    Happened to my friend one time. Charged him with DUI even though he blew UNDER the limit. Took him years and thousands of dollars to clear his name. Crooked police are everywhere.

    Any persons falsely arrested should be compensated for legal fees, lost pay, pain/ suffering, and any other damages received from the arrest and related actions. I can’t believe that is not a state and federal law.

      Lying isn't illegal, and they do this to fluster people so they are less likely to resist or pull away. If anything, it's for their own benefit. If you disagree and pull away because you know you're sober, you get charged with resisting even if you're found innocent of the DUI charge.

      There is no disincentive for the cops makings these types of arrests. In fact it looks good on their record, they get credit for the arrest and the fact that charges are dropped months later doesn't affect that. In addition by making the arrest they get to search the person and their car on the off chance they're able to find something illegal then it's another arrest. If they find a wad of cash or anything else of value they claim it's 'proceeds of drugs' and keep it for themselves (Civil Forfeiture: Last Week Tonight with John Oliver: ruclips.net/video/3kEpZWGgJks/видео.html).
      There is literally no disincentive for this kind of activity.

These cops are just humans like the rest of us, how can they be allowed to have so much power that they can arrest someone based on their hunch or assumptions, something that is so serious that can change a persons life in a flash. I know it is suppose to be valid because they've had this training, but it shouldn't surpass the lab test or just plain common sense. So if this is what they are relying on why even do a drug test? These cops are motivated to make these arrest because of awards and raises, of course, money is ruling everything.This is the most stupid thing I have ever seen!!

They doubled down by saying they are better at detecting marijuana than the blood tests, and that "the test results come back wrong all the time." Even after the blood test came back negative, "police investigators exonerated him, saying they doubted Ebner’s innocence because “the marijuana could have already metabolized out of the blood.”"

    This happened to me in PA with a state police officer. He was called “the most aggressive dui officer” he has awards for duis. I had my license for 5 days and made an oopsie in the rain… he aggressively told me I was stoned. Said I was lying. If this happened now? I’d lose my job. He would be taking food from my child’s mouth. I proved my innocence, but this needs to end. I don’t deserve to live in fear.

Your phone tracks your location and there's a camera on nearly every street corner. When you walk into Walmart, you are photographed using facial recognition. AND there is no place you can go in the store where you are not on camera. AND your purchases will be logged and recorded. As with nearly every other transaction in nearly every other store. Still think this isn't a police state? ALL of your internet activity is logged and saved. As are all of your emails, phone calls and text messages. Still think this is not a police state? When you drive a motor vehicle on the street, the police cruisers are equipped with license plate scanning cameras that scan the license plate of each car that gets in front of them and tells them if the registration is up to date, the insurance is in force, and if there are any warrants for the owner. Still think this isnt a police state? US Marshals are currently tracking down anyone who was in the DC metro area the month of JAN 2021. Not just people at the Capital building on 06JAN. Anyone in DC that month. They have that information and you say this isn't a police state???
      Not to mention, you can't do anything with permits or licenses. Just try driving down the street in your vehicle with insurance or current registration. Try opening a business or putting up a room addition to your house.

      We are not a totalitarian or authoritarian state, even with surveillance. Also, our police forces are super decentralized. An effective police state requires a strong centralized police force, which we largely lack with the exception of the FBI which only deals in specialized affairs. I will agree that the FBI’s resources have frequently been misused in the past few years though. Furthermore, in any system, some freedoms are traded for safety. This is the bedrock of American constitutionalism. There is good reason to make sure that cars are correctly registered and businesses are meeting proper standards. A lack of certain qualifications can be detrimental. Some of these complaints you have apply to private institutions also, not the government. Walmart, for instance, has a right to monitor people who come in in order to deter and pursue theft.

      I don't believe there's a "quota" although if the officer was held accountable after making a bad arrest this wouldn't happen as often. It's so sad they can ruin someone's life with a snap of a finger.     I was almost arrested for DUI despite being several years sober (I was confused at a busy light and went over the line a little but it was clearly a dui trap zone in a college town). I told them I was sober and they scoffed. I then passed the field sobriety tests but they were still saying they didn't believe me until I blew zeros. Then they let me leave and sarcastically congratulated me on my sobriety. I'm kind of shocked they didn't arrest me just to do it

      Always decline roadside tests. A dirty cop could've said you failed and that you blew over the limit.
      Carry two phones. Whenever you're stopped, start recording with one phone, and use the other one to call a witness.

Roadside field sobriety tests are purely subjective and exist only to give the cop a contrived basis for determining that the person is intoxicated. *Don't do them.* You are not legally required to do so, and they are only used to give the cop an excuse to arrest you. Ordinances and local county regulations are code violations and usually are adoptions of state codes as they can not supersede them. I agree local ordinances have no reason to exist but state created laws go through the state legislative process as allowed by the constitution under states rights. Federal law and state laws are two separate legal process that have existed for hundreds of years, have never been challenged by the Supreme Court or United States Congress , but sure you just show up on a RUclips comment section and tell us differently. If only we had that wisdom those hundreds of years ago this video would never have been made.

    When found innocent with no trace of alcohol or drugs , police departments should pay for all their victim's legal fees plus more. Police should also hold the offending officer accountable for legal fees. This is unacceptable abuse of police powers.

      @@magdalene74 That is 90 DUI arrests, not 90 arrests based on his "drug expertise". How many of those were alcohol confirmed prior to arrest? 4 out of 90 sounds like a good track record, but if only 15 of those were based on his drug assessment, 4 out of 15 is a really poor track record.

      That's letting him off too easy. He want's to ruin lives on a whim? Take everything from him, and make it EXTREMELY public. He gets a new reality show that's free online to watch. Cameras follow him 24/7. No privacy. Then, start by liquidating everything he owns and disburse all assets to the people he's wronged. Toss him in prison, gen pop, no protection. If he makes it out, make him completely unhirable. Tattoo a swastika on his forehead, put him on the sex offender registry, and make sure he can't open a bank account. Anywhere.
      Rinse and repeat for every corrupt piece of shit that abuses the little trust they have that hasn't been pissed away killing innocents (of all skin colors, religions, and backgrounds... [except they never seem to get the rich, for some reason]).
      Start taking away their protection, make them face real consequences... see how fast they step back in line.

      @@TamaraGarrettAlpha !!! I am diabetic also and add on a seizure disorder for good measure after a TBI that left me in a coma. I was food shopping and had a seizure in the grocery store parking lot. Someone called for an ambulance but the cop came first. 🙄
      At that point I was sitting in the drivers seat with the door open and trying to get my bearings. The keys were around my wrist. He was a “drug recognition expert “ and said I seemed “under the influence “ because I seemed “confused and dazed”, no shit, I just had a seizure. Had another and was sent to the hospital. Come to find out that while unconscious they took blood AFTER the ambulance/ER medicated me. So yup, dui right there.

    This happened to me.
    Except when they couldn't find alcohol, they did a drug test and found nothing except one of my medication's was still in my system. It's a very common medication and it's not illegal to drive while taking it. If anything, people should be more scared of my driving when I don't take it. Although there is no caselaw in Wisconsin of anyone being convicted of driving under the influence of this medication, instead of dismissing the charges outright, they dismissed them with presidents. They told me if I get pulled over again, they will re-charge me for this offense. Anyone I've ever told this story to can't believe it. But if you don't have money to fight the government this abusive power will continue to happen. Any intelligent person would've said she wasn't drunk or on drugs and dismissed it. I fought the law and the law won. Justice and freedom is an illusion.

      There’s a LOT of medications that can cause a person to have a false negative for opioids. I’ve always known this but I’m really finding this out. Recently a friend of mine’s son had a seizure at school. She took him to the ER at a children’s hospital. They did a UDS and found fentanyl in his system. My friends and I did some of our own research and found that one of his meds can not do that but also cause seizures to begin with. We’re finding out just exactly how many medications can do this. Even the ones I’m on can.

    Think of all the victims of false arrest (like me) who couldn't find an attorney to take their case. In my case, all the attorneys I could contact within the statute of limitations, which is actually quite brief, against a government agency said my case had merit but either were swamped with cases or didn't find my case lucrative enough. I live with injustice.

      I was arrested for extortion for trying to recover $7000 a dentist cheated me out of - I could prove that he cheated me- the court wouldn't even.look at my proof - the dentist had.NO proof- I couldn't afford an attorney so the court just ran right over me - if I would've gone to trial I would have gone to prison- I was forced to plead guilty and was given a two year probation.costing $111 a month and a $500 fine- that is what happens when you can't afford an attorney- also afterwards I found there is plea u can enter that u plead guilty but u don't have to say u ate guilty- well, the person from the public defenders office that was supposed to defend me never told me about this plea- so what it looks like is the public defenders office does not defend you- they just set u up for the prosecution- now that is just my opinion based on my case- just in case they see this and decided to come after me

      This is a quality control issue for policing agencies. The driving force for this is the monies (rewards) received by policing agencies for drunk driving enforcement, I believe a huge amount of money is driven solely based on the number of arrests performed. The MAD (mothers against) award was again recognition given solely on the number of arrests. Moneys on this sort of program should be doled out only on a conviction basis, and only if there is a built in monetary and funding penalty for false arrests and dropped charges. The MAD awards ought to be on the same basis. These officers ought to at least be thinking how they would expect there own mothers to be treated and processed if they were pulled over for the same infraction. Driving on the lines is common enough in my town as if one centers themselves in the lane means you have to drive in the asphalt ruts and potholes. Drunks need to be taken off the road but not at the expense of regularly ruining a large percentage of arrestees lives on the shakiest of evidence. "Probable Cause" ought a also mean probable cause for release.

    I'm in the process of fighting a DUI right now. After I blew negative for intoxication in the toxalizer the police officer told me he could still give me a DUI based on his on perception. Any advice would be appreciated. I can't believe after I blue negative I got a DUI anyway. I had to spend the night in jail, bond out and pay to get my car out. I still haven't been to court on it and it happened about 8 months ago

That sounds like something that would put me on a mission of calling out liars and connivers. Someone is signing the paperwork to keep the charges rolling along and the cop who arrested you has a name. Google is your friend. Get informed about the individuals. I've called out lawyers and judges, including public Google reviews, and gave em a swift legal kick. It's effective. But be careful because online presence will be used against you in a court of law.     I am a nurse and if I was arrested on a suspicion of a DUI I would have my license revoked. This is ridiculous! I’m glad I don’t take Tylenol, weed, alcohol. If I got a blood test, they would probably claim it metabolized too fast. Just take my hair for heavens sake!

    False arrest should require compensation for the victims time and legal fees. It should also fall under the 3 strike rule for officers who think they are mind readers or who think they are a GURU. After 3 false arrest the officer is back on a 180 day probationary period. If a 4th false arrest occurs at anytime during the rest of his employment . The cop is fired.

      They are never held accountable for killing people so why would they ever get in trouble for doing this to completely innocent people. They don’t get into trouble bc all they have to say is their training indicates that the person has whatever drug they say. Their is no proof that know otherwise.       Realistically the possible consequences of the two are completely different. You messing up an order probably has 0 chances of causing a death whereas a police officer messing up a DUI arrest could end up with someone dead. Honestly and I'm probably going to catch a lot of shit about this, I'd rather see an innocent person arrested in error for a DUI than for someone who was actually impaired be let go. Too many innocent people lose their lives to impaired drivers every year and I'm thinking that number far outweighs the number of innocent people arrested in error.
      Unfortunately until there is some form of roadside testing available for drugs this is going to keep happening, but I think things definitely need to be changed with how the cases are handled until test results are received. The police doing the testing need to be completing the full tests not just stopping when they think they've detected impairment. They need to come up with a system where the arrest isn't recorded anywhere publicly accessible until the test results come back and only then if there was an actual DUI. I also think that any expenses incurred because of the arrest if the test results come back negative should be reimbursed by the police department. Unless they're lying about the number of negative test results this shouldn't be a large amount of money.
      The mentality that the testers are always right also needs to be changed. They're humans and whether they like it or not humans make mistakes in judgement. The training where they say the lab techs might be wrong even though the officer is right should in no way be included in the training. If the lab results say a test is negative own up to the fact you were probably wrong in your assessment and move on.

      If you are talking specifically about a case like the above where the people were not guilty and were arrested, then you may not need to hire a lawyer in the first place. They will take blood at the station, if the blood finds nothing, then you can go to court yourself and ask the judge for dismissal. But hiring an attorney for traffic violations like these, are pretty cheap from 50 bucks to 250 dollars. Most anyone can come up with that these days. So no, peoples lives do not need to be ruined if they are in fact innocent. You are not talking about thousands of dollars to hire an attorney for traffic court proceedings.
      This is much cheaper than getting charged convicted of a DUI and paying the thousands of dollars in fines and paying for traffic school and missed work etc. Or if traffic school is not an option, the extra added $ your insurance will go up with the points on your record.
      If you are talking about the case where the three people are suing the department, I would bet the attorneys are doing it for free for a cut of the settlement so again, not out of pocket for the victims.

      Maybe they should take 3 urine tests and 3 blood tests just to be sure .. lol. Bc it’s obvious they only trust the positive results but not the negative results. These people who have had their lives turned upside down and had to prove their innocence, should be given every dime and then some back for everything they had to pay and work missed during their false accusations made by an egotistical cop. It’s ridiculous.
