    The problem isn't our rights, the problem is that there is little to dissuade police from abusing their authority and flat out lieing.
    Say you refuse a search, what is to stop a cop from claiming they smell pot?
    The bottom line is there is little stopping police from this as there is no consequence from BSing because proving they intentionally lied is almost impossible and even if you managed to prove they lied, they face little consequences.
    Until individual cops have something to fear besides paid vacation this will continue.

      schlooonginator you can repeat that you have NOT consented to ANY search and argue that. Keep your mouth shut, get a lawyer and tell him/her that.

      They are paid very well and have no education especially on laws and rights. They take an oath to protect our constitutional rights but they don't know them or care. This is a systematic problem extending to prosecutor's crime labs and just about every other government branch that is employed by we the people.

      USSupremes ruled it is lawful for police to lie. Recently.
      They also approved police can steal under forfeiture laws and can keep the money. They have millions in their retirement funds. You can sue to get money returned but one cannot always afford to do that. So we encourage and reward their misbehavior, i.e., criminal behavior. We need laws so the Supreme cannot make such rulingsm their decisions are taken under consideration of the law.

      I had DC court charge me with a crime, dismiss the charge That gave them probable cause, and still found a way to drag out the court proceedings for almost 2 years, and counting

    In addition to asserting your rights, we need legislation to eliminate the idea of "policing for profit". This includes the unofficial quotas that exist in nearly every department. Police and/or city budgets should not depend upon the police ability to write a certain number or amount of tickets to support shortfalls in the budget. Finally, I believe that the laws supporting Civil Asset Forfeiture needs to go to the Supreme Court as fundamentally unconstitutional against the 4th Amendment. Crazy world we live in today!

      Note: If a cop tells you to get out of your car, BE SURE TO CLOSE THE DOOR BEHIND YOU! By leaving it open, you are INVITING a search!

      @@samuellane8691 it is also an excellent idea that when shutting the door behind you with all windows rolled up or lock the vehicle with your keys on the floorboard always keep a hide a key somewhere on your car so if it is possible that you have to get back into it you may this will keep them from searching it 100% as well as when they ask how you plan on getting back in say I plan on calling a locksmith as soon as you gentlemen are finished with me and then after a few minutes you can get the key out and let yourself back into your car I personally I found this to be a very good idea

      @@suzanh7777 , actually many peace officers and deputy sheriffs, along with certain federal law enforcement agents are recruited directly out of the military. This is especally true for military members who do not hold technical or clerical MOS's or Ratings. Consider this, an individual served a 4 year contract as 11-B or another combat related position. They are trained in weapons platforms both long and handheld, have adapted to stressful environments and situations and have honed their incident management and deployable assets skills. All the while, maintaining continious combat training and physical ability standards.
      There are very few civillian employment options for them. Therefore, advanced level security and executive protection, government overseas contracting and law enforcement are enticing alternatives to flipping burgers at the local greasy spoon restaurant. Due to the maintenance of PT standards while in the military, the physical agility exam and law enforcement academy (FLETC, State & Local Department) will not be a problem.
      The largest hurdle for these individuals is learning and deploying the legal and procedural requirements on a pass/fail basis. Most of police work is talking to people, finding the facts in between the 100's of lies that are told to you each shift and report writing. Some can adapt, while some wash out. Some wash out in the academy, while others break during their probationary period with their FTO, (Field Training Officer). Fewer still, slip under the radar and it may take a year or more to figure out that someone is a crappy officer or abusing privileges.
      The biggest problem is that citizens think officers are robots. They are human too, they are fallible and they too have feelings. I had a woman scream at me for 5 minutes because she felt that I was not being kind enough to her during a traffic stop. Basically, I was not kissing her ass enough, to meet her standards. I apologized to her and stated that I would try harder. I let her go with a warning.
      What I did not tell her is at the beginning of my shift, I responded to a head-on collision at an intersection. Vehicle #1 had a passenger in the front seat that had a seat belt failure. She kissed the windshield at approximately 50mph. So, I pulled the 11 year old girl out of the car and did CPR on her for nearly 20 minutes until EMS arrived. They worked on her for about 10 minutes and called it. She did not survive,... I still remember the smell the shampoo emanating from her hair when I provided rescue breaths. When I smell that brand, it takes me right back to the paramedic telling me she is not responsive and we will do time of death at the hospital.
      Two hours later I had a speeder screaming at me, telling me how horrible I am,.... 10 hours to go until end of shift. That is an event that nearly every officer goes through, out of 100's or 1000's of similar events over the course of a 20 year career. They see the worst that humanity has to offer, are lied to continuously and yes, because they are human, they have bad days,... sometimes very bad.
      So, when thinking about the job and the times where you are the first to encounter tragedy I would prefer to have someone with military experience backing me up, as they have been specifically trained on how to physically and mentally combat the very worst society has to offer. Yup, Fuck the Police, even if they would take a bullet for you and put your life ahead of their own. Cops are some shallow people, eh!?!?

    It's great that you, Steve, have set all this up and have taken the time to organize all this information. I applaud you Sir. I sincerely hope that the people, citizens of the US, take all this to heart and learn to exercise their constitutionally protected rights that the former patriots of this country fought and died for.

    Well, responding "No" when asked by the officer "You don't mind if I take a look?" is bad news. It could be taken either way but the cops interpretation is the one that will win the day in court. Take Steve's first advice "I do not consent to searches". Try always to video the encounter with the cop -

      Get a Dash Cam,... Walmart from $20.00 to $50.00 depending on available models. Then you have a recording of the encounter and do not have to rely on their saving footage and filing a FOIA request for the encounter.
      The best way to not get pulled over is obey the traffic laws. Its not hard, my last traffic stop was in 1996 when the new seatbelt law was imposed. I forgot to put it on and got a warning. Yes just a warning,... because I was not dick and explained myself. Drive safe...👍🏽

      @cassl14 , what makes you think I am not a minority? That was a little presumptuous by enagmatically insinuating that I do not qualify based upon a lack of empherical evidence. However, as an example; My, Son lives in Provo Utah, is Black and never gets pulled over. Mainly because we had "The Talk" when he was 16 years old and he obays the traffic laws. It is, most of the time, how you carry yourself and communicate with others that will dictate what reaction you will recieve from law enforcement. With that said I will say that Utah is the epitome of "Whiteness", as the entire State looks like an Abercrombie & Fitch advertisement. So, thanks for pulling the "Minority Card", but you need to slip that one back in the deck. Love, Peace,... and Hair Grease! ✌🏿

      I definitely regret surrending my rights to police who pulled me over when I have a person of color with me in the car. We were ordered out on the curb and my car was searched in Brooklyn Park mn

      When I hear about police safety, how their number 1 priority is to make sure they and their partner make it home that day, I'm reminded of roofers and drivers. The police took an oath to defend the Constitution. And they're supposed to put themselves between danger and myself to assure I make it home safely today. I'm inclined to believe roofers and drivers could do a better job in protecting the rights of everyone. They certainly look at greater daily risks with more steel in their balls than cops.

    I refuse to consent to any search of my premises, the location of my arrest, my car, or my effects. I wish to exercise my rights under the Fourth, Fifth and Sixth Amendments to remain silent and to have my attorney present during any questioning or lineup. If you ignore my exercise of these rights and attempt to procure a waiver, I wish to confer with my attorney prior to any conversation with the law enforcement agent on the subject of waiver.

    You know if police pull you over and you feel threatened you can stay in your car and call 911 and tell them you fear for your safety.

      I had encounter with a several cops at my condo one night. One, that refused to show me ID tried to force his way in, no warrant, my wife called 911, and told then someone pretending to be a cop was trying to force his way in. 911 operator told her the duty Sargent was walking up to the door, we talked, the cops went away!😊

      We shouldn't have to fight for our rights. That's why we need to DISBAND not defund the police. The current crew must be dismissed and less new ones should be hired and trained according to our new standards. All interactions with the public MUST be recorded. Failing to have their cameras on should be cause for dismissal. Not after five times. The first time. Other functionaries can handle domestic cases, mentally ill people, etc. These Pigs must be taught that they only squeal by our permission.

    I have a disabling condition which causes me to slur my speech often. So, rather than communicate this fact and give the police reasonable suspicion or probable cause to search my vehicle or to create trumped up charges of dui or driving under the influence of drugs Is it legal in Prince George’s county, md to have a typed sign alerting the police when stopped that due to not wanting my fifth amendment rights violated ( self incrimination) , I intend to show you my license, registration , my disability card & proof of insurance in a clear sheet protector cover up against this window, keys will remain visible on my dashboard & doors kept locked for my protection. For I am disabled and I don’t want to be subject to being thrown from my vehicle on a technicality.
    If you are going to issue me a citation of any kind , please put it under the windshield wiper and I will retrieve it once you pull off. Thanks for understanding officer.

Is it legal in Prince George’s county, md to have a typed sign alerting the police when stopped that due to not wanting my fifth amendment rights violated ( self incrimination) , I intend to show you my license, registration , my disability card & proof of insurance in a clear sheet protector cover up against this window, keys will remain visible on my dashboard & doors kept locked for my protection.     Thanks Steve. Very informative video, as are all the rest you have here. I think the more officers (and elected representatives) choose to take liberties and bypass the constitution, the more it becomes necessary for citizens to bring them to school and remind them of it. Calmly and politely, of course.

    Steve and "Flex Your Rights" are providing an essential/important service to US citizens. I admire, respect and appreciate Steve's work!!! Great interview, thanks to C-SPAN for covering this issue. "Bad cops" hurt the reputation of good cops who behave appropriately and within the law. I think it is important to get that message across to those good cops - the "thin blue line" does not ultimately really serve the best interests of the police force in America!

    I'm always surprised by how many police officers do not seem to know the law, or just playing dumb. They do lie a lot and correct me if I'm wrong but I heard they are allow and can lie to get information from you.

    That police officer is absolutely correct that "driving" is a "commercial activity", when you are "charged" with an offense, that IS a literal "commercial activity ~ a commercial financial charge or debt". YOU OWN NOTHING!!! That "vehicle", a commercial term, that you drive is NOT yours, it belongs to the "government" as evidenced by the "license plate". A "driver" is a "commercial operator" of a "commercial vehicle". Your "driver's license" is a "commercial license" to operate the government's "commercial vehicle", the car that you incorrectly believe that you own. What I have just written is less than the "tip of the iceberg" of the deception of the American population. You guys do know a small amount and you are doing a good job. Have a great day!!!

    Best advice. Avoid encounters with law enforcement of every stripe !!! When an encounter is unavoidable remember that you are dealing with a dangerous and unpredictable force. Act submissive and avoid confrontation. Assert your legal rights humbly, if at all !!! Always remember that police are very sensitive about their AUTHORITY !!! Avoid questioning it. Good luck !!! You'll need it !!!

      Sounds like they have personality issues narrssisstic or phsycopathy maybe part of their training should include intense mental health test I have to had it to Alaska Troopers they deal with heavily armed drunk and what would be labeled DANGEROUS and it is RARE any even draws a gun against the other maybe they should internship in Alaska also

      I agree about being humble. When I see people trying to flex their rights on camera they come across like trouble makers. I know they mean well but few of us are skilled at public speaking let alone during a stressful police situation. Unrehearsed, we see a lot of people disapprove of those who are trying to educate public and police about liberty. People think they're jerks. For that reason, I would like to see the utmost respect, almost ass kissing if you will, to explain reason to the police If we don't flex our rights we lose them.

    the federal court in Boston, MA said a few years ago at least. That it is ok to video and audio police at all times when they are on duty in any public or official space (ie the PD while their beating a guy) they have no right to privacy unless in a bathroom or locker room type of thing. NO STATE may pass a law that goes against federal law.
    I would suggest locking your phone with a code and also if you shoot video that you use an app like bambuser that sends it to your email or right to the web itself. That way the police cannot delete it and you can get it to your lawyer and to sources that will force justice to be done.

    My wife recorded an encounter as a passenger where police pulled them over with zero reason. They were polite to the officers, said very little, gave licences etc, but a second officer came to the passenger window while the other one was away checking things. This officer proceded to tell them to get back to their side of town, grilled them about what they were doing in the area, and insulted them repeatedly, up and down until the other officer returned. This was all recorded on my wife's phone. When they went to listen to it on the ride home, nothing but a short loop of static. We figured out that you may need to carry a digital battery operated recorder because some cops will scramble your recording...which is illegal. BTW, the next day, there was was no record of the the stop-also against the law. None. Hmmm. I wonder why.

    16:40 William did not receive an answer to his valid question! In fact the answer he received was extraordinary and a logical fallacy that raises red flags with regard to Mr. Siverman's activities and his actual agenda. William alludes to deep law seldom brought to light that affects Constitutional and individual Sovereign rights. These rights, if understood by the majority, would likely protect the USA from being overthrown by an unnecessarily 'manufactured revolution' that could destroy an otherwise excellent Constitutional system.
    The fact that Mr. Silverman chooses, instead of answering the question asked, to undermine the officer's question by diverting from it and instead associating him with criminal activity is BIZARRE.
    Any organisation that genuinely seeks to defend and promote Constitutional Rights is to be encouraged but there is also the possibility for any organisation to have ulterior motives. e.g. winding up citizens for purposes other than simply defending their Constitutional rights. e.g. Disgruntled citizens rising up against legitimate 'minor' issues can end up destabilising the entire status quo. I am not saying that Mr. Silverman is doing this - I am merely pointing out that his failure to address the question asked, and the manner that he did so, was peculiar. These are troubled times, we need to be particularly vigilant.

    What the policeman at 16.41 was saying is that virtually all traffic statutes in every state are written to control the flow of the only thing the state is allowed to regulate … that would be commerce. Only a commercial for profit ‘driver’ is legally liable for traffic code violations. People are simply suckered in by the police by their immediate ‘request’ for your driver’s license etc. and when you ‘freely’ comply with the REQUEST unchallenged. One of the best things you can do is to clarify on camera at the start of the traffic encounter your declaration that you are not in any way involved in commerce or hire for profit. That should get your ticket dismissed if you fight the ticket. Do your own research first as always.

      You Are full of shit. States have plenary authority to regulate all sorts of things. Even the feds have authority to regulate more than just commerce, although they have to tie most of their regulations to commerce to justify them.

    16:55 That young lad was getting at the fact that driving has a different meaning to travelling etc, that's what that poor guy was trying to say, strictly speaking they are exploiting common law and technically they're not meant to be able to stop you simply travelling, Only of you are "driving" (as in it's for your job ie: truck driver, taxi driver, etc.) I do doubt he was law enforcement, cops don't usually believe in freemans law.

    On the "civil asset forfeiture" law, if a cop steals the cash you have on hand, should you consider that criminal robbery and should the civilian have the right to defend his property by killing the officer as if the officer where a common criminal?       I am dirt poor and if they only took a couple thousand, I would not even fight it in court, because it would cost more than that to get it back.
      But if I had a couple $Million in cash (and I would be insane to carry that much cash) that would be an entirely different matter.
      And I think I disagree a little bit with you on that no law would get repealed. If the encounter was recorded and IF enough cops are justifiably killed I think they would eventually they would get the message and have to back down. Of course I would be long dead and buried, but if that is what it would take....
      You have to ask yourself, how many soldiers died to make and keep this country free only for the citizens to complacently turn it over to a tyrannical government?
      As citizens we have not only a right but a duty to fight for our freedom from all Enemies, Foreign and Domestic. And any law enforcement officer who executes Asset Forfeitures without "Due Process" is my enemy.

    Thank you for your help. It raises many questions about not only policing but also the person behind the badge. A criminal is one who has done an injustice towards others, why does a badge change that? Why do they keep getting away with crimes against the people? One other thing, I see numbers to call for citizens rights, why do you have different numbers for different political parties? Are the laws different from Republican to Democratic to Independents? Are we really that separated if so what’s next banking, healthcare? History hasn’t taught us anything? Nothing good comes from a separated nation except damage from hatred.

      Homeschoolers do through HSLDA and some gun owners Association in case you defend yourself from intruders and criminals and get arrested for defending with you weapon.
      I think there are a few other legal organizations but it is sad that there isnt anything someone can join yo have lawyers retained for criminal, law suits, wills and living wills, trust fund setups and other legal necessities

I believe that's what the officer in Maryland was trying to ask.     Police officers aren't confused about this law, they know what it is. They are given the liberty to tell lies to come up with reasons to arrest or even simply contact someone and they know exactly when they are telling lies. It's not an accident to tell a lie. If they don't know the law, then they can't possibly know someone might be about to commit a crime, is committing a crime, or has just committed a crime therefore they cannot detain you. There really isn't a fine line there in reality, but they have been given that gray area and it should be taken away.

    Bambuser sounds great except its 45 dollars a month and the subscription is for one year and must be paid in full at purchase.. so for the low low price of $540 dollars you can protect yourself with Bambuser.... This is great for the rich kids who never get bothered by Cops... and its great for rich attorneys and the folks living in Central Park East.. However for the rest of us, 45 bucks a month for the ability to stream live video from our phone is kind of expensive when a smart phone subscription is anywhere from 50 bucks {if you own the phone} up to 200 a month for the newest Apple offerings with a 2 year subscription.... This awesome technology gets expensive real quick for people making under 20 bucks an hour...

    I'm confused. So you can only "openly" record police officers... but what does that entail? Do you have to say it or can you just record them where the phone is clearly visible? Because how are you supposed to notify the officers involved that you're recording the arrest/investigation/beating that doesn't involve you interfering with an investigation?

      mossy1 If you make the recording device (cellphone/whatever) visible, that is all you should need to do. Don't try to hide the device under a jacket or conceal it in any way. The officers are likely to realize you're recording them and may say something to you. At this point, you can do as instructed within the video. You don't need to inform the officers you are recording them directly but don't try to hide this fact either.

      RubberusDuckus I know what your saying is confirmed by what Silverman said in the video. However, the future may not be exclusive to smart phones. More people are installing dash cams that record police encounters as well as the road while driving. Those dash cams are hands free, so it may not be so obvious to officers that they're being recorded. And to announce that your filming can alert cops who have a nefarious intent to violate the detainee's rights outside the camera's view. I would love to see the courts embrace surreptitious recordings made in public.

If you just keep you camera in your cup holder and they don't know its recording, the world will hear his aggression when you assert your rights. If you show him the camera they will behave 99% of the time. That rule exists only to save the police from embarrassment.

      CaliforniaArchitect You're absolutely right and I've been looking into getting a front and rear camera system for my vehicle too. I'd like one that can rotate with me when/if I'm outside the vehicle, just to be a little extra secure. (Link it via bluetooh and hit a switch to rotate freely.)
      There is a drone that will actively follow you around as well. Having one of those on top of your vehicle could come in handy when needed.

      mossy1 Openly means in open view of the police officer. Don't hide or conceal the camera because if the video surfaces on youtube and you never told the officer he was being recorded then it is possibly a violation of that officers privacy because he may have incriminated himself. It is like the DUI check points where you are driving down the road and get flagged over to be checked for DUI. The Supreme Court held that the agency conducting the DUI stop MUST publicize in advance in the newspaper or in a news broadcast the location, date and time the stops will be conducted. So, in order to not violate your rights and entrap you, you must be given advance notice. In the recording of police, same principle. So openly simply means, out in the open, not in your pocket or hidden.
