Consensual conversation is just as harmful, and you should always invoke your 5th before you invoke your right to stay silent!
According to the cop's logic, anybody parking their car in the lot and walking away from it lost their right to privacy in their vehicle. It can be considered "abandoned", according to the cop's logic. And we hear it over and over again "We need to know who you are.". That's the last thing they need to know is your ID. They should establish a crime has taken place first and ID last, as IDing someone will not tell you if they are committing a crime (other than being wanted for warrants, which generally has nothing to do with why they are interacting with the subject, it's like catching criminals by accident).
And you could even go further than that: anyone who set their phone beside them on a table could be considered ''abandoned''. It makes no sense... I think the abandoned doctrine would more apply to an example : the Hunter Biden laptop that was left at the repair shop for more than a month after they called him multiple times telling him it was fixed. I think this would be considered an abandoned effect.
@@gnoel5722 that laptop is only abandoned property by contract. Most shops have a policy about how long they will hold your computer after it’s repaired that you agree to at the time you agree to the service. W/o the contract the shop would likely find that the law would require they hold the property for a number of years before they could dispose of it.
If a US police officer asks for ID, ask whether that's a request or a demand. If they say it's a request, refuse. If it's a demand, plead the 5th amendment and DEMAND Assistance of Counsel for your defence as per the 6th Amendment. Note that it MUST be a DEMAND - saying "I want a lawyer" or "Shouldn't I have a lawyer present" is not sufficient under the laws as they exist right now. If the cop asks why you want a lawyer (and they'll probably phrase it as a want rather than a demand so they can dismiss it), point out that they only have a right to demand your ID if they suspect you of criminal activity and (if you remember) cite Brewer v. Williams, 430 U.S. 387 (1977). "An individual against whom adversary proceedings have commenced has a right to legal representation when the government interrogates him." Then repeat your demand for a lawyer. This probably won't work during a traffic stop because while a cop does need a reason to pull you over, you are usually required to provide it along with registration and insurance documentation to the police officer as part of the stop. But this line of reasoning should hold up if a cop stops you while you're just walking on the street, for example. And if enough people do that, then maybe it will stop the cops from almost automatically demanding ID from people.

My brother is a retired cop and he was (thankfully) a good one. I rode with him one day and he arrested a guy for DUI. When he was dropping the guy off for booking and talking to the magistrate he had counted the incorrect number of steps taken by this intoxicated suspect. A minute later we were outside the magistrates office and I told him I counted fewer steps and he looked at me and said, "Oh, really?" and then stuck his head back into the magistrates office and corrected the count without hesitation. And just to make you laugh, my brother also almost shot a cardboard cutout once. He responded to a convenience store (7-11 sized place) for a breaking and entering and while clearing the store he came around the end of an isle and there was a cardboard cutout right in his face and the cutout was standing about how you would expect someone to be pointing a gun at you. Not necessarily, in the risk-averse courts. Go sit in court and watch just how little it takes to get a man thrown out of his own house with an order of protection.

Whether this officer sees “suspicion” wherever he casts his eyes or whether he just has a hard-on for bikers, his conduct demonstrates a fundamental misunderstanding of the proper role of a peace officer. Once the biker began inserting his rights, the officer’s overly inflated ego and sense of power took over, and he was going to teach this biker a “lesson” about who is “in charge”. My dad began teaching me to drive in the large deserted parking lot shared by two schools. Instead of commending Mr Shared for being a responsible driver the police harassed him. Their suspicious concerns were desolved when he told the officer what he was doing, after that they started making things up.
I can't watch these any more. It's a disgrace at what our police departments have become. Actually they've probably always been this way they just now get caught on camera.
I've had the opportunity to live in a few countries in my life time. And I would agree with you. American has in my opinion the best structure for policing. Marshalls, Metro/City, County, State, Federal, Sheriff's with Sheriff's being the highest enforcement office in the land, as Sheriff's are elected officials and can deputize under the constitution. But yes... All of the other countries I have lived in train their officers far better. 2 years in a police university, then 1 year on supervised duties from a sergeant or above until they are a police officer. In America it's lucky if they receive 6 months of training.
@Nicholasasaurus Rex: In America the first two weeks of training is how to find Donut shops and those with private and / or shaded parking spots to hide in are cataloged and assigned ratings of 1-10. (Donut Dash 101 and 102) Week three on is simply multiple ways to screw over their constituents and steal money from them! (Road Pirate 101 Class) Week 4 is: Lying to the public 101 Week 5 is: Become a better Douche Bag! Week 6: Graduation at Dunkin' Donuts

"You abandoned your bag by leaving it there." -- By that reasoning the police abandoned their cars by parking them and getting out. Does that give Mr. Shared the right to search their cars?
The sergeant didn’t de-escalate at all and gave a lame and inaccurate explanation defending a subordinate’s illegal actions. Shame on this police department and it’s lack of leadership and accountability
Classic example of a superior in a hard place. They cant throw their subordinate under the bus but.. They know its wrong. I bet you they had words after.
Cops backing cops...huh no wonder why the public have problems with police. Hope the mayor sees this and does something about it, because the Chief of Police probably agrees with the behavior of these officers considering one of these officers was a supervisor.
The police unions need to be abolished alongside many of the police perks most notably "qualified immunity" before anything is going to change. Mayors can but highly unlikely do anything about cop issues. Mostly in smaller counties the police holds way to much power for the authorities to do anything about it. In this case at max the mayor can ask the chief of police to investigate the issue as that is the only person that actually can induce consequences on these two cops. But it likely will be another case of "We investigated ourselves and found we did nothing wrong".
It's gang mentality. If he were to be a real leader and correct his officer for his wrong behavior he would probably get his ire. Continue this ethical behavior and the "gang" would soon mutiny.

I used to play fetch with my dog at the local school after hours. I have had the cops called on me and been asked to leave. It is private property and I did not have Express permission from the school. Yes, I did dispose of all animal waste properly.
This was my very first assumption based on the premise. Any reasonable person would come to a similar conclusion first, and not jump to wild conclusions. This guy was way off base. It was insane. At one point I told her I knew our conversation was voluntary and I knew I could leave at any time and I was just trying to give her my alibi so she would leave me alone then she started acting much nicer. Looking back on it I still talked way too much, but she sure acted much more respectfully when she realized I knew my rights.

Even if you had good intentions and felt the desire to offer LE an alibi that alone could have been enough for the LEO to conclude in his/her investigation that you're suspicious because you felt compelled to offer a alibi or could be interpreted as you had a alibi readily available in case you were questioned. For LEO to question your involvement to begin with LEO were, in fact, investigative in their conversation with you.
Exactly
And you could even go further than that: anyone who set their phone beside them on a table could be considered ''abandoned''. It makes no sense... I think the abandoned doctrine would more apply to an example : the Hunter Biden laptop that was left at the repair shop for more than a month after they called him multiple times telling him it was fixed. I think this would be considered an abandoned effect.
@@gnoel5722 that laptop is only abandoned property by contract. Most shops have a policy about how long they will hold your computer after it’s repaired that you agree to at the time you agree to the service. @@arsenicjones9125 ahh good to know. I am guessing it's the same with pawnshops and drycleaners?

Yeah but fuck the cops, don't let them hinder your life... just record that bullshit if it ever happens and hold them accountable
Yeah im sure a complaint will hold them accountable…the system doesn’t allow us to hold them accountable, it’s absolute madness the forefathers of this country are rolling in their graves at what their country became. Rule of law in this day and age is but a myth.
😅👌🏿
I live in the small town of Malvern Arkansas. This is pretty normal here. The last sheriff had a bad habit of shooting people as well. This redneck idiot shot 3 people in 2 years and killed 2 of them
With all the crazy things going on it's still the cops I watch out for the most. They have proven themselves to be bullies that are allowed to lie, even in a court of "law".
Damn, can't even put a backpack down without being harassed
I like how they cop searched the bag saying he doesn't know if it really belongs to the rider then proceeds to place it on the riders motorcycle after he was done searching.
Great video. Always informative.
next time you see a unlocked (cop) car - utter I TAKE POSSESSION OF THIS ABANDONED CAR and go check if you can find any dangerous items.
Take all the weapons out and lay them on the hood, then ask the cop, "IS THERE ANY LEGITIMATE REASON WHY YOU NEED TO CARRY THESE WESPONS"?
If you find any drugs, you've hit the jackpot! Cause then you can say, "YOU'RE UNDER CITIZEN'S ARREST FOR POSSESSION OF CONTROLLED SUBSTANCES WITH INTENT TO DISTRIBUTE."
When I bought my first motorcycle I often went to the local high school parking lot after hours to practice driving because it was a large open paved area.
I have done the same thing
I used to play fetch with my dog at the local school after hours. I have had the cops called on me and been asked to leave. It is private property and I did not have Express permission from the school. Yes, I did dispose of all animal waste properly.
i’ve done it too
Your taxes pay for it so what is the big deal right?
This was my very first assumption based on the premise. Any reasonable person would come to a similar conclusion first, and not jump to wild conclusions. This guy was way off base. And this is yet another fantastic example where the officer hanging back and observing would have been far superior to confrontation.
Hard to tell who the Sargent is. He didn't have authority over his men. He's not respected.
File the complaint, sue this cop.
That should be a pretty decent lawsuit. Cops don’t get held accountable bc most people even the ones who video their encounter usually don’t do anything. Cops knows this and depend upon it
That’s why they hate messing with rich people
Cops are better than you, at least to your government. Get fucked ig, as a citizen you can be nothing but a subject when the cops are around. They don't care about what's real or just, just whatever they happen to feel like.
So if I parked my car in a parking lot and walked away, would that be littering by that officer's standards?
Fire them, strip them of their qualified immunity, and sue them for their personal wealth. This is ridiculous.
J. Stenburg. You are 100 percent correct. If you are a LEO Which includes detective, and all others and have been blessed with the govt allowing you to LIE THEN YOU have to pay the fine out of your own money instead of paying using our tax money. Hopefully this would cut down on the. Cops doing illegal things.
You didn’t know what you were saying. You still don’t! Just start paying rent at your moms

This is why finding a good cop is so hard. They stick up for each other regardless how wrong they are. Truly a disgrace how unprofessional they act these day's. Just disgusting behavior of corruption.
I really hope this young man got a good lawyer!!!
Good lawyer? ....isn't that an oxymoron?
Getting a lawyer is the first problem, most aren't interested in helping citizens.
I have watched a lot of these auditor videos and one thing is painfully clear is the cops are actually very ignorant of the laws they are supposed to uphold and that needs to change! Auditors have opened our eyes to this fact! And I thank them for bringing this to our attention!
I disagree most cops know the laws and your rights. The average person does not know their rights and laws. When a cop asks for something or tells them what to do the average person listens and obeys. Cops are so used to it of course they try to enforce non laws and violate your rights. Those that challenge the cops on a non law and a rights violation the cop gets upset. This video is a good example.
@@kurtwetzel154
Yeah. The cops had to know no judge will call that littering or abandoned.
What do you expect? They do 6 months at the academy, maybe a year with a training officer. A hair stylist needs 2-3 years of training before cutting a customer's hair.
@@kurtwetzel154 On one hand, yes, we don't see the many cases where cops act professionally, but on the other hand, how many cops approach citizens who know their rights? If they suddenly all knew their rights, we might initially see 10, 100 or 1000 times as many videos like this.
@@kurtwetzel154 what is the basis of your claim of what "most cops" know?
To have abandon his property he would have had to attempted to or left the area , he didn’t therefore this entire interaction is invalid, fruit of the poison tree is the colloquial term.
Cops like this need to be fired, the arrogance and hostility of these cops is absolutely disgusting.
And by backing his partner, he has now crossed the line from a LEO to a fellow gang member of one of the largest criminal groups in the nation.
You're so funny.
They were most definitely violating his rights trying to justify their actions yet again!!!
So according to these cops, I can go through anyone’s stuff if they put it on the ground. Gotcha.
Audit the Audit gets an A+
He should sue the department, it'll prove lucrative.
By taking taxpayer money. Hardly fixes anything.
@@michaelhaydenbell If it costs the town money, rest assured changes will be made.
@@michaelhaydenbell Doing nothing fixes even less.
@@michaelhaydenbell That's the same argument people use to NOT punish lawbreaking cops and politicians constantly and it's disgusting. No, costing that police department money will cause them to hire better cops and follow legal policing practices when it guts their budget. Stop being part of the problem.
@@michaelhaydenbell
Well bless your heart !
Sergeant needs to search his ass for the law on that.
Me: Throws a frisbee at the park.
Cop: "Hey! You just tossed a foreign substance on the grass. You're going to jail for littering young man!"
This cop baited his bag , so that he could search it illegally
Wtf is happening to this country. Every one and activity is suspicious and crime.
Better be careful about what you think about, it may soon be a crime too.
America is slowly turning into north korea.
It isn't happening now. It has BEEN happening for a long time. The only difference is NOW, there are more people recording it and showing the corruption and abuse on the internet for EVERYONE to see it.
@@sownheard first it's going to turn into China since the new democratic president leans China. China is very progressive but also limits freedom of it's people and implements mad censorships.
@@ic3dragons223 You haven't been paying attention. Police problems starting happening more and more after 9/11 and got way worse under Trump. If anything Biden will help bring sanity back to law enforcement.
Why do all cops say “youre obstructing” any time you stand up for your rights lmao
B/c it's much easier to throw that argument out there than it is to properly defend it.
Because it actually legally obstructs them... and they hate it
Because they are trying to manufacturing a crime.
It’s not your right to deny ID or violate laws. If you think you know the law better than cops go ahead and refuse, resist and flee.
@@mattb6646 right it easier to comply
Imagine if Amber Alerts were as quick as that bag was deemed abandoned!
Ya know, this is like watching I.D. channel. It's amazing how the videos are endless - just like every time I turn on I.D. Just when you think you've seen it all, along comes another one. Watch the news too and you'll see that it doesn't matter how pissed off the public gets, police depts just keep doing dumb shit - week after week. The list just keeps growing and I think part of the reason is the lack of 'man power'. Because there's such a shortage of officers, they hire ANYONE that walks in regardless of whether they know the law or not. I live in the D.C./Baltimore area and at last check Baltimore was down by about 1,500 officers! That's got to be part of it which is why these videos are imperative to get out and inform people of what's going on nationwide. I commend the channel and I learn something new on every single one of them. Very well done!!
Had to edit for a final thought concerning the illegal search and seizure, the worst part is that, even though it would probably be thrown out on that alone, all you ever get is a "you're free to go" in court. No restitution. No apology. Nothing. Just a waste of your day and a loss of that day's pay either. Half the time, they don't even show up if they know they were wrong! But you? Try not showing up and out goes the bench warrant for more hassles to continue. What starts out being a simple offense quickly becomes a major concern.
