  • I CAN NO LONGER MAIL OUT KNOW YOUR RIGHTS CARDS. I am so happy that so many people want to know their rights when having a police encounter. When I made the offer in these videos to send these cards to anyone that asked, I thought very few folks would be watching the videos and that I might get 10 requests per week at the most. However, I have been inundated with requests for these cards, getting over 100 requests per day. There is no way I could keep up with all the requests unless I made it my full-time job and working lots of overtime.
    Accordingly, there is no way I can send cards to all that ask. I apologize for this. I will send cards out to residents of Oklahoma. For those that live in other states outside of Oklahoma, it is best to have a card from a local attorney. If you do get in a bind with the police, you are going to need a local attorney. You can also purchase cards that are very similar to mine from the ACLU: shop.aclu.org/Know-Your-Right... NORML also has some cards that you can print out on their website: norml.org/legal/item/freedom-card Here is another web page that has cards in several different languages that can be printed out: cliniclegal.org/resources/kno...
    In this inaugural episode of Know Your Rights, I discuss the three BIG THINGS you need to know about your Constitutional rights.

    very good. I am a lawyer and he's got it right. 1) always ask, "am I free to leave". keep on saying it. 2) I object to searches, I object to being arrested, I object to being detained. Whatever the police want to do, object to it; 3) if they reach for the tazer, say "I have a heart problem and you cannot Taze me" doesn't matter if you don't have a heart problem, if they Taze you, you will, plus a whole lot more problems. Women can say they are pregnant. I think I may be pregnant and you cannot Taze me. A woman can be between 12 and 90 and you can say this. 4) I do not answer questions, I do not answer questions over and over.

    Having listened to this attorney make his pitch, how would you like to hear some real world truth? I have been arrested, and beaten by the police, for insisting on a search warrant for my apartment. Then they took my keys, let themselves in, and searched my apartment. I spent about 27 hours in jail, and had to spend a bunch of money on an attorney to fight thru 2 court cases to keep me out of jail. Constitutional rights are great, but they don't mean squat on the street. Even the judge would not let my attorney talk about Constitutional rights and search warrants in the trial, told us that he would find us in contempt and throw us (my attorney and I) in jail if we raised that topic.
    These video attorneys can rant and posture all that they want. But the bottom line truth is that they will not be there when you have to deal with the police on the street and you try to stand up for your rights. And you don't have to have broken any laws to be arrested. Yeah, the attorney will be happy to take your case and represent you in court, as long as you are paying their hourly rate.
    Another harsh truth that you will probably learn? The truth and justice are not the same thing. Think about that one for a while.

    • @texasfossilguy
      @texasfossilguy 4 года назад

      You made a mistake hiring an attorney. If you fought it yourself and counter sued you could have won.

    • @bigk4755
      @bigk4755 4 года назад +4

      @@texasfossilguy One lesson that I have learned long ago, and this applies especially when opposing C&C Denver attorneys, (but I suspect would apply in any case where it is a private citizen vs the municipality) is that if you represent yourself in court it will not matter whether you are guilty or not, (right or wrong) you will be found guilty of whatever you have been accused of. In this instance Denver was offering 10 days if I would agree to plead "No Contest" (credit for the one day already served awaiting for bail to be processed, probably have to serve 6 more with good behavior). Why would I ever agree to any kind of plea? Especially if I didn't break any laws? Especially if that deal included time behind bars? That was to big of a risk in my opinion to try and represent myself again.
      If I had tried to represent myself, C&C Denver was bound and determined to have me spend some time in jail. The DA had come in to the courtroom and had a private conference with the judge right before the trial commenced to explain how they (Denver) needed me found guilty of something/anything so that I could not sue them for police brutality. That was why the judge would not allow us to raise the issue of constitutional rights and no search warrant. Denver was also gambling that I would not be able to afford to pursue this case beyond district court where they could influence the outcome. On that count they were right, I did not have the means to finance additional legal fighting. If you are poor, then justice does not apply to you as much as if you have money.
      So in short, no. Hiring an attorney actually did keep me out of jail. And several months later at a separate trial when Denver tried to have my seized property condemned, that same attorney was able to force Denver to return that property.
      And for the record, the seized property was a legally sawed off shotgun.

    this is a very informative video as these situations happened to me as a 24 yr old. Cops pulled up on me while i was sitting in my car eating a burger and drinking a shake. They proceeded to ask me every single question you mentioned in this video. At the time i didn't know my rights so i went along with it and they searched every inch of my car and work bags... and when they couldn't find anything they called in a k9 unit to further search the car. I had to stand in front of the police cruiser while an officer pointed a gun at my face telling me not to run or else they'd shoot. They even took the burger i had and tossed it on the ground. After they still found absolutely nothing they were like "you're free to go " and they drove the hell off. No explanation. No apology. I felt so violated, i just drove home crying. All because i simply didn't know my rights being young. That was about 9 years ago.

    For me, I watch a lot of these video's and thought I knew what was going on. Recently I found out just how our rights here in the country are just total bull shit. My stepdaughter got mad at me, said I tried to have sex with her, told her mother and a old busy body woman, and guess what, without, any due process or rights, I was arrested for kidnapping, assault and battery with a deadly weapon. My rights never had anything to do with it, they just said, you are under arrest and where's the guns!!! After nine days in jail, charges dropped and they just said go on your way, after I had lost my wife, which wasn't a bad thing, cause she could have put a stop to it right off the bat, plus I lost most everything I owned... these people were able to say, I was a veteran, I had guns, and I had a willingness to use those guns, and send the police to kill me. What about this??? Nothing was said about that part of it. Funny thing is, I was arrested for trying to have sex with this girl... and I am not able to have fucking sex due to a stroke, and you ask did this matter? Hell no, I was arrested, convicted and jailed just on this girls word!! So, wake up, you have NO rights!!!!

Well with my head injury as a child I blacked out! Came to and there was the cop on the ground with blood coming out of his head! Never did I ever remember what happened? The court let me go with psychological treatment as my punishment! Not even under hypnosis could I remember what I could or could not have done?! No one in the police force liked this cop anyway! So nothing ever was pinned on me, no evidence! Whewww!

      I agree they will not understand, but nothing will work with an officer during a stop. UCC might be used after the stop in court. I figured it could not hurt to put it on the card.

    • @RetSquid

      The UCC would also be totally worthless in court, there is no commerce being conducted there.

    • @my2cents801

      The thought would be to stop any form of contracting. Some people believe that the city police is under a city corporation and they are attempting to enforce a contract you signed when getting a driver's license. You could be totally correct and the UCC may be worthless, but having it on the card does not hurt you either. If there is a chance it might be helpful, why not put it on the card. It should stop anyone from contracting with you.

    • @RetSquid
      @RetSquid 7 лет назад +1

      There is no contract involved in any way, it's the law. Having that on the card hurts you because it shows you are clueless about the law.

What should you do to ensure your civil rights are not violated without repercussion? In other words, how can police officers be held accountable for unlawful activity?

    Love the series. I've watched this one in particular several times over the past few years but it needs an update to #2. It absolutely does matter how you ask for a lawyer. There's a case out of Louisiana a few years back where a suspect asked for "a lawyer, dawg" and the judge ruled against him in court. If there is any ambiguity the cops will pounce on it. Even saying WANT may be too unclear. Say demand or something like it instead.

Seriously, I am retired now, but was a Deputy Sheriff for a good while, and can say that NONE of this stuff is even mentioned in the entire time at the CLEET academy before certification...I have only recently been researching this subject, and can vouch that these subjects aren't mentioned in any of the training I attended. Wonder why these cops act like this? They aren't educating themselves and think they know everything already. Do Away With Qualified Immunity for Law Enforcement!!! i live in Oklahoma, also.

    I had the exact situation happen to me pulled over for a blown headlight i noticed it when i left the shop for the night after everywhere was closed to go buy bulbs and out of courtesy it was a low beam out rather than ride with my hugh beams on i did dim my hugh beams when passing or riding behind anyone and sure as hell there comes a cop he stops me in a spot with an embankment on the passenger side so i was only able to pull about half way off the road he comes to the passenger window and the conversation went something like this
    Officer: do you know why i stopped you ?
    Me: played stupid no i do not
    Officer: youve got a headlight out and you signaled EARLY to make your turn (blown headlight messing with my depth perception)
    Me: ok
    Officer: you got your license on you ?
    Me : yes
    Officer: ok do you have any guns drigs or BOMBS in here that i need to know about
    (Knowing i have a loaded handgun under my seat i said )
    Me: there is nothing in my truck that you need to be concerned with (because Georgia is not a state where you have to admit you have a gun with you BUT if later he did come up with some reason to search he cant say i lied to him because i didnt say no there are no guns )
    Officer : ok ill be right back
    Comes back this time to the drivers side with a headlight warning mind you we are in the middle of a 2 lane state highway at about 11:30 at night so he is now basically standing on the yellow lines
    Officer: can you step out and sign this for me
    (In my head fuckin great here we go)
    Me : yessir no problem
    I get out and i sign it
    Officer: thankyou heres your copy OH and by the way you looked kind of nervous when i asked you if you had a gun do you mind if i search your truck ?
    Me: for what? I havent threatened you or been aggressive
    Officer: well it would just make me feel better
    Me: holds up the warning paper and asks what is this?
    Officer : a headlight warning
    Me: what did you stop me for ?
    Officer: a headlight
    Me : well youve written me the warning ive signed it the traffic stop is over then right?
    Officer: but it would just make me feel better
    Me: well im sorry but we arent here about how you feel we are done here
    He looked like a deer in the headlights without saying another word i got back in the truck and drove away i watched him standing there in the middle of the road in my mirror as i drove away for i kid you not atleast 5-10 seconds

    Good video, and I agree with you 100%! I was a police officer for over 24 years, then Workers Comp sent me to college, when a line of duty injury put me on the disability list. I became a paralegal, graduating at the top of my class, however what attorney in his right mind would hire a disabled former police chief who is over 50 years of age. A total wast of time, but it was a fun 2 years, and I learned a lot that would have been very useful if I had been able to get back to work as a cop. Now I am (presumed) retired by the bureau, they cut my paycheck in half, but still we have enough to return to our winter quarters at an RV park in Arizona. Anyhow getting back to your video, I loved it, wish I could get one of your cards, because people are always asking me about such things when they learn of my background, and they would save me countless hours trying to explain to just plain common nomads what they should do if they have an encounter with law enforcement, no matter what the circumstance. By the way, love the bayonet!
