    This is a example of another smart-ass cop who just couldn't fathom that everything he says is not believed, you can hear it in his voice and you can see it i his demeanor. He needs to somehow be taken down a peg or two and i hope this defendant sued him PERSONALLY.. 01 18 17

      He is an ADA, I bet the DA has an office policy to not drop certain charges or something and the ADA has to follow it or get a talking to. Seems totally uninterested, I am surprised he didn’t bring other stuff to work on during the trial

      @@Tugyankreel This is the same reason the prosecutor and judge seems to be in Cahoots at times. For example I had a traffic ticket which was in Detroit, MI. Since it was a simple traffic ticket I decided to represent myself. What I notice was that the prosecutor was giving the defendants that were present before me legal advice by telling majority of them to plead not guilty to be set up for another court date in which they'll eventually end up guilty or paying off fines anyway. Now I'm not a brightest light bulb when entering a court house, but I knew that I was guilty of speeding so I didn't take the prosecutor advice and ended up pleading guilty, my reason behind that was to get this done and over with as quick as possible so I could get my license back. But when I pleaded guilty both judge and prosecutor seemed to have some type of animosity towards me.

    Notice the complete change in the officer's demeanor when he goes from addressing the lawyer to addressing the judge at 9 minutes and 15 seconds.

    Regarding the tickets, this is one of the reason why you NEVER anwser cop's questions. Anything response you give can and WILL be used AGAINST you.

Your work deserves to be elevated to a larger stage so we Americans can appreciate how you work to make the "authorities" play within the rules. And by the way, I personally believe your client did have an open bottle container as charged by the State Trooper.

    Cop said he gave 15,000 traffic tickets, he also said he had been a cop for 15 years, That means on the average he issued 1000 traffic tickets per year..Thats 3 tickets every day roughly for 7 days a week, day after day, month after month, year after year. I don't know but that's a little hard to believe. No time off for vacation or holidays? Dedicated to his job?

      He could issue more than one at a stop and many more than 3 over the course of his shift which for most officers is 10-12 hours. He could have wrote that many which shows he is not a police officer but that he is a revenue agent for the state.

    Why is the judge interjecting in the case Cross examining the witness, and the defense council? This is highly suspect as to weather or not this judge belongs on the bench!

    So if I get a license at my age it would be suspicious? I've never had a license due to the fact that I can't afford a car so if I was able to finally afford a car and got my licences it would be suspicious to police amazing.

    dam this defense is on point. the judge is explaining because he knows the law and the trooper just broke the law so the judge wants to be clear that you found something where there was nothing to be found so you presumed the defendant guilty of a crime with no crime being present.

    I've watched this more than once - the whole set of these reinforce my belief that officers are selected from the lesser of us. always remember and never forget that the police fought in court to NOT hire the best and brightest applicants. they won. and it is obvious. peace out.       Carl Malone let the individual be judged for the individuals actions. Judge not a whole state! That's the kind of shallow thinking that's led to the polarized world we live in today. "One cop thinks it therefore every cop within the geographical irregularly shaped state of Michigan must think the same way."
      You're jumping to a conclusion that this state trooper even did this because the defendant was black. Maybe he just gets a thrill from asserting his authority and overstepped his bounds this time.

    I submit, the cross examination showed the trooper is a poor excuse for a cop who is more than willing to simply "make up" an excuse too effect an arrest. He should be made to pay attorney's fee's AND court cost

      It is obviously a judge trial. In civil cases, I saves the person money to opt for a judge trial
      In criminal cases, the defendant can ask for a judge trial instead of a jury trial. Examples why u would want a judge trial: u think u can't get objective jurors, extreme example you beat the hell out if a woman and you don't think having female jurors will bode well for you but a singular judge will...
      Often in a judge trial, the judge interrupts to ask questions to understand. Go back and listen to under these pretenses: sometimes the attorney has to walk the judge to the conclusion they are trying to make...and the judge can just cut right through and ask just like he did here several times. It's as if the judge is saying, "This is what you are trying to ask, and Tooper you are trying to say...."

    Show me a defense atty who wins a bench trial (sans exclusion) and I’ll show you some respekt. Winning a prelim has more to do with the state’s incompetence than the defense’s skills.

      Douglas W. Bonner, Jr. Attorney at Law. Defense attorney who won most of his cases based on fact, not games, not deceit. Probably 50% of his cases never made it past the prelim hearing because he could disprove the prosecutions evidence so easily with facts. I worked for him for over 30 years!

      Katherine McMahon that means the State sucked. Sorry but the standard is only P.C. and most of the time the defendant gets bound over for trial. Think about it, the defense hardly gets to even call witnesses. Everything is stacked in the states favor. Shoot I remember back in my days as an intern we would get most of the prelims the ADA didn’t want

    So I hold law enforcement in super high regard they’ve saved my ass a few times. But I think it’s funny, every time I see a cop on the stand they always look super put upon, annoyed, and like almost offended that someone would question what they did or how they did it. It’s part of the job description if you wanna enforce the law.

    Hate to inform the Cop. But not every state reports DL to other states. You can get one in Utah or Idaho and they don't give shit if you never had one or if it's been suspended. They issue you one after taking the test and passing..

    The state trooper has the same polite condescension as the officers who testified in the Steven Avery case from Netflix's "Making A Murderer". One can't help but wonder if it's a tactic that cops are trained for when testifying in a case...

    Did anybody catch that the trooper said he’s had roughly 15,000 traffic stops in his 15 years. Is it normal for a cop to make 1000 stops a year?. He’s basically saying he stopped 3 to 4 people a day for the past 15 years. Talk about generating revenue. Can anybody comment on this if it’s normal or not ?

    I hope this officer was fired and prosecuted for fabrication of evidence, falsifying police reports, and perjury! This is why Americans don’t trust the police or the judicial system.
    What if... just what if, this defendant did not have the $ to hire this great attorney and was provided a public defender? He would have been pressured into a guilty plea deal of some sorts and the facts of the case would have never been fleshed out! These officers get away with this behavior more times than not, and it’s disgusting and a disgrace to our system!

      It's a perogative of his office. The judge is the one who's in charge of the order of the courtroom. He has the explicit right to do so where no one else does. The robe is conferred with a level of authority and respect that no one else in the courtroom has and everyone else must recognize. There is also great trust given to judges that they will not abused this right. This judge only interrupts to cut to the quick of an issue.

      The judge in this case (instead of a jury) is the one who will make a ruling based on the evidence presented to him. In order to make a legit ruling, he needs to clearly understand the evidence presented to him - so at times he asks questions to clear up any confusion he may have. Perfectly normal in a bench trial. The judge is in control of the courtroom. I'm surprised the judge allowed this defense attorney to talk over him in part 1 and 2 of this cross examination. Most judges would've told the defense attorney "I'm speaking" or "don't interrupt me", but this one seems kinda chill. Probably already knows how he will rule in this case, and just ready to get this hearing over.

    The inconsistency of whether he had previous tickets are not, and the cop fucking admitting that it did not show up in the database gave him 'suspicion' is one more reason to keep your mouth shut when pulled over or a police starts questioning you.

    How is it suspicious that a person gets his/her first license later than usual? My brother is 37 and never had a license, if he gets a drivers license will he be treated like the defendant ?

    Judge is working for the state here and it is as if it is common place. The judge is trying to coach the officer on cause for the suspicion for him to reach cause to search this man's car or whatever the cop did it this case. If there is no cause to search and the driver does not give consent , then if the cop searches anyway , whatever he fines is not , or can not be , use against him in court. Fruit of the poisonous tree.

    As far as his record goes, just how is the defendant to know what is actually on there? It's not like he has open access to it. Here in Florida, you have to go to the Sherriff's Office and pay about $20 for them to print it up for you. I've had to do that trying to apply for a job. That's not something an average Joe is going to do.

    People get very nervous when a cop pulls them over. The cop had no reason to arrest this guy. He had a legal license. What a waste of time and resources over nothing.

    Thank The Lord that THIS Officer Never stopped me... He would’ve had me in Cuffs and dead based on his Logic....I went from MI to FL to MI to FL and BOTH STATES lost all my info at one point and neither would give me a License... this Trooper believes his Computer is perfect and with minimal info that was flawed along with his own “logic” he came up with Imma arrest this guy!

    @9:50 not everyone has a car or can get their license at a young age, so the fact a license was recently issued to a older person should not be cause for suspension, pretty sure this cop profiled this guy, and when there was nothing illegal or wrong the cop felt as if he needed to arrest this person on the ground they had a recently issued license at a older age, how the fuck .....
