plenty of examples of cops that flip out when surprised by someone, last thing you want is someone with a lot of stress and a deadly weapon misidentifying your motives.
Honestly, just everybody should buy a brightly colored phone or phone-case. Even if you think you'll never need to record the police, if the day ever arrives you'll be glad you did.

+dcs002 when someone tries to become a cop, one of the tests they have to take is a iq test. if they score too high on the test then they do not get the job. they say this is because people with a high iq would get bored with the job too easily and so by eliminating high iq applicants the turnover rate for employment is lessened which saves the department money.. long story short, you are absolutely right.. keep it simple lol.

the Beaverton Police Department pulled me over they asked if they could search my car I told them no they Lolly gagged for five minutes wouldn't let me leave then another car pulled up with a police dog in the car they have the dog go around the car and said the dog hit on your car now we have the right to search your vehicle there was nothing in my car they kept me for 2 hours searching my car this happens to everyone in my area there is no way to tell them no because they'll say their dog hit on your car and that gives them the right to search your car

jennifer hess almost funny how a barking dog suspends the Constitution. There are laws about how long you can be held for a k-9 sniff test,too..
They train these dogs to react to a tap on any part of the car. Once the dog barks or does whatever they train it to do once the officer taps a part of the car then they say they have probable cause to search your car. Best thing to do in my humble opinion is to comply if you have nothing illegal in the car just to get on with your life with the least amount of hassle. Being polite and agreeable goes a long way with these folks.

Thank you. Herein lies the true value of the internet, informing the citizens on the law and other such important matters that may have wonderful or grave consequences to all. Just knowing what you may or may not be required to do in the presence of police , when anything you may do has the chance of undermining your freedoms, can be of immense value, especially in such times as now, when the police stretch the rules when interrogating. And nothing short of having a personal attorney on scene is more vital than having and using a camera to record ALL contact. When you are able to add streaming video to your arsenal, you begin to level the field with those officers that would break the law, and in fact, you may come to overwhelm them.
Use your freedoms or lose them, but be prepared to fight for them at all costs and be the true patriot, as those of Concord and Lexington, and Valley Forge and Yorktown, and all the points that defined our nation's birthplace, who committed more than just words to secure our freedoms for generations to come. It would be far more than a travesty to let their sacrifices go to waste simply because we had become too complacent, too wrapped up in our material world to continue the struggle they commenced to secure and maintain our right to be free. Freedom, that which is not physical in nature, with no taste or smell, silent and unseen, and given little thought until it is missing, or taken from us, like love, is worthy of all efforts to cultivate and nourish, to protect and to fight for, least it be gone.

Think of it as a second source of income you are earning because if you follow these instructions and stream the encounter to an off-site server, even if they destroy the phone, you have access to the evidence to sue them for unlawful arrest, detainment and possible property damage.😊

This guy is missing the point: if the cops see you recording what they are doing, they come beat you up and take your camera, more often than not. They seize it as "evidence", which is a very true statement, it's evidence AGAINST THEM, so they seize it and it disappears forever, just like that. Since they are entrusted with that power, then it stands to reason that laws against recording someone without their knowledge don't apply to the police, either, that's what "no expectation of privacy" means, it means AT ALL TIMES, regardless of if they know it or not. They should conduct themselves assuming that someone is recording them AT ALL TIMES.
Ask for a warrant. if its truly evidence in a crime they will get one. If they take it upon ur insistence that u r not consenting, then prepare for a rough ride till u can leave in one piece and file a complaint. Sometimes police let their frustration get the best of them and u r the pounding board.
Oh, he understands that. But he knows he's on C-Span, so he's being careful about what he says and how. That's why he is advocating for using a recording app that records off-site. If they beat you up and take your phone, you'll have proof of exactly what happened, even without the phone itself. Also, telling the police that you're recording to an off-site server lowers your odds of getting beaten up. They know you'll have evidence, even without your phone.
Exactly......yet unfortunately for some strange reason(s) there "still" is NOT a decent(imo) "free" app(for android anyway) in existence that does this, as relatively straightforward as it actually is, as far as software development goes.

Good stuff! That's some useful advise.
This video should be shown to every officer around the country, and it should especially be shown in every training program for every new officer. I know it's frustrating now, but smart phones are still a relatively new thing, and a lot of older police officers haven't acclimated to the fact that almost anyone has a camera in their pocket ready to film at any time. Give it about 5-10 years and the majority of police should be educated about the laws pertaining to recording in public.

Also, never use fingerprint scans or facial recognition as your phone's security password. The courts have ruled that law enforcement can compel you to unlock your phone using these methods, but not using an actual password.
@@---cr8nw install Tasker and set a profile for any time the phone is unlocked by fingerprint to trigger an action to relock the phone unless a gesture is swiped on the screen or you open a certain app within an x amount of seconds. That way, if they force your finger on the scanner, you unlock it and watch as it relocks because they don't know the gesture or which app will disable the action.
When a police officer steps outside the law, he/she loses the protection of that law.
Many jurisdictions protect police from lawsuits, but only if they are acting within the law.

If you step back, officers take this as an opportunity to step towards you and tell you again to step back until they have walked you backwards to a location where you cannot effectively film the police action. Ive just finished watching a 45min compilation of public filming police where men,women and young teenagers are getting beat up then locked up with made up charges. Cops who rarely go to to court got let off even when footage clears the filmer of any wrong doing and proves the cops were lying in their accounts of what hppened and the authorities said in one statement "We dont view footage but we do take it case by case. If the police impedes your movement in any way, to investigate you with questions, and commands, you are technically already under arrest, but they don't want you to know that. You should make the agent for the bench aware that you know that, so he can read your maranda rights so that you do not have to answer any questions as they may be used against you in a court of law, be it kangaroo, statutory, or maritime military.

It's also nice to have your mobile as a collar, so you don't have to hold it --- and the police doesn't force you to drop it during an arrest so you can have more audio recorded. Bonus points for not triggering nervous policeman who think of the little mobile device as a potential weapon to bonk people on the head or be a hidden gun (to be frank, fake mobiles that can shoot bullets DO EXIST but are very rare --- but cops will mention them to judges all the time)

One thing to remember is that when you are recording you may be recording a crime. This makes your phone and all of it's contents subject to subpoena in court and everything on your phone could be presented in public in open court.

Hmm, hidden or out in the open recording, so long as it occurs in public, the interaction doesn't have a reasonable expectation of privacy...it's happening in public; there could be a dude on a bench within earshot that could hear everything. There are no consent laws that would apply in how you choose to record.
Also, to avoid conflict, I'd just saying "huh..? What? Hey officer, let's get one thing straight here, I'm birdwatching, it's one of my hobbies. I'm not disrupting you, you have approached and disrupted me; so walk back, back to whatever you were doing. The world doesn't revolve around you sir! ... That's right, keep walking...pick up the pace too while your at it. A birdwatcher and this guy says I'm interfering all the way over here! What's with the flip out officer; you confiscate some drugs that got "lost" today...in your nose?! Or you just jittery when planning on beating the hell out of someone? Seriously, why are you so paranoid officer? This is America officer! This is America!"
Ok, maybe a bit extreme; but birdwatching is entirely innocuous and, once revealled they weren't even noticed, it makes them look even worse; like some shit is knowingly going to happen that needs to be off camera.

This information is so valuable, but it is very challenging to use in communities of color predominately Black and Indigenous, Mexican or Spanish speaking communities. Can we have more guest from Black or Indigenous background speak on the issue. I have noticed many successful videos of citizens recording police tend to only reflect white males. Thanks great work!

That means, detainment, finger printed, ID'd, visiting the Magistrate (if its not the weekend, you may have a comfortable overnight stay and Cement Hilton if its the weekend), and agreeing to post a 2500 bail (10% usually). Either the way the state wins... Money you out your pocket, and your time wasted.

In California it's 72 hours (3 days) to see a judge until then you stay with general population unless, as you mentioned, you have the poor luck of going in Thursday (or was it Friday) so you stay an extra day inside at your expense (no court on Sunday). That's not to mention most likely staying in the holding tanks for 24 hours or more quite literally like sardines before getting processed upstairs. Then even after getting your jail attire and going to gen population you still might sleep in the middle of the day room because of the incredible and constant overpopulation problem. One time they had also ran out of blankets so my group had to sleep in the middle of the day room and use the towels we had for bathing (4ft x 3ft) as blankets. Not fun when you're freezing your ass off on the hard concrete floor.
@@dsandoval9396 this won't always work but an acquaintance of mine has at least once in the past lied during processing about his state of health; they'll ask you questions to avoid having a room full of people become sick because they weren't quarantined or isolated. So he says he has tuberculosis or something and according to him, his stay is long but he's alone and peaceful. And this guy is no stranger to jail so I take his word for it.

I've only been to jail like 6 times, 2 were actual crimes (non-violent), the rest were bench warrants cause I was living on the street at the time and didn't find out about court dates in time. But yeah, I remember learning about that my last time going to jail. This one guy had cancer and I never saw him go upstairs with general population, either got kicked out (O.R.) or got his own room in medical. Then the last time I went I was sick as a dog seeing as I was already dope sick BEFORE getting arrested, so when they finally processed me my blood pressure was like 220 over 180 not to mention you could just look at me and think something was wrong. So they kept me in medical and boy was that sweet! Not freezing cold, your own room, no asshole CO's, day room ALL day... It was nice.
But that was the last time I went and I don't plan on going back just for the hospitality in the med ward.

akilla214u2c That means you were arrested. If you were arrested without probable cause or detained without reasonable, articulate, suspicion then your rights were violated and you have basis for a strong civil rights case. Checkout first amendment audits. They'll show you the way.
And that's if you're not on probation, if you're on probation you'll probably violate either way. And go to jail. Correct?

How about retraining officers on what they need to do when in public or dealing with laws that already exist?

There is no way for anyone, even the lawyers defending the public to know all the laws, ordinances and rules for their city, county or state. This is not a huge deal, it's understandable. You likely don't know every aspect and rule governing your job regardless of how good you are at it. If laws were easily understood, you wouldn't need the courts to interpret them. You are right, education is the key. The biggest problem in society today is an "us against them" mentality. If you want real change then constructively go about it. +Radly Badly said his/her friends are at odds with the positions they are in. Knowing a few cops myself, I know that these guys go to work with the best intentions and are tired of the idiots who make them look bad, but the general public wants to do exactly what they tell the cops they can't...PROFILE. Any public servant can be openly filmed. Police, Fireman, EMTs, FBI, CIA, Court Officers. Anyone who's salary comes from your taxes, you may openly record/film them.

I have a question. I have a dashcam in my car pointed forward to record my driving and to act as evidence in the event of an accident. I have not had the chance to do it, but if I ever get pulled over, I plan to turn the camera towards my driver's side window to record my interaction with the officer. The officer pulling me over will most likely not have any idea that they are being recorded . Does this count as 'open recording' or do I need to inform the officer that he is being recorded? I know the question may sound silly, but it's little things like that, that can make a big difference in a lot of situations.
One of the biggest issues I see when I watch 1a auditors etc is when they state that they are going to remain silent.. the cops Always have a way of getting them to talk..! Every time. I’m like “Dude, shut the hell up..”. Silent means silence.
