After watching this video I wanted to see what my state say about where a officer is allowed to be. And ran across a story where a officer at midnight saw a car in a driveway with its lights on. Then the officer a hour later saw the headlight still on. So he block the driveway and saw urine on the outside of the car. Then he went around the the passenger side of the car and saw a person slumped down asleep in the car. The officer arrested the man in the driveway for a DWI. Even though he had no proof that the person was out driving the car on public roads.
They are experts at twisting the stories just enough to favor them and make you look dangerous so their buddies go in hard. Thankfully body cams exist. But we really need a better way to audit the police actions. Them investigating themselves never works since they lie like pigs.
Also the law here is so questionable; you are standing in the door and as the cop tries to plow though you, you are "resisting", by not diving out of the way I guess?
The second video is wild. That cop just does a chokeslam on the dude and invites himself in for no reason. Then the cop tries to rewrite history and deny what happened.

Law enforcement shouldn't be allowed to lie on matters of law. With very limited exceptions. And if they don't know the law that they're trying to enforce? Or they don't understand the constitutionality of the law that they are trying to enforce? Shouldn't they be held personally accountable for their behavior in actions?
I'm flabbergasted that they have a law that they can't resist an unlawful arrest! Police can do whatever they want there. Including that home invasion and assault.

I generally try to recognize law enforcement are given an extra set of laws, they can break them if requirements are met. However I've always though, well if they break them and the requirements were not met, there should be no such thing as immunity. If you break into someone's home, for no reason, assault two people, for no reason. Then show no remorse. You should be held to a standard of the law as a normal citizen. Since he didn't use any of the extra circumstances on his side. The most sickening part is how he continuously made it about him. How the dog attacked him and the children ran screaming. If resisting an unlawful arrest is a criminal offense then an unlawful arrest should be a felony, especially when it's as blatantly wrong as this one was and involves a completely unwarranted battery.
Until someone with deep enough pockets can challenge that law all the way to SCOTUS, the state of PA will continue to get away with an unconstitutional law. Not being allowed to defend yourself against cops should be a violation of the 2nd Amendment.
The law as a whole is weird. We make it up as we go, cops break laws to “figure it out in court”, and new laws are made and named after victims lol. And at the end of the day cops are nearly never held accountable unless they have no other choice and most of the time it’s a paid vacation or they just (get “fired”) have to go work in another state/county/parish whatever. That 2nd video is absolutely shocking how that officer behaved. Absolutely assault and battery, and violation of entering home without warrant or probable cause.
Also a perfect example of how there's nothing that can't be made worse by inviting police into the situation. Especially when it's a mental health disorder. By asking police for help, this guy got attacked, choked, home invaded, arrested, jailed, and likely charged with a crime. Fella needs to get into a mutual self-help community for mental health, and probably drug abuse.
I disagree. The first violation can be documented with 30 days in jail depending on the discretion of the judge. The second violation should be at least 90 days in jail and a loss of pension. The third violation should be removed from duty, no collected benefits of any kind, 5-10 depending on severity, and a permanent ban on working in law enforcement. If it's "three strikes for me" why isn't it "three strikes for thee" for them?
Resisting isnt just against arrest. They also use it as another form of obstruction of government operations. Resisting their tyranny is a crime to them.
They’re aware that it won’t stick but they also know that they can arrest you and let the courts sort it out later and there’s nothing you can do about it once they’ve decided to arrest you.

I've seen cops arrest a priest for feeding the homeless. Got my first job at McDonalds. They wrote me up twice when for bagging the wrong orders they throw in the trash but i couldn't help it bc everyday omw home from work, id see the homeless man under the crossover holding a sign asking for "food only". To avoid the write ups, id order my free meal when i got off instead. Aft a month or so, these people made is so we can only get a free meal on our breaks and u have to eat in. Humanity is fkn doomed

It is. I'm not sure how true this is, but there's some country where apparently escaping from prison isn't illegal because they see it as normal human instinct. resisting arrest should be the same. The charge is abused far too often anyways. It shouldn't even exist

The responding officer said “I understand it” referring to the innocent man wanting to press charges against the off duty cop and the supervisor responded “yeah I would have done the same thing” thinking the responding officer was talking about understanding the assault committed by the off duty cop.

My understanding is that police reports are not under oath, but affidavits are, so that may be why you don't see LEOs get nailed for perjury on a police report.
Girl Scouts do NOT have to get permits. I used to be a Girl Scout back when they still went door to door and had booths outside of retail like grocery stores and pharmacies, my mother was the "cookie mom" who ran everything for my troupe, and we NEVER had to get a permit to sell cookies. Ever. That cop is full of sh*t.
I sold "World's Best Chocolate" bars as a kid for 5th grade camp and Safeway, Walmart, and many big chain stores required a permit to solicit on their property. This could be a state to state basis, but when I went inside, this exact policy took up the entire wall by the claw machines in customer service.
@@soultrex9722 To clarify, it's not State law that differs, the diff is between PUBLIC and PRIVATE property (ie Wal-Mart etc are PRIVATE entities). The ACTUAL ISSUE raised here is a CONSTITUTIONAL one. Ie, pertaining to citizens 1stA rights in PUBLIC areas. You need to get permission in PRIVATE locations (which can charge a fee if they so choose), but you cannot charge a fee or be selective (as in issuance of permits), for 'access' to Constitutional RIGHTS. It was done this way because these stores owned the parking lot and the store permits helped the stores manage/secure their property. However the whole process of going to the city for these things is indeed far too much

An addendum to this is that private businesses can still ban solicitations on their private property, so if there are posted signs saying they don’t want solicitors then you do still have to comply.

A cop can do pretty much whatever they want and as long as they have even the flimsiest justification, it's entirely legal. "yessir, the 105 year old woman with cancer and only one leg lunged at me with a knife. I had to tackle her and bash her face in repeatedly." *meanwhile, body cam shows the old woman sitting down calmly with a knitting needle. (in this, cop forgot he had a bodycam, as most seem to do.)
That's every state. There used to be self defense against cops but it got removed. The cop could know you personally and actively try to unalive you when off duty. Defending yourself is automatic life. No self defense is allowed.
I see the fire department employees running around with a boot asking for money walking in and out of traffic while at a stop lights. I've never heard of a firefighter being arrested for soliciting.

'short of possible death' doesn't even apply. there are countless cases where the cops used unlawful and excessive force, both where they had no authority to even touch someone let alone use enough violence to end their life, but then they use enough force to end their life, and they are deemed to have done nothing wrong and even receive promotion, not even being forced to go through the 'moved-to-the-next-town-over' catholic priest shuffle. in almost every state and every city, if the cops can create a false narrative that is proven wrong by video evidence, MAYBE someone get away with self-defense against criminals with badges, but the general rule even when your life is illegaly endangered or actually taken, if the person doing it took a few week course and got a uniform from the government, your rights don't matter and if you do somehow defend yourself, you're going away for a very long time assuming the cops gang-member buddies don't go for more immediate retribution.
@@xjcrossx If you'd actually watched the video before commenting you'd have seen where he read the statute that says in no uncertain terms that in Pennsylvania you do not have a right to resist arrest, even if it's unlawful, followed by a Supreme Court ruling in the state reaffirming this, and stating unequivocally "there does not exist in Pennsylvania a right to resist arrest, under any circumstance." Whether or not that should be the law (and to be clear, it shouldn't be), the problem is apparently that's what it is at the moment.
My city has laws against begging on the MEDIAN. Not public sidewalks. I agree it was dangerous to have people in traffic on the median at intersections.

Anyone else notice the police officer rolled down the squad cars back window with the arrestee not wearing a shirt and having wet socks from having to walking the snow to get to the car. That's a classic example of cruel and unusual punishment.
This literally happened in my city a few years ago. They had a similar law that was deemed unconstitutional, a homeless man who was arrested for this law like 25 times sued and won about 4 million dollars.
I would disagree with the grading in the first video. Police is executive branch, not legislative, right? Seems rather that they did their job quite well. Didn't even arrest her rightaway, but gave her a chance to leave. Also they actually printed out that ordinance, which is a huge service. Aren't citizens usually required to know the laws, regardless of their constitutionality? Also also it's at least good that they changed the law rightaway. Usually this would only go through arrest, courts, escalation to supreme court. Or political action.

How can the Supreme Court keep allowing Pennsylvania to be able to keep a resisting arrest charge in their books when no other crime had occurred is well beyond unconstitutional? What a crock!
Had anyone challenged it all the way to SCOTUS? There isn't a division that looks at state or federal laws, determines there may be a constitutional violation and then sends it on to the full SCOTUS. Personally, I think that should be part of their job as the branch of government tasked with making sure the legislative and executive branches don't violate the Constitution.
@@buckeyenative1365 that is what is wrong with our court system...too many times you hear of a court challenge being made but the appeals courts refuse to make decisions and kick it back down to the lower courts...so many times they could have settled case law but instead refuse to do their jobs...we need to wipe the slate clean, get rid of ALL federal judges all the way up to SCOTUS, and take the power of appointment away from the President and Senate as we see that has HUGE holes in it that can violate the constitution. Make all new applicants go thru a rigorous background check, and if they are not able to pass the same muster as our military is to get a security clearance then they can't be judges either. Then voters for each district vote for their federal judges with 10 year term limits on the bench, if they are judges at a lower court they can apply for judgeships at higher courts....same goes for SCOTUS...10 years max, voted on by the entire United States....have the terms spaced so that we vote 2 to 3 new SCOTUS judges every 2 years during the regular elections.
The Supreme Court doesn't go around nannying individual laws, it tries cases. If such a PA case makes it to the Supreme Court, and is overturned, THEN you can start bitching.

I used to be a Girl Scout back when they still went door to door and had booths outside of retail like grocery stores and pharmacies, my mother was the "cookie mom" who ran everything for my troupe, and we NEVER had to get a permit to sell cookies. Ever. That cop is full of sh*t.
I sold "World's Best Chocolate" bars as a kid for 5th grade camp and Safeway, Walmart, and many big chain stores required a permit to solicit on their property. This could be a state to state basis, but when I went inside, this exact policy took up the entire wall by the claw machines in customer service.

To clarify, it's not State law that differs, the diff is between PUBLIC and PRIVATE property (ie Wal-Mart etc are PRIVATE entities).
The ACTUAL ISSUE raised here is a CONSTITUTIONAL one. Ie, pertaining to citizens 1stA rights in PUBLIC areas. You need to get permission in PRIVATE locations (which can charge a fee if they so choose), but you cannot charge a fee or be selective (as in issuance of permits), for 'access' to Constitutional RIGHTS.

That second video is psychotic. The cop walks up, asks what's going on, is told "you can't come in quite yet" and without saying another word immediately proceeds to beat the shit out of the guy. And because the law says you're not allowed to resist under any circumstances short of possible death that's totally fine? Just, unbelievable.
it's worse than that. 'short of possible death' doesn't even apply. there are countless cases where the cops used unlawful and excessive force, both where they had no authority to even touch someone let alone use enough violence to end their life, but then they use enough force to end their life, and they are deemed to have done nothing wrong and even receive promotion, not even being forced to go through the 'moved-to-the-next-town-over' catholic priest shuffle. in almost every state and every city, if the cops can create a false narrative that is proven wrong by video evidence, MAYBE someone get away with self-defense against criminals with badges, but the general rule even when your life is illegaly endangered or actually taken, if the person doing it took a few week course and got a uniform from the government, your rights don't matter and if you do somehow defend yourself, you're going away for a very long time assuming the cops gang-member buddies don't go for more immediate retribution.

@@xjcrossx If you'd actually watched the video before commenting you'd have seen where he read the statute that says in no uncertain terms that in Pennsylvania you do not have a right to resist arrest, even if it's unlawful, followed by a Supreme Court ruling in the state reaffirming this, and stating unequivocally "there does not exist in Pennsylvania a right to resist arrest, under any circumstance." Whether or not that should be the law (and to be clear, it shouldn't be), the problem is apparently that's what it is at the moment.

I get what youre saying, it is. But I’ve known career criminals that wouldn’t agree, they would always tell me that the cops are always right even when theyre wrong. That a person should be strong and face the consequences of their actions no matter what. Basically that the buck has got to stop somewhere, the alternative is complete chaos. Even in prison there is usually a hierarchy to maintain order, because some people are just no good. Imo if drug laws didnt exist the way they do the whole dynamic would change. Could focus on violent people and pedos etc. rather than trying to control what people do with their own bodies when it doesn’t directly affect anyone

This literally happened in my city a few years ago. They had a similar law that was deemed unconstitutional, a homeless man who was arrested for this law like 25 times sued and won about 4 million dollars.

I would disagree with the grading in the first video. Police is executive branch, not legislative, right? Seems rather that they did their job quite well. Didn't even arrest her rightaway, but gave her a chance to leave. Also they actually printed out that ordinance, which is a huge service. Aren't citizens usually required to know the laws, regardless of their constitutionality? Also also it's at least good that they changed the law rightaway. Usually this would only go through arrest, courts, escalation to supreme court. Or political action.

How can the Supreme Court keep allowing Pennsylvania to be able to keep a resisting arrest charge in their books when no other crime had occurred is well beyond unconstitutional? What a crock!
Had anyone challenged it all the way to SCOTUS? There isn't a division that looks at state or federal laws, determines there may be a constitutional violation and then sends it on to the full SCOTUS. Personally, I think that should be part of their job as the branch of government tasked with making sure the legislative and executive branches don't violate the Constitution.
@@buckeyenative1365 that is what is wrong with our court system...too many times you hear of a court challenge being made but the appeals courts refuse to make decisions and kick it back down to the lower courts...so many times they could have settled case law but instead refuse to do their jobs...we need to wipe the slate clean, get rid of ALL federal judges all the way up to SCOTUS, and take the power of appointment away from the President and Senate as we see that has HUGE holes in it that can violate the constitution.
Make all new applicants go thru a rigorous background check, and if they are not able to pass the same muster as our military is to get a security clearance then they can't be judges either.
Then voters for each district vote for their federal judges with 10 year term limits on the bench, if they are judges at a lower court they can apply for judgeships at higher courts....same goes for SCOTUS...10 years max, voted on by the entire United States....have the terms spaced so that we vote 2 to 3 new SCOTUS judges every 2 years during the regular elections.
The Supreme Court doesn't go around nannying individual laws, it tries cases. If such a PA case makes it to the Supreme Court, and is overturned, THEN you can start bitching.
And how can you resist an arrest, when the cop didnt say a word to him? He just walked up and turned violence up to 10. Is he supposed to read the cops mind or what? I thought citizens must be aware of the arrest, before it can even turn into resisting.
